Availability of Modified Chapter 105 Water Obstruction and Encroachment Permit Application and Supporting Documents for Consistency with the Pennsylvania State Programmatic General Permit 4 (PASPGP-4) [41 Pa.B. 4255]
[Saturday, August 6, 2011]The Department of Environmental Protection (Department) announces the modification of Chapter 105 Water Obstruction and Encroachment permit application (permit application) and supporting documents for consistency with the Pennsylvania State Programmatic General Permit 4 (PASPGP-4). The permit application and supporting documents required minor revisions to remain consistent with PASPGP-4 and to reflect the changes made from PASPGP-3. The minor revisions also provide clarity and updated contact information for the applicant. No changes have been made to the General Permits. This notice is for information only and is not legally mandated and does not represent a decision or final action of the Department.
On June 3, 2011, the Army Corps of Engineers (Corps) published Special Public Notice—11-44, issuing PASPGP-4 for a 5-year period with an effective date of July 1, 2011. The Department published a proposed conditional Water Quality Certification under section 401(a) of the Federal Clean Water Act (33 U.S.C.A. § 1341(a)) and a determination of Coastal Zone Management Consistency under section 307 of the Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1456) for PASPGP-4 at 41 Pa.B. 2762 (May 28, 2011). The final 401 WQC and CZM Consistency for PASPGP-4 was published at 41 Pa.B. 3938 (July 16, 2011).
This action by the Corps continues the present Federal permitting process undertaken jointly with the State permitting process for activities affecting waterways, water bodies and wetlands authorized under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27). PASPGP-4 places the Department Regional Offices and delegated county conservation districts in the lead for the majority of permit actions. Through the consolidation of Federal and State permitting standards in one process, the PASPGP-4 continues a streamlined process for permit applicants without compromising comprehensive environmental protection.
The permit application and supporting documents required minor revisions to remain consistent with PASPGP-4 and to reflect the changes made from PASPGP-3. The minor revisions also provide clarity and updated contact information for the applicant. The revised documents include:
