[Saturday, May 10, 2014]THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges regarding industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFO). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 Individual Permits and Individual Stormwater Construction Permits in Sections IV and VI, the Department, based upon preliminary reviews, has made tentative determinations of proposed effluent limitations and other terms and conditions for the permit applications. In accordance with 25 Pa. Code § 92a.32(d), the proposed discharge of stormwater associated with construction activities will be managed in accordance with the requirements of 25 Pa. Code Chapter 102. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the United States Environmental Protection Agency (EPA) Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on NPDES applications are invited to submit statements to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on WQM permit applications are invited to submit statements to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for public hearings on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Henry M Hershey has submitted an application for an Individual NPDES permit for a new CAFO known as Henry Hershey Farm CAFO, located in Fulton Township, Lancaster County.
The CAFO is situated near Peters Creek and Unnamed Stream in Watershed 7-K, which is classified for high quality warm water fishery. The CAFO is designed to maintain an animal population of approximately 391.22 animal equivalent units (AEUs) consisting of 87,000 poultry (broilers) and 90 dairy cows with 60 heifers/calves. Manure is collected as dry litter within the poultry barns and the liquid dairy manure is collected in an underneath storage with collected bedpack for the heifers/calves and some uncollected manure left in a pasture. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.

Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907)
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.302—6026.305) require the Department to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. A person intending to use the background standard, Statewide health standard, the site-specific standard or intend to remediate a site as a special industrial area shall file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of cleanup standards or receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the following site, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified as follows. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.

NEW SOURCES AND MODIFICATIONSThe Department has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received an application and intends to issue a Plan Approval to the abovementioned company for the abovementioned project. This plan approval may be incorporated into the company's facility-wide permit via an administrative amendment at a later date.
Plan Approval No. 06-05002J is for the authorization to combust Class A Dried Biosolids (DBS) as an alternative fuel in Source IDs 121 & 122, Portland Cement Kilns #1 & #2, respectively. The facility will be permitted to combust up to a combined total of 6.0 tons per hour DBS in both kilns & a total of 52,560 tpy DBS. The project does not include the installation of any new equipment nor will it increase the clinker production capacity of the kilns. The facility will be required to comply with the amended requirements of 40 CFR 63, Subpart LLL by September 9, 2015. The plan approval will contain emission limits, performance testing, monitoring, recordkeeping & work practice standards designed to keep the facility operating within all applicable air quality requirements.

In accordance with 25 Pa. Code §§ 127.44(a) and 127.45(a), the Department of Environmental Protection (DEP) has received an application and intends to issue a Plan Approval to the abovementioned company for the abovementioned project. This plan approval may be incorporated into the company's facility-wide permit via an administrative amendment at a later date.
Plan Approval 06-05069V is for installation and startup of pieces of equipment controlled by fabric filters and mist eliminators. The company shall be subject to and comply with 40 CFR 60 Subpart KK, 40 CFR 63 Subpart MMMM and BAT. The expected actual air emissions from the proposed project are 13.7 tpy of NOx, 1.5 tpy of SO2, 23.1 tpy of CO, 5.9 tpy of particulate, 1.5 tpy of VOC and 29.5 tpy of HAP. The specific changes are proposed as follows:
1.) for dry pasting operations:
(a) Upgrade of Baghouse C29 (controlling part of Source 146 and formerly controlling Source 147) with a larger 60,000 CFM fan
(b) Move the existing C30 baghouse (formerly controlling Source 148) with a 60,000 CFM fan next to existing BaghouseC29 as a part of C29
(c) Install one new secondary HEPA filtration (C29A) designed for 120,000 CFM air flow for control of the combined exhaust of the resulting C29 ventilation system
(d) Install three new paste lines and three new paste operating hoods as a part of Source 146 controlled by C29
(e) Change the ventilation of the existing Source 147 equipment formerly controlled by C29 and instead control that equipment with new Baghouse/HEPAC147/C147A (see change 8 below)
(f) Change the ventilation of the existing Source 148 equipment formerly controlled by C30 and instead control that equipment with new Baghouse/HEPAC148/C148A (see change 9 below)
2.) for wet pasting operations: Install three new paste mixers and three new flash dry ovens as a part of Source 146 and controlled by existing fabric filter C40 with secondary HEPA filtration (C40A)
3.) for gridcasting operations:

Code §§ 127.441, 127.425 and 127.521, the Department is providing notice that they intend to issue a Title V Operating Permit for the continued operation of a bulk gasoline transfer terminal, known as the Midland Terminal, located in Midland Borough, Beaver County.
The facility consists of six ''swing'' storage tanks, with storage capacities between 84,000 and 3,100,000 gallons (1 barrel petroleum = 42 US gallons), one distillate oil, 3,900,000 gallon, fixed roof tank, two ethanol tanks with capacities of 36,000 gallons and 21,000 gallons, equipment for barge loading and unloading, and gasoline and distillate loading racks. The swing tanks are equipped with internal floating roofs. Emissions from the loading racks are controlled by a Vapor Recovery Unit. (VRU) When the VRU is not available, these emissions are controlled by an off-site, portable Vapor Combustion Unit. (VCU) The swing tanks may include any liquid which produces emissions less than or equal to storage of gasoline. Throughput of the loading racks is limited to 172,000,000 gallons of gasoline and 80,000,000 gallons of distillate oil. Loading of gasoline into barges is limited to 40,000,000 gallons per year. Emissions of VOC from the loading racks are limited to 20 mg per liter of gasoline loaded. This facility has the potential to emit the following type and quantity of pollutants: 115 tons per year of VOC, 2.9 tons per year of NOx, 7.2 tons per year of CO, and 2.0 tons of the sum of all HAPs combined. No equipment or emission changes are being approved by this action. Sources at the facility are subject to 40 CFR Part 60 Subpart XX—Standards of Performance for Bulk Gasoline Terminals, 40 CFR Part 60 Subpart Kb—Standards of Performance for Volatile Organic Liquid Storage Vessels (Including Petroleum Liquid Storage Vessels) for Which Construction, Reconstruction, or Modification Commenced After July 23, 1984, and 40 CFR Part 63 Subpart BBBBBB—National Emission Standards for Hazardous Air Pollutants for Source Category: Gasoline Distribution Bulk Terminals, Bulk Plants, and Pipeline Facilities, as well as 40 CFR 64—Compliance Assurance Monitoring, and state requirements. The booths are heated with an air make-up unit rated at 5.3 mmbtu/hr. The heater is fired with natural gas. The facility has an emission limit of 10 TPY for VOC emissions in any 12-month rolling period. The facility is an area source of emissions. The operating permit contains requirements from plan approval 25-1021A, applicable emission restrictions, testing requirements, monitoring requirements, reporting requirements, work practice requirements, and additional requirements in accordance with the Clean Air Act.
43-00361: Butler Petroleum Corp.—Elliot Oil Division (408 Erie Street, Grove City, PA 16127) to issue a Synthetic Minor Operating Permit for this petroleum products distribution facility, located in the Grove City, Mercer County. In order to remain classified as a ''Bulk Gasoline Plant'' and not a ''Bulk Gasoline Terminal'' this facility has elected to limit gasoline throughput to no more than 20,000 gallons per day.
This operating permit issuance incorporates a GP-2 (General Plan Approval and General Operating Permit, BAQ-GPA/GP-2) for two 12,000 gallon gasoline storage tanks, Subpart BBBBBB—National Emission Standards for Hazardous Air Pollutants for Source Category: Gasoline Distribution Bulk Terminals, Bulk Plants, and Pipeline Facilities, and the applicable requirements from 25 Pa. Code §§ 129.57, 129.60, 129.61 and 129.62.
The primary sources of emissions from this facility are the gasoline storage and transferring equipment. If gasoline throughput at this facility were at the maximum rate of 20,000 gallons per day, the VOC emissions from this facility would be 24.8 tons per year. Actual throughputs and VOC emissions are expected to be well below these estimates. Emissions of all other criteria pollutants are well below major source thresholds.

Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, state or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.
Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.
A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

In addition, the Department imposes a technology-based aluminum limit of 2.0 mg/l (30 day average) to protect stream uses.
A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The BAT limits for noncoal mining activities as provided in 40 CFR Part 436 and 25 Pa. Code Chapter 77 are as follows:

Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.
In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.
More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).
The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 362-0600-001, NPDES Program Implementation-Memorandum of Understanding (MOU) Concerning Water Quality Management, NPDES Program Implementation, and Related Matters. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.
Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.
Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevantState requirements. Lancaster Plan Description: The planning module for the Lamar Weaver Subdivision, DEP Code No. A3-36959-192-2, APS Id 834122, providing for the creation of a 1.132 acre lot using an individual on lot sewage disposal system is disapproved. The property is located on the east side of South Fairmount Road, approximately 800 feet north of Wissler Road in West Earl Township. This plan is disapproved because the preliminary hydrogeologic study inaccurately characterized the background nitrate-nitrogen concentration in the groundwater under the proposed subdivision. All of the water sample locations were about 1/4 mile away from the proposed lot and only one of those samples was within the same drainage basin as the proposed lot. Also, the proposed groundwater recharge easement used to mitigate the plume from the proposed on lot sewage disposal system is insufficient in size and position to be acceptable. The easement does not provide enough recharge down gradient of the proposed system to mitigate the impact prior to the plume moving down a well-defined drainage swale and onto the neighbor's property.

Southwest RegionThe Pennsylvania Department of Environmental Protection (''DEP''), under the authority of the Hazardous Sites Cleanup Act, 35 P. S. Section 6020.101 et. Seq. (''HSCA''), has initiated a prompt interim response at the McQuaid Property and Nearby Areas (''Site''). This response has been initiated pursuant to Sections 501(a) and 505(b) of the HSCA, 35 P. S. Sections 6020.501(a) 6020.505(b). The Site consists of properties located in a residential area of the Borough of Aspinwall and the Township of O'Hara in Allegheny County. The McQuaid Property is located at 37 Western Ave and the Nearby Areas are in the immediate vicinity of it.
An on-going investigation conducted by DEP at the Site indicates that these areas have been impacted or have the potential to be impacted by TCE and/or PCE contamination in the groundwater and soil. This contamination can potentially result in elevated levels of PCE/TCE in the indoor air of buildings in the area. Pending completion of the investigation, the extent of the contamination has yet to be determined.
The current and/or potential threat from the Site to human health or welfare from the Site to human health or welfare is the direct contact threat to persons entering buildings where there is the potential for exposure to hazardous substances in the air. The Site is in a residential area.
The Department considered the following two alternatives to address the threats at the Site: (Alternative 1) No action and (Alternative 2) Installation of vapor intrusion mitigation systems in impacted buildings. Alternative 2 was chosen because it complies with the applicable, relevant, and appropriate requirements.
This notice is being provided under Section 506(b) of the Hazardous Sites Cleanup Act. The Administrative Record which contains information forming the basis and documenting the selection of this response action is available for public review and comment at the Department's Southwest Regional Office, 400 Waterfront Drive, Pittsburgh, PA 15222 and is available for review between 9 a.m. and 4 p.m.
The Administrative Record will be open for comment until August9, 2014. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION UNDER ACT 2, 1995
PREAMBLE 3
The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).
Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

Consent Order and Agreement; Treatment of Post-Mining Discharges and Seeps at the Addison and Stutzman Mine Sites Mineral Resources Management, District Mining Operations, Cambria Office, 286 Industrial Park Road, Ebens-burg, PA 15931-4119
The Commonwealth of Pennsylvania, Department of Environmental Protection (Department), pursuant to Sections 4.2 and 4.3 of the Surface Mining Conservation and Reclamation Act, 52 P. S. §§ 1396.4b and 1396.4c; Section 5 of the Clean Streams Law, 35 P. S. § 691.5; and Section 1917-A of the Administrative Code of 1929, 71 P. S. § 510-17, and in settlement of a Complaint docketed at 596 M.D. 2009 before the Commonwealth Court of Pennsylvania has entered into a Consent Order and Agreement (COA) between the Department, Bituminous Coals, Inc. (BCI), and Fetterolf Mining, Inc. (FMI) concerning the treatment of post-mining discharges and seeps at the Addison and Stutzman Mine sites (jointly, the Sites). Both BCI and FMI are operated by Mr. M. Mitchell Fetterolf, who serves as President, Treasurer, and Chief Executive Officer.
The Addison Mine site, located in Addison Township, Somerset County, Pennsylvania, includes permitted mining activities at three sites: Addison #1 (MDP No. 40A77SM11), Addison #1 Mine (MDP No. 5679116), and the Addison Strip (SMP No. 56773136). Between 1981 and 2009, the Department determined there were numerous effluent limit violations as a result of BCI's mining discharge and subsequent treatment attempts.
The Stutzman Mine, MDP No. 56800103, is located in Stonycreek Township, Somerset County, Pennsylvania. In February 1986, the Department discovered four seep locations both on and off the site previously permitted to FMI and requested that FMI implement a permanent abatement plan for the seep treatment.
The Department also notified BCI and FMI in October 2004, that the initial bonds posted for the Sites in the amounts of $504,640 and $8,700 were insufficient to guarantee payment of perpetual treatment of the post-mining discharges and seeps. Jointly, BCI and FML claimed in a June 2005, letter that they lacked the financial resources to provide for perpetual payment and in September 2005, notified the Department that treatment of the discharges and seeps would cease when then-current materials had exhausted. The Department immediately took over treatment of the discharges and seeps after BCI and FMI ceased treatment activity on December 31, 2005. The Department then notified BCI and FMI in January 2006, of its intention to forfeit the bonds for the Sites. Those bonds are currently held by the Mid Continent Insurance Company.
On November 12, 2009, the Department filed a Complaint with the Commonwealth Court seeking that BCI and FMI be required to resume or begin to treat all of the discharges and seeps resulting from the operator's mining activity, and to post long-term financial guarantees so as to provide for those treatments.
Under the terms of the COA, in settlement of litigation, BCI and FMI have agreed to construct and/or repair the treatment systems for the discharges and seeps on the Sites. Rather than collecting on the forfeited bonds, the Department will direct funds from the Mid Continent Insurance Company, Inc., to a treatment trust that has been established with the Clean Streams Foundation for the perpetual treatment of the mine discharges resulting from the mining operations.
