    NPDES APPLICATIONS

    PART I PERMITS

       Pursuant to the Federal Clean Water Act and the Pennsylvania Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I below, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For all new permit applications, renewal application with major changes or applications for permits not waived by EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II below. These determinations are published as proposed actions for comments prior to taking final actions.

       Unless indicated otherwise below, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated above the application.

       The receiving stream, West Run, is in watershed 16-F and classified for: high quality cold water fish, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply considered during the evaluation is the Emlenton Water Company on the Allegheny River located at Emlenton, approximately 79.6 miles below point of discharge.

       The draft discharge limitations are based on either Best Available Treatment (BAT) or Best Conventional Treatment (BCT) as defined by the promulgated effluent limitation guidelines, Best Professional Judgment (BPJ), Water Quality based on criteria in Chapter 93 (WQ-93), Water Quality based on criteria in the Department's Chapter 16 (CH-16), monitoring only (MO) in order to develop a firmer database for future evaluation, discharge standards based on Chapter 97 (CH-97), or other requirements as identified in a subnote to the outfall (subnote). The basis of the following permit limits are identified in the parenthesis beside each parameter.

For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply considered during the evaluation is the Camp Allegheny Intake on Slippery Rock Creek located at Wayne Township, Lawrence County, approximately 11 miles below point of discharge.

    PART II PERMITS

       The following permit applications or requests for plan approval have been received by the Department of Environmental Protection (Department).

       Persons wishing to comment on any of the applications are invited to submit a statement to the office noted above the application within 15 days from the date of this public notice. Comments received within this 15-day comment period will be considered in making the final decision regarding the application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

       The Department reserves the right to hold a public hearing if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation of the area. If no hearing is held, the Department's Water Management Program Manager will make a final determination regarding the applications after a complete review. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       A copy of the permit application or proposed plan is on file in the office indicated and is open to public inspection. Appointments to review the application may be made by contacting Records Management at the indicated telephone number.


    Industrial Waste and Sewerage Applications Under The Clean Streams Law (35 P. S. §§ 691.1--691.1001).

    NPDES Stormwater Individual Permit

       The following parties have applied for an NPDES permit to discharge stormwater associated with a construction activity into waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions.     LAND RECYCLING AND ENVIRONMENTAL REMEDIATION UNDER ACT 2, 1995

    PREAMBLE 1


    Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified below. During this comment period the municipality may request that the person identified below, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The fabric coating and curing operation consists of a roll coater and associated dryer, a curing oven and ancillary equipment (mixers, churns, paint mill, etc.) which are used to apply rubber compounds to various fabric substrates. The resultant volatile organic compound emissions are controlled by a thermal oxidizer which has been demonstrated, via stack testing, to have a volatile organic compound destruction efficiency in excess of the 95% required by Plan Approval 47-318-009. The volatile organic compound emission rate determined to have existed during the respective stack testing was less than .5 pounds per hour.

       The Department of Environmental Protection has determined that the respective fabric coating and curing operation was constructed, and is operating, in conformance with all conditions contained in Plan Approval 47-318-009 as well as in compliance with all applicable requirements contained in Article III of the Rules and Regulations of the Department of Environmental Protection. The Department of Environmental Protection consequently intends to issue an operating permit for the fabric coating and curing operation.

       The Department intends to place conditions in the operating permit to be issued which are intended to assure continued compliance with all applicable requirements as well as require appropriate monitoring, testing, record keeping and reporting. The following is a summary of these conditions:

       1.  The thermal oxidizer shall maintain a minimum oxidizer chamber outlet temperature of 1400° F at all times.

       2.  The thermal oxidizer shall be equipped with an oxidizer chamber outlet temperature monitoring and recording system.

       3.  100% of the volatile organic compounds emitted from the fabric coating and curing operation shall be captured and ducted to the thermal oxidizer and at least 95% of the volatile organic compounds ducted to the thermal oxidizer shall be destroyed therein.

       4.  The only cleaning solvent that shall be used is d-limonene except that up to 52 gallons of ethyl alcohol may be used per year. The thermal oxidizer shall be operational whenever cleaning solvent is in use.

       5.  The fabric coating and curing operation shall be retested by no later than January 31, 2005.

       6.  Records shall be maintained of all surface coating material and cleanup solvents used in the fabric coating and curing operation and shall be submitted to the Department on a calendar quarter basis.

    NOTICE OF INTENT TO ISSUE A PLAN APPROVAL AND AMEND A TITLE V OPERATING PERMIT

       Under 25 Pa. Code §§ 127.1 and 127.11, the Department of Environmental Protection (DEP) intends to issue a plan approval to Agere Systems Inc. (William R. Knolle, Air Quality Engineer, 555 Union Blvd., Allentown, PA 18103) for their plant in Allentown, Lehigh County. The facility currently has a Title V Operating Permit No. 39-00001. The plan approval includes terms and conditions to assure the proper operation of the sources, which satisfy the state and federal requirements. It includes, at a minimum, the conditions related to source description, emissions limits for pollutants, monitoring, recordkeeping and reporting, temporary operations to facilitate shakedown and temporary operation period. This plan approval will be incorporated into the Title V Operating Permit through an administrative amendment at a later date.

       Plan Approval No. 39-313-044 is for operation of VOC emitting sources. The emissions from the sources will be controlled by a carbon adsorption and condenser and shall have a Plantwide Applicability Limit of 87.7 tons of VOC per year. Although the sources covered by this plan approval may be located at a major facility, the installations/ modifications do not trigger major new source review or prevention of significant deterioration requirements.

       Northwest Region:  Air Quality Program, 230 Chestnut Street, Meadville, PA 16335-3481.

       Under 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Department of Environmental Protection (DEP) intends to issue a plan approval to American Refining Group (77 North Kendall Avenue, Bradford, PA 16701) for their plant in the city of Bradford, McKean County. The facility currently has a Title V Operating Permit No. 42-00004, which was issued November 13, 2000. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V Operating Permit through an administrative amendment at a later date.

       The application is for an Isomer Unit that will take Light Straight Run (LSR) feed from the existing naphtha fractionator unit and treat it with platformer gases to boost the octane value of the LSR. The design maximum processing rate for the LSR is 1000 barrel per day. This process will not cause an increase in production nor will it cause an increase in emissions for any other process. The only emission point in this unit will be a natural draft gas fired heater. The draft is adjusted manually. There will be a number of potential fugitive emission points due to potential equipment leaks. There are two relief valves on the recycle gas system for protection of equipment. All relief valves will be connected to flare header such that any release that occurs at the startup, shut down, or upset, will be passed through the refinery flare. The fuel usage and emissions for natural gas and refinery gas are based on continuous operation of 8,760 hours per year. This source is subject to Federal NSPS Regulations, 40 CFR Part 60, Subpart J Standards of Performance for Petroleum Refineries. The applicable refinery gas is low sulfur fuel (<162 ppm). Subpart J requires the facility to comply with the H2S emission limit of 0.10 gr/dscf for the refinery fuel gas. The facility has proposed using an existing H2S CEMS monitoring the low sulfur stream from the stabilizer unit and achieve compliance with the requirements of Monitoring of Emissions and Operations (Subpart J Section 60.105). The refinery already implements LDAR for the equipment leaks. The new isomerization unit will be covered by the same program. There are no process vents associated with this unit. Existing storage vessels will be utilized for feed and product storage.

       Under 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Department of Environmental Protection (DEP) intends to issue a plan approval to Ellwood Quality Steels Company (700 Moravia Street, New Castle, PA 16101) for their plant in the City of New Castle, Lawrence County. The facility currently has a Title V Operating Permit issued December 27, 1999. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V Operating Permit through an administrative amendment at a later date.

       This plan approval application is for modification of Furnace No. 17. The modification will remove the existing 1942 vintage burners and controls and replace them with new burners and controls, which will utilize low NOx technology. The overall NOx emissions are expected to drop from 12.3 tpy to 4.6 tpy.

    MINING ACTIVITY APPLICATIONS


    Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); The Coal Refuse Disposal Control Act (52 P. S. §§ 30.51-30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

       The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

       Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

       Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settable solids, alkalinity, and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

       Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Discharge of dredged material from the East Avenue Launch Ramp into the Lake Erie Harbor Confined Disposal Facility, in Erie City, Erie County, ACOE Pittsburgh District, Erie North, PA. Quadrangle N:  4.7 inches; W: 10.3 inches).

       Project description: The Erie-Western Pennsylvania Port Authority has requested a State certification under Section 401(a) of the Federal Clean Water Act (33 U.S.C.A. § 1341(a)) discharge of dredged material from the East Avenue Launch Ramp into the Lake Erie Harbor Confined Disposal Facility (CDF) will comply with the applicable provisions of Sections 301--307 of Federal Clean Water Act.

       This request was necessitated by conditions imposed by the Department's Water Obstruction and Encroachment Permits E25-404A and E25-581 issued to the Erie-Western Pennsylvania Port Authority requiring Federal Water Act Section 401 certification for the disposal of dredged material into the CDF prior to each dredging and disposal event. The Erie-Western Pennsylvania Port Authority has sampled and tested the sediments in accordance with Attachment A ''Sample Collection and Testing Protocol'' of both Water Obstruction and Encroachments Permits E25-404A and E25-581. Laboratory testing was conducted in accordance with the US Army Corps of Engineer's Inland Testing Manual and the document ''Ecological Evaluation of Proposed Discharge of Dredged or Fill Material in Navigable Waters.'' Based upon this sampling and laboratory testing, the Erie-Western Pennsylvania Port Authority indicates that the approximately 500 cubic yards of basin sediments from the East Avenue Launch Ramp (Erie North, PA N: 3.6 inches; W: 8.9 inches) discharged into the Lake Erie Harbor Confined Disposal Facility (Erie North, PA N: 4.7 inches; W: 10.3 inches) will have a relatively insignificant impact on the water quality of Lake Erie. This 401 Water Quality Certification is only for this single activity. Any subsequent dredging of the East Avenue Launch Ramp basin and use of the CDF will require separate 401 Water Quality Certification.

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION UNDER ACT 2, 1995

    The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.        Parkesburg Manufactured Gas Plant Site, PECO Energy Co., Parkesburg Borough, Chester County. Frederick C. Gloeckler, PECO Energy, 2301 Market St., S21-2, Philadelphia PA 19101, on behalf of PECO Energy Co., has submitted a Cleanup Plan concerning the remediation of site soil and groundwater contaminated with heavy metals, BTEX and polycyclic aromatic hydrocarbons. The report was approved by the Department on February 26, 2001.

       Former Friendship Automotive, Gunnar Properties, Inc., Caln Township, Chester County. James H. Mulry, P.G., Mulry & Cresswell Environmental, Inc., 1691 Horseshoe Pike, Suite 1, Glenmoore PA 19343, on behalf of Gunnar Properties, Inc., 399 E. Market St., West Chester PA 19380, has submitted a Baseline Remedial Report concerning remediation of site soil contaminated with lead, BTEX, MTBE and naphthalene and site groundwater contaminated with BTEX, MTBE and naphthalene. The report was approved by the Department on February 27, 2001.

       Former Ennis Oil & Burner Service Terminal, Chester Heights, Delaware County. Charlene R. Drake, ReAct Environmental Services, Inc., 6901 Kingsessing Ave., Philadelphia PA 19142, on behalf of James R. and David Ennis Partnership, Route 1 and Valleybrook Rd., Chester Heights PA 19017, has submitted a Final Report concerning remediation of site soil contaminated with benzene, and site groundwater contaminated with lead, benzene, Dichloroethane 1, 2 and ethylene dibromide. The report demonstrated attainment of the Statewide Health Standard and was approved by the Department on February 28, 2001.

       Northeast Region: Environmental Cleanup Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

       Eugene Lecher Property, Great Bend Township, Susquehanna County. David R. Crowther, Project Manager, Hydrocon Services, Inc., 2945 South Pike Avenue, Allentown, PA 18103 submitted a Final Report (on behalf of his client, Eugene Lecher, RD 1, Susquehanna, PA 18821) concerning the remediation of site soils and groundwater found or suspected to have been contaminated with kerosene.        Primages Property (203 Charles Street), Coopersburg Borough, Lehigh County. All Phase Environmental Services, Inc, 131 Technology Drive, Bethlehem, PA 18015 submitted a Final Report (on behalf of their client, Paul Chernay, 7483 South Main Street, Coopersburg, PA 18036) concerning the remediation of site soils contaminated with no. 2 fuel oil and waste oil. The report documented attainment of the Statewide health standard and was approved on February 28, 2001.

       Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

       PPL Distribution Pole 40258S26257 (Site 115), City of Lancaster, Lancaster County. PPL Generation, LLC, Two North Ninth Street, Allentown, PA 18101-1179 submitted a Final Report concerning the remediation of site soils contaminated with PCBs. The Final Report demonstrated attainment of the Statewide health standard and was approved by the Department on February 21, 2001.

       Adele M. Keech Estate, Berwick Township, Adams County. Herbert Rowland & Grubic, 116 Baltimore Street, Gettysburg, PA 17325 on behalf of Adele M. Keech Estate, c/o Allfirst Bank, Executor, 213 Market Street, Harrisburg, PA 17105 submitted a combined remedial investigation and final report concerning the remediation of site soils and groundwater contaminated with BTEX and PHCs. The report demonstrated attainment of a combination of the Statewide health and site-specific standards, and was approved by the Department on February 22, 2001.

       Penn Fuel Gas, Inc., Shippensburg Borough, Cumberland County. Key Environmental, Inc., 1200 Arch Street, Suite 200, Carnegie, PA 15106 on behalf of Penn Fuel Gas, submitted a remedial investigation report concerning the remediation of site soils and groundwater contaminated with lead, BTEX, PAHs and phenolic compounds. The report was approved by the Department on February 22, 2001.

    REQUEST FOR INFORMATION FROM QUALIFIED CONTRACTORS

    OPERATION AND MAINTENANCE OF AMD TREATMENT SYSTEMS

       The Bureau of Abandoned Mine Reclamation (BAMR) is seeking qualified contractors to provide the services needed to maintain interim treatment of acid mine drainage (AMD) discharges. This work will include the operation and maintenance of existing AMD treatment systems as well as the operation and maintenance of new or supplemental systems designed and constructed under BAMR authority. This work will be performed in the anthracite and bituminous coal fields of Pennsylvania.

       Contractors should submit information that describes their personnel qualifications, direct experience and geographical areas of interest. This information must be submitted to BAMR on or before 2 p.m., April 25, 2001. BAMR will maintain a list of qualified contractors, grouped by geographical area of interest as well as the type of active or passive AMD treatment systems they are qualified to operate and maintain. This list will be used in one of two ways. If a need arises because of circumstances constituting an emergency as described in Section 516 of the Commonwealth Procurement Code, one or more qualified contractors may be selected from the list of qualified firms without competitive bid and issued a contract for the short-term. The second way the list may be used is to invite qualified contractors, and other interested firms, to participate in the Request for Proposal process if a contractor is needed to operate and maintain the site for the long-term.

       The types of AMD treatment systems that will require operation and maintenance have not yet been specifically identified. Generally, most of the work will include active treatment systems such as, but not limited to, the following:

       *  Lime slurry

       *  Pebble lime slurry

       *  Calcium oxide

       *  Caustic soda flush or drip

       *  Soda ash briquettes

       *  Hydrated lime Many of these systems will require the operation and maintenance of facilities such as mixing systems, slurry storage tanks, clarifiers, pumps, retention dams and wells. Any well-developed technologies for active AMD treatment systems may be considered, as will well-developed technologies for passive AMD treatment systems. The types of passive AMD treatment systems include, but are not limited to, the following:

       *  Limestone beds

       *  Aerobic wetlands

       *  Anoxic limestone drains

       *  Vertical flow systems

       *  Semi-active dosing systems

       Any combination of active and passive AMD treatment systems may also be considered.

       The information to be submitted to BAMR includes the contractor's personnel qualifications, direct experience, and geographical areas of interest. Include the number of professional personnel such as analysts, auditors, researchers, programmers, consultants and others who may be engaged in the work. For each personnel listed, include education and experience in geology, engineering, mine water treatment and abatement. Indicate the responsibilities each will have and how long each has been with your company. Include experience in the operation and maintenance of AMD treatment systems as well as acid mine water prevention, abatement and treatment and the design of AMD mitigation projects. Experience shown should be work done by individuals who will be assigned to this work as well as that of the company. Identify studies or projects referred and for customers, provide the name, address, and telephone number of the responsible official, customer, company, or agency. Include the geographical areas that your company is interested in doing work. Geographic areas are those covered by five District Offices in the Bureau of District Mining Operations. The District Offices included are Cambria, Greensburg, Hawk Run, Knox, and Pottsville. To remove the existing structure and to construct, operate and maintain a new single span bridge structure over the South Branch of Towanda Creek 58 feet downstream of the existing structure. The new structure shall have a 95 foot span, a roadway width of 28 feet and an underclearance of 13 feet. This permit also authorizes the filling of .05 acres of wetland and the installation of four in-stream water deflectors. The in-stream structures will be located 80 feet upstream of the bridge, 15 feet, 120 feet, and 240 feet downstream of the bridge as measured on the centerline of the South Branch of Towanda Creek. Plantings shall be planted according to the approved planting schedule to include the restoration of the impacts from the removed bridge and the impacts to the wetland fills.

       E14-375. SEDA-COG Joint Rail Authority, R. R. 1, Box 372, Lewisburg, PA 17837.        All construction of in-stream structures and stream restoration shall be completed in dry work conditions through dam and pumping or fluming stream flow around work area. All rock materials used for in-stream work shall be free of fines and silts. The project will permanently impact 0.36-acre of wetland and 600-feet of waterway. The 600-feet of waterway impacted by the activities authorized by this permit shall be successfully mitigated by 0.12-acre of stream restoration. The permittee must replace 0.44-acre of wetland for the permanent impact of 0.36-acre by making a monetary contribution to the National Fish and Wildlife Foundation, Pennsylvania Wetland Replacement Project, ID Number 95-096. The permittee shall make a minimum contribution to the Pennsylvania Wetland Replacement Project of seven thousand five hundred dollars ($7,500) or the current monetary contribution required to construct 0.44-acre of wetland by the National Fish and Wildlife Foundation. The monetary contribution for wetland replacement must be submitted to the Department prior to commencement of any construction activity authorized by this permit. The stream restoration shall be completed prior to commencement of any construction activity authorized by this permit. The project is located along the western right-of-way of SR 0550 approximately 5,000-feet north of Upper Gyp Road and SR 0550 intersection in Benner and Spring Townships, Centre County.

       E14-377. Aaronsburg Water Pipes, Inc., P. O. Box 234, Aaronsburg, PA 16820. Filtration Plant, in Haines Township, Centre County, ACOE Baltimore District (Millheim, PA Quadrangle N:   6.7 inches; W:   10.3 inches). Big Run channel realignment, in Decatur Township, Clearfield County, ACOE Baltimore District (Houtzdale, PA Quadrangle N:   18.7 inches; W:   4.6 inches). To realign and maintain the channel of Big Run; remove an existing structure; and construct, operate and maintain a single cell box culvert to carry SR 0053, Section A06 across Big Run to improve public highway safety. The Big Run channel realignment shall be limited to a maximum length of 40-feet that shall include rock stream bank stabilization. The pre-cast reinforced concrete box culvert shall be constructed and maintained with a minimum span of 12-feet, rise of 6-feet, and skew of 86°. The project is located along SR 0053 approximately 1.1-miles west of SR 0970 and SR 0053 intersection in Decatur Township, Clearfield County. This permit also authorizes the construction, operation, maintenance and removal of a temporary stream diversion. All construction and realignment activity shall be conducted when Big Run is at maximum seasonal low flow. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E19-172. Millville Municipal Authority, P. O. Box 30, Millville, PA 17846. Wastewater treatment facility in floodplain, in Millville Borough, Columbia County, ACOE Baltimore District (Millville, PA Quadrangle N:   20.5 inches; W:   4 inches). To place 200 ft. x 200 ft. x 8 ft. of fill and wastewater treatment facilities in the floodplain of Little Fishing Creek two blocks west of the intersection of Morehead Avenue and Route 42 in Millville Borough, Columbia County.        E55-171. George W. Robinson, P. O. Box 38, Kreamer, PA 17833-0038.        E55-173. Gary L. Eisenhuth, 49 River Rd., Selinsgrove, PA, 17870. Floodway Dwelling, in Monroe Township, Snyder County, ACOE Baltimore District (Sunbury, PA Quadrangle N:  11.5 inches; W:  13.5 inches). The permit proposes to remove the existing 1,574 sf mobile home and construct, operate and maintain a new, elevated 1,560 sf mobile home in the floodway of the Susquehanna River. The new structure will be elevated 2 feet above the 100 year flood elevation atop of a garage. The garage structure will be constructed with garage doors on the upstream and downstream end of the structure in addition to having flood vents surpassing the 1 square inch of vent per one square foot of floor space. This structure will be constructed out of concrete block and reinforced with rebar and poured concrete. The permit also proposes to build a deck at the same elevation as the mobile home.     SPECIAL NOTICES

    Availability of Grants for the Remediation of Waste Tire Piles in Pennsylvania

       The Department of Environmental Protection (Department) hereby announces the availability of grants for fiscal year 2001/2002 for the remediation of six waste tire piles in Pennsylvania. Only the waste tire piles listed below are eligible under this grant offering.

       In order to be considered for a grant, an applicant: 1) must propose to remediate any of the following waste tire piles: Griffin 1, East Providence Township; Bedford County; Griffin 2, East Providence Township, Bedford County; Tire Tread Shredder, Madison Township, Clarion County; Kushak, Menallen Township, Fayette County; Houssock, Fairmount Township, Luzerne County; and Bonner, Hazle Township, Luzerne County; 2) must not have contributed, in any manner, to the creation of a non-compliant waste tire pile; and 3) must have an identifiable end-use for the waste tires to be remediated.

       Grant funds are to be used for activities directly related to the remediation of priority waste tire sites (such as employe wages, operation of equipment, transportation, processing costs, and the like). Grants may not be used for the purchase of equipment and grant recipients shall use funds only for those activities approved by DEP.

       All applicants must complete and submit an official two-part application for each proposed tire pile remediation. The Waste Tire Remediation Grant Application Parts A and B include all the materials and instructions necessary for applying for a grant.     Notice of Public Hearing for NPDES Permit No. PAS107421

       Notice is hereby provided that the PA Department of Environmental Protection (Department) will hold a public hearing to accept comment on an individual National Pollutant Discharge Elimination System (NPDES) Permit Application No. PAS107421 for the discharge of stormwater from construction activities at the proposed wind energy production site (Waymart Wind Farm) in Canaan and Clinton Townships, Wayne County.

       The hearing will be conducted on April 19, 2001 at 7 p.m. in the main courtroom of the Wayne County Courthouse in Honesdale, PA by the PA Department of Environmental Protection, Water Management Program, Soils and Waterways Section, 2 Public Square, Wilkes-Barre, PA 18711, (570) 826-2553. The hearing is in response to an application submitted by National Wind Power, 405 14th Street, Suite 712, Oakland, CA 94612 and published in 31 Pa.B. 1160--1161 (February 24, 2001).     BUREAU OF DEEP MINE SAFETY

    REQUEST FOR VARIANCE

       The Department of Environmental Protection, Bureau of Deep Mine Safety, has received a request for variance from Mon View Mining Company. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

       The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice.        Section 702 of the Pennsylvania Bituminous Coal Mine Act (52 P. S. §§ 701 and 702), provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

       Section 268 (b) states that shelter holes shall be provided on the clearance side along designated travelingways, which are also used as haulage entries, other than belt conveyor haulage entries. Such shelter holes shall be spaced not more than 80 feet apart.

       Summary of the Request: As a result of adverse roof conditions, Mon View Mining Company requests a variance to exceed the 80 feet spacing but not to exceed 137-foot distance through two low cover stream areas in the 2 West Mains (from survey station 2+88 to station 10+08 and from station 28+32 to station 46+68). The maximum shelter hole spacing in these areas would be 137 feet with the majority spaced no more than 110 feet apart.
