[31 Pa.B. 1869] NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS NPDES APPLICATIONS PART I PERMITS Under the Federal Clean Water Act and the Pennsylvania Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I below, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For all new permit applications, renewal application with major changes or applications for permits not waived by EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II below. All oil and gas related permit applications are listed below under Section III. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise below, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).
Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated above the application.

WATER QUALITY MANAGEMENT PERMITS CONTROLLED INDUSTRIAL WASTE AND SEWAGE WASTEWATER APPLICATIONS UNDER THE PENNSYLVANIA CLEAN STREAMS LAW PART II PERMITS The following permit applications or requests for plan approval have been received by the Department of Environmental Protection (Department). The applications are listed in two categories. Section I lists all municipal and industrial permits and Section II lists oil and gas related permit applications.
Persons wishing to comment on any of the applications are invited to submit a statement to the office noted above the application within 15 days from the date of this public notice. Comments received within this 15-day comment period will be considered in making the final decision regarding the application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

NPDES Stormwater Individual Permit

Acknowledgment of notices of intent to remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908)
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY NOTICE OF PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS The Department of Environmental Protection (DEP) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

This modification will result in an emission increase of 0.56 ton of particulate matter per 12-month rolling sum. This source will result in an emission increase of 0l.00035 tons of lead (particulate matter) and 2.37 tons of volatile organic compounds (VOCs) per 12-month rolling sum. The Selective Soldering Machine No. 6 shall only be used for soldering electronic circuit boards. The Operating Permit will contain recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

The plan approval includes terms and conditions to assure the proper operation of the source to satisfy the State and Federal requirements. It includes at minimum the conditions related to source description, emissions limits for pollutants, monitoring, recordkeeping and reporting, temporary operations to facilitate shakedown and temporary operation period. This plan approval will be incorporated into the Title V operating permit through an administrative amendment at a later date.
The plan approval is for the ability to burn bituminous-anthracite coal, petroleum coke, virgin wood chips and paper process residual (filter cake) in the Circulating Fluidized-Bed (CFB) boiler. The emissions from the unit will be controlled by Fabric collectors, SNCR and Lime injection and shall not exceed the following emission limits:

The plan approval will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements. The company will be required to operate and maintain a Continuous Air Contaminants Emission Monitoring System which is certified by the Department for opacity, oxygen, sulfur dioxide, nitrogen oxides and carbon monoxide.

The proposed equipment will consist of six conveyors, a feeder and a bin. The air contaminant emissions from this equipment will be controlled by water spray dust suppression systems. The resulting fugitive particulate matter or dust emissions will be negligible.
The Department of Environmental Protection (Department) has determined that the proposed conveyors, feeder and bin will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants, including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue plan approval for construction of the respective conveyors, feeder and bin.
The Department intends to place conditions in the plan approval to be issued pertaining to the operation of the proposed equipment and associated water spray dust suppression system. These are intended to assure proper operation of the equipment as well as compliance with all applicable air quality regulatory requirements. The following is a summary of these conditions:
1. Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the air contaminant emissions from the respective sources shall be controlled by a water spray dust suppression system.
2. Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, if at any time, it is determined that the air contaminant emissions are in excess of any applicable air contaminant emission limitation, the company shall immediately install additional spray nozzles or take other such control measures as are necessary to reduce the air contaminant emissions to within the applicable limitations.
3. Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the water spray dust suppression system associated with the equipment shall be connected to an on-demand water source capable of delivering an adequate supply of water at any time the plant is in operation. On-demand shall be interpreted as meaning that adequate water can be provided to all spray nozzles at any time with no more effort than turning a valve. If at any time the water source cannot deliver an adequate supply of water to properly operate the water spray dust suppression system, the company shall immediately cease plant operation.
47-318-009B: Aldan Acquisition, Inc. (115 Woodbine Lane, Danville, PA 17821-9118) for construction of a festoon oven in their fabric coating and curing facility in Mahoning Township, Montour County.
The proposed festoon oven will be fired with natural gas, will have a maximum heat input of 4.8 million BTU per hour and will be used to cure rubber coated cloth. The air contaminant emissions potentially resulting the combustion of natural gas in the oven will be no greater than 2.1 tons of nitrogen oxides, .44 ton of carbon monoxide and .12 ton of volatile organic compounds per year. The oven will also potentially emit malodorous air contaminants from the curing process. Aldan is proposing to control the malodorous air contaminants with a thermal oxidizer currently in use at the facility for the control of volatile organic compound emissions from an existing fabric coating operation. The thermal oxidizer is expected to reduce the emission of malodorous air contaminants to a nondetectable level.
The Department has determined that the proposed festoon oven will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue plan approval for the construction of the respective oven.
The Department intends to place conditions in the plan approval to be issued pertaining to the operation and monitoring of the festoon oven and associated thermal oxidizer. 2. Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the festoon oven shall not be operated without the simultaneous operation of the thermal oxidizer.
3. Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the thermal oxidizer shall maintain a minimum oxidizer chamber outlet temperature of at least 1400°F at all times the festoon oven is operating.
4. Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the thermal oxidizer shall be equipped with a continuous oxidizer chamber outlet temperature monitoring and recording system. All records generated by this system shall be retained for at least 5 years.
59-00005C: Dominion Transmission Corp.--Sabinsville Compressor Station (CNG Tower, 625 Liberty Avenue, Pittsburgh, PA 15222-3199) for installation of air cleaning devices, ''screw-in prechambers'' on five 1300 horsepower natural gas-fired reciprocating internal combustion compressor engines (Engines 1--5) at their facility in Clymer Township, Tioga County. The Department's review of the information contained in the application indicates that the proposed installations will meet all applicable air quality requirements. Based on this finding, the Department intends to approve the application and issue a plan approval to install the proposed air cleaning devices on the respective engines.
The Sabinsville Compressor Station is a major facility, which has been issued Title V Operating Permit No. 59-00005. The proposed air cleaning devices will replace existing air cleaning devices and are intended to better assure compliance with the nitrogen oxides and volatile organic compound emission limitations previously established for the respective engines under the reasonably available control technology requirements of 25 Pa. Code §§ 129.91--129.95 as well as with the carbon monoxide emission limitation to which the engines are currently subject. These installations will not result in any change in the amount of any air contaminant allowed to be emitted from the engines but may result in a reduction in the emission rate of one or more air contaminants from the levels now actually occurring.
The following is a summary of the conditions the Department proposes to place in the plan approval to ensure compliance with all applicable air quality regulatory requirements:
1. Under the requirements of Title V Operating Permit 59-00005 and the reasonably available control technology provisions of 25 Pa. Code §§ 129.91--129.95, the nitrogen oxides emissions from each of the five engines shall not exceed an emission rate of 8.60 pounds per hour while operating at full load/full speed conditions and an emission rate of 17.16 pounds per hour while operating at any other conditions following the installation of the screw-in prechamber system on the respective engine. Additionally, the emission of volatile organic compounds and carbon monoxide shall not exceed 2.30 and 10.37 pounds per hour respectively.
2. Within 120 days of the completion of installation of the screw-in prechamber system on each of the respective five engines, the engine shall be stack tested for nitrogen oxides, volatile organic compounds and carbon monoxide using reference method test procedures acceptable to the Department while the engine is operating at full load and full speed.
3. Under the requirements of Title V Operating Permit 59-00005 and the reasonably available control technology provisions of 25 Pa. Code §§ 129.91--129.95, semi-annual nitrogen oxides portable analyzer testing shall be performed on each engine.
4. Under the recordkeeping requirements of 25 Pa. Code § 129.95, records shall be maintained of the number of hours per month each engine is operated as well as the amount of fuel used each month in each engine.
5. Under the requirements of Title V Operating Permit 59-00005 and the reasonably available control technology provisions of 25 Pa. Code §§ 129.91--129.95, the engines shall only be fired on pipeline quality natural gas.
6. Under the requirements of Title V Operating Permit 59-00005 and the reasonably available control technology provisions of 25 Pa. Code §§ 129.91--129.95, the engines are not required to comply with the nitrogen oxides, volatile organic compound and carbon monoxide emission limits specified in this plan approval during engine startup and shutdown provided that the duration of startup and shutdown does not exceed one hour per occurrence.
MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

The purpose of the project is to eliminate approximately 7,550 feet of highwall. Eight strip mine pits will be backfilled with 470,000 cubic yards of material. A 0.07 acre Palustrine Unconsolidated Bottom Permanently Flooded Excavated (PUBHX) wetland exists in one of the strip mine pits (AMLF #8 of PA3661). The extension will consist of a combination of gravity and pressure sewers. Sewage will flow into the Richmond Municipal Authority's system and be conveyed to the Mansfield Borough sewage treatment plant. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.
PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT Avtex Adjunct Mercury Sites Crawford County Under section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), notice is hereby provided that the Department of Environmental Protection (Department) has agreed to a de minimis Consent Order and Agreement (Agreement) with Ralph Hunter, Inc. (Hunter) concerning the resolution of its liability for the Avtex Fibers, Inc. mercury release and the Avtex Adjunct Mercury Sites (Sites). The Sites are located at 33 separate locations in Hayfield, Richmond, Spring, Union, Venango, Vernon and Woodcock Townships, Crawford County.
In 1995 and 1996, Hunter transported mercury-containing wastes (wastes) from the Avtex Fibers, Inc. facility in Vernon Township, Crawford County for use as fill material to various locations. The Sites received wastes for road base in the construction of access roads used for timbering, oil and gas exploration and residential driveways. These wastes contaminated the environment at the Sites. Mercury in the wastes is defined in section 103 of HSCA (35 P. S. § 6020.103) as a ''hazardous substance.'' To date, the Department has removed the wastes from most of the Sites for proper off-site disposal (response). These responses will continue into the construction season for the year 2001, until all remaining specific Sites are completed. The estimated cost for all the responses for the Sites is approximately $1,318,309. Those responses mitigated the threat to human health and the environment posed by the wastes.
As a transporter and operator during the time of the release and threatened release of hazardous substances at the Sites, Hunter is a ''responsible person'' as defined in section 103 of HSCA (35 P. S. § 6020.103). Under the terms of the Agreement, Hunter shall pay the Department $48,000 to resolve its liability at the Sites. The specific terms of this settlement are set forth in the Agreement between Hunter and the Department. The Department will receive and consider comments relating to the Agreement for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations, which indicate that the Agreement is inappropriate, improper, or not in the public interest.
After the public comment period, the Department's settlement with Hunter shall be effective upon the date that the Department notifies Hunter, in writing, that this Agreement is final and effective in its present form, and that the Department has filed a response to significant written comments to the Agreement, or that no such comments were received.

Description: The Pennsylvania Infrastructure Investment Authority (PENNVEST) which administers Pennsylvania's State Revolving Fund (SRF) is intended to be the funding source for the project defined by the previously approved plan. The State Environmental Review Process for PENNVEST, SRF funded projects requires the Department to reaffirm project planning approvals if the approvals are, as in this case, 5 or more years old. The existing plan provides for sewerage facility improvements and sewer extensions to resolve existing sewerage problems including raw sewage discharges. The Department's review of the project and information received has not identified any significant, adverse environmental impact. The Department hereby reaffirms the plan approval.
