    Credit Cards for Payment

       Under section 133(a)(3) of the Associations Code (code) (15 Pa.C.S. § 133(a)(3)) (relating to powers of Department of State) and 19 Pa. Code § 3.105 (relating to credit card payment of fees), the Department of State (Department), Corporation Bureau (Bureau) authorizes the acceptance of approved credit cards for payment of Bureau fees for filings submitted and processed electronically. Until additional notice is given, credit cards will not be accepted for filings submitted via fax, courier service, mail or in person.

       The Department authorizes credit card payment of fees for electronic transactions based upon its determination that the Bureau may process these filings without net cost to the Department. The processing of electronic filings without net cost to the Department satisfies the statutory requirement in section 133(a)(3) of the code. The Department will not currently be accepting credit cards for payment of nonelectronic filings because nonelectronic transactions must be imputed and processed by Bureau personnel and the costs of accepting credit cards would produce additional costs to the Department. These additional costs prevent the acceptance of credit cards for these transactions based upon the provisions in section 133(a)(3) of the code.

       This notice shall be effective immediately.
