Section 1034. Motion for Judgment on the Pleadings

(a) After the relevant pleadings are closed, but within such time as not to unreasonably delay the trial, any party may move for judgment on the pleadings.

Only the pleadings between the parties to the motion for judgment on the pleadings must be closed prior to filing the motion.
Rule 239.6 requires every court to promulgate Local Rule 1034(a) describing the local court procedure governing motions for judgment on the pleadings. Local Rule 1034(a) shall be published on the Pennsylvania Judiciarys Web Application Portal (http://ujsportal.pacourts.us).
(b) The court shall enter such judgment or order as shall be proper on the pleadings.
