    THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

     This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

     For NPDES renewal applications in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements.

     For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.

     Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).

     Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

     The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Detention Basin 4 drains through Outfall 001 to an unnamed intermittent tributary to Wissahickon Creek. Detention Basin 2 drains through Outfall 002 to an unnamed intermittent tributary to Towamencin Creek. Detention Basin 3 drains through Outfall 003 to an unnamed intermittent tributary to Wissahickon Creek. The amendment includes a revised condition for reporting of acrylamide. The reporting limit is changed from 0.1 microgram per liter to 10 micrograms per liter.

     The receiving streams, unnamed tributaries to Wissahickon Creek and unnamed tributary to Towamencin Creek, are located in State Water Plan watersheds 3-F and 3-E, respectively, and are classified for Trout Stocking, Migratory Fishes, aquatic life, water supply and recreation.     STATE CONSERVATION COMMISSION

    PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

     This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

     Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described.     Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)

     Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

     Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

     For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office listed before the notice. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office.     PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

     The Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

     The Department received applications for Plan Approvals or Operating Permits from the following facilities.

     Copies of the application, the Department's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate Department Regional Office. Appointments for scheduling a review must be made by calling the appropriate Department Regional Office. The address and phone number of the Regional Office is listed before the application notices.

     Persons wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the Department's Regional Office.      Notice is hereby given pursuant to 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Pennsylvania Department of Environmental Protection (DEP) intends to issue Plan Approval 62-017X to United Refining Company for the installation of a 182.8 MMBtus/hr capacity natural gas & refinery gas-fired boiler at the company's facility located at 15 Bradley St., City of Warren, Warren County. The facility currently has a Title V Operating Permit No. 62-00017.      Plan Approval No. 62-017X is for the 182.8 MMBtus/hr capacity natural gas & refinery gas-fired boiler (''Boiler #6'', Source ID #037), which will be used to provide additional steam producing capacity to the existing refinery operations. Based on the information provided by the applicant and DEP's own analysis, the subject source will result in potential emissions not to exceed 32.0 tons of carbon monoxide, 28.8 tons of nitrogen oxides (NOx), 8.0 tons of particulate matter, all of which will be particulate matter less than 2.5 microns (PM-2.5), 7.3 tons of sulfur oxides (SOx), 4.0 tons of volatile organic compounds (VOC), 0.62 ton of sulfuric acid, and 0.00036 ton of lead per year, calculated as a 12-month rolling total.

     The proposed source will be subject to the applicable requirements of 40 CFR 60 Subpart(s) Db [Standards of Performance for Industrial-Commercial-Institutional Steam Generating Units], and Ja [Standards of Performance for Petroleum Refineries for Which Construction, Reconstruction, or Modification Commenced After May 14, 2007], and 40 CFR 63 Subpart DDDDD [National Emission Standards for Hazardous Air Pollutants for Major Sources: Industrial, Commercial, and Institutional Boilers and Process Heaters, ''Boiler MACT''].

The facility's main sources include six natural gas-fired space heaters rated 0.1 MMBtu/hr; four natural gas-fired space heaters rated at 5.0 MMBtus/hr; one natural gas-fired space heater rated at 3.0 MMBtus/hr; resin batch mixer; nine bake ovens controlled by afterburners; three graphitizers; resin impregnation/curing operation; carbon batch mixers controlled by impinge units, thermal oxidizer, and filter panels; five baking ovens controlled by thermal oxidizers; three diesel-fired emergency generators; three natural gas-fired generators; one parts washer; two spray booths venting internally; two oxidation kilns; three exo gas generators; a batch oven controlled by a thermal oxidizer; and purbide E reactors.

     The facility has potential emissions of 20.54 tons of carbon monoxide, 29.52 tons of nitrogen oxides, 91.91 tons of sulfur oxides, 4.50 tons of particulate matter (including particulate matter less than 10 microns in size), 21.61 tons of volatile organic compounds, 5.75 tons of hazardous air pollutants, and 24,361 tons of carbon dioxide equivalent. The terms and conditions of Plan Approval 53-00009D have been incorporated into this operating permit.

     The engines incorporated into Source ID P114 are subject to the MACT requirements of 40 CFR Part 63 Subpart ZZZZ (National Emission Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines). The 287 bhp Cummins diesel-fired engine and the 162 bhp Kohler natural gas-fired engine incorporated into Source ID P114 are subject to the requirements specified in 40 CFR Part 60 Subparts IIII (Standards of Performance for Stationary Compression Ignition Internal Combustion Engines) and JJJJ (Standards of Performance for Stationary Spark Ignition Internal Combustion Engines), respectively.

    COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

    MINING ACTIVITY NPDES DRAFT PERMITS

     This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

     The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

    Effluent Limits for Coal Mining Activities

     For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

     The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

     A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

     Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

    Effluent Limits for Noncoal Mining Activities

     The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

     Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

     In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

     More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

     The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

     Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

     Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

     The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

    FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

     The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

     2) To construct temporary stream diversion utilizing sandbag diversions and an 18-inch temporary diversion pipe to convey flows through the project area and through the center of the channel during the construction of the abutments.

     4) To conduct minor grading and compaction within the floodway of the stream to facilitate the overall objective of the project.

     The applicant is seeking authorization to (1) change the Brooks Run channel, (2) install, operate and maintain in-stream structures for habitat and grade control and (3) place and maintain fill in the existing stream channel. The channel change of Brooks Run shall be limited to a maximum of 350-linear feet with the successful creation of functional wetlands on both realigned channel overbank areas. Installation of in-stream habitat and grade control structures shall be limited to the realigned channel and 250-linear feet upstream. The project is located along the western right-of-way of SR 0872 adjacent to the Sinnemahoning State Park boat launch at George B. Stevenson Reservoir. Since Brooks Run is a wild trout fishery, no in-stream or riparian wetland construction or future repair work shall be performed between October 1 and December 31 without prior written permission from the Pennsylvania Fish and Boat Commission. All in-stream activities authorized by this permit shall be completed in dry work conditions by dam and pumping, fluming or diverting stream flow around the work area. The applicant has agreed to mitigate the 325-feet of permanent stream impact by constructing riparian wetlands on either realigned channel overbank.

    E59-526. Tennessee Gas Pipeline Company, 1001 Louisiana Street, Suite 1460A, Houston, Texas 77002-5089.      Tennessee Gas Pipeline Company (TCP) has applied for a Standard—Joint Permit Application to construct, operate and maintain 8.1-miles of 36-inch diameter natural gas pipeline for their 300-line loop along Bear Wallow Branch, Left Straight Run, Wildcat Hollow, Right Straight Run and Spoor Hollow Brook in Tioga County. The project will also be modifying one existing compressor station CS 315—Charleston Township.

     The total estimated stream impacts for the project are approximately 3,524 ft2 of permanent impacts. The total estimated wetland impacts for the project are approximately 75,800 ft2 (1.74 acre) of permanent impacts and 24,400 ft2 (0.56 acre) of temporary impacts.

     Bear Wallow Branch, Left Straight Run, Wildcat Hollow and Right Straight Run are classified with a designated use of High Quality—Cold Water Fishery (HQ-CWF) and with an existing use of Exceptional Value (EV).

     Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).     PUBLIC WATER SUPPLY PERMITS

     Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Use of a total of five flares, including three previously approved for the GROWS Landfill, are proposed to serve as back-up control devices in the event the landfill gas cannot be transmitted to the end users. The final GCCS shall be designed and operated according to the specifications and operational standards of the New Source Standards of Performance (NSPS) for Municipal Solid Waste Landfills 40 CFR Part 60, Subpart WWW. The interim and final GCCS comprise Best Available Technology (BAT) for the source.     46-00001: JBS Souderton, Inc. (741 Souder Road, Souderton, PA 18964) On April 7, 2014 located in Fran-conia Township, Montgomery County, PA. The Title V facility is a meat-packing and rendering plant, which emits major levels of Nitrogen Oxides (NOx). The Minor Modification of Title V Operating Permit is issued under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code § 127.462. The modification addresses a change to the chemistry of the existing scrubbing system (Control Devices: C02—Batch Packed Tower 1, C03—Batch Packed Tower 2, C06—Continuous Packed Tower 1, C07—Continuous Packed Tower 2). The permit contains all applicable requirements including monitoring, recordkeeping and reporting. Sources at this facility are not subject to Compliance Assurance Monitoring (CAM) pursuant to 40 CFR Part 64 because the existing control devices are not used to reduce emissions for which the facility is major (NOx).

    Permit No. 46-00035: Glaxosmithkline (709 Swede-land Road, Upper Merrion Township, Montgomery County) On February 2, 2015 submitted a Title V Operating Permit (TVOP) Minor Modification. The following changes were made to the permit:

     GSK voluntarily took a facility wide hazardous air pollutant (HAP) emission limit of 10 tons/year of a single HAP and 25 tons/year of combined HAP's both calculated on a 12-month rolling sum, in order to become an Area (Minor) HAP source. Removal of all Major Source Boiler MACT requirements codified in 40 CFR Part 63, Subpart DDDDD and replacing them with the Area Source Boiler MACT requirements codified in 40 CFR Part 63, Subpart JJJJJJ.

     The modified TVOP includes monitoring, recordkeeping, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

     Minor modification of TVOP No. 46-00035 is issued under the Air Pollution Control Act (35 P. S. §§ 4001—4015) and 25 Pa. Code § 127.462.

    09-0007C: Waste Management Disposal Services of Pennsylvania, Inc. (1000 New Ford Mill Road, Morrisville, PA 19067) On April 20, 2015 for a minor modification to plan approval 09-0007C for the Grows North Municipal Solid Waste Landfill located in located in Falls Township, Bucks County. The plan approval was modified in order to remove an operating hour restriction for two enclosed flares and to replace it with an equivalent heat input limitation.     SPECIAL NOTICES

    Water Quality Certification under Section 401 of the Federal Clean Water Act for the Columbia Gas Transmission—East Side Expansion Project

    EA15-012—On November 1, 2013, Columbia Gas Transmission, LLC (Columbia) filed an application with the Federal Energy Regulatory Commission (FERC) in Docket No. CP14-17-000 under Section 7(b) and (c) of the Natural Gas Act (NGA) seeking a Certificate of Public Convenience and Necessity (Certificate) to authorize the abandonment, construction, and operation of the Columbia Gas East Side Expansion Project located in Pennsylvania and other states. The proposed facilities (a.k.a. Line 1278 Loop) would consist of approximately 9.5 miles of 26-inch-diameter natural gas pipeline between the existing Eagle Compressor Station in West Vincent Township, Chester County and the existing Downingtown Compressor Station in Downingtown Borough, Chester County.

     The pipeline facility is a single 9.5 mile loop that, to the extent practicable, will be co-located parallel to existing pipelines or other existing rights-of-way. The project also includes a launcher/receiver on each end of the loop and one mainline valve on the loop. Additionally, Columbia proposes to construct modifications and upgrades at the existing Eagle Compressor station. The Environmental Assessment prepared by FERC may be viewed on FERC's website at www.ferc.gov under the Docket No. CP14-17-000.

     The Pennsylvania Department of Environmental Protection (PADEP) certifies that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The PADEP further certifies that the construction, operation and maintenance of the projects complies with Commonwealth water quality standards and that the construction, operation and maintenance of the projects does not violate applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the projects complies with the conditions for this certification, including the criteria and conditions of the following:

     1. Discharge Permit—Columbia shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P. S. §§ 691.1—691.1001) and all applicable implementing regulations (including 25 Pa. Code Chapter 92a).

     2. Erosion and Sediment Control Permit—Columbia shall comply with its Chapter 102 ESCGP-2 Permit, No. ESG0002914001, for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17) and all applicable implementing regulations (including 25 Pa. Code Chapter 102).

     3. Water Obstruction and Encroachment Permit—Columbia shall comply with its Chapter 105 Water Obstruction and Encroachment Permit, No. E15-846, for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27), Flood Plain Management Act (32 P. S. §§ 679.101—679.601), and all applicable implementing regulations (including 25 Pa. Code Chapter 105).

     4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational or construction process that may be employed by Columbia.

     5. Operation—For each Project under this Certification, Columbia shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Certification and all required permits and approvals. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Columbia.

     6. Inspection—The Project, including all relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Certification, including all required permits and approvals, Pennsylvania's Water Quality Standards, and the conditions of this Certification. A copy of this Certification shall be available for inspection by the PADEP during such inspections of the Project.

     7. Transfer of Project—If Columbia intends to transfer any legal or equitable interest in the Project which is subject to this Certification, Columbia shall serve a copy of this Certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Southeast Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of Certification responsibility, coverage, and liability between them.

     8. Correspondence—All correspondence with and submittals to PADEP concerning this Certification shall be addressed to the Department of Environmental Protection, Southeast Regional Office, Domenic Rocco, P.E., Waterways and Wetlands Program Manager, 2 East Main Street, Norristown, PA 19401.

     9. Reservation of Rights—PADEP may suspend or revoke this Certification if it determines that Columbia has not complied with the terms or conditions of this Certification. PADEP may require additional measures to achieve compliance with applicable law, subject to Columbia's applicable procedural and substantive rights.

     10. Other Laws—Nothing in this Certification shall be construed to preclude the institution of any legal action or relieve Columbia from any responsibilities, liabilities, or penalties established pursuant to any applicable federal or state law or regulation.

     11. Severability—The provisions of this Certification are severable and should any provision of this Certification be declared invalid or unenforceable, the remainder of the Certification shall not be affected thereby.

    Environmental Assessment

    Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. Bell & Evans proposes upgrades to their existing wastewater treatment plant to comply with more stringent NPDES discharge limits. The Department's review of the project and the information received in the Environmental Report for the project has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby approves the Environmental Assessment.
