  • For the purposes of this section only:

    (1) The members of the Committee shall be considered Commonwealth employes in the service of the Department and subject to the State Adverse Interest Act (71 P. S. § § 776.1—776.8).

    (2) Members of the Selections Committee shall be subject to the Code of Ethics for Appointed Officials and State Employes (4 Pa. Code § § 7.151—7.154).

    (3) Under section 2401.1(12) of the act (71 P. S. § 631.1(12)), no Selections Committee member may, on leaving the employ of the Department, negotiate or participate in any contract for the providing of goods or services to the Department before the expiration of one year from the date of termination of his employment.

    (4) Selections Committee members shall file a statement of financial interest for the preceding calendar year with the Department no later then May 1 of each year that they hold the position and of the year after they leave the position under the act of October 4, 1979 (P. L. 883, No. 170) (65 P. S. § 404).

    (5) Committee members shall not answer requests for information made by professionals seeking the recommendation of the Selections Committee, but rather, the committee members shall inform the professional that all requests for information regarding the work assigned to the committee must be:

    (i) In writing.

    (ii) Addressed to the Selections Committee as a whole.

    (6) The Chairperson of the Selections Committee shall answer in writing properly submitted requests for information following consultation with the members of the committee.

    (7) The Selections Committee shall keep on file all requests for information and answers thereto and the questions and answers shall be available for review to all professionals seeking the recommendations of the Committee.
