DEPARTMENT OF ENVIRONMENTAL PROTECTION Applications, Actions and Special Notices [26 Pa.B. 2499] APPLICATIONS The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.
Following the 30-day comment period, the Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges
The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (DEP) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.
The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

Acknowledgment of Notices of Intent to Remediate
Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department must provide a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought to responsible persons not participating in the remediation.

Opening of the Administrative Record; Prompt Interim Response Under the Hazardous Sites Cleanup Act

Hellam Township, York CountyThe Department of Environmental Protection (Department or DEP), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) is initiating a prompt interim response at the P & H Automotive site.
The P & H Automotive site is located along Route 463 in Hellam Township, York County, PA. The site is an abandoned auto body shop bordered by commercial property on the south, agricultural land use on the west and north and residential property on the east. There are approximately 25 drums of unknown material and an undetermined quantity of contaminated soil.
DEP considered several alternative interim responses including: 1) no action, under which all hazardous wastes and substances would remain in place; 2) limited action which would prevent access to the drums and contaminated soils; and 3) waste removal which involves taking action to remove drums and contaminated soils, as well as arranging for the treatment and/or disposal and cleaning of the concrete floor in the drum storage area.
The Department determined that the no action alternative (1) and limited action alternative (2) would not be protective of human health and the environment.
Therefore, DEP proposes to characterize and remove the hazardous wastes and substances from the site. This action (3) would remove the direct contact threat of exposure. This would also prevent the spread of contamination.
The Administrative Record which contains information about the site and which supports DEP's decision to perform a prompt interim response action at the site is available for public review and comment. The Administrative Record is located at Kreutz Creek Library, located at 66 Walnut Springs Road, York, PA and is available for review during normal hours of operation. Extended Submission Date for County Recycling Coordinator Grant Applications under the Municipal Waste Planning, Recycling and Waste Reduction Act
The Department of Environmental Protection announces an extension of the deadline date for 1995 County Recycling Coordinator Grant applications under section 903 of the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 4009.903). The deadline date has been extended to 3 p.m., June 30, 1996. Applications received after that date will not be considered. Applications must be on forms provided by the Department. All grant awards will be predicated on the receipt of recycling fees required by section 701 of Act 101 and the availability of monies in the Recycling Fund.
Grant funds may not exceed 50% of the approved cost of the county recycling coordinator's salary and expenses incurred on or after January 1, 1995, to December 31, 1995. The following duties of county recycling coordinators will be considered approvable for reimbursement:
1. Proving technical assistance to municipalities on developing and implementing waste reduction and recycling programs.
2. Developing recycling and waste reduction public education programs.
3. Assisting municipalities in identifying recyclable materials to be marketed and locating markets.
4. Assisting municipalities in preparing recycling grant applications.
5. Assisting municipalities with developing and coordinating leaf collection and composting programs and identifying markets for compost.
6. Serving as contact for recycling questions within the county.
7. Identifying and encouraging opportunities for inter-municipal cooperation and cooperative efforts with other organizations to further waste reduction and recycling.

Plan Approval Application No. 09-328-009 Under 25 Pa. Code § 127.44, the Department of Environmental Protection intends to issue a plan approval to Blue Mountain Power, LP, 2500 City West Boulevard, Suite 150, Houston, Texas 77042, to construct an electrical generation plant and associated air pollution control devices as described in the Applicant's application of March 27, 1995, at their Blue Mountain Power Plant located at East Pumping Station Road, Richland Township, Bucks County.
Based on the information provided by the applicant and DEP's own analysis, this plant will not emit in excess of:
Nitrogen Oxides (NOx): 94.8 tons per year; Volatile Organic Compounds (VOCs): 31.5 tons per year; Carbon Monoxide (CO): 97.3 tons per year; Sulfur Oxides (SOx expressed
as SO2):64.2 tons per year; Particulate Matters (PM): 72.9 tons per year; Ammonia emissions (NH3). 71.3 tons per year. The plant is regulated under the Department's New Source Review Rules and Regulations, 25 Pa. Code Chapter 127, Subchapter E. It requires that the plant employ the current lowest achievable emission rate (LAER) for VOC and NOx emission control. If approval to construct the plant is granted, the Department will prohibit its operation until sufficient emission offset credits for VOC and NOx emissions are provided in accordance with the applicable requirements of Subchapter E. Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

The Menallen Township Sewage Authority proposes to construct sanitary sewers, a pump station, and force main to serve the existing Village of Keisterville in Menallen Township, Fayette County. The purpose of the project is to eliminate the discharge of untreated and inadequately treated sewage from direct discharges and malfunctioning on-lot septic systems. Treatment will be provided at the existing Upper Middletown STP in accordance with NPDES Permit PA0205931.
Application for funding of this project is to be submitted to the Pennsylvania Infrastructure Investment Authority (PENNVEST) which administers Pennsylvania's State Revolving Fund. The Department's review of the Sewage Facilities Plan has not identified any significant environmental impact resulting from this proposal.

Project Description: Approval of a revision to the Official Sewage Plan of Centre Township, Berks County. Project involves a 57 lot residential subdivision on 58.76 acres to generate 57 EDUs or 22,800 gallons per day in sewage flows to be treated by a package sewage treatment plant with a discharge to an intermittent stream tributary to Irish Creek. The point of discharge is located 85 feet east of the Ohlinger Spring. The project name is Jordan Crossing and the DEP Code Number is C3-06926-069-3.

Branch Township, Schylkill County.
The Department of Environmental Protection (Department) has completed its review of the April 1996 Version of the Act 537 Official Sewage Facilities Plan (Plan) for Branch Township, Schuylkill County. The Plan was prepared by Alfred Benesch and Company and adopted by Township Resolution No. 6, dated October 26, 1995, and 6A dated December 11, 1995, as amended. The Department's review of the Plan has not identified any significant environmental impacts resulting from the proposal and planning approval is hereby granted for the project.
The Plan was undertaken to address the environmental problems related to raw sewage discharges from the nonpermitted sewage collection system (wildcat) and malfunctioning onlot sewage disposal systems in study areas such as Lewellyn, West West Terrace, Dodentown, Phoenix Park, New Minersville and Stein's Mill.
The chosen alternative (Alternative IV) consists of the following work:
1. Construction of a sanitary sewage collection system and a 200,000 gallons per day (gpd) extended aeration treatment plant in Lewellyn to serve 599 Equivalent Dwelling Units (EDUs) in Lewellyn, West West Terrace, Dodentown and Phoenix Park. The treated effluent will be discharged into the west branch of Schuylkill River.
2. Construction of a sanitary sewage collection system and a 5,000 gpd package treatment plant to serve 19 EDUs in the Stein's Mill study area. The treated effluent will be discharged into Muddy Branch Creek.
3. Construction of a sewage collection and conveyance system to serve 54 EDUs in the New Minersville study area. This new sewer will be tied into the Minersville Sewer Authority's existing collection system. The sewage from this area will be treated at the Authority's existing 1 million gallons per day (1 mgd) capacity treatment plant.
In accordance with the provisions of the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20) (Act 537), and Chapter 71 of the Department's Rules and Regulations, 25 Pa. Code Chapter 71, the Department will hold Branch Township responsible for complete and timely implementation of the chosen alternative.

Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

Request for Variance
The Bureau of Deep Mine Safety has approved a request for variance from the Tanoma Mining Company. The following notification contains a summmary of both this request and the Department's decision regarding approval. Complete copies of both the variance request and the Department's decision may be obtained from Glen Ziegler by calling (717) 787-1376.
Summary of the request: Tanoma Mining Company's plan calls for 105` distances between track shelter holes in the Main E and all future mains development at the Tanoma Mine. Studies have shown that the main entries in the Tanoma Mine should be developed in 120` centers in order to enhance roof control. This 120` center will result in shelter holes being approximately 105` apart since the crosscuts are driven a maximum of 20` wide.
Summary of the decision: The Bureau has determined that Tanoma Mining Company's approved plan will provide protection to personnel and property substantially equal to or in excess of the requirements set forth in the Bituminous Coal Mine Act. The basis for the Bureau's determination for approval can be summarized in the following conclusions:
1. Development of pillars on maximum of 120 foot centers will enhance roof control in the Main E area and all future main areas where adverse and subnormal roof conditions are encountered.
2. The use of a continuous conveyor belt system eliminates high speed coal transportation equipment. This eliminates the many negative aspects of coal haulage equipment. These are increased traffic, equipment moving at higher speeds, and exposing employes to greater hazards when required to travel along track haulage travelways.
3. The additional time required to reach shelter in areas with extended shelter hole distances is minimal (an average of 1.56 seconds according to walking time tests).
This approval is limited to a variance from the distance requirements for shelter holes contained in section 268(b) of the Bituminous Coal Mine Act. All other terms, and requirements of section 268 shall remain in effect. Continued authorization for operation under the approval is contingent upon compliance with the measures described in the approved plan.
The Department of Environmental Protection has taken the following actions on previously received Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).
Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street Floor 2, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, 1-800-654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. To place and maintain fill in the floodway for the purpose of constructing an elevated ''tee-off'' for a proposed golf course driving range located along the right side of Chartiers Creek at a point approximately 3 miles downstream of the Allegheny/Washington County Line (Bridgeville, PA Quadrangle N: 16.1 inches; W: 15.5 inches) in Upper St. Clair and South Fayette Townships, Allegheny County. To operate and maintain the existing retaining wall constructed under EP0296203 to protect an exposed existing gas pipeline. The wall is located on the left bank of Pucketa Creek, just west of the intersection of S. R. 366 and Albee Road (New Kensington, PA Quadrangle N: 8.3 inches; W: 15.0 inches) in Plum Borough, Allegheny County. This permit was issued under section 105.13(e) ''Small Projects''. E26-214. Encroachment. David and Jill S. Dongilli, P. O. Box 616, Smithton, PA 15479. To remove the downstream 13.0-foot portion of an existing 60-inch RCP culvert for the purpose of cleaning and debris removal and to reinstall and maintain said 13.0-foot portion of culvert in a tributary to the Youghiogheny River. The project is located along TR 495, approximately 0.75 mile east of S.TR. 51 (Fayette City Quadrangle N: 20.6 inches; W: 1.6 inches) in Perry Township, Fayette County.
E26-217. Encroachment. Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17107-7676. To construct and maintain 9.3 acres of replacement wetlands and to perform grading and to construct and maintain outfall protection in an unnamed tributary to Rubles Run as part of wetlands replacement impacted by the Mon/Fayette Expressway, S. R. 0043. This project is known as construction section 50W and is located along the intersection of S. R. 3002 (Gans Road) and S. R. 857 (Lake Lynn, PA-WV Quadrangle N: 19.8 inches; W: 7.6 inches) in Springhill Township, Fayette County.
E32-373. Encroachment. Joseph Kuzneski, 115 North Sixth Street, Indiana, PA 15701. To place and maintain fill in three separate wetlands totaling 0.29 acre and along an unnamed tributary to McCarthy Run for the purpose of developing a parking area and proposed expansion of the existing Shelly Plaza located east of the intersection of Route 422 and Shelly Drive (Indiana, PA Quadrangle N: 22.0 inches; W: 9.0 inches) in White Township, Indiana County. The permit applicant has met the wetland replacement requirement by participating in the Pennsylvania Wetland Replacement Project.
E56-256. Encroachment. John and Donna Gennett, R. R. 1 Box 403, Friedens, PA 15542. To place and maintain fill in 0.25 acre of wetlands for construction of a commercial building. This site is located approximately 3,000 feet west of Ferrellton along the south side of Route 30 (Boswell, PA Quadrangle N: 3.25 inches; W: 4.25 inches) in Jenner Township, Somerset County. The permit applicant has met the wetland replacement requirement by participating in the Pennsylvania Wetland Replacement Project.

To construct and maintain 1) a timber beam bridge, having a 30-foot span with an average underclearance of 3 feet; 2) a 5-foot diameter culvert with a drop inlet structure for diverting flood flows at said bridge; and 3) two stormwater outfall structures consisting of endwalls and rock energy dissipating pads; across and along a tributary to Birch Run,located at the Birch Run Subdivision, approximately 550 feet upstream of T-434 on the western side of SR 1030 (Pottstown, PA Quadrangle N: 1.7 inches; W: 4.75 inches) in West Vincent Township, Chester County. Permit No. E15-390 is hereby reissued and extended to December 31, 1988.
E23-143. Encroachment. Claude deBotton, c/o Springfield Square, 1001 Baltimore Pike, Springfield, PA 19042. To amend permit no. E23-143 as follows: 1) to revise the location of a proposed access roadway just south of the previously permitted location. This roadway, North Crum Creek Road, crosses the northern tributary to Crum Creek and adjacent wetlands at a point approximately 1,450 feet northwest from the PA Route 3 crossing of Crum Creek, 2) to delete an 8 foot x 4 foot 2-inch culvert which was previously permitted, and to install and maintain 825 linear feet of an 8-foot x 4-foot box culvert stream enclosure and place 0.29 acre of fill in wetland near the westerly tributary to Crum Creek for the establishment of a parking area. This facility is located approximately 2,000 feet northwest from the PA Route 3 crossing of Crum Creek. These activities occur at the proposed Edgmont Country Fair Project (Media Quadrangle N: 19 inches; W: 17.5 inches) situated in Edgmont Township, Delaware County. The permittee shall provide 0.29 acre of replacement wetlands.
E15-501. Encroachment. Nantmeal Woods, Inc., 2 Scholl Drive, Oley, PA 19547. To place fill in 0.12 acre of wetlands (PEM) associated with construction of a storm water detention basin and dam in the proposed Daisy Meadows subdivision. The site is situated along a tributary to Bickels Run (HQ) at a point along the eastern side of Hanover Street (S. R. 1037), approximately 1/4 mile north of the intersection with S. R. 100, (Pottstown, PA Quadrangle N: 16.3 inches; W: 4.4 inches) in North Coventry Township, Chester County. The permittee shall provide 0.12 acre of wetland replacement. Approval is also granted for an Environmental Assessment for the aforementioned nonjurisdictional dam.
E51-134. Encroachment. PECO Energy Company, 955 Chesterbrook Boulevard 53A-1, Wayne, PA 19087-5691. To restore and maintain water depth to pre-existing levels by dredging at the following locations: 1) Along the east bank of the Schuylkill River at a point 1,700 feet downstream from the South Street bridge at the Schuylkill Generating Station (Philadelphia-PA Quadrangle; N: 12.4 inches; W: 9.3 inches); 2) In the Delaware River at a point approximately 1.1 miles north of the Benjamin Franklin Bridge at the Delaware Generating Station (Philadelphia-PA Quadrangle N: 16.5 inches; W: 0.1 inch); 3) In the Delaware River at a point approximately 1,500 feet south of the Betsy Ross Bridge at the Richmond Generating Station. (Camden-NJ Quadrangle N: 19.75 inches; W: 10.5 inches). All three of the above sites are located in the City of Philadelphia, Philadelphia County.
E23-335. Encroachment. Delaware County Commissioners, Government Center Building, Media, PA 19063. To remove an existing two lane 80-foot single span concrete encased steel truss bridge over Chester Creek on West Fifth Street and to construct and maintain an 82.5-foot single span composite prestressed concrete spread box beam bridge at the same location with an average underclearance of 5.9-feet (Bridgeport, PA-NJ Quadrangle N: 17.5 inches; W: 15.8 inches) in the City of Chester, Delaware County. The submerged Land License Agreement has been approved for the project.
Actions on applications filed under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and sections 5 and 402 of the act of June 22, 1937 (P. L. 1987, No. 394) (35 P. Request for Proposals The DEP, BLWC, NPS Program is accepting project proposals for the next two (FY 97 and FY 98) Section 319 NPS Implementation Grant cycles. There will not be another request for proposals before January 1998. Projects selected for funding will begin in March '97 or October '97 depending upon which grant the project is funded under. The Project start date along with the project time constraints must be indicated in the implementation plan.
The following information presents a brief overview of project selection criteria:
A. Three project categories are eligible for funding:
1) Watershed Assessments
2) Watershed Projects
3) Projects of Statewide Importance
Projects must have local support and commitment, clear goals and objectives, and be able to produce measurable environmental results. For Watershed Projects, points are awarded if the project is located in a high priority watershed.
B. EPA Grant Guidance has identified Nine Key Elements which are components of a good state NPS Program. You will have to identify how the project applies to one or more of these key elements.
C. The Scoresheets have been significantly revised. The DEP/DCNR NPS Task Force will use these scoresheets to select projects.
D. The Project Solicitation schedule will be followed closely. Project proposals are due in the BLWC office by 4 p.m. on July 29, 1996. Project proposals submitted after this date will not be considered.
E. The State Priority Watershed list has been significantly revised. The list is an EPA requirement.
To be considered, the proposal packet must include the following items:
1. One copy of the project proposal and budget. Your project budget must follow specific categories.
2. A Point of Contact with phone and fax numbers, and address, must be clearly identified on the proposal's cover page.
The NPS Program looks forward to working with you in the future to address NPS pollution issues in PA.
