       By letter dated December 12, 2008, the Department of Environmental Protection provided a written response to the United State Environmental Protection Agency (EPA) regarding certification under section 401 of The Clean Water Act with respect to the draft EPA NPDES Vessel General Permit for Discharges Incidental to the Normal Operation of Commercial and Large Recreational Vessels. The response granted such certification subject to certain conditions.

       Notice of the draft General Permit was published at 73 FR 34296 (June 17, 2008). A notice of the final General Permit was published at 73 FR 79473 (December 29, 2008). The General Permit, which became effective February 6, 2009, generally applies to discharges incidental to the normal operation of vessels that are greater than 79 feet in length into waters of the United States.
