Russ, of Pittsburgh, Allegheny County, License Number RS-127398-A, was disciplined for making a substantial misrepresentation, failing to pay over a deposit promptly to his broker, engaging in conduct in a real estate transaction demonstrating bad faith, dishonesty, untrustworthiness or incompetency, failing to account in a timely manner for all money received from any consumer to a transaction and performing services and recovering a fee paid by a consumer without setting forth the nature of the service and the fee to be charged in a written agreement between the broker and the consumer that was signed by the consumer. Respondent's license has been suspended for 90 days, and he is ordered to pay a $5,000 civil penalty.

This adjudication and order represent the final State Real Estate Commission (Commission) decision in this matter. It may be appealed to the Commonwealth Court of Pennsylvania by the filing of a petition for review with that court in accordance with the Pennsylvania Rules of Appellate Procedure. Individuals who take an appeal to the Commonwealth Court must serve the Commission with a copy of the petition for review.
