     On September 29, 2009, Rosalyn D. Hutchings, t/d/b/a Glorious Dreams Realty, license nos. AB061495L and RB061495L, of Effort, Monroe County, had her licenses revoked and assessed a $16,000 civil penalty based on her making a substantial misrepresentation; for engaging in conduct during a real estate transaction which demonstrates bad faith, dishonesty, untrustworthiness or incompetence; for failing to deal honestly and in good faith; for failing to maintain deposit moneys in a separate custodial or trust fund account; for misappropriating money that is required to be held in escrow; for failing to account for the $21,000 deposit after being ordered to pay the deposit money into court during civil litigation; for commingling money that is required to be held in escrow with busi-ness, personal or other funds; for failing to put all contracts, commitments and agreements in writing; for performing a service for a consumer of real estate services for a fee, commission or other valuable consideration in the absence of a written agreement, signed by the consumer, setting forth the nature of the service and the fee to be charged; for failing to deposit rents received into a rental management account that is separate from the broker's escrow account and general business accounts; and for failing to account in a timely manner to her client for the security deposit that she collected from her client's tenant.

     This final order represents the final State Real Estate Commissioner's (Commission) decision in this matter. It may be appealed to the Commonwealth Court of Pennsylvania by the filing of a petition for review with that court in accordance with the Pennsylvania Rules of Appellate Procedure. Individuals who take an appeal to the Commonwealth Court, must serve the Commission with a copy of their petition for review.
