Section 23.41. Notice requirements for filing changes in rates

(a) In order to establish uniformity in the rules, regulations, and practices of common carriers subject both to the jurisdiction of the Interstate Commerce Commission and the Commission, and so that common carriers subject to the exclusive jurisdiction of the Commission may not be unreasonably prejudiced or burdened, all common carriers, except as specified in subsection (c), are, unless otherwise directed, permitted to file changes in existing and duly established rates upon 30 days notice to the Commission and the public.
(b) Except by specific authority of the Commission, no change shall be made in any existing and duly established rate, except as specified in subsection (c), unless such rate has been in operation and effect for at least 30 days. This limitation shall not, however, apply to tariffs on schedules containing rates for excursions limited to certain designated periods under authority of § 23.43 (relating to excursion fares).
(c) Railroads and their agents operating in Pennsylvania intrastate transportation are permitted to file decreased rates on 10 days notice and increased rates on 20 days notice.
