General Permit Number WMGR123. The Department of Environmental Protection (Department) has reissued revised general permit WMGR123, which authorizes the processing and beneficial use of processed liquid wastes generated on oil and gas well sites and associated infrastructure. The general permit identifies other waters eligible for processing and beneficial reuse under the permit including contaminated water from well sites, transmission line construction operations and facilities authorized to operate under this permit. The general permit also identifies specific water quality criteria that, if met, will not require the processed water to be stored in impoundments, tanks or containers that meet the residual waste requirements prior to future use as make up water for hydraulic fracturing or other oil and gas well development activities.
This action merges three existing permits (WMGR119, WMGR121 and WMGR123) into one permit WMGR123, providing clarity for the regulated community, general public and the Department.
WMGR123 encourages the reuse of liquid wastes generated on oil and gas well sites and related infrastructure through a closed loop process that allows the return of treated liquid waste to oil and gas well sites for reuse, thereby minimizing water withdrawals and impacts on this Commonwealth's valuable water resources. Solids generated by the treatment process are residual wastes and must be managed in accordance with the residual waste regulations.
General Permit Number WMGR123 was amended and General Permit Numbers WMGR119 and WMGR121 were revoked.
