Statutory Note
Section 13(4)(i) of the act of June 30, 2011 (P. L. 159, No. 26) (Act 26), repealed the act of August 31, 1971 (P. L. 423, No. 101), known as the Higher Education Equal Opportunity Act—the statutory authority for this chapter. However, section 7 of Act 26 also added to the act of April 9, 1929 (P. L. 343, No. 176), known as The Fiscal Code, a new section 1738-E (relating to Pennsylvania Higher Education Assistance Agency). New section 1738-E(b)(5) of the Fiscal Code provides as follows:
Beginning July 1, 2011, the rights, powers and duties exercised by the Secretary of Education under the former act of August 31, 1971 (P. L. 423, No. 101), known as the Higher Education Equal Opportunity Act, are transferred to and shall be exercised by the Pennsylvania Higher Education Assistance Agency. Existing regulations promulgated under the former Higher Education Equal Opportunity Act shall continue in full force and effect by the Pennsylvania Higher Education Assistance Agency until the agency promulgates new or additional regulations.
