Title 25--ENVIRONMENTAL PROTECTION DEPARTMENT OF ENVIRONMENTAL PROTECTION [25 PA. CODE CH. 93] Corrective Amendment to 25 Pa. Code § 93.9x [38 Pa.B. 1357]
[Saturday, March 22, 2008]The Department of Environmental Protection has discovered a discrepancy between the agency text of 25 Pa. Code § 93.9x (relating to Drainage List X) as deposited with the Legislative Reference Bureau and the official text published at 30 Pa.B. 6059, 6106 (November 18, 2000), and the text published in the Pennsylvania Code Reporter (Master Transmittal Sheet No. 315) (February 2001), and as currently appearing in the Pennsylvania Code. The text which appeared at 30 Pa.B. 6106 inaccurately reflected the description of the zone for Lake Erie (Outer Erie Harbor and Presque Isle Bay).
Therefore, under 45 Pa.C.S. § 901: The Department of Environmental Protection has deposited with the Legislative Reference Bureau a corrective amendment to 25 Pa. Code § 93.9x. The corrective amendment to 25 Pa. Code § 93.9x is effective as of November 18, 2000, the date the defective official text appeared in the Pennsylvania Bulletin.
The correct version of 25 Pa. Code § 93.9x appears in Annex A, with ellipses referring to the existing text of the drainage list.
