Unless otherwise indicated, on the basis of preliminary review and applications of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible official considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges
The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.
The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

HAZARDOUS SITES CLEAN-UP Under the Act of October 18, 1988 Proposed Response under the Hazardous Sites Cleanup Act Nicolet Site
Borough of Norristown, Montgomery CountyThe Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) has proposed an interim response at the Nicolet site.
The Nicolet site is located at 600 and 700 East Washington Street, in the Borough of Norristown, Montgomery County. The site is the location of a former facility of Nicolet, Incorporated.
The Department has determined the following:
At this facility, Nicolet Incorporated (formerly Nicolet Industries, Inc.) produced pipe and boiler insulation, commercial grade asbestos papers, roofing and flooring felt, and underground pipewrap.
Approximately 100 drums are left on site, all but 12 inside the main building. There are also other containers of waste material inside the building. There are five above ground storage tanks outside the building, which have leaked onto the surface of the ground. Wastes inside the buildings are in deteriorated containers without proper spill containment systems.
One drum was observed in the Schuylkill river at the edge of the property.

[Continued from previous Web Page] On April 30, 1997 the Department sampled two drums at the site and found that they contain hazardous wastes.
The records of the Montgomery County Recorder of Deeds list the area of the Nicolet buildings as 116,278 square feet, and of the parcel on which they are located (parcel number 13-00-37996-007) as 3.50 acres (152,460 square feet). The parcel with the former Nicolet parking lot (parcel number 13-00-38000-003) has an area of 4.16 acres (181,210 square feet); that parcel of land is owned by Reading Real Estate Corporation, and was formerly leased to Nicolet. The Nicolet HSCA site comprises both parcels.
Analysis of soil samples taken on site during the Site Investigation by the United States Environmental Protection Agency (EPA) indicated significant soil contamination with heavy metals and with semivolatile organic compounds.
The Department considered the following alternatives in response to conditions at the Nicolet site that pose a threat to public health or safety and the environment.
Alternative 1: No Action
HSCA requires the Department to consider the alternative of taking no action. Under this alternative no action would be taken to prevent releases of hazardous substances to the environment at the Nicolet site. This alternative would do nothing to protect public health. Hazardous waste would remain on site, allowing further releases to the environment.
Alternative 2: Removal of Waste Piles and Containerized Waste and Further Investigation of Site Contamination
Hazardous wastes in piles and various containers (including drums, bags, cylinders and the like) would be removed from the site and properly disposed. The number of drums is estimated at 100. This alternative would be protective of public health in that it would eliminate a source of potential exposure of the public to hazardous wastes, and prevent further releases of hazardous substances to the environment.
A further investigation would be undertaken by the Department to characterize wastes in tanks, and to identify any additional uncontained wastes or contaminated soil which pose a threat to the public health or safety or to the environment.
Proposed Response:
The Department is proposing alternative 2 as previously described. Alternative 1 is not protective of public health or the environment. Alternative 2 is cost effective and is protective of public health and the environment.

Settlement Under the
Hazardous Sites Cleanup Act
Industrial Solvents and Chemical Company
Newberry Township, York CountyThe Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has entered into a proposed consent decree regarding the Department's costs incurred for response activities at the Industrial Solvents and Chemical Company (ISCC) site. This proposed consent decree has been entered into with Columbia Leather and Coatings Company, a defendant in Pennsylvania Department of Environmental Protection v. Columbia Leather and Coatings Company, Inc., et. al., 1:CV-96-1502 (M. D. Pa.) and has been lodged with the court during the 60-day comment period required by section 1113 of HSCA (35 P. S. § 6020.1113).
The ISCC site is a 9-acre parcel of land in Newberry Township, York County, adjacent to Interstate 83. The surrounding area is primarily rural, although residential, commercial and industrial developments are located within a close vicinity of the site. A number of private residential wells have been contaminated by hazardous substances migrating from the ISCC site.
ISCC was involved in the reprocessing of used solvents. Because of violations of hazardous waste requirements, the Department on July 6, 1989, terminated ISCC's authority to operate a hazardous waste treatment and storage facility. The site was abandoned in 1990 when ISCC declared bankruptcy. A total of 996 potentially responsible parties for the hazardous substances located at the ISCC site were identified by the Department.
Because of the threat to human health and the environment posed by the ISCC site, the site was placed on the Pennsylvania Priority List for Remedial Response on October 26, 1991. The Department and a group of approximately 136 cooperating potentially responsible parties have conducted a number of interim actions at the site to address the release or threat of release of hazardous substances. To date, the Department has incurred costs of approximately $3.1 million to implement and/or oversee these interim actions. A final remedial action for the groundwater and soil at the ISCC site will be selected by the Department and implemented in the future.
The proposed consent decree with Columbia Leather and Coatings Company was lodged with the Federal District Court for the Middle District of Pennsylvania on July 21, 1997. Under the terms of the consent decree Columbia Leather and Coatings will pay the Department a total of $5,000 over a period of 1 1/2 years to reimburse the Department for its response costs at the ISCC site. The amount of this settlement was based primarily upon Columbia Leather's limited ability to pay the total amount claimed by the Department.
This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). The Department will respond to any significant written comments and request that the Court take appropriate action regarding the proposed consent decree. The proposed consent decree that contains the specific terms of the proposed settlement is available for public review and comment. Notice of Plan Approval Application Minor Source
The following stationary sources have filed a request for a plan approval with the Department of Environmental Protection (Department), Bureau of Air Quality. Persons wishing to file protests or comments on the proposed plan approval have 30 days to submit the protests or comments to the Regional Office at the address listed. Interested persons may also request that a hearing be held concerning the plan approval application by filing a request with the Regional Office stating the reason for the request.
The Department will evaluate and consider all protests and comments received. The Department will, where appropriate, modify the proposed plan approval based on the protests and comments received.

MINING CONDUCT COAL AND NONCOAL ACTIVITIES MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. APPLICATIONS RECEIVED UNDER SECTION 401: FEDERAL WATER POLLUTION CONTROL ACT ENCROACHMENTS The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection.
In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a United States Army Corps of Engineers (ACOE) permit. E46-778. Encroachment. PECO Energy, 680 Ridge Pike, Plymouth Meeting, PA 19462-1945. To relocate aerial utilities into under ground electrical duct bank systems. The proposed work is associated with the proposed roadway and interchange modification to U. S. Route 202 Section 400 from Swedesford Road to Gulph Road (Valley Forge, PA Quadrangle Start W: 5.0 inches; N: 13.8 inches; End W: 1.6 inches; N: 15.2 inches) in Tredyffrin Township, Chester County and Upper Merion Township, Montgomery County. Work consists of:
1. To construct and maintain six concrete encased, 6-foot by 2-foot, electrical duct bank utility line stream crossings of an unnamed tributary to Trout Creek (WWF) located at station 213+00 of the proposed Devan Park Drive, situated approximately 800 feet northeast of Old Eagle School Road and Devan Park Drive. This work includes 320 feet of temporary channel relocation.
2. To install and maintain two 48-inch utility line stream crossings under Crow Creek (WWF) located near Station 82+50 of I-76.
This application also includes a request for an Environmental Assessment approval for installing a riser pipe for sediment basin no. 3 in an unnamed tributary of Trout Creek. This riser pipe will be attached to an existing culvert which extends beneath an abandoned railroad embankment.
E46-780. Encroachment. Lower Pottsgrove Township, 2199 Buchert Rd., Pottstown, PA 19464. To replace an existing deteriorated and inadequate single span, concrete encased steel stringer bridge, spanning Sanatoga Station Road over Sprogels Run (WWF). The proposed single span bridge will be constructed on the same horizontal and vertical alignments. The project proposes to increase the bridge's roadway width from 14 feet 10 inches, to 24 feet, to accommodate increased traffic volumes. The proposed bridge is a 20-foot single span structure with a minimum underclearance of 12 feet, and consists of composite prestressed concrete adjacent box beams with reinforced concrete slab superstructure on reinforced concrete abutments. This bridge is located approximately 850 feet upstream from the confluence of Sprogels Run with the Schuylkill River and south of the intersection of Porter Road with Sanatoga Station Road (Phoenixville, PA Quadrangle N: 20.5 inches; W: 15.4 inches) in Lower Pottsgrove Township, Montgomery County.
E09-756. Encroachment. Hickory Ridge Inc., 541 Germantown Pike, Plymouth Meeting, PA 19462. To construct and maintain 98 linear feet of 48-inch reinforced concrete culvert and to place and maintain fill within wetlands associated with the construction of Hickory Ridge Drive in and along an unnamed tributary of the Neshaminy Creek (TSF, MF). Total wetland impact from this project is approximately 0.95 acre. This site is located approximately 1,500 feet southwest of the intersection of Upper State Road and Bristol Road (Doylestown USGS Quadrangle N: 4.8 inches; W: 8.7 inches) in Warrington Township, Bucks County.

To remove the existing structure and to construct and maintain a single span bridge having a span of approximately 113 feet and minimum underclearance of approximately 55 feet across an abandoned, flooded quarry. The project is associated with the proposed S. R. 0329 realignment project and is located just south of the existing bridge, along S. R. 0329, Section 04B approximately 0.5 mile west of the intersection of S. R. 0329 and S. R. 3017 (Catasauqua, PA Quadrangle N: 12.8 inches; W: 15.0 inches) in Allen Township, Northampton County (Philadelphia District, Army Corps of Engineers).

To construct, operate and maintain an enclosure of an unnamed tributary to Beaver Run that will provide access to an industrial development. The work shall consist of constructing the stream enclosure with a 48-inch diameter corrugated metal pipe that will have a length of 150-feet. The project is located along the southern right-of-way of SR 0080 approximately 1.1 miles west of the intersection of SR 0255 and SR 0080 (Sabula, PA Quadrangle N: 1.2 inches; W: 14.7 inches) in Sandy Township, Clearfield County. Estimated stream disturbance is 190 feet of stream and 0.32 acre of wetland impact; stream classification is Cold Water Fishery.
E17-311. Encroachment. Glyn D. and Mary Powell, R. R. Box 668H, Houtzdale, PA 16651. The applicant proposes to 1) remove an existing stream enclosure and restore and maintain the channel of an unnamed tributary to Beaver Run; 2) remove and restore 0.13 acre of impacted wetlands associated with an unnamed tributary to Beaver Run; and 3) place and maintain fill in 0.47 acre of wetlands associated with an unnamed tributary to Beaver Run for the development of a commercial facility. As proposed the work shall consist of 1) removing 255.0 linear feet of stream enclosure and constructing 255.0 linear feet of rock lined trapezoidal stream channel 2) removing fill from 0.13 acre of wetland and restoring the wtland cross section and hydrology and 3) placing and maintain fill in 0.47 acre of wetlands. The project is located along the wetern right-of-way of SR 0053 approximately 0.95 mile north of the intersection of SR 0253 and SR 0053 (Houtzdale, PA Quadrangle N: 13.9 inches; W: 12.9 inches) in Woodward Township, Clearfield County. The 0.47 acre of permanently impacted wetlands shall be mitigated with 2.0 acres of replacement wetlands.

The approved plan provided for construction of a .08 mgd wastewater treatment plant and collection system to provide public sewer service to the Edenville area of St. Thomas Township. The interim method of sewage disposal will be continued use of onlot disposal systems with an OLDS Maintenance program. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION Under Act 2, 1995 Preamble 3 The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

To remove the existing structure and to construct and maintain a stream enclosure of Solomon Creek, consisting of approximately 260 linear feet of a three-cell precast concrete box culvert, having waterway openings of 19.0 feet × 11.0 feet. To construct and maintain a freshwater pumping station approximately 45 feet by 70 feet with an 8 foot by 4 foot rectangular intake 300 feet long within the floodway of Baldwin Creek, WWF, and the Cowanesque Reservoir for the purpose of supplying water to an underground gas storage facility (Tioga, PA Quadrangle N: 175 inches; W: 8.9 inches) in Lawrence Township, Tioga County. The total project will permanently impact .27 acre of wetlands, and total temporary impacts on 28.59 acres of wetlands located throughout Farmington, Tioga, Middlebury and Delmar Townships. Included in this application are 46 stream crossings both for road crossings and utility lines permitted under the Department's General Permit BDWW-GP-8 and General Permit BDWW-GP-5, respectively. PUBLIC HEARING The Department of Environmental Protection will hold a public hearing to receive testimony and comments on a major permit modification for installation of equipment designed to beneficially utilize landfill gas for leachate reduction and to supply electrical power at the existing permitted Dauphin Meadows Landfill.
The hearing will be held on Wednesday, September 10, 1997, at the Millersburg Area High School Auditorium in Millersburg, PA beginning at 7 p.m.

__________Recycling Grant Awards under the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904).
__________The Department of Environmental Protection announces the following grants to municipalities for recycling programs under section 902 of the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 4000.902).
Grant funds are used to develop and implement recycling programs. Municipalities and counties are eligible for up to 90% funding of approved recycling program costs. Municipalities considered financially distressed under the Financially Distressed Municipalities Act (53 P. S. §§ 117.01--117.501), are eligible to receive funding for an additional 10% of approved costs. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
This notice includes nine Public-Private Partnership Recycling Grants in which grant funds are offered to local governments on behalf of private sector or not-for-profit entities. These entities cooperate with local governments to enhance recycling, processing and manufacturing capacity for source separated recyclable materials including clear glass, colored glass, aluminum, steel and bimetallic cans, high-grade office paper, newsprint, corrugated paper, plastics and other marketable grades of paper. Facilities and equipment funded under this program remain the property of the local government grantee for their useful life. This program has been discontinued by the Department and has been replaced by a low-interest Recycling Market Development Loan Fund.
