Section 95.57. Objections to the Boards conduct of election

Objections to the conduct of a Board agent regarding the election shall be filed within 5 working days of the final tally of votes.

The provisions of this § 95.57 amended under section 502 of the Public Employe Relations Act (43 P. S. § 1101.502); section 4(f) of the Pennsylvania Labor Relations Act (43 P. S. § 211.4(f)); and the act of June 24, 1968 (P. L. 237, No. 111) (43 P. S. § § 271.1271.12).
Timeliness
A challenge to an election will not be sustained where no unfair practice charge or objection to the Boards conduct of an election was filed within 5 working days of the holding of the election and canvassing of the challenged ballots. Bucks County Schools, Intermediate Unit No. 22 v. Labor Relations Board, 466 A.2d 262 (Pa. Cmwlth. 1983).
