    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

    DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

    (Part I Permits)

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the Field Office indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Field Office the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Managers will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the Field Office indicated above the application.

       This proposed action is for issuance of an NPDES permit for the existing STP. The discharge of treated sewage is to Shamokin Creek and the combined sewer overflows to Shamokin Creek and Butternut Creek in Mount Carmel Borough and Mount Carmel Township, Northumberland County. The receiving stream is classified for the following uses: warm water fishery and aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply (PWS) considered during the evaluation is at Dauphin, PA on the Susquehanna River 70 miles downstream.

       This application is for renewal of an NPDES permit to discharge treated process water and stormwater from the Phillips Power Station in Crescent Township, Allegheny County.

       The following effluent limitations are proposed for discharge to the receiving waters, Ohio River, classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. This is an existing discharge.

       The receiving water is classified for cold water and migratory fishery, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, there is no public water supply to consider, as the stream discharges into Lake Erie.

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements. The updates may include but will not be limited to, applicable permit conditions and/or requirements. The updates will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department at the address indicated above each permit application or plan.     Stormwater Individual

       The following parties have applied for an NPDES permit to discharge stormwater from a proposed construction activity into the surface waters of the Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit and special conditions. The proposed determinations are tentative. Limitations are provided in the permit as erosion and sedimentation control measures and facilities which restrict the rate and quantity of sediment discharge.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision of 40 CFR 123.24(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement to the Regional Office or County Conservation District Office indicated as the responsible office, within 30 days from the date of this public notice. A copy of the written comments should be sent to the County Conservation District Office. Comments reviewed within this 30-day permit will be considered in the formulation of the final determinations regarding this application.     LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302--304 and 305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(l)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

       For further information concerning the content of a Notice of Intent to Remediate, contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice appears.        PPL Carlisle Manufactured Gas Plant formerly, Borough of Carlisle, Cumberland County. PPL Corporation, Two North Ninth Street, Allentown, PA 18101, and UGI Utilities, 100 Kachel Boulevard, Reading, PA 19612 have submitted a Notice of Intent to Remediate site soils and groundwater contaminated with lead, heavy metals, solvents, BTEX and PAHs. The applicants propose to remediate the site to meet the requirements for a combination of the Statewide health and site-specific standards. A summary of the Notice of Intent to Remediate was reported to have been published in the Carlisle Sentinel on April 20, 2000.

       Former Poloron Homes, Middleburg Borough, Snyder County. HydroScience, Inc. on behalf of their client, Middlecreek Industrial Development Corporation, LLC, P. O. Box G, Hummels Wharf, PA 17831, has submitted a Notice of Intent to Remediate soil and groundwater contaminated with lead, heavy metals, BTEX and PAHs. The applicant proposes to meet the requirements of the Special Industrial Area designation. A summary of the Notice of Intent to Remediate was reported to have been published in the Sunbury Daily Item on April 12, 2000.

       Permit I. D. No. 300913. Westwood Generating Station, CinCap VI, LLC, 139 E. 4th Street, Cincinnati, OH 45202. A permit renewal/reissuance for this captive residual waste landfill, located in Frailey Township, Schuylkill County. This permit application is directed at the transfer of the ownership of a closed ash disposal area located on Westwood property. Specifically, this application is for a permit reissuance to transfer the current residual waste disposal facility permit no. 300913, which was issued to Westwood Energy Properties, LLP on December 31, 1985.

       In January 1999, Westwood was sold to Cinergy Capital & Trading, Inc. by the CinCap VI, LLC subsidiary. Westwood is hereby seeking the permit reissuance of facility no. 300913 to the new owner, CinCap IV, LLC.

The Sterimed system is an onsite, alternative method for the processing infectious waste by shredding and chemical disinfection. No chemotherapeutic waste is allowed to be processed using this technology. The Department determined the application to be administratively complete on May 1, 2000.

The Isolyser LTS-Plus is an alternative method and closed system for the encapsulation, solidification and processing of infectious liquid waste contained in suction canisters.     Notice of Plan Approval and Operating Permit Applications

    Nonmajor Sources and Modifications

       The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       Notice is hereby given that the Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice.        N96-016:  Stokes Vacuum (5500 Tabor Road, Philadelphia, PA 19120) for operation of designing, manufacturing, and selling of vacuum pumps, blowers and related vacuum dryers. The facility's air emission sources include three boilers rated at 3.5 MMBTU/hr or less, a pump test line and a paint booth in the City of Philadelphia, Philadelphia County. The facility's air emission control device is a grit blast room baghouse.

       V95-029:  The Budd Co. (2450 Hunting Park Ave., Philadelphia, PA 19129) for a Title V Operating Permit for operation of two < 100 MMBTU/hr boilers, an emergency generator and 37 <= 2.1 MMBTU/hr space heaters in the City of Philadelphia, Philadelphia County. The operating permit, issued on April 16, 1999, is being modified to allow emergency testing for each generator to be limited to 20 minutes per week.

       V95-078:  Nabisco Biscuit Co. (12000 East Roosevelt Blvd., Philadelphia, PA 19116) for a Title V Operating Permit for operation of two 38 MMBTU/hr boilers, six non-yeast baking ovens and two yeast baking ovens which are controlled by a catalytic oxidizer in the City of Philadelphia, Philadelphia County. The operating permit, issued on March 2, 2000, is being modified to change the requirement for the performance test of the catalytic oxidizer from within 90 days of permit issuance to December 1, 2000.


    Notice of Intent to Issue Title V Operating Permits

       Under 25 Pa. Code § 127.521, notice is given that the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F and G (relating to operating permit requirements; and Title V operating permits).

       Appointments to review copies of the Title V application, proposed permit and other relevant information must be made by contacting Records Management at the regional office telephone number noted. For additional information, contact the regional office noted.

       Interested persons may submit written comments, suggestions or objections concerning the proposed Title V permit to the regional office within 30 days of publication of this notice. Written comments submitted to the Department during the 30-day public comment period shall include the name, address and telephone number of the persons submitting the comments, along with the reference number of the proposed permit. The commentator should also include a concise statement of any objections to the permit issuance and the relevant facts upon which the objections are based.

    Notice of Intent to Issue

       In accordance with 25 Pa. Code §§ 127.44(b) and 127.45 the Department of Environmental Protection (Department) intends to issue an Air Quality Plan Approval PA-26-495A to Allegheny Energy Supply Co., LLC (800 Cabin Hill Drive, Greensburg, PA 15601) to allow the construction of the Gans Turbine Station located 0.6 mile west of Gans, on the north side of Lake Lynn Road at the intersection of Township Road 468, in Springhill Township, Fayette County.

       Facility is subject to the applicable requirements of 25 Pa. Code, Chapter 127 (related to construction, modification, reactivation, and operation of sources), 40 CFR Part 60, Subparts GG and Kb (related to standards of performance for turbines and storage tanks), 40 CFR Parts 72, 73, 75 and 77 (related to acid rain), and 25 Pa. Code §§ 123.102--123.120 (related to the NOx budget program). The Department believes that the facility will meet these requirements subject to the following Plan Approval conditions related to allowable emission limitations, testing, monitoring, recordkeeping, and reporting requirements.

       It is proposed that the following conditions be placed in the Plan Approval:

       1.  The facility is to be constructed in accordance with the plans submitted with the application (as approved herein).

       2.  Upon completion of the construction of the facility, an operating permit must be obtained. Notify the Department when the installation is completed so that the facility can be inspected for issuance of an operating permit.

       3.  This Plan Approval authorizes Allegheny Energy Supply Co. LLC to construct the Gans Station Combustion Turbine Project, located in Springhill Township, Fayette County.

       4.  Sources at this facility will include two simple cycle combustion turbines, General Electric Model LM 6000 PC, rated at 424.6 mmbtu/hr max and 44 MW each. Each is to be equipped with a mechanical draft cooling tower, a water injection system for the control of NOx emissions, and a 60-foot exhaust stack.

       5.  Supporting equipment at this site will include electric gas compressors, a 500,000 gallon low-sulfur diesel fuel storage tank, and approximately 23 small (less than 10,000 gallon) storage tanks for various low-vapor pressure liquids such as turbine oils, insulating oils, refrigerants, used oil and demineralized water.

       6.  All equipment at this facility shall be equipped with manufacturer-designed silencers and/or mufflers. The turbines, generators and gas compressors shall be enclosed in structures designed by the manufacturer to minimize sound levels.

       7.  Total consumption of natural gas by the turbines per 12 consecutive month period shall not exceed 1,795,000,000 cubic feet when fired in conjunction with diesel fuel, and shall not exceed 1,820,000,000 cubic feet when fired solely on natural gas. Total unit-operating hours per 12 consecutive month period shall not exceed 4,000 hours of natural gas combustion when fired in conjunction with diesel fuel, and shall not exceed 4,050 hours of natural gas combustion when fired solely on natural gas.

       8.  Total consumption of low-sulfur diesel fuel by the turbines together shall not exceed 1,470,000 gallons per 12 consecutive month period. Total unit-operating hours shall not exceed 450 hours of diesel fuel combustion per 12 consecutive month period.

       9.  The sulfur content of the low-sulfur diesel fuel shall not exceed 0.05 weight percent.

       10.  NOx emissions from the turbines shall be limited to 25 ppm while firing natural gas and 42 ppm while firing low-sulfur diesel fuel.

       11.  Pollutant emissions from the turbines shall not exceed the following while combusting natural gas for 4,000 hours per consecutive 12 month period:

       16.  The 500,000-gallon low-sulfur diesel fuel storage tank is subject to the applicable requirements of 40 CFR Part 60, Subpart Kb, Standards of Performance for Volatile Organic Liquid Storage Vessels.

       17.  In accordance with 40 CFR 60.334(a), permittee shall install and operate a continuous monitoring system to monitor and record the fuel consumption and the ratio of water to fuel being fired in the turbine. This system shall be accurate to within ±5% and must be approved by the Department.

       18.  In accordance with 40 CFR 60.344(a), permittee shall monitor the sulfur content and nitrogen content of the fuel being fired in each turbine. Certification by the fuel supplier shall be used for this condition.

       19.  Permittee shall install, certify, maintain and operate a Department-approved continuous emission monitoring system (CEMS) in accordance with 25 Pa. Code Chapter 139, the Department's Continuous Source Monitoring Manual, 40 CFR Part 60, and 40 CFR Part 75. At a minimum the system shall measure and record the following for each turbine:

          Nitrogen Oxide emissions (as NO2)

          % Oxygen (or CO2)

          Exhaust gas flow

    20.  Permittee shall record hours of operation of each of the turbines, and the amount and type of fuel consumed, on a daily basis.

    21.  Permittee shall comply with the applicable reporting requirements of 40 CFR 60.7, 60.116b(d) and 60.334(c).

    22.  In accordance with 40 CFR 60.4, copies of all requests, reports, applications, submittals and other communications shall be forwarded to both the Environmental Protection Agency and the Department of Environmental Protection at the addresses shown below, unless otherwise noted:

       23.  In accordance with 40 CFR 60.334(c), permittee shall record daily, and shall report quarterly, in accordance with 40 CFR 60.7(c), any 1-hour period during which the average water-to-fuel ratio, as measured by the continuous water and fuel measuring system, falls below the ratio that was determined during the stack test to demonstrate compliance with NOx emission limitations. Permittee shall also report any period during which the actual fuel-bound nitrogen content exceeds the fuel-bound nitrogen content determined during the stack test to demonstrate compliance with the NOx emission limitations. Permittee shall also report any period during which the actual fuel-bound sulfur content exceeds 0.05%.

       24.  Compliance with the turbine emission limitations for NOx and CO while using both low-sulfur diesel fuel and natural gas shall be demonstrated through performance stack testing on each turbine.

       A.  In accordance with 40 CFR 60.335(c)(2), the monitoring device required by 40 CFR 60.334 shall be used to determine the fuel consumption and to establish the water-to-fuel ratio necessary to comply with turbine NOx emission limitations at 30, 50, 75 and 100% of peak load, or at four points in the normal operating range of the gas turbine, including the minimum point in the range and peak load. All loads shall be corrected to ISO conditions using the appropriate equations as supplied by the turbine manufacturer.

       B.  All stack testing shall be performed in accordance with 40 CFR 60.8 and 60.335, 25 Pa. Code Chapter 139 regulations and the most recent version of the Department's Source Testing Manual.

       C.  Two copies of the stack test protocol shall be submitted to the Department at least 60 days in advance of the stack test date. Stack testing shall not take place until permittee has received written approval of the stack test protocol.

       D.  Company shall notify the Department of the date and the time of the stack test at least 2 weeks prior to the tests so that an observer may be present.

       E.  Two copies of the stack test results shall be submitted to the Department within 60 days of completion of the test.

       F.  Stack testing shall be performed within 60 days of achieving maximum firing rate but no later than 180 days after the initial startup.

       G.  Permittee shall record all pertinent operating data during the stack test and include this data with the stack test results.

       25.  The combustion turbines are subject to the Title IV Acid Rain Program of the 1990 Clean Air Act Amendments, and shall comply with all applicable provisions of that Title, including the following:

       26.  The combustion turbines are subject to the applicable requirements of the NOx Budget Program established at 25 Pa. Code §§ 123.102--123.120.

       27.  Per 25 Pa. Code § 127.13, if construction is not commenced within 18 months of issuance of this Plan Approval, or if there is more than an 18-month lapse in construction, a new Plan Approval application shall be submitted.

       28.  This Plan Approval authorizes the temporary operation of the sources covered by this Plan Approval provided that the following conditions are met.

       A.  The Department must receive written notice from the permittee of the anticipated date that sources will commence operation.

       B.  Operation is authorized only to facilitate the startup and shakedown of the sources, to permit operation of the sources pending the issuance of an Operating Permit, or to permit the evaluation of the sources for compliance with all applicable regulations and requirements.

       C.  This condition authorizes temporary operation of the sources for a period of 180 days from the commencement of operation, provided that the Department receives notice from the permittee under Subpart (A), above.

       D.  Permittee may request an extension of this Plan Approval if compliance with all applicable regulations and Plan Approval requirements has not been established. The extension request shall be submitted in writing at least 15 days prior to the end of this period of temporary operation and shall provide a description of the compliance status of the source, a detailed schedule for establishing compliance, and the reasons that compliance has not been established.

       E.  The notice submitted by the permittee under Subpart (A), above, prior to the expiration date of this Plan Approval, shall modify the Plan Approval expiration date. The new Plan Approval expiration date shall be 180 days from the date of the start-up.

       F.  Permittee shall submit a Title V Operating Permit Application within 120 days of startup.

       Any person wishing to either object to issuance of plan approval or a proposed condition thereof or to provide the Department with additional information which they believe should be considered prior to the issuance of a plan approval, may submit the information to the Department. Comments may be mailed to the Department at the address shown. All comments must be received within 30 days of the appearance of this public notice. Comments shall include the following:

    Proposed Revision to the State Implementation Plan for Volatile Organic Compounds Approval of a Reasonably Available Control Technology Plan and Operating Permit

       The Department of Environmental Protection (Department) has made a preliminary determination to approve a Reasonably Available Control Technology (RACT) Plan and an amendment to the State Implementation Plan (SIP) for the Spherical Roller Bearing Production Plant owned and operated by SKF USA, Inc. at 525 Fame Avenue in Penn Township, York County.

       The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in (RACT) Operating Permit No. 67-02010A for the existing facility to comply with current regulations. Upon final approval, the operating permit will include material substitution, recordkeeping and reporting requirements.

       A public hearing will be held for the purpose of receiving comments on the proposed operating permit and SIP revisions.        The Department of Environmental Protection (Department) will conduct a public hearing on July 7, 2000, beginning at 1 p.m. in the Air Quality conference room at the Meadville Regional Office located at 230 Chestnut Street.

       The hearing is for the Department to accept testimony concerning the Department's decision to approve, with conditions, the revised Reasonably Available Control Technology (RACT) plans by The International Metals Reclamation Co. (245 Portersville Road, P. O. Box 720, Ellwood City, PA 16117) in Ellwood City, Lawrence County. The revised RACT has been filed to meet the requirements under 25 Pa. Code §§ 129.91--129.95 (RACT), concerning the volatile organic compounds (VOCs) from various air contamination sources. The final RACT proposal will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan (SIP).

       The revision will be to the facility RACT VOC emission limit. VOC emissions from the facility shall be revised to a limit not to exceed 178.1 tons per year, to be defined as any 12-month rolling total. The VOC limit is revised from 13.14 tons/year, as defined in RACT Operating Permit No. OP 37-243.

       The proposed SIP revision does not adopt any new regulations. The SIP revision incorporates the provisions and requirements contained in RACT approvals for these facilities to comply with current regulations.

       The preliminary revised RACT determination, if finally approved, will be incorporated into Plan Approvals and/or Operating Permits for the facilities and will be submitted to the EPA as a revision to the SIP.

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).        The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity, and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

       Section 702 of The Bituminous Coal Mine Act (act) (52 P. S. §§ 701 and 702), provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

       Section 224 states that whenever any working place approaches within 200 feet of any workings of an adjacent mine, boreholes shall be drilled at least 20 feet in advance of the face of the working place and sufficiently close to each other to insure that the advancing face will not accidentally hole through into the workings. Boreholes shall also be drilled not more than 8 feet apart in the rib of the working place to a distance of at least 20 feet and at an angle of 45°. The rib holes shall be drilled in one or both ribs of such working place as may be necessary for adequate protection of persons working in the place.

       Summary of the request:  Mon View Mining Company requests a variance to drill a 3.5 inch diameter exploratory borehole 20 feet inby the planned ribline for the No. 9 entry of the 1 North submains. This borehole will be drilled 200 feet inby the extent of the projected mining. The exploratory borehole will be drilled to ensure that the projected mining will not encounter uncharted workings of the Buffalo Mine.

       2.  To modify an existing non-jurisdictional dam, Detention Basin No. 1, by reconstructing the embankment across 60 linear feet of unnamed intermittent tributary to Matsunk Creek and 0.05 acre of wetland (PEM). The applicant seeks an Environmental Assessment approval for construction of this facility.

       3.  To excavate 190 linear feet of unnamed intermittent tributary to Matsunk Creek and portions of the assumed 100-year floodway to facilitate the construction of stormwater Detention Basin No. 2.

       4.  To construct a non-jurisdictional dam, Detention Basin No. 2, by constructing the embankment across 100 linear feet of unnamed intermittent tributary to Matsunk Creek and 0.09 acre of body of water (POW). The applicant seeks an Environmental Assessment approval for construction of this facility.

       5.  To place fill in 0.12 acre of body of water (POW) to facilitate the construction of Drive C.

       This project proposes impact to a total of 0.05 acre of wetland, 0.21 acre of two bodies of water and approximately 1,060 feet of watercourse. The project is located immediately south of the intersection of Horizon Drive and Renaissance Boulevard (Norristown, PA Quadrangle N:  1.70 inches; W:  1.75 inches) in Upper Merion Township, Montgomery County.

       E15-622. Encroachment. West Whiteland Township, 222 North Pottstown Pike, Exton, PA 19341. To remove a single span 6.5 foot by 3.0 foot reinforced concrete box culvert along an unnamed tributary to Valley Creek (CWF-MF) and to install and maintain, in its place, a 205-foot long stream enclosure consisting of twin 68-inch by 43-inch reinforced concrete elliptical pipes. This work will also impact 0.04 acre of wetland (PFO). The site is located at the intersection of Swedesford Road (T-413) and Ship Road (S. R. 1001) (Malvern USGS Quadrangle N:  6.8 inches; W:  16.3 inches) in West Whiteland Township, Chester County.

To construct and maintain segment 1 of the Eastern Shore Natural Gas 2000 Expansion Project which consists of 2.1 miles of 16-inch pipeline along the existing pipeline right-of-way. The pipeline will consist of seven stream crossings and adjacent wetlands:

       Four utility line crossings of the West Branch of the White Clay Creek (TSF) (Stream Crossing ID Nos. 9922-1, 9925-1, 9925-2, and 9927-1) and adjacent wetlands (Wetland Crossing ID Nos. 9922, 9925, and 9927).

       Three utility line crossings of unnamed tributaries to the West Branch of White Clay Creek (TSF) (Stream Channel ID Nos. 9921-1, 9922-1, and 9926-1) and adjacent wetlands (Wetland Crossing ID Nos. 9921 and 9926).

       There will be a total of 0.68 acre of temporary impact to wetlands. This is a linear project which will begin at a point located approximately 200 feet east of the intersection of State Road and School Road in New London Township (West Grove PA-DEL USGS Quadrangle, N:  8.75 inches; W:  15.25 inches) and extend south to a point located approximately 2,000 feet west of the intersection of S. R. 896 and Hess Mill Road in Franklin Township (West Grove PA-DEL USGS Quadrangle N:  3.5 inches; W:  13.25 inches) Chester County.

       4.  To construct and maintain a pedestrian bridge having a total length of approximately 187 feet and a minimum underclearance of 1.5 feet over a total of 0.052 acre of wetland C approximately 1,500 feet east of the intersection of Jordan Road and Knowledge Parkway (Hammett, PA Quadrangle N:  20.65 inches; W:  13.2 inches).

       5.  To fill 0.004 acre of wetland N for construction of North Ridge Road approximately 1,900 feet east of Jordan Road (Hammett, PA Quadrangle N:  21.2 inches; W:  13.3 inches).

       6.  Fill 0.007 acre of wetland N for lot development north of North Ridge Road approximately 2,200 feet east of Jordan Road (Hammett, PA Quadrangle N:  21.25 inches; W:  13.2 inches).

       Construction of two roadway crossings, a sanitary sewer line stream crossing and two non-jurisdictional dams in tributaries of Fourmile Creek (having contributory drainage areas less than 100 acres) associated with Phase 1 has been completed.

       This project includes creation of 0.272 acre of replacement wetland adjacent to Wetland C south of Knowledge Parkway (Hammett, PA Quadrangle N:  20.85 inches; W:  13.25 inches).

       E25-609. Encroachment. Thomas A. Calicchio, 410 Rondeau Drive, Erie, PA 16505. To extend and maintain an existing jetty by placing 2-foot by 2-foot by 6-foot concrete blocks to a maximum distance from shore of approximately 85 feet into Lake Erie (WWF) to provide shoreline protection. This project is located along the shore of Lake Erie approximately 2,400 feet north of the intersection of SR Alternate 5 and Grant Avenue (Swanville, PA Quadrangle N:  18.0 inches; W:  7.2 inches) located in Millcreek Township, Erie County.

       E25-611. Encroachment. Pennsylvania Department of Transportation, Engineering District 1-0, 225 Elm Street, Oil City, PA 16301. To relocate and maintain approximately 805 linear feet of 96-inch-diameter reinforced concrete culvert stream enclosure, to re-line and maintain an additional 90 linear feet of the existing Garrison Run stream enclosure by slip-lining with PVC liner, fiberglass liner, or an ''in-situ'' resin lining, and replace and maintain an additional 90 linear feet of 96-inch-diameter reinforced concrete culvert stream enclosure of Garrison Run under S. R. 5 (12th Street). All of these activities are associated with the S. R. 4034 Section A51 (East side access highway) located approximately 700 feet west of the intersection of S. R. 5 (12th Street) and Wayne Street adjacent to Kosciuszka Park (Erie North, PA Quadrangle N:  1.2 inches; W:  8.4 inches) located in the City of Erie, Erie County.

       E42-268. Encroachment. Pennsylvania Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110-9797. To remove the existing structures and to construct and maintain the following structures in Skinnner Creek (HQ-CWF) to provide timber harvesting and public access within State Game Lanes No. 61 west of Port Allegany in Liberty Township, McKean County:

       1.  A reinforced concrete box culvert having a 14-foot-wide by 4-foot-high waterway opening or two 5.9-foot-wide by 3.9-foot-high corrugated metal pipe arch culverts on Skinner Creek Road approximately 3.8 miles west of T-408 (Port Allegany, PA Quadrangle N:  8.5 inches; W:  12.9 inches).

       E62-365. Encroachment. Eldred Township Supervisors, R. D. 2, Box 123A, Pittsfield, PA 16305.     Approvals to Use NPDES and/or Other General Permits

       The following parties have submitted (1)  Notices of Intent (NOIs) for coverage under General NPDES Permits to discharge wastewater into the surface waters of this Commonwealth; (2)  NOIs for coverage under General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; or (3)  Notifications for First Land Application of Sewage Sludge.

       The approval of coverage under these General Permits may be subject to one or more of the following:  pollutant or effluent discharge limitations, monitoring and reporting, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection (Department) has reviewed the NOIs and determined that they comply with administrative requirements of the respective permit application. Also, the Department has evaluated the First Land Application of Sewage Sludge for the sites applying for coverage under PAG-7, PAG-8 and PAG-9 and determined that the sites are suitable for land application of sewage sludge.

       The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.

       The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.

    HAZARDOUS SITES CLEANUP

    Under the Act of October 18, 1988


    Notice of Settlement under CERCLA and HSCA

       The Department of Environmental Protection (Department) under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675) has entered into a settlement regarding past and future response costs related to the Strasburg Landfill Superfund Site. The settlement is embodied in a Consent Decree between the Department and Somerset Strippers of Virginia, Inc., Buckley & Company, Inc., Robert R. Buckley, Sr. and Joseph M. Martosella, Sr. (collectively Defendants). The Consent Decree has been lodged with the United States District Court for the Eastern District of Pennsylvania.

       The Strasburg Landfill Superfund Site is located in Newlin and West Bradford Townships, Chester County, PA. The Site encompasses approximately 300 acres and includes the groundwater, soil and other media affected by the release of hazardous substances from the Strasburg Landfill. The United States Environmental Protection Agency (EPA) placed the site on the National Priorities List on March 31, 1989. Thereafter, the EPA conducted a Remedial Investigation/Feasibility Study at the site wherein it determined that hazardous substances and contaminants, including but not limited to VOCs, benzene, PCE, TCE, toluene, arsenic and chromium, had been released into the environment at the site. The EPA designated four Operable Units at the site, and has selected remedial responses for three of the four Operable Units. The EPA has implemented remedial actions at the Site relating to leachate collection and treatment (Operable Unit 1), site access control (Operable Unit 2), and subsurface remediation and construction of a landfill cap (Operable Unit 3). The EPA has not yet selected a remedy for groundwater at the site (Operable Unit 4).

       Under the terms of the Consent Decree, the settling parties shall pay to the Department $750,000.00 for costs incurred and to be incurred by the Department at the Strasburg Landfill site. Once payment has been made under the Decree, Somerset Strippers of Virginia, Inc., Buckley & Company, Inc., Robert R. Buckley, Sr. and Joseph M. Martosella, Sr. will have resolved their liability to the Department and will be eligible for contribution protection as provided in section 705(c)(2) of HSCA (35 P. S. § 6020.705(c)(2)) and section 113(f) of CERCLA (42 U.S.C.A. § 9613(f)), regarding matters addressed in the Consent Decree.

       This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113).     Notice of Interim Response

    Upper Salford Township, Montgomery County

    Baghurst Alley Site

       The Department of Environmental Protection (Department) is issuing this notice under section 506(b) of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1304) (HSCA).

       The Department, under the authority of HSCA, began an interim response action on November 23, 1999, at the Baghurst Alley Site (Site), located near Baghurst Alley and Hendricks Road in Upper Salford Township, Montgomery County. The Site has a plume of contaminated groundwater, affecting a number of residential wells. Based on the release and threat of release of hazardous substances at the Site, and corresponding threats to human health and the environment, the Department decided that it was necessary to implement an interim response action at the Site under authority under sections 501(a) and 505(b) of HSCA (35 P. S. §§ 6020.501(a) and 6020.505(b)).

       The contaminants of concern at this site include 1,1-Dichlorothene (1,1-DCE), 1,1-Dichloroethane (1,1-DCA), 1,1,1-Trichloroethane (1,1,1-TCA) and Trichloroethene (TCE). All of these compounds have been reported over MCLs in at least one residential well. Approximately 30 homes are currently known to be affected by the contamination.

       The Department is providing bottled water to affected residents, to minimize the exposure to and threat from the contaminants.

       A separate Response Action is planned to investigate the source and extent of the contamination.

       Alternative 1)  A No Action alternative provides a baseline against which all other alternatives can be compared and/or judged. Had the Department selected the ''No Action'' alternative, any actual or potential health and environmental risk posed by the Site would have remained the same.

       Alternative 2)  Carbon Filtration is not a permanent solution and would require many years of ongoing operations and maintenance costs. In addition, some of the homes could not accommodate the filtration systems. It does not comply with the ARAR preference for a permanent solution.

       Alternative 3)  Connection to a Public Water Supply System is a permanent solution, and complies with ARARs. There are permitting and franchising issues which might significantly delay implementation of this alternative for this community.

       Alternative 4)  Creative of a Community Water System is the preferred alternative. It is a permanent solution, complies with ARARs, and could be implemented quickly, assuming the support and cooperation of the municipality.

       In evaluating these alternatives, the Department considered the criteria of permanence, protection of human health and environment, and the alternatives' ability to meet applicable, relevant and appropriate State and Federal requirements (ARARs). The Department also considered cost-effectiveness in analyzing the interim alternatives. The Department determined that the ''No Action'' alternative would not be protective of the public health. The Department proposes Alternative 4, Creation of a Community Water Supply. This alternative is protective of the public health and environment, compiles with ARARs, and is feasible and effective.

       An Administrative Record which contains more detailed information concerning the interim response action is available for public inspection.        Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The report is intended to document remediation of the site to a combination of the Statewide health and site specific standards.

    The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.

       Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

A Final Report concerning remediation of site soil contaminated with petroleum hydrocarbons and polycyclic aromatic hydrocarbons and groundwater contaminated with solvents was submitted to the Department. The report demonstrated attainment of site specific standards for soil and background standards for groundwater and was approved by the Department on November 12, 1997.

       Bristol Borough Recreation Authority, Bristol Borough, Bucks County. A Final Report concerning remediation of site soil contaminated with pesticides was submitted to the Department. The report demonstrated attainment of the Statewide health standard and was approved by the Department on November 18, 1997.

       Clifford McCoy Residence, New Britain Township, Bucks County. A Final Report concerning remediation of site soil contaminated with petroleum hydrocarbons and polycyclic aromatic hydrocarbons was submitted to the Department. The report demonstrated attainment of the Statewide health standard and was approved by the Department on November 19, 1997.

    Bureau of Deep Mine Safety

       The Bureau of Deep Mine Safety (BDMS) has approved Maple Creek Mining, Inc.'s request for a variance from the requirements of section 224 of the Pennsylvania Bituminous Coal Mine Act at the Maple Creek Mine. This notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

       Summary of the request:  Maple Creek Mining, Inc. requested a variance from section 224(b) of the Pennsylvania Bituminous Coal Mine Act to use an alternate method to drill test holes at the New Eagle Section of the Maple Creek Mine. The purpose of the alternate drilling method is to prevent accidental mining into the abandoned Dunkirk Mine. The proposal accords protections to persons and property substantially equal to or greater than the requirements of section 22(b).

       The basis for the Bureau's approval is summarized in the following statements:

       1.  The long horizontal borehole method proposed in lieu of the requirements set forth in section 224 is a proven technology which has been used successfully at the New Eagle Mine and other underground mines in the Commonwealth.

       2.  The long horizontal borehole method proposed is much less labor intensive and provides much less exposure to lifting and strain type injuries, by not having to handle and use hand-held drills and steels. By mining normal depth cuts, the work force will be subjected to less risk associated with equipment place changes, rather than mining the outside entry 8 feet at a time.

       3.  The long horizontal borehole proposed in lieu of the requirement set forth in section 224(b) will provide a greater coal barrier than required by section 224(b). Maple Creek Mining, Inc.'s proposed long horizontal borehole method provides a 72% larger barrier for the protection of the miners from contacting the abandoned mine over the requirements of section 224(b).

       4.  The long horizontal boreholes will provide a quicker method to close the borehole in the event of contacting the abandoned mine by closing the valve located at the end of the pipe grouted in the rib and will be more suitable for grouting, if needed.

       5.  The long horizontal borehole will provide a much larger area of coverage for protecting the workers against accidentally mining into the abandoned mine.
