    NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS

    NPDES APPLICATIONS

    PART I PERMITS

       Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For new permit applications, renewal application with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.

       Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted before the application, within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated before the application.

       Description of Proposed Activity:  Renewal of a treated minor discharge from a privately owned sewage treatment works.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the Allegheny River and Emlenton Water Company located at River Mile 90, 32.87 miles below point of discharge.

       The receiving stream, unnamed tributary to the Allegheny River, is in watershed 16-G and classified for WWF, aquatic life, water supply and recreation.

       The proposed effluent limits for Outfall 001 are based on a design flow of 0.0063 MGD.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is the Beaver River and Beaver Falls Municipal Authority located at River Mile 3.76, 15.5 miles below point of discharge.

       The receiving stream, unnamed tributary to the Beaver River, is in watershed 20-B and classified for WWF, aquatic life, water supply and recreation.

       The proposed effluent limits for Outfall 001 are based on a design flow of 0.0004 MGD.

       Description of Proposed Activity:   Renewal of an NPDES permit for the discharge of filtered groundwater from TDY Industries, Inc., 229 Waterford Street, Edinboro, PA 16412.

       The receiving stream, Darrows Creek, is in the Conneaut Creek watershed and classified for WWF, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply considered during the evaluation is the Franklin General Authority intake on French Creek in Franklin, approximately 46 miles below the point of discharge.

       The proposed effluent limits for Outfall 001 based on a design flow of 0.0864 MGD:

    II. Applications for New or Expanded Facility Permits, Renewal of Major Permits and EPA Nonwaived Permit Applications

       Southeast Region:  Water Management Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

       PA0011568, Amendment No. 1, Industrial Waste, Bethlehem Lukens Plate, 50 South First Street, Coatesville, PA 19320. This application is for amendment of an NPDES permit to discharge treated process wastewater and stormwater from Bethlehem Lukens Plate facility located in Chester, Chester County. This is an existing discharge to Sucker Run and the West Branch Brandywine Creek.

       The receiving stream is classified for WWF, aquatic life, water supply and recreation.

       The proposed permit amendment is for revision of Nickel effluent limits for Outfall 016, based on an average flow of 0.482 mgd are as follows:

       Description of activity:  Renewal of an NPDES permit for an existing discharge of treated industrial waste.

       The receiving stream, Dunning Creek, is in Watershed 11-C and classified for WWF, water supply, recreation and fish consumption. The nearest downstream public water supply intake for the Saxton Municipal Water Company is on the Raystown Branch Juniata River, approximately 62 miles downstream. The discharge is not expected to affect the water supply.

       The proposed interim effluent limits for Outfall 001 based on a design flow of 1.95 MGD are:

       In addition to the effluent limits, the permit contains the following major special conditions:  Process discharges are to be eliminated to Outfall 001 and at least 20% of the spring flow to the unnamed tributary to Stone Creek shall be maintained at all times by November 1, 2003; and a Water Quality Management Part II application for diverting 80% of spring flow for process water to Dunning Creek and a settling basin must be submitted by May 1, 2003.

       Northcentral Region:  Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701.

       NPDES Permit No. PA0022187, Sewage, SIC 4952, Beavertown Municipal Authority, 111 West Walnut Street, Beavertown, PA 17813. The existing discharge is located in Beavertown Borough, Snyder County.

       Description of Proposed Activity:  Amendment to the NPDES permit for Outfall 001 for Beavertown Municipal Authority Wastewater Treatment Plant. The Authority is proposing to replace the existing extended aeration facilities with an upgraded sequencing batch reactor.

       The receiving stream, Luphers Run, is in the State Water Plan watershed 6A and is classified for CWF. The nearest downstream public water supply intake for United Water Pennsylvania, located on the Susquehanna River, is about 65 miles below the point of discharge.

       The following current effluent limits for Outfall 001, based on a design flow of 0.144 MGD, will be enforceable when the existing extended aeration sewage treatment plant is in operation:

This application is for issuance of an NPDES permit to discharge treated stormwater and groundwater and wastewater from the Right Bank Site Development--Charleroi Lock and Dam in Rostraver Township, Westmoreland County.

       The following effluent limitations are proposed for discharge to the receiving waters, Monongahela River, classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is the Charleroi Municipal Authority, at approximately 1 mile below the discharge point.

       Outfall 001 and the emergency overflow:  new discharge, design flow rate of 60 gpm.

       PA0023698, Sewage, Vanport Township Municipal Authority, 285 River Avenue, Vanport, PA 15009. This application is for renewal of an NPDES permit to discharge treated sewage from Vanport Water Pollution Control Plant in Vanport Township, Beaver County.

       The following effluent limitations are proposed for discharge to the receiving waters, known as Twomile Run, which are classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Midland Borough Municipal Authority.

       Outfall 001:  existing discharge, design flow of 1.56 mgd.

       PA0025674, Amendment No. 2, Sewage, Franklin Township Municipal Sanitary Authority, 3001 Meadowbrook Road, Murrysville, PA 15668. This application is for amendment of an NPDES permit to discharge stormwater from the Meadowbrook Sewage Treatment Plant Site located in Municipality of Murrysville, Westmoreland County.

       The receiving waters, known as Turtle Creek, are classified as a TSF with existing and/or potential uses for aquatic life, water supply and recreation.

       Outfalls SWA, SWB and SWC:  existing stormwater discharges.

       This amendment adds Outfalls SWA, SWB and SWC to NPDES Permit PA0025674 and authorizes a discharge of uncontaminated stormwater from the sewage treatment site through the outfalls. There are at this time no specific effluent limitations on these outfalls. These discharges must meet the Stormwater Discharges requirements in Part C of the amendment.

       The EPA waiver is not in effect.

       PA0096598, Sewage, Lower Ten Mile Joint Sewer Authority, 144 Chartiers Road, Jefferson, PA 15344. This application is for renewal of an NPDES permit to discharge treated sewage from Mather Wastewater Treatment Plant in Morgan Township, Greene County.

       The following effluent limitations are proposed for discharge to the receiving waters, known as South Fork Tenmile Creek, which are classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Tri-County Joint Municipal Authority on the Monongahela River.

       Outfall 001:  existing discharge, dry weather design flow of 0.2 mgd and wet weather flow of 0.3 mgd.

The first downstream potable water supply intake from this facility is the Tri County Joint Municipal Authority on the Monongahela River.

       Outfall 001:  existing discharge, design flow of 0.12 mgd.

    NPDES Stormwater Individual Permit

       The following parties have applied for an NPDES permit to discharge stormwater associated with a construction activity into waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions.        Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved and comments, should be directed to the remediator of the site.

    PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

    NEW SOURCES AND MODIFICATIONS

       The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Office identified in this notice. Persons interested in reviewing the application files should contact the appropriate Regional Office to schedule an appointment.

       Persons wishing to receive a copy of the proposed Plan Approval or Operating Permit must indicate their interest to the Department Regional Office within 30 days of the date of this notice and must file protests or comments on a Proposed Plan Approval or Operating Permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. On February 20, 2003, under 25 Pa. Code §§ 127.44(a) and 127.424(b), for issuance of a plan approval for their company's facility in the Borough of Marcus Hook, Delaware County. This plan approval will authorize the applicant to construct a fluosulfonic acid manufacturing process. The Plan Approval will subsequently be incorporated into the company's facility Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450.

       Plan Approval No. PA-23-0056 is for construction of a fluosulfonic acid manufacturing process. Based on the information provided by the applicant and the Department's own analysis, the fluosulfonic acid manufacturing process will emit 0.89 ton of hydrogen fluoride per year, 3.6 tons of PM per year and 3.5 tons of sulfur trioxide per year.

       The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

       23-0014D: Kimberly-Clark Pennsylvania, LLC (Front and Avenue of the States, Chester, PA 19013) for installation of a venturi scrubber to control emissions of PM from paper machine no. 12 in Chester, Delaware County. The facility is a Title V facility. The scrubber will have an hourly emission limit of 0.58 lb/hr and an annual emission limit of 2.56 tons per year. The emission of PM from the scrubber shall not exceed 0.02 grain per dry standard cubic feet. The company shall keep records of pressure drop and flow rate of recirculation water in the scrubber.

       45-399-014: Aventis Pasteur, Inc. This pharmaceutical manufacturing facility is a Title V facility. NOx, VOC and HAP emissions from the process will be less than 1 ton per year. The plan approval will include all appropriate monitoring, recordkeeping and reporting requirements designed to keep the source operating within all applicable air quality requirements and will be incorporated into the Title V Operating Permit through an Administrative Amendment in accordance with 25 Pa. Code § 127.450.

       01-05017C: Quebecor World Fairfield, Inc. (100 North Miller Street, Fairfield, PA 17320) for construction of a four unit double web offset lithographic printing press with two natural gas-fired heatset dryers (Web No. 1) at its Fairfield Plant in Fairfield Borough, Adams County. The press will replace the existing Web No. 1 press. The press replacement will result in no net increase in air emissions. The plan approval and State-only operating permit revision will include emission restrictions, work practice standards and monitoring, recordkeeping and reporting requirements designed to keep their facility operating within all applicable air quality requirements.

       67-03120A: Aero Energy (230 Lincoln Way East, New Oxford, PA 17350-1296) for installation of a propane cylinder filling line in their facility at 149 Bowman Road, Jackson Township, York County.

       Northcentral Region: Air Quality Program, 208 West Third Street, Williamsport, PA 17701; Contact: David Aldenderfer, Program Manager, (570) 327-3637.

       17-305-046: P and N Coal Co., Inc. (P. O. Box 332, Punxsutawney, PA 15767) for modification of a coal processing plant (Stiner No. 1) in Goshen Township, Clearfield County by increasing the plant throughput to a level which exceeds the plan approval exemption criteria of 200 tons per day.

       The plant consists of a coal crusher/screen, a 125 horsepower diesel generator, a radial stacking conveyor and associated coal stockpiles and front-end loaders. Air contaminant emission control will be provided by an enclosure on the crusher/screen, the use of a water truck and the implementation of various work practices (minimizing conveyor free fall height, truck tarping, and the like). The resultant fugitive PM emissions are expected to be minimal.

       The Department's review of the information contained in the application indicates that the modified coal processing plant will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12 and the requirements of Subpart Y of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.250--60.254. Based on this finding, the Department intends to approve the application and issue plan approval for the respective modification.

       The following is a summary of the conditions the Department proposes to place in the plan approval to ensure compliance with all applicable regulatory requirements:

       1.  No more than 490,000 tons of coal shall be processed in any 12 consecutive month period.

       2.  The crusher/screen shall be enclosed except for the feed and discharge openings which shall be equipped with rubber curtains.

       3.  A water truck equipped with a pressurized spray bar and a pressurized nozzle or hose connection shall be kept onsite at all times and shall be used, as needed, for the control of fugitive dust from plant roadways and stockpile areas.

       4.  Plant roadways shall have a posted speed limit of 15 miles per hour and the plant entrance road shall be tarred and chipped.

       5.  Trucks entering or exiting the plant site via a public roadway shall be tarped unless empty.

       6.  The radial stacker-to-stockpile free fall height shall be kept to a minimum at all times as shall the front-end loader bucket-to-truck free fall height.

       7.  The diesel generator shall not operate at a speed in excess of 2,400 rpm nor shall it operate for more than 4,900 hours in any 12 consecutive month period.

       8.  The NOx and CO emissions from the diesel generator shall not exceed 10.1 and 9.3 grams per horsepower/hour, respectively. The visible air contaminant emissions shall not be equal to, or greater than, 10% for more than 3 minutes in any 1 hour or equal to or greater than 30% at any time.

       9.  Records shall be maintained of the number of tons of coal processed through the plant each month as well as the number of hours the diesel generator operates each month.

       49-302-028A: Catawissa Lumber and Specialty, Inc. (Cemetery Street, Catawissa, PA 17820) for installation of an air cleaning device, a fabric collector, on an existing 12.56 million Btu per hour no. 2 fuel oil and woodwaste-fired boiler at their Paxinos facility in Ralpho Township, Northumberland County.

       The PM emissions from the respective boiler are currently controlled by a cyclone collector which will be retained as a precleaner following the installation of the proposed fabric collector. Although the boiler is legally allowed to emit up to 22 tons of PM per year, the installation of the fabric collector will result in an annual PM emission rate which is only a small fraction of this value.

       The Department's review of the information contained in the application indicates that following the installation of the fabric collector, the boiler will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants, including the PM emission requirements of 25 Pa. Code § 123.11 and the visible air contaminant emission requirements of 25 Pa. Code § 123.41. Based on this finding, the Department intends to approve the application and issue plan approval for the installation of the proposed fabric collector.

       The following is a summary of the conditions the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable regulatory requirements:

       1.  The fabric collector bags shall be made of woven fiberglass with a Teflon finish.

       2.  The fabric collector shall be insulated.

       3.  The existing integral boiler flyash reinjection system collector and cyclone collector shall be retained and used as precleaners for the fabric collector.

       4.  The fabric collector shall be equipped with a spark detection system and fabric collector bypass stack which shall be automatically activated if a spark is detected in the fabric collector inlet. Activation of the bypass stack shall also sound or signal an alarm.

       5.  The fabric collector shall be equipped with instrumentation to monitor the pressure differential across the collector on a continuous basis.

       6.  The air compressor used to supply compressed air to the fabric collector shall be equipped with an air dryer and oil trap.

       7.  The flyash collected in the fabric collector shall be removed from the collector and subsequently handled in a fashion as to prevent the occurrence of fugitive dust emissions.

       8.  Spare fabric collector bags shall be kept onsite.

(214 Industrial Lane, Alum Bank, PA 17110) for a Title V Operating Permit renewal to operate a fiberglass reinforced plastic pultrusion operation along with a chrome electroplating operation facility in West Saint Clair Township, Bedford County. The operations are primary emitters of HAPs. Emissions from the other activities are below significant levels.

       The plant is a major facility and is subject to the operating permit requirements of Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F and G. Furthermore, the facility is subject to 40 CFR Part 60 Subpart VVV and 40 CFR Part 63 Subpart N. Annual facility VOC emissions will be limited to less than 50 tons. The styrene usage will be limited to an average input rate of 1,200 lbs/hr.     COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).        The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

       Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the previously-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

       Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

       To remove the existing structure and to construct and maintain a 20-foot long CM Arch culvert having a clear span of 7.25 feet and an underclearance of 5.25 feet with natural channel bottom in North Branch Blacklick Creek (CWF) located on T-505 (Gwizdak Road) at a point approximately 0.5 mile south of T-504 (Colver, PA Quadrangle N:  13.29 inches; W:  1.58 inches).

       The applicant proposes to remove the existing structure and to construct and maintain a 70.0-foot long precast concrete box culvert having an 18.0-foot wide by 8.0-foot high waterway opening in Zimmer Run on SR 3025, Section 021, Segment 0020, Offset 0000 approximately 0.3 mile northeast of the intersection of U. S. Route 19 and SR 3025 (Krider Road). Zimmer Run is a perennial stream classified as a WWF. The project proposes to directly affect 70 linear feet of stream channel.

       E25-666, Technica Development Corporation for Presque Isle Downs, Inc., 4800 Tramarlac Lane, Erie, PA 16505-1360. Presque Isle Downs Horseracing Facility, in Summitt Township, Erie County, ACOE Pittsburgh District (42°, 4" 20` North Latitude; 80°, 1", 48` West Longitude).

       To conduct the following activities associated with construction of the Presque Isle Downs horseracing facility south of I-90 east of SR 97:

       1.  To fill a total of 8.61 acres of 24 nonexceptional value wetland areas. Project includes the creation of a total of 10.56 acres of replacement wetlands at five areas within the project site.

       2.  To construct and maintain a prefabricated steel truss bridge having three 116.67-foot spans and a maximum underclearance of 23 feet across Walnut Creek (WWF-MF) approximately 3,000 feet upstream of SR 97.

       3.  To construct and maintain a prefabricated steel truss bridge having two 125-foot spans and a maximum underclearance of 15 feet across Walnut Creek approximately 4,800 feet upstream of SR 97.

       4.  To impact a total of approximately 11,808 feet of tributaries to Walnut Creek and elimination of approximately 12.1 acres of floodplain storage as a result of grading and fills associated with site construction, stormwater detention and wetland replacement. Approximately 1,576 feet of new open channel will be created near the north end of the site as part of the relocation of a tributary to Walnut Creek, restoration of approximately 1.79 acres of previously impacted floodplain of Walnut Creek, excavation to provide 11.8 acres of additional floodplain storage and construction of stream bank enhancement at nine locations along Walnut Creek.

       5.  To construct and maintain a 350-foot long reinforced concrete box stream enclosure having two 12-foot wide by 6-foot high waterway openings in the relocated tributary to Walnut Creek approximately 780 feet upstream of its mouth.

       6.  To construct and maintain a 249-foot long reinforced concrete box stream enclosure having two 12-foot wide by 6-foot high waterway openings in the relocated tributary to Walnut Creek approximately 175 feet downstream of the existing railroad line.

       7.  To modify and maintain the existing 50-foot long, 60-inch diameter steel culvert in a tributary to Walnut Creek on Footemill Road approximately 750 feet north of Robison Road.

       8.  To construct and maintain five stormwater outfalls to Walnut Creek and adjoining wetlands.

       9.  To fill an approximately 0.58 acre manmade pond at the northern end of the site.

       10.  To install and maintain sanitary sewer and water lines across Walnut Creek attached to the northern bridge.

       11.  To install and maintain a sanitary sewer line across a tributary to Walnut Creek on the southern end of the site.

       To modify and maintain a total of approximately 600 feet of the channel of a tributary to Wolf Creek to provide flood capacity and erosion protection along the north side of East Water Street between SR 258 and SR 173. Project includes additional remediation to stabilize approximately 550 feet of channel previously modified without a permit and to realign and stabilize an additional 50 feet of channel including riprap, vegetative stabilization, rock vanes and guide rail and fence installation.

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

Richard Merhar, Project Manager, PMC Environmental, Whiteland Business Park, 835 Springdale Drive, Suite 201, Exton, PA 19341-2843 has submitted a revised Final Report (on behalf of Mr. and Mrs. B. Bruce Najaka, Cherokee Drive, Shickshinny Lake, PA 18655) concerning the remediation of soils contaminated with no. 2 fuel oil. The report was resubmitted to document remediation of the site to meet the Statewide Health Standard.

       Teledyne Readco Lot 2A, Spring Garden Township, York County. EPSYS Corporation, 1414 North Cameron Street, Suite A, Harrisburg, PA 17103, on behalf of International Paper Company, 6400 Poplar Avenue, Tower II, 5-023, Memphis, TN 38197 submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with BTEX, PHCs and PAHs. The applicant is seeking attainment of a combination of Statewide Health and Site Specific Standards.

       Former United Piece Dye Works, Spring Garden and Springettsbury Townships, York County. BL Companies, 830 Sir Thomas Court, Harrisburg, PA 17109, on behalf of Spring Garden Township, 558 South Ogontz Street, York, PA 17403-5709, submitted a Remedial Investigation report concerning remediation of site soils, groundwater, surface water and sediment contaminated with PCBs, lead, heavy metals, solvents, BTEX and PAHs. The applicant proposes to remediate the site to meet a combination of the requirements for the Site-Specific and Statewide Health Standards.

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    UNDER ACT 2, 1995

    PREAMBLE 3


    The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the Act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

       For further information concerning the plans and reports, contact the Environmental Cleanup Program Manager in the Department Regional Officer after which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed. BL Companies, 830 Sir Thomas Court, Harrisburg, PA 17109, on behalf of Spring Garden Township, 558 South Ogontz Street, York, PA 17403-5709, submitted a Remedial Investigation report concerning remediation of site soils, groundwater, surface water and sediment contaminated with PCBs, lead, heavy metals, solvents, BTEX and PAHs. The applicant proposes to remediate the site to meet a combination of the requirements for the Site-Specific and Statewide Health Standards. The report was approved by the Department on March 31, 2003.

    FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

       The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

The modifications will include regrading the dam embankment to a uniform elevation, armoring the emergency spillway with concrete block mats, installing a stone drain along the downstream embankment toe and repairing the principal spillway structure. Modifications will lower the normal pool 6 to 9 inches below the level maintained in recent years. The dam is located across a tributary to Beaver Creek (EV) approximately 2,000 feet north of the intersection of T425 and T485 (Frenchtown, NJ-PA Quadrangle N:  2.60 inches; W:  15.65 inches).

    Public Hearing on the East Penn Sanitation, Inc. Major Permit Modification Application Lower Nazareth Township, Northampton County

       The Department of Environmental Protection will conduct a public hearing to solicit comments on East Penn Sanitation, Inc.'s Major Permit Modification Application, ID No. 101358, which consists of the implementing of a Radiation Monitoring Plan, an increase in the daily capacity and the incorporation of rail transportation at this municipal waste transfer station located in Lower Nazareth Township, Northampton County.
