Implementation of Act 37 of 2005--Commercial Drivers' License Disqualification Program [35 Pa.B. 4885] By notice published July 16, 2005 (35 Pa.B. 4029), the Department of Transportation (Department), under sections 9 and 10 of the act of July 5, 2005 (P. L. 100, No. 37) (Act 37), Senate Bill 724, Printers No. 868, amending 75 Pa.C.S. (relating to the Vehicle Code) implementing the Federal Motor Carrier Safety Improvement Act of 1999, gave notice that it was prepared to implement the administrative changes required by the aforementioned Act 37 of 2005. That notice was overly broad. Although the Department is prepared to implement most of the provisions of the Act, it is not ready to implement the provisions of section 4107(d)(3) of the Act (relating to penalty) and section 1603 (relating to definitions), insofar as the definition of ''serious traffic violation'' includes violations of 75 Pa.C.S. § 3309(3), should be excepted from the provisions which the Department is prepared to implement. All other provisions will be implemented as previously noticed.
