In an action arising out of the death of a state employe who was killed while controlling traffic around a work zone, the towing service, which was removing a tractor-trailer, was responsible for the safety of persons in the work zone even though the Department of Transportation had taken charge of directing traffic around the work zone, where a contractor has final responsibility for the protection of persons in the work zone. McClintock v. Works, 716 A.2d 1262 (Pa. Super. 1998); appeal denied 747 A.2d 901 (Pa. 1999).
