[32 Pa.B. 4245] NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS NPDES APPLICATIONS PART I PERMITS Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For all new permit applications, renewal application with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).
Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted before the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated above the application.

This proposed facility is located in Manor Township, Lancaster County.
Description of Proposed Activity: The Rohrer Dairy Farm LLC is an existing dairy and swine operation with a total AEUs of 1,557.9. An estimated quantity of total annual manure production is 95,088 tons. The operation consists of 750 milking cows, 100 dry cows, 385 heifers, 1,400 calves and 130 swine. The dairy manure is handled as both a liquid and solid. The liquid manure storage consists of a slotted floor barn with two pits 432 ft × 47 ft × 8 ft deep with a useable storage of approximately 2.3 million gallons. There is also a slurry store and three round concrete manure storages associated with the main dairy. The slurry store is 62 ft × 23 ft with a useable storage of 490,000 gallons. The round concrete structures are 32 ft × 12 ft with a combined useable storage of 216,000 gallons. The manure storage for the swine facility is a lagoon roughly 0.35 acres × 12 feet with a useable storage of 1.200 million gallons. All of the manure generated on the farm is used on the farm.
The receiving stream, Stamans Run, is in the State Water Plan watershed 7-J and is classified for: WWF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25 year/24 hour rain storms, the CAFO general permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.
PA#0246875, CAFO, Robert B. Ruth and Dale Martin, Quail Ridge Farm, P. O. Box 9, 101 West Harrisburg Avenue, Rheems, PA 17570.
This proposed facility is located in Perry Township, Berks County.
Description of Proposed Activity: The Quail Ridge Farm is new swine facility with estimated total AEUs of 1,379.8. An estimated quantity of total annual manure production is 1,488 tons. The operation will consist of 2,800 sows, 336 sows with litter, four boars and 688 gilt finishers. The animals will be confined to two barns 365 days a year, 100% of the time. The gestation barn will be 87 feet wide and 718 feet long with a 9-foot deep reinforced, concrete, manure storage under the building. The total depth of the storage minus the freeboard from the lowest level of the pit fans is seven foot. The approximate total volume of the storage equals 3,270,720 gallons. The farrowing barns will be 82 feet wide and 458 feet long with a 2-foot shallow reinforced concrete storage under the building. The approximate total volume of the storage equals 561,838 gallons. The manure from the farrowing barn flows via gravity into the large storage under the gestation barn. The manure is pumped from the large storage into a tank truck for injection into the soil. Of the 2,975,860 gallons of manure generated on the farm, 1,055,870 will be used on the farm with 1,919,990 gallons exported from the farm to neighboring farms.
The receiving stream, UNT to Pequea Creek, is in the State Water Plan watershed 3-B and is classified for: HQ-CWF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25 year/24 hour rain storms, the CAFO general permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. This proposed facility is located in North Heidelberg, Berks County.
Description of Proposed Activity: The Gel-Bare Farms is an expanding dairy operation with a total AEUs of 1,328.5. An estimated quantity of total annual manure production is 23,678 tons. The expansion will include a new free-stall barn with milking parlor and a new manure handling system. After the expansion there will be approximately 600 Holstein milking cows with 100 dry cows, 350 heifers, 350 calves and four bulls. The new manure handling system will consist of a solid separator and a two stage HDPE lined liquid storage facility. Of the 5,866,257 gallons and 8,866 tons of manure generated on the farm none of this is exported from the farm but all used on the owned or rented farm..

The receiving stream, dry swale to Rocky Spring Branch, is in Watershed 13-C, and classified for trout stocking fishery, water supply, recreation, and fish consumption. The nearest downstream public water supply intake for Hagerstown, Maryland is located on the Potomac River. The discharge is not expected to affect the water supply.

Application No. PA 0246859, Concentrated Animal Feeding Operation (CAFO), Amos L. Hoover (Hickory Lane Farm), RD 1, Box 706, Blain, PA 17006.
Amos Hoover has submitted an application for an Individual NPDES permit for an existing CAFO known as Hickory Lane Farm, located on Hickory Lane in Jackson Township, Perry County.
The CAFO is situated near Sherman Creek in Watershed 7-A, which is classified for High Quality-Cold Water Fishes. The CAFO is designed to maintain an animal population of approximately 1,165 animal equivalent units (AEUs) consisting of 672 gestating sows, 98 sows with litter, 33 boars, 1,865 nursery pigs, 4,759 grower/finishes pigs, 77 gilt replacement, 104 gilt developer and 110 feeder cattle. The animals will be housed in one barn. Manure is piped to a clay-lined storage pond. The total capacity of the manure storage facilities is 4,070,662. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
The permit application and draft permit are on file at the Southcentral Regional Office of the Department. Individuals may make an appointment to review the files by calling the File Review Coordinator at (717) 705-4732.
Persons wishing to comment on the proposed permit are invited to submit written comments to the above address within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in formulating the Department's final determination regarding the application. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION UNDER ACT 2, 1995 PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908)
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

The respective plant is a minor facility. The plant incorporates various pieces of crushing, screening and conveying equipment. Particulate matter emissions from the plant are minimal due to the inherent moisture in the material being processed and the application of water during processing.
The Department of Environmental Protection (Department) has determined that the sand and gravel processing plant has been constructed, and is operating in accordance with all conditions of Plan Approval 49-310-007 as well as in compliance with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue an operating permit for the operation of the respective sand and gravel processing plant.
The following is a summary of the conditions the Department proposes to place in the operating permit to be issued to ensure compliance with all applicable requirements:
1. The permittee shall have onsite an operable water truck equipped with a pressurized spray bar to be used, as needed, for the prevention and control of fugitive air contaminant emissions from roadways, stockpiles, etc.
2. At least the first 250 feet of the main plant entrance/exit road shall be paved.
3. No stationary fossil fuel fired engines or generators shall be operated on site.
4. If it is ever determined that the air contaminant emissions from any piece of sand and gravel processing equipment incorporated in the plant are in excess of any applicable air contaminant emission limit, the permittee shall install water spray dust suppression nozzles and/or take such other control measures as are necessary to reduce the air contaminant emissions to within the applicable limits.
MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.
Written comments, objections or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number, and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

ABANDONED MINE RECLAMATION Under Act 181 of 1984, the Department of Environmental Protection (Department) gives notice of solicited proposals received from Ben Hal Mining Company and Amerikohl Mining, Inc. to reclaim an abandoned surface mine in Slippery Rock Township, Butler County. The Department intends to enter into negotiations with one of these companies to contract for site reclamation, if funding is available.
The project, CRF 003-101.1, involves reclamation of the area mined by Adobe Mining Company at their Branchton site where bonds were forfeited to the Department under SMP No.10890701.
They are proposing to backfill, regrade and re-vegetate 24 acres. All areas will be re-graded to promote surface drainage and provide integration with surrounding un-mined areas.

To remove the existing twin span riveted thru-truss bridge which has an open steel grid deck, normal clear span lengths of 290 feet and 253 feet for the west and east span, respectively, a minimum underclearance of 21.0 feet and a hydraulic opening of 15,071 square feet and to construct and maintain a five span prestressed concrete I-beam bridge with normal clear spans of 118.25 feet for the two end spans and 118.75 feet for the three interior spans with a hydraulic opening of 16,184 square feet and a minimum underclearance of 20.6 feet. The piers and abutments will be built normal to the roadway and at a 90° skew to the Susquehanna River and to construct a separate causeways constructed of clean rock material and 4 foot and 6 foot diameter pipes for existing bridge removal and new bridge construction. The bridge will span the Susquehanna River between Athens and East Athens on SR 1056, Section 001. The project will not impact wetlands while impacting about 130 feet of waterways. The Susquehanna River is a Warm Water Fisheries Stream.

PUBLIC WATER SUPPLY PERMITS The Department of Environmental Protection (Department) has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.
Persons aggrieved by these actions may appeal, under section 4 of the Environmental Hearing Board Act (35 P. HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988 Prospective Purchaser Agreement Settlement under the Comprehensive Environmental Response, Compensation And Liability Act and the Hazardous Sites Cleanup Act The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675) among other statutes, has entered into a Prospective Purchaser Agreement with Equity Brokerage, Inc. (EBI) related to the East Tenth Street HSCA Site in Marcus Hook, Delaware County, PA.
Under the terms of the Prospective Purchaser Agreement, EBI will make a contribution towards the Department's response costs at the Site and agrees not to exacerbate any existing contamination attributable to the East Tenth Street Site in exchange for a covenant not to sue and contribution protection from the Department.
Copies of the full Prospective Purchaser Agreement are maintained in the Department's Southeast Regional Office, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428, and may be viewed or obtained by contacting April Flipse at (610) 843-5937 or William Blasberg at (610) 832-6000 during normal business hours. A 60-day period of public comment will follow the date of publication of this Notice, and the Department has reserved the right to withdraw from the Prospective Purchaser Agreement in the event that comments submitted during the comment period disclose facts or considerations which indicate, in the Department's discretion, that the Prospective Purchaser Agreement is inappropriate or not in the public interest. Notice of Prompt Interim Response Mount Union Creosote Site

Huntingdon County, PennsylvaniaThe Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) has initiated a prompt interim response at Mount Union Creosote Site. This response has been initiated under sections 501(a) and 505(b) of the HSCA (35 P. S. §§ 6020.501(a) and 6020.505(b)). The site is located at Mount Union Borough, Huntingdon County, PA.
The Mount Union Creosote Site (Site) is located in the northeastern section of Mount Union Borough, Huntingdon County. The area of concern is 15.5 acres previously occupied by a creosote treatment plant and its associated features. Former creosote treatment, storage and disposal activities have resulted in the release of hazardous substances. The athletic fields of the Mount Union Area High School are located in the area previously occupied by the south end of the former creosote plant operations and are believed to have been constructed over the area used for drying creosote impregnated railroad ties.
The Department conducted an investigation during July 1999 to assess the impact of former creosote activities on surface soils (less than 2 feet below the ground surface), the bedrock aquifer, and to determine groundwater flow paths and impacts to surface waters and sediments of the Juniata River.
The collection and analysis of surface soil samples throughout the Site indicate a sporadic occurrence of creosote-impacted soils. The chemicals of concern (COCs) are creosote related organic contaminants present above regulatory site-specific standards. The Site COCs are benzo(a)anthracene, benzo(a)pyrene, and benzo(b)fluoran- thene. Analysis of site monitoring wells shows the presence of soil COCs in the shallow groundwater.
To assess the site-specific potential impact of the COCs in the surface soil on the groundwater, a fate and transport analysis of potential leaching was performed and site-specific concentrations were calculated. The calculations indicate that existing groundwater contaminant levels are not currently impacting the Juniata River and will not impact river sediment and surface water in the future.
The Department proposes a prompt interim response at this Site to protect public health and safety or the environment. This determination is based on the potential and actual human exposure to hazardous substances in the shallow soil via inhalation, ingestion and dermal contact.
The Department considered three alternatives: 1. No action, which allows the continued exposure to COCs in the shallow soil. 2. Limited action, which includes implementation of a deed restriction to prevent future intrusive activities at the Site, and prohibit future use of groundwater at the Site. 3. Excavation and disposal of contaminated surface soil, and continued groundwater monitoring.
The Department has chosen to implement specific elements of Alternative 2 and implement Alternative 3. Both comply with applicable, relevant and appropriate requirements (ARARs), will reduce hazardous constituent concentrations below regulatory standards, remove direct contact threats, and are cost effective. These alternatives are protective of human health, safety, welfare and the environment by eliminating the risk from further release of hazardous substances at the Site.
The Department is providing this notice under sections 505(b) and 506(b) of HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)), and the publication of this notice starts the administrative record period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office located at 909 Elmerton Avenue, Harrisburg, PA 17110, by contacting Crystal Snook at (717) 705-6645. The Administrative Record can also be reviewed at the Mount Union Public Library, Mount Union, PA.
The Administrative record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days. Settlement Under the Comprehensive Environmental Response, Compensation and Liability Act and the Hazardous Sites Cleanup Act North Front Associates/Container Recyclers Site, Philadelphia County The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with William H. Cooper's Sons, Inc., concerning the cleanup of the North Front Associates (former Container Recyclers Ltd.) site in Philadelphia County, PA. Under the terms of the proposed Consent Decree, William H. Cooper's Sons, Inc. will pay into the Pennsylvania Hazardous Sites Cleanup Fund the sum of $10,600 in three installments. In the mid 1990's the Department implemented an Interim Response and a Prompt Interim Response to mitigate the threat to human health and the environment posed by the hazardous substances released there.
The specific terms of this settlement are set forth in the proposed Consent Decree between the Department and William H. Cooper's Sons, Inc. The Department will receive and consider comments relating to the proposed Consent Decree for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the proposed Consent Decree if the comments concerning the proposed Consent Decree disclose facts or considerations which indicate that the proposed Consent Decree is inappropriate, improper, or not in the public interest. Dougherty and Lehman NPDES-CAFO Permit Applications
Limestone Township, Lycoming CountyThe Department of Environmental Protection (Department) is cancelling, until further notice, the public meeting/public hearing, originally scheduled for September 5, 2002, at the Jersey Shore Area High School auditorium. The original purpose of the hearing was to discuss two separate National Pollutant Discharge Elimination System (NPDES) Concentrated Animal Feeding Operation (CAFO) General Permit applications for facilities proposed in Limestone Township, Lycoming County. The two applicants are: (1) Charles L. and Michelle L. Dougherty: and (2) Michael V. and Dorothea A. Lehman. The meeting/hearing has been cancelled because the Department has determined that it will be necessary for the applicants to submit Individual NPDES application packages, rather than Notices of Intent to be covered under the General NPDES permit. It will also be required that Water Quality Management permit applications be submitted for the proposed manure storage facilities. A meeting/hearing may be re-scheduled, after the Department receives the new application packages. Notice of any rescheduled meeting/hearing will be announced in this Pennsylvania Bulletin.
