DEPARTMENT OF ENVIRONMENTAL PROTECTION Applications, Actions and Special Notices [26 Pa.B. 2715] APPLICATIONS The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

S. § 6026.101 et seq.) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

Notice of Plan Approval Application Minor Source
The following stationary sources have filed a request for a plan approval with the Department of Environmental Protection (DEP), Bureau of Air Quality. Persons wishing to file protests or comments on the proposed plan approval have 30 days to submit the protests or comments to the Regional Office at the address listed below. Interested persons may also request that a hearing be held concerning the plan approval application by filing a request with the Regional Office stating the reason for the request.
The Department will evaluate and consider all protests and comments received. The Department will, where appropriate, modify the proposed plan approval based on the protests and comments received.
The final plan approval will contain terms and conditions to ensure that the source is constructed and operated in compliance with the Department's regulations contained in 25 Pa. Code Chapters 121 through 143 and the requirements of the Federal Clean Air Act. A notice of the Department's final decision on the proposed plan approval will be published in the Pennsylvania Bulletin. The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

E61-203. Encroachment. Richard Schiffer, P. O. Box 389, Franklin, PA 16323. To install and maintain a 100-foot long by 4-foot diameter stream enclosure in a tributary to French Creek (WWF). This enclosure will have a cast in place concrete inlet and outlet which will connect to two existing concrete enclosures. This enclosure will allow site development for commercial use. To remove the existing structure and to construct and maintain a dual 8-span continuous steel girder bridge having a total length of 1,230.0 feet with an underclearance of approximately 56 feet or an alternative design with work consisting of to construct and maintain a dual 9-span prestressed concrete bridge having a total length of 1,201.83 feet with an underclearance of approximately 56 feet across the Lehigh River (TSF) and to construct and maintain approximately 21 feet of 6-foot × 5-foot concrete box culvert to extend an existing arch culvert at Station 226+30 in an unnamed tributary to the Lehigh River. E40-444. Encroachment. Bear Creek Village Borough, Box 332, Bear Creek, PA 18602. To construct and maintain a roadway crossing of a tributary to Bear Creek (HQ-CWF) (locally known as Sand Spring Run), consisting of an 8-foot by 4-foot precast concrete box culvert. The purpose of the project is to replace the previous multiculvert crossing, which was washed out during the January 1996 flood event. To enlarge the reservoir surface area of a nonjurisdictional dam to approximately 0.65 acre by reshaping, extending and raising the earth embankment. The project is located on the south side of T615 (Kromer Road), approximately 0.2 mile west of its intersection with S. R. 1001 (Wind Gap, PA Quadrangle N: 12.8 inches; W: 8.4 inches) in Bushkill Township, Northampton County (Philadephia District, Army Corps of Engineers).

To maintain a roadway crossing of Billings Creek (HQ-CWF), consisting of three side-by-side 71-inch × 47-inch elliptical corrugated metal pipes, located on S. R. 4004, Segment 0210, Offset 2200. The crossing was constructed under an Emergency Permit, which also authorized removal of the former flood-damaged crossing at this location. The crossing is located approximately 0.2 mile west of the intersection of S. R. 0739 and S. R. 4004 (Pecks Pond, PA Quadrangle N: 21.2 inches; W: 9.2 inches) in Blooming Grove Township, Pike County (Philadelphia District, Army Corps of Engineers).
E54-222. Encroachment. Borough of Shenandoah, 15 West Washington Street, Shenandoah, PA 17976. To modify and maintain the existing structure in Kehly Run (CWF) with work consisting of the following: to construct and maintain approximately 81 linear feet of 9.0 foot × 4.0 foot concrete box culvert sleeved within the existing stream enclosure having a varying width of approximately 9 feet, 7 inches to 12 feet, 5 inches and height of approximately 2 feet, 6 inches to 5 feet; to remove the existing deteriorated roof slab and to construct and maintain approximately 35 linear feet of concrete roof slab on the existing stream enclosure from station 0+05 to station 0+40; to remove the existing deteriorated roof slab and to construct and maintain approximately 60 linear feet of concrete cap and associated chain link fence on top of the existing stone masonry walls, on either side of the stream from station 2+25 to station 2+85. The project is located approximately 0.04 mile south east of the intersection of Center Street and Bridge Street (Shenandoah, PA Quadrangle N: 13.0 inches; W: 9.5 inches) in Shenandoah Borough, Schuylkill County (Baltimore District, Army Corps of Engineers).
E58-212. Encroachment. Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501. To place fill in 0.33 acre of PEM and POWZx wetlands, to widen the Interstate 81 Bridge carrying the southbound lanes across Trowbridge Creek (CWF) and to place fill in the floodway of Trowbridge Creek for construction of a proposed welcome center. This project is located between S. R. 0011 and I-81 along the north side of Trowbridge Creek (Great Bend, PA Quadrangle N: 19.8 inches; W: 16.9 inches) in Great Bend Township, Susquehanna County (Baltimore District, Army Corps of Engineers).
E64-168. Encroachment. Ariel Land Owners, Inc., 513 W. 15th Street, Honesdale, PA 18431. To remove the existing concrete slab bridge and to construct and maintain a road crossing consisting of two 66-inch × 51-inch CMP arch culverts in Ariel Creek (HQ-CWF). The project is located on Schlager Road, in the Lake Ariel Development, approximately 150 feet downstream of Lake Ariel Dam and 0.25 mile northwest of the intersection of S. R. 3025 and S. E66-107. Encroachment. Paul and Lynda Jenceleski, 52 Armstrong Street, Edwardsville, PA 18704. To construct and maintain a steel I-beam bridge with wood decking across Leonard Creek (HQ-CWF) having a single-span of approximately 38.0 feet and an underclearance of approximately 4.0 feet to provide access to a private residential building site. The project is located on the east side of S. R. 309, approximately 500 feet southeast of the intersection of S. R. 309 and S. The modified watercourse will be concrete lined with a 2-foot wide bed and 3-foot deep and will have a concrete headwall structure at the end to be connected to an existing 18-inch diameter C.M.P. storm sewer located beneath the Dunks Ferry Road. This project also includes the construction and maintenance of an approximately 309-feet long, 18-inch diameter R.C.P. storm sewer piping having a concrete headwall intake structure to be located within a wetland. The project site is situated approximately 400 feet east of the intersection of Street Road (S. R. 2007) and Dunks Ferry Road (T-324) (Beverly, PA-NJ Quadrangle N: 14.5 inches; W: 8.0 inches) in Bensalem Township, Bucks County. The permittee shall provide a minimum of 0.31 acre of wetlands replacement. Approval is also granted for the environmental assessment related to the construction of the proposed stormwater detention basin.

Recycling Grant Awards Under the Municipal Waste Planning Recycling and Waste Reduction Act.
The Department of Environmental Protection hereby announces the following grants to municipalities for recycling programs under the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (35 P. S. §§ 4000.101--4000.1904).
Grant funds can be used to develop and implement recycling programs. Municipalities and counties are eligible for up to 90% funding of approved recycling program costs. Municipalities considered financially distressed by the Department of Community Affairs under the Municipalities Financial Recovery Act (53 P. S. §§ 11701.101--11701.501) are eligible to receive funding for an additional 10% of approved costs. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
