    APPLICATIONS

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the Field Office indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Field Office of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Managers will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the Field Office indicated above the application.

       This application is for renewal of an NPDES permit to discharge treated sewage from the City of Duquesne Sewage Treatment Plant in the City of Duquesne, Allegheny County.

       The following effluent limitations are proposed for discharge to the receiving waters, known as the Monongahela River, which are classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Western Pennsylvania Water Company located on the Monongahela River.

       Other Conditions:  Outfalls 002 through 005 which discharge to the receiving waters, known as Monongahela River and Thompson Run, serve as combined sewer overflows necessitated by stormwater entering the sewer system and exceeding the hydraulic capacity of the sewers and/or the treatment plant and are permitted to discharge only for such reason. There are at this time no specific effluent limitations on the outfalls.

       PA 0031313.  Sewage, Brownsville Area School District, R. D. 1, Route 40 East, Grindstone, PA 15442.

       This application is for renewal of an NPDES permit to discharge treated sewage from the Colonial Elementary School Sewage Treatment Plant in Redstone Township, Fayette County.

       The following effluent limitations are proposed for discharge to the receiving waters, known as unnamed tributary of Colvin Run, which are classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first downstream potable water supply intake from this facility is the Pennsylvania American Water Company on the Monongahela River.

Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain limitations set forth in the permit and special conditions. These proposed determinations are tentative. Limitations are provided in the permit as erosion and sedimentation control measures and facilities which restrict the rate and quantity of sediment discharged.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement to the Regional Office or County Conservation District Office indicated as the responsible office, within 30 days from the date of this public notice. A copy of the written comments should be sent to the County Conservation District Office. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Regional Office of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Regional Office considers the public response significant.

       Following the 30-day comment period, the Water Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealable to the Environmental Hearing Board.

    Reasonably Available Control Technology; Public Hearing

       The Department of Environmental Protection has made a preliminary determination to approve a Reasonably Available Control Technology (RACT) Plan and an amendment to the State Implementation Plan (SIP) for a paperboard mill owned and operated by Stone Container Corporation at 423 Kings Mill Road, York, York County.

       The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in RACT Operating Permit No. 67-2002 for the existing paperboard mill to comply with current regulations. Upon final approval of the company's case-by-case analysis, the permit will contain emission limits on the mill's boilers. Additional permit conditions will require verification of these limits through recordkeeping and reporting of operating hours, fuel consumption and NOx emissions.

    MINING ACTIVITY APPLICATIONS

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).        Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa.        Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

    Request for Variance

       The Bureau of Deep Mine Safety has received a request for variance from Valley Coal Company. The following notification contains a summary of this request. Complete copies of the variance request may be obtained from Glen Ziegler by calling (717) 787-1376.

       The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice.        Section 702 of The Bituminous Coal Mine Act (52 P. S. §§ 701--702) provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

       Section 242(c) of The Bituminous Coal Mine Act requires that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

       Summary of the Request: Valley Coal Company is proposing to incorporate a rail system for transporting personnel and supplies to the working sections of the 6-West Mains. The rail system entry would be established in an entry adjacent to the belt entry. Both entries would maintain common intake air, isolated from the primary intake and return entries.

       The following Dam and Safety and Encroachment permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department).

       In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a United States Army Corps of Engineers (ACOE) permit. Section 401(a) of the Federal Water Pollution Control Act requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1301--1303, 1306 and 1307, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the BDWW permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Bureau or Field Office indicated as the responsible office.

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (DEP) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address, telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Managers will make a final determination regarding the proposed permit action. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The permit renewal application and related documents, proposed effluent limitations and special conditions, comments received and other information are on DEP's file.        The approved Act 537 Planning Revision provides for the abatement of extensive onlot sewerage problems in portions of Portage Township to the northeast of Portage Borough through the construction of an interceptor and collection system. Treatment is to be provided at the Portage Area Sewer Authority Sewage Treatment Plant.

       Portage Township and the Portage Area Sewer Authority propose to use Pennsylvania's State Revolving Fund administered by the Pennsylvania Infrastructure Investment Authority (PENNVEST) to construct these sewerage facilities. The Department's review of the Sewage Facilities Update Revision has not identified any significant environmental impacts resulting from this proposal.

These updates address the re-rating of the Authority's Treatment Plant to a daily flow capacity of 2.85 million gallons per day.


    Submission of Final Reports on Attainment of Background and Statewide Health Standards (sections 302(e)(2) and 303(h)(2)).

       The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act, act of May 19, 1995 (P. L. 4, No. 1995-2).

       Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

In the past, wastes containing hazardous substances were disposed throughout the Filmore Site. The Department has determined that response actions are necessary to protect the public health and welfare and the environment at the Filmore Site.

       Lena Kimmel currently owns two parcels within the Filmore Site that cover approximately 0.17 acre. The Department has incurred and will incur response costs because of the hazardous substances that have contaminated these parcels. However, based upon information obtained by the Department, and based upon information certified to by Ms. Kimmel, the Department has determined that Ms. Kimmel did not cause or contribute to the contamination of these parcels or the rest of the Filmore Site. Accordingly, the Department has agreed to settle any claims that it may have against Ms. Kimmel for $3,475 and her consent to access so that the Department, and its designated agents, may conduct response actions at the parcels owned by Ms. Kimmel.

       The specifics of the Department's settlement with Ms. Kimmel are set forth in the Consent Order and Agreement. The Department will receive and consider comments relating to the Consent Order and Agreement for 60 days from the date of this Public Notice. The Department may withdraw its consent to the settlement with Ms. Kimmel if the comments concerning the Consent Order and Agreement disclose facts or considerations which indicate that the settlement is inappropriate, inadequate or not in the public interest. The Department's settlement with Ms. Kimmel shall become final upon the filing of the Department's response to any significant comments that it receives during the 60-day public comment period.

    Notice of Settlements Under the Hazardous Sites Cleanup Act

    Industrial Solvents and Chemical Company Site
    Newberry Township, York County

       The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has entered into eight proposed consent decrees regarding the Department's costs incurred for response activities at the Industrial Solvents and Chemical Company (ISCC) site. The proposed consent decrees have been entered into with Biddle Sawyer Corporation (Biddle), Quebecor Printing Memphis Inc. (Quebecor), Verla International, Ltd. (Verla), Dynamics Corporation of America (Dynamics), Specialty Screw Machine Products, Inc. (Specialty), American Inks and Coatings Corporation (American), Stambaugh's Air Service, Inc. (Stambaugh's), and various departments and agencies of the United States (United States), all defendants in Pennsylvania Department of Environmental Protection v. Reeves Hoffman Div./Dynamics Corp. of America, et al., 1:CV-95-0499 (M.D. Pa.) and were lodged with the Court during the 60-day comment period required by section 1113 of HSCA, (35 P. S. § 6020.1113).

       The ISCC site is a 9-acre parcel of land in Newberry Township, York County, adjacent to Interstate 83. The surrounding area is primarily rural, although residential, commercial, and industrial developments are located within a close vicinity of the site. A number of private residential wells have been contaminated by hazardous substances migrating from the ISCC site.

       ISCC was involved in the reprocessing of used solvents. Because of violations of hazardous waste requirements, the Department on July 6, 1989, terminated ISCC's authority to operate a hazardous waste treatment and storage facility. The site was abandoned in 1990 when ISCC declared bankruptcy. A total of 996 potentially responsible parties for the hazardous substances located at the ISCC site were identified by the Department.

       Because of the threat to human health and the environment posed by the ISCC site, the site was placed on the Pennsylvania Priority List for Remedial Response on October 26, 1991. The Department and a group of approximately 136 cooperating potentially responsible parties have conducted a number of interim actions at the site to address the release or threat of release of hazardous substances. To date, the Department has incurred costs of approximately $2.7 million to implement and/or oversee these interim actions. A final remedial action for the groundwater and soil at the ISCC site will be selected by the Department and implemented in the future.

       The proposed consent decree with Biddle was lodged with the Federal District Court for the Middle District of Pennsylvania on February 22, 1996. Under the terms of this consent decree, Biddle will pay the Department a total of $288,116 over a 3-year period to reimburse the Department for its past costs at the ISCC site. The proposed consent with Quebecor was lodged with the Court on March 5, 1996. Under the terms of this consent decree, Quebecor will pay the Department $133,121 to reimburse the Department for its past costs at the ISCC site.

       The proposed consent decree with Dynamics was lodged with the Court on March 8, 1996. The proposed consent decrees with Verla, Specialty, American, and Stambaugh's were lodged with the Court on March 12, 1996. Under the terms of these consent decrees, Verla will pay $87,565, Dynamics will pay $359,033 over 2 years, Specialty will pay $135,401, American will pay $93,670 over 5 years, and Stambaugh's will pay $40,859 to reimburse the Department for its past costs at the ISCC site.

       The proposed consent decree with the United States was lodged with the Court on March 12, 1996. Under the terms of this proposed consent decree, the United States will pay $500,000 to the Department to resolve its liability for the Department's past and future costs at the ISCC site, as well as for natural resource damages.

       This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). The Department will respond to any significant written comments and request that the Court take appropriate action regarding the proposed consent decrees. The proposed consent decrees that contain the specific terms of the proposed settlements are available for public review and comment.     Notice of Prompt Interim Response Under the Hazardous Sites Cleanup Act

    Lackawanna County

       The Department of Environmental Protection (Department) under the authority of the Hazardous Sites Cleanup Act (HSCA), act of October 18, 1988, initiated a prompt interim response (response) at the Windship Road Drum Site (Site). The site is located along a private roadway off of Windship Road near Route 307, in Covington Township, Lackawanna County.

       On February 26, 1995, Department personnel inspected the site subsequent to a citizens report that several drums of unknown material were discovered as a result of some excavation activities performed during the cleanout of a drainage culvert. During the inspection, six drums, exposed or partially exposed, were noted. A subsequent investigation by the Department, using metal detection instrumentation, indicated the probable presence of additional buried drums. The site is located directly adjacent to a commercial property as well as several residences. A small stream runs along the eastern edge of the site into a wetland approximately 200 feet south of the site.

       After determining that the Site constituted a substantial threat to public health and safety and the environment, the Department initiated a response at the site on February 28, 1996. The prompt action interim response chosen by the Department consisted of excavation of drums, re-packaging, chemical analysis, temporary storage and final disposal at an approved facility. A total of 56 drums, as well as 1 small container, were discovered during the response. The Department also considered taking no action at the site. However, due to the imminent threat to human health and safety and the environment, this option was rejected by the Department.

       The administrative record contains information which was used as the basis for the decision to conduct the response at the site. The administrative record will be available for public inspection from 8 a.m. to 4 p.m., Monday through Friday, at the Department's Northeast Regional Office located at 2 Public Square, Wilkes-Barre, PA 18711.

       Written comments concerning the response or information in the administrative record will be accepted in person, if delivered, or by mail, if postmarked, on or before June 21, 1996 to the attention of Joseph Iannuzzo, Project Officer--Hazardous Sites Cleanup Program, at the Northeast Regional Office address.

       Additionally, the public will have an opportunity to present oral comments at a public hearing. The public hearing has been scheduled for May 16, 1996, at 7 p.m. at the Covington Township Municipal Building.
