Federal Consistency under the Coastal Zone Management Act; Maintenance Dredging at Presque Isle and Erie Bluffs State Parks [45 Pa.B. 2007]
[Saturday, April 18, 2015]This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that the Department of Conservation and Natural Resources (DCNR) is proposing to conduct maintenance dredging at Presque Isle and Erie Bluffs State Parks.
Low lake levels and the accumulation of sediments have created hazardous boating conditions at Presque Isle and Erie Bluffs State Parks in Erie County. The project includes maintenance dredging of 11,160 cubic yards of material at 15 sites within Presque Isle State Park and another 200 cubic yards at the Elk Creek access boat launch area in Erie Bluffs State Park. Two disposal areas have been identified within the Presque Isle State Park to dispose of the dredged material Beach #5 and Misery Bay which are located in upland areas. Beach #5 will be used as a part of a sand dune creation project including stabilizing dune grass plantings. The Misery Bay disposal site is an area of eroded shoreline. This dredging activity is being authorized by the Department under Water Obstruction and Encroachment Permit E10-9998 and United States Army Corps of Engineers authorization is pending (LRB 2013-561).
This project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on this Commonwealth's coastal resources or uses.
In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), DCNR has determined that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. Interested parties may request a copy of the Federal Consistency Certification from the Department contact listed as follows.
