[28 Pa.B. 1324] APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT [National Pollution Discharge Elimination System Program (NPDES)] DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER (Part I Permits) The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the Field Office indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Field Office of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the Field Office indicated above the application.

Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges
The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.
The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations Officer indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit action. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER Applications under the Pennsylvania Clean Streams Law (Part II Permits) The following permit applications and requests for plan approval have been received by the Department of Environmental Protection (Department).
Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department at the address indicated above each permit application or plan. Each written protest should contain the following: name, address and telephone number; identification of the plan or application to which the protest is addressed; and a concise statement in sufficient detail to inform the Department of the exact basis of the protest and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given protest or protests. Each commenter will be notified in writing of the time and place if a hearing or conference concerning the plan, action or application to which the protest relates is held. To insure consideration by the Department prior to final action on permit applications and proposed plans, initial protests and additions or amendments to protests already filed should be filed within 15 calendar days from the date of this issue of the Pennsylvania Bulletin. Cyprus Cumberland Resources Corporation (Cyprus)
Cyprus chose a case-by-case approach to meeting the requirements of 25 Pa. Code § 129.92 for the thermal dryer, the frothing operations, solvent cleaning operation, storage tanks and fuel dispensing. Cyprus proposed low NOx burners as add-on controls for the thermal dryers as they were determined to be cost effective through a top-down analysis. Cyprus proposes there are no additional control technologies available for the frothing and degreasing operations. Cyprus proposes to meet the presumptive RACT requirements of 25 Pa. Code § 129.93 for all other sources at this facility.
Cyprus has applied for ERCs for the reduction of 64 tons/year of NOx and 15 tons/year of VOC emissions generated through the shutdown of the thermal dryer at the Cumberland Mine as provided for in 25 Pa. Code § 127.207(5)(I).
United Coaters (Centria) Ambridge Plant
The proposed RACT permit for the Ambridge Plant is for the application of presumptive RACT to the three Cleaver Brooks Steam Boilers, and the operation of an incinerator on the emissions from the coil coating operation. This incinerator will perform with an efficiency adequate to reduce the VOCs emitted from the coating materials employed to a level meeting the requirements of 25 Pa. Code § 129.52. Based upon information supplied by United Coaters and the Department's analysis of that information, the current work practices in the cleanup and paint mixing areas limit solvent emissions to a level for which further environmental benefit will require expenditures beyond the RACT guidelines.
A public hearing will be held to receive comments on the RACT plan and ERC approval. The hearing date is April 8 for Cyprus Resources Corporation and for United Coaters (Centria) at the Department of Environmental Protection Island Conference Room, 400 Waterfront Drive, Pittsburgh. The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the RACT approval for the facility to comply with current regulations.

The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the RACT approval for the facility to comply with current regulations.
The preliminary RACT determination, if finally approved, will be incorporated into an operating permit (OP-60-0006) for the facility and will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan.
The following is a summary of the preliminary volatile organic compound RACT determination for this facility:
* All topcoats and sealers shall comply with the volatile organic compound content limitations specified in the EPA's CTG document ''Control of Volatile Organic Compound Emissions from Wood Furniture Manufacturing Operations.''
* All coatings shall comply with the applicable volatile organic compound content limitations specified in 25 Pa. Code § 129.52 unless the limitations specified in the CTG document are more restrictive in which case, they will supersede the respective § 129.52 limitations.
* Semitransparent wiping and glazing stains shall not contain volatile organic compounds in excess of 6.4 pounds per gallon of coating (minus water) as applied.
* Semitransparent spray stains and toners shall not contain volatile organic compounds in excess of 6.8 pounds per gallon of coating (minus water) as applied.
* The total volatile organic compound emissions from the ''Deburg Line'' shall not exceed 760 tons in any 12 consecutive month period and the total volatile organic compound emissions from the ''Flat Conveyor Line'' shall not exceed 267 tons in any 12 consecutive month period.
* The only solvents to be used in the wash off area and surface coating cleanup operations shall be acetone or other materials which contain no volatile organic compounds or hazardous air pollutants.
* Pennsylvania House shall develop and implement a coating transfer equipment leak inspection and maintenance plan and an operator training program.
* All containers of volatile organic compound-containing materials shall be kept closed when not in actual use.
* The combined volatile organic compound emissions from the facility's combustion sources shall not exceed 14.4 tons in any 12 consecutive month period.
* The volatile organic compound emissions from the lumber drying operation shall not exceed 3 pounds per hour, 15 pounds per day or 2.7 tons in any 12 consecutive month period.

Code § 129.93 for all other sources at this facility. The conditions of the RACT permit as proposed limit facility wide NOx emissions to 191.6 tons/yr. and facility wide VOC emissions to 4.5 tons/year.
AL has applied for ERCs for the reduction of 7.78 tons/year of NOx and 8.7 tons/year of VOC emissions generated through the shutdown of three electric arc furnaces at the Washington Facility as provided for in 25 Pa. Code § 127.207(5)(I).

MINING APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES Applications under the Surface Mining Conservation and Reclamation Act (52 P. Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

Bureau of Deep Mine Safety Request for Variance The Bureau of Deep Mine Safety has approved a request for variance from Cyprus Emerald Resources Corporation. The following notification contains a summary of this request. Complete copies of the variance request may be obtained from Matthew A. Bertovich by calling (724) 439-7469.
Summary of the Request: Cyprus Emerald Resources Corporation requested an increase in shelter hole distances to 150-foot centers for all mains development at the Emerald Mine.
The basis for the Bureau's approval can be summarized in the following statements:
1. Pedestrians will have the right-of-way. All vehicle operators must stop until workers are able to enter shelter hole.
2. Locomotives used to transport supplies or equipment must be of sufficient size (tonnage) to be able to stop their loads within a safe distance.
3. All vehicles will be operated at speeds that will allow controlled stops under prevailing track conditions.
4. Signs shall be posted stating the shelter hole spacing distance.
5. A means of identifying shelter hole locations shall be provided using a reflective indicator/marker which will be visible from along the track haulage travelway. Markers will be of standardized color and design.
6. Crosscuts which are used as shelter holes shall be maintained free of obstructions and debris, other than normal roof-to-ground supports. Clearance will be maintained for a depth of at least 15 feet and the entire width except for roof support.
7. Shelter holes will be maintained at all switch throws and doors.
8. Supply cars and equipment will be pulled by a locomotive in the direction of travel. When it is necessary to push nonpropelled (supply cars, and the like) track haulage equipment, it shall be done only from the last track switch. Trip lights shall be used on the end that does not have locomotive coupled.
9. Workers performing tasks, that is track repair, block repair, and the like, along track haulage roads shall be provided with flashing warning lights. These devices shall be placed in clear view of approaching haulage equipment, but as close as practicable to the work site.
10. All employes and persons entering the mine shall be trained concerning shelter hole procedure and safety precautions.
This approval is limited to a variance from the distance requirements for shelter holes contained in section 268(b) of the Bituminous Coal Mine Act. All other terms and requirements of section 268 shall remain in effect. Continued authorization for operation under the approval is contingent upon compliance with the measures described in the approved plan.
APPLICATIONS RECEIVED UNDER SECTION 401: FEDERAL WATER POLLUTION CONTROL ACT ENCROACHMENTS The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. The Department of Environmental Protection (Department) has completed its review of the Airport Road Act 537 Special Study (Special Study), dated July, 1997 and revised January, 1998 (received by the Department on January 13, 1998), with additional documentation dated October 13, 1997 (received by the Department on October 16, 1997), as prepared by Schumacher Engineering Inc., on behalf of Hazle Township.
The Department's review has found that the Special Study is now acceptable and hereby grants planning approval.
The Hazle Township Municipal Authority (Authority), on behalf of Hazle Township, proposes to implement Alternative No. 1 of the Special Study. Alternative No. 1 proposes the construction of a new wastewater collection and conveyance system to serve limited, specific portions of Hazle Township. The areas to be served by the proposed system are limited to those shown on Drawing No. 1 of the Special Study: the Village of Hollywood including the Woodcrest Estates Subdivision and Holly-Lynn Mobile Home Park, properties adjacent to a portion of the Airport Beltway (SR3026) from SR0309 west to the area of the Wal-Mart Super Center, properties adjacent to Old Airport Road (T-470) and Hess Road (T-499) and the Hazleton Municipal Airport. Construction of the proposed system will occur in two phases. Phase 1 will include all areas except for the Old Airport Road and Hazleton Municipal Airport Areas. Phase 2 will include only the Old Airport Road and Hazleton Municipal Airport Areas.
The wastewater collection and conveyance systems proposed will consist of approximately 13,300 lineal feet of gravity sewer lines and force main along with associated appurtenances. The conveyance system will also include the construction of a 460 gpm wastewater pumping station. The pump station's equipment will be housed in a 45 foot by 25 foot aboveground structure to be constructed along the Airport Beltway. The proposed pump station's force main will discharge its wastewater to an existing manhole located on Liberty Avenue in the Park Crest Subdivision located within Hazle Township. Wastewater will then be conveyed through existing collection and conveyance system lines to the Greater Hazleton Joint Sewer Authority's Wastewater Treatment Facility for treatment and discharge.
Due to the project's construction, the Authority will abandon the existing Hollywood Pump Station. Wastewater from the Hollywood Collection System will be conveyed to the proposed pump station to be constructed adjacent to the Airport Beltway. The project's construction will also allow for the abandonment of the Holly-Lynn Mobile Home Park's Wastewater Treatment Facility. Several commercial establishments, including Lagana's Corporate Center, Affordable Dentures Inc., Rex TV and Appliance Inc, and the Hazleton Municipal Airport, which currently utilize holding tank facilities as their method of wastewater disposal, will be required to properly abandon their holding tanks and connect to the proposed wastewater collection system.
The proposed project will be financed through commercial and residential tapping fees, a capital contribution from the Authority's Capital Improvement Fund and a commercial bank loan obtained by the Authority.
In accordance with the provisions of the Pennsylvania Sewage Facilities Act, 35 P. S. §§ 750.1--750.20(a) (Act 537), and 25 Pa. Code Ch. 71, the Department will hold Hazle Township responsible for the complete and timely implementation of the Special Study's chosen wastewater disposal alternative. Implementation of the Special Study's chosen wastewater disposal alternative must be performed within the time frames indicated in the Special Study's Schedule of Implementation.
Any additional wastewater-related improvements, additions, deletions or changes outside of those explicitly described in the Special Study must be in compliance with the Department's regulations and be submitted to and approved by the Department in writing.
This approval covers only the wastewater planning aspects of the proposed construction project as it relates to Hazle Township's Official Sewage Facilities Plan. Before construction of the proposed project may commence, the Authority must obtain a Part II--Water Quality Management Permit from the Department. A copy of the Special Study's approval correspondence must accompany the permit application when it is submitted to the Department's Northeast Regional Office.

R. 332) at a point approximately 300 feet east of the intersection of Silver Lake Road (Langhorne, PA Quadrangle N: 19.3 inches; W: 3.7 inches) in Newtown Township, Bucks County. E46-770. Encroachment Permit. Hatfield Township, 1950 School Road, Hatfield, PA 19440-1992. To replace the existing deteriorated and inadequate single span Line Lexington Road Bridge which crosses the Unionville Tributary of the West Branch of Neshaminy Creek (WWF-MF). The proposed single span bridge consists of composite prestressed concrete adjacent box beams with reinforced concrete slab superstructure on reinforced concrete cantilever type abutments with appurtenant wing-walls. The 40-foot clear span bridge, will have a 30-foot roadway width with a 5-foot sidewalk, and have 4 feet 10 inches of minimum underclearance. The proposed work also includes placing rip-rap stone protection along the new abutments and wing walls. This bridge is located approximately a half mile southwest of the intersection of County Line Road (S. R. 309) and Line Lexington Road (Telford, PA Quadrangle N: 5.2 inches; W: 2.8 inches) in Hatfield Township, Montgomery County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.
E09-755. Encroachment Permit. Middletown Township, 2140 Trenton Avenue, Levittown, PA 19056-1483. To relocate a reach of an unnamed tributary to Queen Anne Creek (WWF) into a stormwater management basin, to excavate within its assumed 100-year floodway to provide storage capacity and to construct and maintain a 45-foot extension to the upstream end of an existing 24-inch reinforced concrete stream enclosure which will disturb a total of approximately 255 feet of stream and 0.28 acre of wetland. The site is located just north of the intersection of Terrace Road and Trim Road, approximately 1,000 feet southeast of the intersection of Woodbourne Road (SR 2033) and Lincoln Highway (SR 2037) (Langhorne USGS Quadrangle N: 9.1 inches; W: 1.1 inches) in Middletown Township, Bucks County. This permit also approves an Environmental Assessment for the proposed in-stream nonjurisdictional dam. This permit requires the construction of 1.3 acres of replacement wetlands.
E46-786. Encroachment Permit. Pennsylvania Department of Transportation, District 6-0, 200 Radnor-Chester Road, St. Davids, PA 19087-5178. To replace the existing deteriorated Bridge Road (S. R. 1015) steel truss bridge which spans Skippack Creek (TSF) at a point immediately upstream of the Evansburg State Park boundary. The proposed bridge will be constructed at the same location and includes reconstruction and relocation of approximately 650 feet of roadway bridge approaches. The proposed multiple stringer, composite steel deck bridge structure with a 78-foot single span and a minimum underclearance of 10.4 feet will be supported by reinforced concrete abutments. The width of the proposed bridge, will be increased from 16 feet to 34 feet to accommodate two lane automobile traffic. The work also will include placing a rock scour protection along abutment footings and wing walls. The bridge is located approximately 500 feet south of the intersection of Old Forty Foot Road (S. R. 1006) with Bridge Road (Collegeville, PA Quadrangle N: 19.9 inches; W: 0.4 inch) in Lower Salford and Towamencin Townships, Montgomery County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.
