Section 299.155. Storage of whole and processed waste tires

(a) This section and § § 299.156299.163 do not apply to persons or municipalities who store less than 500 waste tires in open storage or who store less then 1,500 waste tires in enclosed storage unless the open or enclosed storage threatens or causes harm to the public health, safety, welfare or the environment.
(b) The requirements of this section and § § 299.156299.163 may be waived or modified for small piles at the location of waste tire generators.
(c) A person or municipality may not accumulate whole and processed waste tires speculatively or store for longer than 1 year. The actual tons of waste tires removed from a facility shall be verified through weight receipts.
(d) A person or municipality storing whole and processed waste tires shall maintain operational records that provide detailed information in accordance with § 299.112 (relating to design and operation).
