Section 93.1. General

Those portions of some Department directives and policy statements which concern the interaction of Department inmates and employees with the community at large are published. The full text of the directives and other policy statements are maintained in all Department facilities.

Prisoner alleged bulletin authorizing Department of Correction (DOC) employees to confiscate UCC filing documents mailed to inmate was invalid since DOC failed to comply with Commonwealth Documents Law and Regulatory Review Act (RRA) requirements for adopting regulations; bulletins are not regulations for purposes of Documents Law or RRA and represent agency decisions that are inherently committed to agencys sound discretion that cannot reasonably be subjected to the normal public participation process.
