CODE CHS. 1, 3, 4, 11, 13, 15, 23, 25, 28--30, 36, 36a, 36b, 37, 38 AND 40] Transfer of Regulations [27 Pa.B. 2415] The Pennsylvania Emergency Management Agency, the Department of State and the Department of Community and Economic Development (DCED) jointly submit this notice for the purpose of renumbering certain existing regulations and statements of policy. The renumbering has been made necessary by the enactment of the Community and Economic Development Enhancement Act (act) (71 P. S. §§ 1709.101--1709.2106).
Among other things, the act changed the name of the Department of Commerce to the DCED, eliminated the Department of Community Affairs and transferred to the DCED certain functions which had previously been assigned to the Department of Community Affairs. Section 2101 of the act (71 P. S. § 1709.2101) authorizes the Legislative Reference Bureau to recodify regulations to effectuate the reassignment of functions. In addition, the renumbering of another regulation is necessitated by the transfer of responsibilities from the Department of Community Affairs to the Pennsylvania Emergency Management Agency.
Therefore, in recognition of the transfers of functions set forth in the act, the executive agencies named in this notice hereby request the Legislative Reference Bureau to create a new Title 12 of the Pennsylvania Code and to make changes to the organizational numbering of the affected regulations and statements of policy, as set forth in the following tables.
