       Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For new permit applications, renewal applications with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.

       Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

       Persons wishing to comment on a proposed permit are invited to submit a statement, to the office noted before the application, within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding the application. The comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       Renewal applications, including proposed effluent limitations and special conditions, are available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated before the application.

       Description of Proposed Activity:  Renewal of a treated minor discharge from a privately owned sewage treatment works.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the Beaver River and Beaver Falls Municipal Authority at River Mile 3.76, 29.77 miles below point of discharge.

       The receiving stream, unnamed tributary to Big Run, is in watershed 20-A and classified for WWF, aquatic life, water supply and recreation.

       The proposed effluent limits for Outfall 001 are based on a design flow of 0.0024 MGD.

       Description of Proposed Activity:  Renewal of municipal separate stormwater system consisting of 165 miles of storm sewer pipe with 227 outfalls to the Lehigh River, Little Lehigh Creek, Trout Creek, Cedar Creek, Little Cedar Creek and Jordan Creek.

       The permittee must develop, implement and maintain programs to characterize the outfalls and minimize their impact on water quality.

       Permit requirements include:  establishing legal authority; source identification; discharge characterization; stormwater management programs including implementation of appropriate best management practices; assessment of controls; adequate fiscal resources; submission of annual report.

       The receiving stream, West Branch Susquehanna River, is in the State Water Plan watershed 9B and classified for WWF. The nearest downstream public water supply intake for the Pennsylvania American Water Company is on West Branch Susquehanna River, 51 miles below the point of discharge.

       The proposed effluent limits for Outfall 001 based on a design flow of 1.3 MGD.

       The receiving stream, Susquehanna River, is in the State Water Plan watershed 5D and classified for WWF. The nearest downstream public water supply intake for the Danville Municipal Water Authority is on the Susquehanna River, 10 miles below the point of discharge.

       Description of Proposed Activity:  Pending issuance of an amended NPDES permit to include discharge of site stormwater through Outfall S01. Existing limits for wastewater through Outfall 001 remain unchanged.

       The receiving stream for Outfall 001, the Susquehanna River, is in the State Water Plan watershed 5E and is classified for WWF. The nearest downstream public water supply surface water intake, owned by Merck and Company, Inc., is on the Susquehanna River, 2.35 miles below the discharge.

       The existing effluent limits for Outfall 001 will remain the same and were based on a design flow of 0.1 MGD.

       The receiving stream for Outfall S01, an unnamed tributary to the Susquehanna River, is in the State Water Plan watershed 5E and is classified for CWF. The nearest downstream public water supply surface water intake, owned by Merck and Company, Inc., is on the Susquehanna River, 2.39 miles below the discharge. Approximately 0.084 MGD of stormwater will be discharged through Outfall S01 from an average storm event. Annual Inspection Certification will be required.

       PA0028461, Sewerage, 4952, Mifflinburg Borough Municipal Authority, 333 Chestnut Street, Mifflinburg, PA 17844. This facility is in Mifflinburg Borough, Union County.

       Description of Proposed Activity:  Issuance of an amended NPDES permit to include discharge of site stormwater through Outfalls S01 and S02. The existing limits for treated effluent through Outfall 001 remain unchanged.

       Outfalls S01 and S02 will discharge via sheet flow onto a gravel driveway area onsite. The nearby receiving stream, Buffalo Creek, is in the State Water Plan watershed 10C and is classified for CWF. The nearest downstream public water supply intake for Sunbury Municipal Authority is on the Susquehanna River, approximately 23.7 miles below the point of discharge. Approximately 0.02 million gallons per day of stormwater will be discharged through Outfalls S01 and S02 during a rainfall intensity of 1 inch per hour.

       PA0032514, Sewage, 4952, Department of Conservation and Natural Resources, Denton Hill State Park, 262 Sizerville Road, Emporium, PA 15834. This facility is in Ulysses Township, Potter County.

       Description of Proposed Activity:  The Department of Conservation and Natural Resources is proposing to change the receiving stream of Outfall 001 from Elm Hollow Run (HQ-CWF) to Nine Mile Run (HQ-CWF). The Department of Conservation and Natural Resources intends to replace the existing sewage treatment plant at Denton Hill State Park with a new sewage treatment plant. All of the existing permit conditions and effluent limitations will remain the same except for the previously mentioned change of the receiving water.

       PA0005037-A3, Industrial Waste, SIC 4911, EME Homer City Generation LP, 1750 Power Plant Road, Homer City, PA 15748-9558. This application is for an amendment of an NPDES permit to discharge treated process water from the flue gas desulfurization wastewater plant in Center Township, Indiana County.

       The following effluent limitations are proposed for discharge to the receiving waters, Blacklick Creek, classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is the Saltsburg Municipal Water Authority--Saltsburg, 28 miles below the discharge point.

       Outfall 027:  existing discharge, design flow of 0.179 mgd.

    PART II PERMITS

       The following permit applications or requests for plan approval have been received by the Department of Environmental Protection (Department).

       Persons wishing to comment on an application are invited to submit a statement to the office noted before the application within 15 days from the date of this public notice. Comments received within the 15-day comment period will be considered in making the final decision regarding an application. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

       The Department reserves the right to hold a public hearing if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation of the area. If no hearing is held, the Department's Water Management Program Manager will make a final determination regarding the application after a complete review. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

The design flow for the system is 8,325 GPD.

       Description of Proposed Action/Activity:  The project consists of construction of a new sanitary sewer extension to the Hallstead Great Bend Joint Sewer Authority sanitary sewer system, including gravity sewers and three pumping stations with force mains. The proposed Phase I Sewer Extension will be a main trunk line that will extend from the existing Hallstead Great Bend Joint Sewer Authority sewer system through Great Bend Township to New Milford Township boundary, where it will connect and receive wastewater flow from the New Milford Municipal Authority's new sewer system.

    NPDES Stormwater Individual Permit

       The following parties have applied for an NPDES permit to discharge stormwater associated with a construction activity into waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

       Where indicated, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

       Persons wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department Regional Office noted before the application within 30 days from the date of this public notice.     PREAMBLE 1


    Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

       For further information concerning the content of a Notice of Intent to Remediate, contact the Environmental Cleanup Program Manager in the Department Regional Office after which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.     NEW SOURCES AND MODIFICATIONS

       The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Office identified in this notice. Persons interested in reviewing the application files should contact the appropriate Regional Office to schedule an appointment.

       Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate interest to the Department Regional Office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning a proposed plan approval and operating permit. This facility is a non-Title V facility. Along with all other processes in Building A, the new Turbo Blender will be subject to an emission limit of 21.0 tons per year for VOCs, 8.83 tons per year for HAPs--formaldehyde and 10.41 tons per year for NOx. Emissions of CO from all processes in Building A are expected to be less than 36 tons per year. Emissions of PM from all processes in Building A are expected to be less than 8 tons per year. Emissions of VOCs and HAPs will be controlled by the existing thermal oxidizer, which shall be operating at all times during operation of processes in Building A. Emissions of PM will continue to be controlled by dust collectors and the existing thermal oxidizer. The Plan Approval will contain recordkeeping and further operating restrictions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.

       48-322-004: IESI PA Bethlehem Landfill Corp. (2335 Applebutter Road, Bethlehem, PA 18015-6004) for construction of the Phase IV landfill expansion and replacement of an enclosed ground flare at its facility in Lower Saucon Township, Northampton County. The VOC emissions from the landfill will be controlled by the enclosed ground flare and shall not exceed 50 tons per year. Although the sources covered by this plan approval may be at a major facility, the construction does not trigger major new source review or prevention of significant deterioration requirements. Additionally, the landfill is subject to Subpart WWW of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.750--60.759. The plan approval will include all appropriate monitoring, recordkeeping and reporting requirements designed to keep the source operating within all applicable air quality requirements.

       39-399-057: GEO Specialty Chemicals--Trimet Product Group (2409 North Cedar Crest Boulevard, Allentown, PA 18104) for modification and operation of calcium formate process at their facility. This modification involves installation of a baghouse to collect nuisance fugitive dust emitted from the calcium formate process equipment. GEO Specialty Chemicals is a major facility subject to Title V permitting requirements and is in Whitehall Township, Lehigh County. The modification will increase particulate emissions by 780 pounds per year from the facility. The Plan Approval will contain conditions requiring the source to show compliance with the emission rates. The Plan Approval and Operating Permit will contain additional recordkeeping and operation restrictions designed to keep the facility operating within all applicable air quality requirements. The facility is a non-Title V (State-only) facility. The facility's VOC emissions will be limited to less than 25 tons per year. The HAPs emissions will be limited to 10/25 tons per year. The facility will be required to record the coating usages and calculate the VOC and HAP emissions monthly. Limits will be placed on the VOC content of the coatings used in the operation. The permit will include monitoring, work practices, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

       36-03105B: Binkley and Ober, Inc. (P. O. Box 7, East Petersburg, PA 17520) to construct an air classifier controlled by a knock out box and fabric filter at their East Petersburg stone crushing plant in East Hempfield Township, Lancaster County. This air classifier has a potential to emit 22 tons per year of PM. Actual emissions by the air classifier are expected to be 6 tons per year of limestone dust (PM). This plan approval will include monitoring, recordkeeping and reporting requirements designed to keep the sources operating within all applicable air quality requirements.

       36-05067I: C and D Technologies, Inc. (82 East Main Street, Leola, PA 17540) for modifications to the existing lead-acid battery manufacturing plant in Upper Leacock Township, Lancaster County. The modifications include the installation of a lead casting pot and the relocation of an existing fabric filter. Plant emissions will be marginally impacted by the proposed modifications. The plant is subject to 40 CFR Part 60, Subpart KK--Standards of Performance for Lead-Acid Battery Manufacturing Plants. The plan approval will include emission limits, testing, monitoring, recordkeeping and reporting requirements to ensure the facility complies with the applicable air quality requirements.

       36-05128A: Compass Quarries, Inc. d/b/a Independence Construction Materials (P. O. Box 130, 47 McIlvaine Road, Paradise, PA 17562-0130) for modifications that include burning of waste derived fuels in the stone dryer and the addition of three nonmetallic conveyors for their facility in Paradise Township, Lancaster County. The plan approval will contain appropriate conditions designed to keep the source operating within all applicable air quality requirements.

       67-03058B: Coates Electrographics, Inc. (1160-A Fahs Street, York, PA 17404) for addition of a new classifier, a separator/cyclone and a baghouse for their facility in West Manchester Township, York County. The plan approval will contain appropriate conditions designed to keep the source operating within all applicable air quality requirements.

       67-05098A: Global Stone PenRoc, LP (495 Global Stone Drive, York, PA 17405) for replacement of both a rotary dryer burner and associated dust collector at their roofing plant (West Operations) in West Manchester Township, York County. There are no expected increases in particulate matter emissions as a result of the replacements. The plan approval and ensuing update to the facility wide operating permit shall contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

       49-308-002: Jeff's Auto Body and Recycling Center, Inc. (R. R. 1, Box 318, Paxinos, PA 17860) for the construction of an aluminum ''sweat'' furnace (an aluminum scrap melting furnace) in Shamokin Township, Northumberland County.

       The respective furnace will be used to melt the aluminum out of ''irony aluminum'' automotive, and the like, scrap (scrap consisting of both iron and aluminum). The air contaminant emissions from the furnace will be controlled by a thermal afterburner. The resultant air contaminant emissions will be up to .239 ton of NOx, .032 ton of CO, .017 ton of SOx, .008 ton of hydrocarbons, .007 ton of PM and .0014 gram of dioxins/furans per year.

       The Department's review of the information contained in the application indicates that the proposed sweat furnace will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12 and Subpart RRR of the National Emission Standards for Hazardous Air Pollutants (40 CFR 63.1500--63.1519, National Emission Standards for Hazardous Air Pollutants for Secondary Aluminum Production). Based on this finding, the Department intends to approve the application and issue plan approval.

       The following is a summary of the conditions the Department proposes to place in the plan approval to ensure compliance with all applicable regulatory requirements:

       1.  The sweat furnace shall be used to process irony aluminum scrap only. At no time shall the furnace be used to process lead scrap nor shall it be used to recover aluminum or copper from insulated wire or cable nor shall it be used as an incinerator to dispose of wastes.

       2.  At no time shall fluxes be used in the sweat furnace.

       3.  The sweat furnace shall be fired with propane only.

       4.  The sweat furnace shall not be operated more than 2,080 hours in any 12 consecutive month periods.

       5.  The sweat furnace shall not be operated if the afterburner is inoperable.

       6.  The sweat furnace shall be equipped with instrumentation to monitor and record the flue gas temperature at the exit of the furnace and afterburner exhaust stack.

       7.  At any time scrap is being processed in the sweat furnace, a flue gas temperature of at least 1,600°F shall be maintained at the temperature sensor at the exit of the furnace and afterburner exhaust stack. No scrap shall be placed into the furnace at any time the temperature is less than 1,600°F.

       8.  The sweat furnace shall be attended by an operator at all times it is in operation.

       9.  The particulate matter emissions from the sweat furnace shall not exceed .02 grain per dry standard cubic foot. The visible air contaminant emissions shall not exceed 10% opacity at any time. The dioxin/furan emissions (on a TEQ or toxicity equivalents basis) shall not exceed .00000000035 grain per dry standard cubic foot corrected to 11% oxygen.

       10.  The sweat furnace shall comply with all applicable requirements of Subpart RRR of the National Emission Standards for Hazardous Air Pollutants, 40 CFR 63.1500--63.1519.

       11.  Records shall be maintained of the number of hours the sweat furnace is operated each month. All records and all temperature records generated by the continuous stack temperature monitoring and recording instrumentation shall be retained for at least 5 years and shall be made available to the Department upon request.

       14-00005: Department of Corrections/Rockview State Correctional Institution (P. O. The facility is a non-Title V facility. Annual VOC emissions from the paint spraying operations will be 23.3 tons per year of which 10.8 tons per year will be HAPs. The particulate emissions from the process will be controlled through the use of filter panels and will be less than 0.02 grain/DSCFT. The Operating Permit will include monitoring, reporting and recordkeeping requirements designed to keep the source operating within all applicable air quality requirements.

       40-399-050: Genova Products (502 Forest Road, Humboldt Industrial Park, Hazleton, PA 18202) for operation of a new PVC trimming operation which will be controlled by the use of a baghouse at their facility in Hazle Township, Luzerne County. The new line will not emit particulate emissions more than 0.02 grain/dscf. The Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

       54-301-040A: MAGDALENE (Ruth Ann Brouse, P. O. Box 215, Ringtown, PA 17967) for operation of a second new human crematory incinerator at their facility in Ringtown, Schuylkill County. The unit will have a rated capacity of 150 lbs/hr and fire on natural gas. The minimum operating temperature of 1,800°F shall be maintained with a minimum gas retention time of 1 second. Particulate emissions shall not exceed 0.08 grain/dscf, corrected to 7% O2. Visible air contaminants shall not be emitted in a manner that the opacity of the emissions is equal to or greater than 10% for a period or periods aggregating more than 3 minutes in any 1 hour or equal to or greater than 30% at any time. The Operating Permit will include monitoring and recordkeeping requirements designed to keep the source operating within all applicable air quality requirements.

       40-328-005: Transcontinental Gas Pipeline Corp. (P. O. Box 1396, Houston, TX 77251-1396) for operation of the existing natural gas turbine, Unit No. 6, increasing the horsepower from 12,600 to 15,000 and retrofitted with SoLoNOx technology at their facility in Buck Township, Luzerne County. NOx emissions will not exceed 42 ppm from 6 and will not operate more than 3,120 hours/year. The company currently has a Title V Permit 40-00002. The Operating Permit will include testing, monitoring, recordkeeping and reporting requirements designed to keep the sources operating within all applicable air quality requirements. The Plan Approval will, in accordance with 25 Pa. Code 127.450, be incorporated into the Title V Operating Permit through an administrative amendment at a later date.

The facility has the potential to emit 6 tons per year of NOx, 5 tons per year of CO, 4 tons per year of PM and less than 1 ton per year of SOx, VOCs and HAPs. The facility wide (State-only) operating permit shall contain testing, monitoring, recordkeeping and reporting requirements, emission restrictions and work practice standards designed to keep the facility operating within all applicable air quality requirements.

       36-03135: Shared Mail Acquisitions, LLC (72 Industrial Circle, Lancaster, PA 17601) for the operation of presses at their printing facility in Upper Leacock Township, Lancaster County. This printing facility is a non-Title V (State-only) facility. This operation emits 10 tons per year of VOCs, 2.4 tons per year of NOx, 2 tons per year of CO and less than 1 ton each of HAPs, PM and SO2 to be emitted. A thermal oxidizer controls the VOC emissions from the heat set presses. Conditions for monitoring, recordkeeping and operating are included to keep the facility operating within the applicable air quality requirements.

    COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

       Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of the NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30 day period to review and submit comments on those requirements.

    FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

       The application is for an after-the-fact permit application. The work was conducted under an emergency permit since the existing crossings were failing. The new culverts measurements are a 6-foot corrugated metal pipe in Little Marsh Creek and a 5-foot diameter corrugated metal pipe in an unnamed tributary to Little Marsh Creek (CWF). The project impacted 25 feet of Little Marsh Creek and 25 feet of the tributary.

       E53-389. Department of Transportation District 2-0, 1924-30 Daisy Street, Clearfield, PA 16830. Bridge Replacement in Genesee Township, Potter County, ACOE Baltimore District (Ellisburg, PA Quadrangle N:  20 inches; W:  .125 inch).

       The permit application proposes to remove the existing timber deck ''I'' beam bridge structure and replace it with a prestressed concrete bridge structure with a clear span of 51.5 feet and an underclearance of 9 feet. The proposed structure is also intended to remain on the existing horizontal alignment. The permit proposes to impact 100 feet of the West Branch of the Genesee River (HQ-CWF). This project does not intend to impact any wetlands.

       E59-441. Grant D. Davis, R. R. 2, Box 304A, Middlebury Center, PA 16935. Culvert Replacement in Middlebury Township, Tioga County, ACOE Baltimore District (Cherry Flats, PA Quadrangle N:  13.9 inches; W:  16.6 inches).

       The application proposes to install an 8-foot diameter by 25-foot long corrugated metal pipe with precast concrete wing walls. The project intends to impact 50 feet of Willis Run (WWF) and does not intend to impact any wetlands.

       E59-442. Middlebury Township Supervisors, R. R. 2, Box 293A, Middlebury Center, PA 16935. Bridge Replacement in Middlebury Township, Tioga County, ACOE Baltimore District (Elkland, PA Quadrangle N:  1.4 inches; W:  12.2 inches).

       The applicant is proposing to remove the existing bridge structure and replace it with a reinforced concrete box culvert. The proposed culvert is intended to be 20 feet by 6.5 feet, depressed 1 foot to allow for a continuous natural steam bed. The proposed structure is designed to pass the 25-year storm with no overtopping or backwater. The application also includes plans for flow bypass pipes to allow flow through the construction area during construction. The project proposes to impact 200 feet of Losey Creek (WWF).

       E04-294. Norfolk Southern Corporation, 99 Spring Street, Atlanta, GA 30303-0142. Norfolk Southern Bridge YG-92.81 in Daugherty Township, Beaver County, Pittsburgh ACOE District (Beaver Falls, PA Quadrangle N: 0.2 inch; W: 8.1 inches). The applicant proposes to remove the existing 30-foot steel open deck railroad bridge, to construct and maintain a new concrete ballast deck railroad bridge on the existing; to repair the existing concrete of the abutments and to construct and maintain a 6-inch concrete encasement on the face of both wall abutments. The bridge will have a span of approximately 23.9 feet and underclearance of approximately 12.1 feet. The bridge spans over a tributary to the Beaver River (WWF) locally known as Trough Run. The bridge is along the left bank side of the Beaver River, approximately 3,000 feet north of the railroad crossing with the 10th Street Bridge. This project proposes to impact approximately 95 feet of the tributary to the Beaver River.

       E56-322. Somerset Township Supervisors, 2209 North Center Avenue, Somerset, PA 15501-9344. Somerset Township Road T-524 Sechler Road Bridge in Somerset Township, Somerset County, Pittsburgh ACOE District (Somerset, PA Quadrangle N:  7.43 inches; W:  9.06 inches). The applicant proposes to extend and maintain an existing 20.1-foot long single span having a normal span of 18.0 feet and an underclearance of 5.5 feet across an unnamed tributary to East Branch Coxes Creek (WWF), 4.0 feet upstream and 4.0 feet downstream for the purpose of improving transportation safety and roadway standards. The project is on Sechler Road (T-524).

       E63-539. Authority of the Borough of Charleroi, 3 McKean Avenue, P. O. Box 211, Charleroi, PA 15022. Van Voorhis Waterline in Fallowfield Township, Washington County, Pittsburgh ACOE District (Monongahela, PA Quadrangle N:  3.9 inches; W:  14.4 inches). The applicant proposes to construct and maintain a new waterline (Voorhis Waterline) in, along and across the channel of Pigeon Creek and an unnamed tributary to Pigeon Creek beginning at the intersection of Camway Lane and Vancik Road and extending northeast along Bentleyville Road for a distance of approximately 16,000 linear feet.

These impacts from this proposed project will be approximately 60 feet of stream impacts to Little Chartiers Creek and fill in .14 acre of wetlands.

    APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

The approval for coverage under these general NPDES permits is subject to applicable effluent limitations.     HAZARDOUS SITES CLEANUP UNDER THE ACT OF OCTOBER 18, 1988

    Administrative Record Reopening

    Yorktowne Special Products Site, Red Lion Borough, York County

       The Department of Environmental Protection (Department), under the authority of section 506(g) and (h) of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. § 6020.506(g) and (h)), reopens the administrative record for interim response at the Yorktowne Special Products Site (Site), 101 Cherry Street, Red Lion Borough, York County. The Department is opening the administrative record solely for the purpose of documenting its response costs at the Site.

       The Department originally opened the administrative record under section 506(b) of the HSCA on December 15, 2001, to provide the public the opportunity to comment on the proposed prompt interim response action for removal and disposal of the wastes at the Site. The Department closed the administrative record on March 15, 2002, by filing its Statement of Decision under section 506(e) of the HSCA.

       The administrative record is being reopened for the Department to document its response costs at the Site. The new information is available for public review Monday through Friday from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Ruth Bishop, (717) 705-4833. A copy of the administrative record is also available for review during normal office hours at the Red Lion Borough Office in Center Square, Red Lion. The administrative record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 60 days. Comments will be limited solely to this new cost information.        Former Conrail Railroad Property (Main Street and Page Avenue), Kingston Borough, Luzerne County. Martha Fleming, Technical Manager, Environmental Strategies Corporation, 300 Corporate Center Drive, Suite 200, Moon Township, PA 15108 has submitted a Final Report (on behalf of the property owner, David A. Kovalchik, Schuyler Avenue, Kingston, PA) concerning the remediation of soils found or suspected of being contaminated with chlorinated solvents and other organics, lead and other inorganics (except arsenic), polycyclic aromatic hydrocarbons, PCBs and unleaded gasoline constituents as the result of former railroad line operations. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

ERM, on behalf of Nassau Metals Corporation, 101 Crawfords Corner Road, Room 2J-132B, Holmdel, NJ 07733-3030, has submitted a Remedial Investigation Report, Risk Assessment Report and Cleanup Plan concerning soil contaminated with chlorinated solvents, diesel fuel, lead, other organics, inorganics, PAHs, PCBs and unleaded gasoline; and groundwater contaminated with chlorinated solvents, inorganics, lead, other organics, PAHs and unleaded gasoline. This combined submission is in partial fulfillment of the Site-Specific Standard and all reports were approved by the Department on May 16, 2003.

       The permittee shall routinely maintain all the previously listed hydraulic structures to ensure the maximum, unobstructed flow capacity. Since Crossings 3--8 are in wild trout streams, no maintenance work shall be conducted in or along Crossings 3--8 between October 1 and December 31 without the prior written permission from the Fish and Boat Commission. The railroad right-of-way subject to this permit is along the northern and southern right-of-way of SR 0322 western most beginning point approximately 2,600 feet east of SR 0970 and SR 0332 intersection This permit does not authorize any temporary or permanent impact to wetlands that may be along the railroad right-of-way.

       E30-206. Department of Transportation, Engineering District 12-0, P. O. Box 459, Uniontown, PA 15401. Culvert Crossing for Greene County Maintenance in Franklin Township, Greene County, Pittsburgh ACOE District (Waynesburg, PA Quadrangle N:  4.9 inches; W:  4.6 inches). To construct and maintain a maintenance road along the right bank of South Fork Tenmile Creek, classified as WWF and to construct and maintain a dual elliptical concrete pipe having two waterway openings of 91 inches wide by 58 inches high with 12 inches depressed invert and 70 feet long in Laurel Run (WWF). The culvert is on the proposed maintenance road approximately 400 feet west of SR 188.

       E63-378. Matt Canestrale, P. O. Box 234, Belle Vernon, PA 15012. Canestrale Barge Facility in Carroll Township, Washington County, Pittsburgh ACOE District (Donora, PA Quadrangle N:  12.9 inches; W:  17.3 inches). To remove the existing barge docking facility, to construct and maintain a new barge docking facility in the channel of and along the left bank of the Monongahela River (WWF) and to perform periodic maintenance dredging in the channel of said stream at River Mile 34.6. The new docking facility will be three stacked barges high to elevation 742.6. Each barge will be 26 feet wide and 250 feet long. Fifteen feet of R-7 riprap will be placed along the river bank, at both the upstream and downstream limits of the new docking facility.

       E63-526. Dolores Dosse, P. O. Box 57, Venetia, PA 15367-1333. Great Meadows Residential Development Culvert in Peters Township, Washington County, Pittsburgh ACOE District (Hackett, PA Quadrangle N:  22.2 inches; W:  7.8 inches). To construct and maintain a 48-inch diameter culvert 80-feet in length and a 24-inch diameter culvert 100.0-feet in length in an unnamed tributary to Peters Creek (TSF) and associated wetlands and to place and maintain permanent fill in 0.47 acre of PEM wetlands and temporary fill in 0.006 acre of PEM wetlands for the purpose of providing access to the Great Meadows Residential Development. The project is on Scenic Ridge Drive, approximately 40.0 feet east from the intersection of Scenic Ridge Drive and Great Meadows Drive. The project will impact a total of 330.0 feet of stream channel that includes the following waived activities under Chapter 105; a 100.0-foot long culvert under an access road to provide access to the stormwater detention facility and a 130.0 foot long culvert under Sutherland Drive. The project will also impact 0.47 acre of PEM wetlands (permanent) and 0.0006 acre of PEM wetlands (temporary). The applicant proposes to pay to the Wetland Replacement Fund.

       E65-798. Walnut Capital Partners, Inc., 5500 Walnut Street, Suite 300, Pittsburgh, PA 15232. Walnut Capital Restaurants Wetland Fill in the Municipality of Murrysville, Westmoreland County, Pittsburgh ACOE District (Murrysville, PA Quadrangle N:  8.5 inches; W:  5.0 inches). To place and maintain fill in 0.23 acre of wetland along Turtle Creek (TSF) and an unnamed tributary to Turtle Creek for the purpose of constructing a retail center and two restaurants. Also, to construct and maintain a sewer line crossing of said unnamed tributary and a temporary road crossing and three outfall structures in Turtle Creek. The permittee will construct 0.50 acre of replacement wetlands. The project is on the south side of SR 22 at the intersection of SR 22 and Cline Hollow Road.

       EA06-004:  Pioneer Crossing Landfill, 727 Red Lane Road, Birdsboro, PA 19508 in Exeter Township, Berks County, ACOE Philadelphia District.

       To construct and maintain a stream improvement project consisting of:  (1) trash and debris removal; (2) placement of riprap scour protection; (3) removal of gravel washed from adjacent roadways; (4) removal of an existing 24-inch CMP; (5) replacement of an existing 14-inch steel pipe culvert with a 2-foot by 4-foot concrete box culvert; (6) eradication of invasive plant species; and (7) installation of native riparian plantings in and along 1,250 feet of an unnamed tributary to the Schuylkill River (WWF) near the intersection of Lincoln Road and South Center Road (Birdsboro, PA Quadrangle N:  4.3 inches; W:  8.2 inches) in Exeter Township, Berks County.
