Section 4210.91. Description

(a) All of the patient services described previously shall be available to persons who are mentally retarded. In addition, interim care is exclusively for those persons who are mentally retarded.
(b) Inpatient care of persons who are mentally retarded is the responsibility of State operated institutions. The final determination as to whether a person is in need of inpatient care is the responsibility of the Department. When the Department determines that a person is eligible for care in a State operated facility, but that there is no room for him at the time of that determination, the Department will place the person on a waiting list. Interim care is intended for a person who, having been removed from his home, is on a waiting list.
