Section 104.62. Definitions

The following words and terms, when used in this subchapter, have the following meanings, unless the context clearly indicates otherwise:
ActThe Pennsylvania Agricultural Commodities Marketing Act of 1968 (3 P. S. § § 10011013).
Affected producerA person who produces, grows or causes to be grown 500 or more peach trees or nectarine trees, or both, of all ages, for the production of peaches or nectarines, or both, for sale or marketing.
DepartmentThe Department of Agriculture of the Commonwealth.
Peaches and nectarinesAll peaches and nectarines (prunus persica) produced in this Commonwealth for the purpose of sale by a producer as defined in this subchapter.
PersonAn individual, firm, partnership, corporation, association or other business unit.
ProgramThe Pennsylvania Peach and Nectarine Research Program.
