Abandoned Contaminants
The battery casings abandoned on the site in 1980 occurred prior to the enactment of the Solid Waste Management Act (35 P. S. § 6018.104 et seq.), continue to affect and contaminate the environment today, and will continue to affect the environment until properly remediated through closure. It would frustrate the purpose of the General Assembly in passing the Act if the Acts application is limited only to circumstances where the act of dumping is presently occurring. Therefore, to the extent that an individual dumped the battery casings at the site and left them in a manner in which the hazardous waste constituents of the battery casings entered and continue to enter the environment and were discharged and continue to discharge into waters of the Commonwealth, the individual had disposed of the battery casings within the meaning of the Act and these regulations, and this disposal continues until the battery casings and contaminants are removed.
