Unless otherwise indicated, on the basis of preliminary review and applications of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible official considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

The Village Square, R. D. 1, Shermansdale, PA 17090-1997 has applied to renew its current NPDES permit, PA 0084417, to allow the continued discharge of controlled wastewaters into the waters of the Commonwealth. The Department of Environmental Protection (DEP) has made a tentative determination to renew the permit, subject to the current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

Acknowledgment of Notices of Intent to Remediate submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act, the act of May 19, 1995 (P. L. 4, No. 2).
Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department must provide a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

S. § 6020.1113) notice is hereby provided that the Department of Environmental Protection (Department) has entered into a Consent Order and Agreement with New Castle Junk Company (Company), and Roland Levine and Miriam Levine (Levines) concerning the Dupont/New Castle Junk Site (site). This site is located in the City of New Castle and Union Township, Lawrence County, PA.
The Department has incurred $1,100,000 in response costs at the site, and estimates that it will cost between 11 and 14 million dollars to clean up the site in the future. However, based upon the Company's and the Levines' available assets and Roland Levine's uninsured medical expenses, the Department has determined that the Company and the Levines cannot pay for any substantial portion of the response costs at the site. Accordingly, the Department has agreed to enter into a financial inability to pay settlement with the Company and the Levines whereby the Company and the Levines will, among other things, pay $216,000 to the Hazardous Sites Cleanup Fund and will place a lien for $1,100,000 on the Company's property within the site. The specifics of the Department's settlement with the Company and the Levines are set forth in the Consent Order and Agreement.
The Department will receive and consider comments relating to the Consent Order and Agreement for 60 days from the date of this public notice. The Department has the right to withdraw its consent to the Consent Order and Agreement if the comments disclose facts or considerations which indicate that the Consent Order and Agreement is inappropriate, improper, inadequate or not in the public interest. After the public comment period, the Department's settlement with the Company and the Levines shall become final upon the filing of the Department's response to significant written comments to the Consent Order and Agreement.

Under the terms of the Consent Order and Agreement, upon obtaining indicia of ownership of the site, or a portion of the site, LCEDC will grant the Department access for the clean-up of the site. In addition, upon obtaining indicia of ownership of the Battery property at the site, LCEDC will maintain the Response actions conducted at the Battery property. The following stationary sources have filed a request for a plan approval with the Department of Environmental Protection (DEP), Bureau of Air Quality. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

The Municipal Authority of Buffalo Township, Armstrong County, has submitted an application requesting permission to acquire rights for the acquisition of water from Allegheny River. The applicant is requesting permission to withdraw 1,250,000 million gallons per day of water as a daily peak, from the Allegheny River.

The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Standards Act, the act of May 19, 1995 (P. L. 4, No. 2).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

E46-273. Encroachment. Department of Transportation, 200 Radnor-Chester Road, St. Davids, PA 19087. To amend and reissue permit No. E46-273 by performing the following activities: (1) To rehabilitate, operate and maintain the bridge which carries Route 29 across the Schuylkill River. This bridge has five clear normal spans of 103 feet each with an underclearance of 12 to 28 feet. The original deck superstructure will be removed. The lower portion of the bridge piers, abutments and foundation will remain in tact. (2) To rehabilitate, operate and maintain an adjacent box beam bridge carrying Route 29 across the Schuylkill Canal having a normal span of 50 feet with an underclearance of 12 to 14 feet. (3) To install, operate and maintain a temporary causeway with a top elevation of 79.0 feet (Mean WSEL = 75.0 feet) consisting of multiple pipes ranging from 12" to 36" in diameter and maintain a temporary minor road crossing of the Schuylkill Canal for driveway access. This site is situated where Route 29 crosses the Schuylkill River and Canal (Phoenixville USGS Quadrangle N: 1.9 inches; W: 1.25 inches) in Phoenixville Borough, Chester County and Upper Providence Township, Montgomery County.
