Section 86.167. Transfer of permits

Before a permit is transferred as provided in Subchapter B (relating to permits), the successor operator shall post a new bond in an appropriate amount determined by the Department under this subchapter but in no case less than the amount of bond on deposit with the Department, in the successor operators name, assuming all accrued liability for the permit area. The successor operator may use negotiable securities of the former permittee as the bond guarantee if they obtain an assignment of residual right, title and interest to the negotiable securities from the former permittee and provide the Department with proof of the assignment.
