[36 Pa.B. 1134] THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

The receiving stream, a UNT to Northeast Creek, is in the State Water Plan watershed 7K and is classified for TSF. There are no public water supply intakes identified downstream on Northeast Creek.

Description of Proposed Activity: This action is to amend the Municipal Separate Storm Sewer System (MS4) NPDES Permit for discharges of storm water from the City of Philadelphia. The MS4 Permit was issued on September 30, 2005. The amendment is a result of an appeal by the City of Philadelphia.
The NPDES Permit allows the City of Philadelphia to discharge stormwater from the city's municipal separate storm sewer system (434 point sources) to Wissahickon, Pennypack, Poquessing, Tacony/Frankford, Cobbs and Monoshone Creeks, the Schuylkill River and Delaware Estuary.
The receiving water bodies are classified for the following uses: TSF (Wissahickon Creek), WWF, aquatic life, water supply and recreation.
The permit has been amended on page 3 (Part I., Section A.1.a.) by inclusion of the following language:
Should the Department or the city determine that such a discharge has occurred, or is occurring, from the city's MS4 system, such discharge shall, by the terms of this permit, constitute an unpermitted discharge, and the city shall take the steps outlined in this paragraph. The city shall conduct a study to determine the source, cause, frequency and severity of such discharge, and shall determine possible actions to address the condition. The study shall be completed, and provided to the Department, within 90 days of the Department's or the city's determination. Upon request by the city, the Department, in its discretion, may grant additional time to conduct the study. The study shall outline such steps as the city has determined are necessary to address and/or eliminate the unpermitted discharge, and the time frame for completion of the identified steps, and, upon Department approval, or within thirty days of submission of the study if no response is received from the Department, the city shall implement those steps in accordance with the schedule outlined in the study. The Department may determine that additional measures are necessary to address and/or eliminate the discharge, and shall inform the city in writing of such determination.
PA0025437, Sewage, SIC 4952, North Coventry Municipal Authority, 1485 East Schuylkill Road, P. O. Box 800, Pottstown, PA 19464. This proposed facility is located in North Coventry Township, Chester County.
Description of Proposed Activity: The permittee requests increase wastewater flow from 1.5 mgd to 2.01 mgd at the treatment plant.
The receiving stream, Schuylkill River, is in the State Water Plan watershed 3D-Manatawny and is classified for WWF. The nearest downstream public water supply intake for Citizens Utility Home Water Company is located on the Schuylkill River and is 6.25 miles below the point of discharge.
The proposed effluent limits for Outfall 001 are based on a design flow of 1.5 mgd.

Description of Proposed Action/Activity: The applicant (Department of Conservation and Natural Resources) proposes the construction and operation of a 2,200 gpd sewage treatment plant to serve campsites at Kettle Creek State Park. The proposed treatment plant will consist of an equalization tank, a package activated sludge treatment plant, Ultraviolet Disinfection, sludge holding and a stream discharge to Kettle Creek downstream of the Alvin Bush Dam.

Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a Site-Specific Standard or as a special industrial area, the municipality within which the site is located may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office before which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. AIR QUALITY PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department has received applications for plan approvals and/or operating permits from the following facilities.
Copies of the applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.
Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate their interest to the Department regional office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Code §§ 127.44(b) and 127.424(b), the Department of Environmental Protection (Department) intends to issue Plan Approval No. 13-399-011 to Altadis USA, 1000 Tresckow Road, McAdoo, PA 18237 for their facility in Banks Township, Carbon County. This plan approval will be incorporated into the Title V operating permit No. 13-00005 through an administrative amendment at a later date, and the action will be published as a notice in the Pennsylvania Bulletin.
Plan approval No. 13-399-011 is to exhaust an existing dust collector to the outdoors at the facility located in Banks Township, Carbon County. The dust collector is used to control fugitive dust within a tobacco processing room, and currently vents inside the building. The purpose to exhaust outside is to minimize heat and humidity buildup inside the building in the processing area.
The facility is located in an area designated as a marginal nonattainment area for ozone. The project area is also included in the northeast Ozone Transport Region. The facility is currently a major source for SOx emissions only. The proposed net emission increases from the facility will be 0.6 tpy of PM, which is below the PSD applicability triggering thresholds from the proposed source. Thus, the source will not subject the facility to PSD review. The following emission limitations are set for the source.
PM emissions from BAT, 0.02 gr/dscf.
The company will operate the facility and maintain the system in accordance with the good engineering practices to assure proper operation of the system.
Copies of the application, the Department's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at Air Quality Program, 2 Public Square, Wilkes-Barre, PA 18711.

06-03132: Ernst Cabinet Works, Inc. (51 Primrose St., Hamburg, PA 19526) for modification of a wood furniture surface coating operation controlled by dry filters in Hamburg Borough, Berks County. The facility is a non-Title V (State-only) facility. The modification involves the construction of two new paint spray booths and drying oven. This will result in the facility having the potential to exceed the 2.7 ton per year permitting threshold. The facility will be required to record the emissions of VOC and HAPs from the facility. The permit will include monitoring, work practices, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.
22-05034E: Pennsy Supply, Inc. (P. O. Box 3331, Harrisburg, PA 17104-3331) for modification to the pulverizing operation to use on specification waste derived liquid fuel as a back-up fuel, at the Hummelstown Pulverizing Plant, South Hanover Township, Dauphin County. The facility is a non-Title V (State-only) facility. The facility is subject to 40 CFR Part 60, Standards of Performance for New Stationary Sources. The plan approval will include conditions designed to keep the project in compliance with all applicable air quality requirements. The plan approval will be incorporated into the State-only operating permit in accordance with 25 Pa. Code § 127.450 (Administrative Amendment).

18-00011F: Croda, Inc. (8 Croda Way, Mill Hall, PA 17751) for construction of a chemical process operation in the Mill Hall Facility in Bald Eagle Township, Clinton County.
The Mill Hall Facility is a major facility which has been issued a Title V operating permit (No. 18-00011).
The respective chemical process operation is identified as the ''Synthesis Area--General Products'' operation and actually already exists onsite. The operation consists of 14 batch chemical processing vessels and ancillary equipment (process condensers, condenser receivers, vacuum pumps, and the like) used to manufacture a variety of products for the personal care industry (lotions, hair care products, and the like) and household products industry (floor wax, cleaners, and the like) as well as some products used as carriers in the pharmaceutical industry. These products include some ethoxylated and propoxylated products identified as polyether polyols.
The combined emission of ethylene oxide and propylene oxide (both of which are HAPs) from the Synthesis Area--General Products operation will be limited to 2.5 tons per year and the combined emission of VOCs will be limited to 36.5 tons per year. Additionally, the combined emissions of any single HAP from the entire facility in which the Synthesis Area--General Products operation is located will be limited to less than 10 tons per year and the combined emissions of all HAPs from the entire facility will be limited to less than 25 tons per year. As the Synthesis Area--General Products operation already exists, no increase in the actual emission of any air contaminant from the Synthesis Area--General Products operation is however expected to occur as a result of plan approval issuance.
The Department of Environmental Protection's (Department) review of the information submitted by Croda, Inc. indicates that the Synthesis Area--General Products operation should comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement of 25 Pa. Code §§ 127.1 and 127.12 and the requirements of Subpart PPP of the National Emission Standards for Hazardous Air Pollutants, 40 CFR 63.1420--63.1439 (National Emission Standards for Hazardous Air Pollutants for Polyether Polyols Production). Based on this finding, the Department proposes to issue plan approval for the construction of the Synthesis Area--General Products operation. Additionally, if the Synthesis Area--General Products operation is determined by the Department to be operating in compliance with all plan approval conditions and all applicable regulatory requirements following the issuance of plan approval, the conditions of Plan Approval 18-00011F will be incorporated into Title V Operating Permit 18-00011 via administrative amendment in accordance with the requirements specified in 25 Pa. Code § 127.450.
The following is a summary of the conditions the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable requirements:
1. Any batch of polyether polyol product produced in any chemical processing vessel contained in the Synthesis Area--General Products operation shall be subject to an epoxide cookout time of no less than 90 minutes (during which time the vessel shall not be vented to atmosphere) whether the vessel is subject to Subpart PPP or not.
2. Any batch of product requiring the use of ethylene oxide or propylene oxide (other than a polyether polyol product) produced in any chemical processing vessel contained in the Synthesis Area--General Products operation shall be subject to an epoxide cookout time of no less than 30 minutes (during which time the vessel shall not be vented to atmosphere).
3. The total combined ethylene oxide and propylene oxide emissions from the Synthesis Area--General Products operation shall not exceed 2.5 tons in any 12-consecutive month period.
4. The total combined VOC emissions from the Synthesis Area--General Products operation shall not exceed 36.5 tons in any 12-consecutive month period.
5. The total combined emissions of any single HAP from the entire Mill Hall Facility shall not equal or exceed 10 tons in any 12-consecutive month period and the total combined emissions of all HAPs from the entire facility shall not equal or exceed 25 tons in any 12-consecutive month period.
6. At the conclusion of each epoxide cookout for any batch of polyether polyol product produced in any chemical processing vessel contained in the Synthesis Area--General Products operation, the permittee shall perform such sampling and analysis on the vessel as is necessary to determine the amount of epoxide which will be emitted. If the vessel is a ''subject vessel'' under the requirements of Subpart PPP, the vessel shall not be vented to atmosphere until the analytical results are known and a determination made as to whether additional cookout time is needed. Vessels which are not ''subject vessels'' may be vented prior to the availability of the analytical results but the epoxide emission date for all batches produced in all vessels, whether the vessels are ''subject vessels'' or not, shall be recorded.
7. At the conclusion of each cookout period for any batch of product which requires the use of ethylene oxide or propylene oxide (other than a polyether polyol product) produced in any chemical processing vessel contained in the Synthesis Area--General Products operation, the permittee shall perform the sampling and analysis on the vessel as is necessary to determine the amount of epoxide which will be emitted (except that the sampling and analysis need not be performed on any batch involving the use of isopropyl alcohol or ethanol). The epoxide emission date for all batches of the products (other than those involving the use of isopropyl alcohol or ethanol) produced in all vessels shall be recorded.
8. The permittee shall maintain records as are needed to demonstrate compliance with all applicable requirements of Subpart PPP as well as with all limitations and requirements specified in this plan approval.
9. All conditions contained in Title V Operating Permit 18-00011 which have applicability to the Synthesis Area-- General Products operation remain in effect except as those conditions may be amended or superseded by a condition contained in this notice. If there is a conflict between a condition contained in this plan approval and a condition contained in Title V Operating Permit 18-00011, the permittee shall comply with the condition contained in this plan approval rather than the conflicting condition contained in Title V Operating Permit 18-00011.
08-00004B: Rynone Manufacturing Corp. (P. O. Box 128, North Thomas Avenue, Sayre, PA 18840) for increase in production throughput and increase in VOC and HAPs emissions at their Sayre facility in Sayre Borough, Bradford County. Rynone Manufacturing Corporation is a Title V facility.
The proposed VOC and HAP emission increases take place in the main production operation, consisting of gel coating operations and molding and casting operations. The permittee is taking emission restrictions of 49.7 tons of VOCs and 51.6 tons of combined HAPs in any 12-consecutive month period (CMP) from all sources at the facility. The VOC and HAP emissions represent increases of 15.3 tons of VOCs and 14.6 tons of combined HAPs in any 12 CMP. Part of the emission increase is due to the use of updated emission factors for HAP emissions from gel coating operations and part of the emission increase is due to increased production throughput.
The Department of Environmental Protection's (Department) review of the information provided by Rynone Manufacturing Corporation indicates that the proposed emission and production throughput increases will comply with all air quality requirements, including the Best Available Technology (BAT) requirement of 25 Pa. Code §§ 127.1 and 127.12 pertaining to air contamination sources and the emission of air contaminants. The proposed modification will also comply with the applicable requirements of 40 CFR Part 63, Subpart WWWW (National Emissions Standards for Hazardous Air Pollutants: Reinforced Plastic Composites Production), 63.5780--63.5935. Based on these findings, the Department intends to approve the application and issue plan approval for the proposed increase in VOC and HAPs emissions and the increase in production throughput. Additionally, if the Department determines that the sources and the air cleaning devices are operating in compliance with all plan approval conditions, the conditions established in the plan approval will be incorporated into the State-only operating permit No. 08-00004 by means of an administrative amendment under 25 Pa. Code § 127.450.
The following is a summary of the conditions that the Department proposes to place in the plan approval to ensure compliance with all applicable regulatory requirements.
1. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the emission of VOCs from all sources at the facility shall not exceed 49.7 tons in any 12 CMP.
2. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the emission of total combined HAPs from all sources at the facility shall not exceed 51.6 tons in any 12 CMP.
3. The permittee shall keep up-to-date records of Certified Product Data Sheets that identify the VOC content and HAP content of each VOC and/or HAP containing material used at the facility.
4. The permittee shall keep records of the supporting calculations for VOC emissions from all sources at the facility on a monthly basis and shall verify compliance with the VOC emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
5. The permittee shall keep records of the supporting calculations for total combined HAP emissions from all sources at the facility on a monthly basis and shall verify compliance with the total combined HAPs emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
6. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the VOC emission limitation for all sources at the facility in any 12 CMP. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
7. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the total combined HAP emission limitation for all sources at the facility in any 12 CMP. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
8. Under 25 Pa. Code § 123.13, no person may permit the emission of PM from the exhaust of each gel coating operation filter bank associated with the gel coating operations at the facility into the outdoor atmosphere in a manner that the concentration in the effluent gas exceeds 0.04 grain per dry standard cubic foot.
9. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, there shall be no emission of VOCs or HAPs from the gel coating operations at the facility, except for styrene and methyl methacrylate (MMA). The total combined emission of styrene and MMA from the gel coating operations at the facility shall not exceed 35.2 tons in any 12 CMP.
10. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, there shall be no emission of VOCs or HAPs from the molding and casting operations at the facility, except for styrene. The emission of styrene from the molding and casting operations at the facility shall not exceed 10.7 tons in any 12 CMP.
11. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the emission of VOCs from the mold release operations at the facility shall not exceed 2.8 tons in any 12 CMP. There shall be no emission of HAPs from the mold release operations at the facility, except for dibutyl ether, methanol, toluene, xylenes and ethylbenzene. The emission of total combined HAPs from the mold release operations at the facility shall not exceed 1.2 tons in any 12 CMP.
12. The molding and casting operations and gel coating operations at the facility are subject to 40 CFR Part 63, Subpart WWWW (National Emissions Standards for Hazardous Air Pollutants: Reinforced Plastic Composites Production). The permittee shall comply with all the applicable requirements specified in 40 CFR 63.5780--63.5935 for the molding and casting operations and gel coating operations at the facility.
13. Under 40 CFR 63.5910, the submission of all requests, reports, application submittals and other communications required by the National Emission Standards for Hazardous Air Pollutants (Reinforced Plastic Composites Production, 40 CFR 63.5780--63.5935) must be made to both the United States Environmental Protection Agency (EPA) and the Department.
14. Under 40 CFR 63.5910, the permittee shall submit compliance reports to the Department and the EPA on a semi-annual basis that include the information required by 40 CFR 63.5910. The first compliance report shall be submitted to the Department and the EPA no later than September 1, 2006 (for April 21, 2006, through June 30, 2006). The second compliance report shall be submitted to the Department and the EPA no later than March 1, 2007 (for April 21, 2006, through December 31, 2006). Each subsequent compliance report shall be submitted to the Department and the EPA no later than September 1 (for July 1 of the previous year through June 30 of the current year) and March 1 (for January 1 through December 31 of the previous year).
15. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, as well as 40 CFR 63.5805(b) and 63.5810(c), the weighted average combined styrene and MMA (organic HAP) content calculated for the gel coatings used in the gel coating operations at the facility shall comply with the weighted average organic HAP emission limit calculated for the gel coatings listed in Table 3 of 40 CFR Part 63, Subpart WWWW. The permittee shall comply with the all applicable requirements for the weighted averaging compliance method for gel coatings used at the facility, as specified in 40 CFR 63.5810(c). Compliance with the requirement specified in this streamlined permit condition assures compliance with the provisions in 40 CFR 63.5805(b).
16. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the materials used in the molding and casting operations at the facility shall not contain styrene monomer in excess of 40% by weight.
17. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, as well as 40 CFR 63.5895, the permittee shall keep records of the identity, type and amount of each VOC and/or HAP containing material used each month in the molding and casting operations and gel coating operations at the facility. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request. Compliance with the requirement specified in this streamlined permit condition assures compliance with the provisions in 40 CFR 63.5895(c) and (d) and 63.5920.
18. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, as well as 40 CFR 63.5895(c), 63.5900(a)(2), 63.5915(c) and 63.5920, the permittee shall keep records of the supporting calculations for weighted average organic HAP content calculated for gel coatings used in the gel coating operations at the facility for each 12 CMP on a monthly basis and shall verify compliance with the weighted average organic HAP emission limit in any 12 CMP. The records shall clearly show both the weighted average organic HAP content and the weighted average organic HAP emission limit over each individual month and over each 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request. Compliance with the requirement specified in this streamlined permit condition assures compliance with the provisions in 40 CFR 63.5900(a)(2), 63.5915(c) and 63.5920.
19. The permittee shall keep records of the supporting calculations for total combined styrene and MMA emissions from the gel coating operations at the facility on a monthly basis and shall verify compliance with the total combined styrene and MMA emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
20. The permittee shall keep records of the supporting calculations for styrene emissions from the molding and casting operations at the facility on a monthly basis and shall verify compliance with the styrene emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
21. The permittee shall keep records of the supporting calculations for VOC emissions from the mold release operations at the facility on a monthly basis and shall verify compliance with the VOC emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
22. The permittee shall keep records of the supporting calculations for total combined HAP emissions from the mold release operations at the facility on a monthly basis and shall verify compliance with the total combined HAP emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
23. The permittee shall submit reports to the Department on a semi-annual basis that include the records of the identity, type and amount of each VOC and/or HAP containing material used each month in the molding and casting operations and gel coating operations at the facility. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
24. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the total combined styrene and MMA emission limitation for the gel coating operations at the facility in any 12 CMP. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
25. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the styrene emission limitation for the molding and casting operations at the facility in any 12 CMP. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
26. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the VOC emission limitation for the mold release operations at the facility in any 12 CMP. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
27. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the total combined HAP emission limitation for the mold release operations at the facility in any 12 CMP. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
28. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the permittee shall keep all containers of gel coating, resin and any other VOC and/or HAP containing material associated with the molding and casting operations and gel coating operations at the facility closed when not in actual use.
29. Under 40 CFR 63.5895(c), at all times, the permittee shall maintain necessary parts for routine repairs of all monitoring equipment associated with the molding and casting operations and gel coating operations at the facility.
30. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the permittee shall only use nonatomizing spray technology for the applying clear and white/off-white gel coatings used in the gel coating operations at the facility. The permittee shall only use high-volume low-pressure spray technology for applying all other gel coatings used in the gel coating operations at the facility.
31. Under 40 CFR 63.5796, the permittee shall calculate the total combined styrene and MMA emissions from the gel coating operations at the facility by using the applicable equations found in Table 1 of 40 CFR Part 63, Subpart WWWW.
32. The permittee shall calculate the styrene emissions from the molding and casting operations at the facility by using the following equation.

The Yellow Line is a simulated marble bathroom sink gel coating and molding operation incorporating a Respecta model DB VaC 11/10-20 molding machine to mix the casting resin and a Binks spray booth to house the gel coating operation. The Blue Line is a simulated marble bathroom sink gel coating and molding operation incorporating a Respecta model DB VaC 11/10-20 molding machine to mix the casting resin and a Binks spray booth to house the gel coating operation. The Green Line is a simulated marble bathroom sink gel coating and molding operation incorporating a Respecta model DB VaC 11/10-20 molding machine to mix the casting resin and a Binks spray booth to house the gel coating operation. The Press Line is a simulated marble bathroom sink gel coating and molding operation incorporating a Respecta model DB 11/8-15/5K molding machine to mix the casting resin and a Binks spray booth to house the FANUC robotic gel coating operation. The PM emissions from the gel coating operation in each Binks spray booth shall be controlled by dry filters located at the back of each spray booth. The molding and casting operations and gel coating operations at the facility also include a Hobart batch mixer for special tops and mold preparation and release operations at the facility.
34. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the emission of acetone from cleanup activities throughout the facility shall not exceed 26.0 tons in any 12 CMP.
35. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, there shall be no emission of HAPs from cleanup activities throughout the facility, except for methylene chloride. The emission of methylene chloride from cleanup activities throughout the facility shall not exceed 4.5 tons in any 12 CMP.
36. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the emission of VOCs from cleanup activities throughout the facility shall not exceed 1.0 ton in any 12 CMP.
37. Cleanup activities throughout the facility are subject to 40 CFR Part 63, Subpart WWWW (National Emissions Standards for Hazardous Air Pollutants: Reinforced Plastic Composites Production). The permittee shall comply with all the applicable requirements specified in 40 CFR 63.5780--63.5935 for cleanup activities throughout the facility.
38. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, methylene chloride shall only be used to clean cured resin from application equipment, which includes any equipment that directly contacts resin. Compliance with the requirement specified in this streamlined permit condition assures compliance with the provisions in 40 CFR 63.5805(b).
39. The permittee shall submit keep records of the identity, type and amount of each acetone and/or HAP containing material used each month in cleanup activities throughout the facility. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
40. The permittee shall keep records of the supporting calculations for acetone emissions from cleanup activities throughout the facility on a monthly basis and shall verify compliance with the acetone emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
41. The permittee shall keep records of the supporting calculations for methylene chloride emissions from cleanup activities throughout the facility on a monthly basis and shall verify compliance with the methylene chloride emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
42. The permittee shall keep records of the supporting calculations for VOC emissions from cleanup activities throughout the facility on a monthly basis and shall verify compliance with the VOC emission limitation in any 12 CMP. These records shall be retained for a minimum of 5 years and shall be made available to the Department upon request.
43. The permittee shall submit reports to the Department on a semi-annual basis that include the records of the identity, type and amount of each acetone and/or HAP containing material used each month in cleanup activities throughout the facility. The semi-annual reports shall be submitted to the Department no later than March 1 (for January 1 through December 31 of the previous year) and September 1 (for July 1 of the previous year through June 30 of the current year).
44. The permittee shall submit reports to the Department on a semi-annual basis that include the supporting calculations used to verify compliance with the acetone emission limitation for cleanup activities throughout the facility in any 12 CMP. 47. Under the BAT provisions in 25 Pa. Code §§ 127.1 and 127.12, the permittee may flush all solvent used for spray line cleaning associated with cleanup activities throughout the facility into closed containers as a solid stream and/or soak spray lines and spray guns in closed containers; under no circumstance shall the permittee remove cleanup solvent from spray lines by spraying through a spray gun so that the solvent exits the gun as an atomized or shower spray. The permittee shall keep all containers of cleanup solvent associated with cleanup activities throughout the facility closed when not in actual use and store all solvent-wet rags, and the like in closed containers when not in actual use. Under no circumstances shall the permittee dispose of waste solvent associated with cleanup activities throughout the facility via evaporation or treat or pretreat solvent-wet rags, and the like prior to disposal or reuse by subjecting them to air drying or any other means of solvent removal that would unnecessarily cause solvent to be evaporated into the air.
48. This facility is subject to 40 CFR Part 63, Subpart WWWW (National Emissions Standards for Hazardous Air Pollutants: Reinforced Plastic Composites Production). The permittee shall comply with all the applicable requirements specified in 40 CFR 63.5780--63.5935.
49. Conditions contained in TVOP 08-00004 remain in effect unless superseded or amended by conditions contained in this plan approval. If there is a conflict between a condition contained in this plan approval and a condition contained in TVOP 08-00004, the permittee shall comply with the condition contained in this plan approval.

The facility incorporates two rust inhibitor dip tanks, 18 natural gas-fired annealing, draw, and the like furnaces, 67 natural gas-fired heaters and two solvent cold cleaning machines. The VOC emissions from the facility will be limited to less than 50 tons per year and the nitrogen oxides, CO, PM including PM10 and SOx emissions are not expected to exceed 21.61, 4.54, 1.62 and .13 tons per year, respectively.
The facility is not a major (Title V) facility for any air contaminant.
The Department of Environmental Protection (Department) proposes to incorporate into the operating permit to be issued conditions requiring compliance with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants as well as conditions previously established in Operating Permit 17-318-016, issued on December 21, 1995.
The previously-established conditions include:
1. A condition limiting the total combined VOC emissions from the entire facility to less than 50 tons in any 12-consecutive month period.
2. A condition limiting the amount of thinner added to the amber dip tank to no more than 1 gallon for every 2.75 gallons of rust inhibitor coating material added to the tank (on an annual average basis).
3. A condition requiring the springs coated in the amber dip tank to be drained over the dip tank for as long as possible before moving them to the drying area.
4. A condition limiting the rust inhibitor coating materials and thinners used in the amber dip tank to those identified in Plan Approval Application 17-318-016 unless prior Department approval is obtained to use other coatings and thinners.
5. A condition requiring the maintenance of records of rust inhibitor coating material and thinner usage in the amber dip tank.
The Department additionally proposes to incorporate into the operating permit to be issued a number of new conditions including:
1. A condition limiting the total combined emission of any single HAP from the entire facility to less than 10 tons in any 12-consecutive month period and the total combined emission of all HAPs to less than 25 tons in any 12-consecutive month period.
2. A condition requiring the maintenance of records as are necessary to verify compliance with the VOC and HAP facility-wide emission limitations.
3. A condition limiting the total combined amount of rust inhibitor coating materials used in the two dip tanks to 11,891 gallons in any 12-consecutive month period, of which no more than 10,899 gallons shall have a VOC content in excess of 2.80 pounds per gallon and none shall have a VOC content in excess of 3.14 pounds per gallon.
4. A condition limiting the total combined amount of thinners used in the two dip tanks to 1,048 gallons in any 12-consecutive month period, of which no more than 948 gallons shall have a VOC content in excess of 7.40 pounds per gallon and none shall have a VOC content in excess of 7.94 pounds per gallon.
5. A condition prohibiting the use of the two dip tanks to apply coatings other than rust inhibitor coatings unless prior Department approval is obtained.
6. A condition requiring the maintenance of rust inhibitor coating material and thinner usage in the black dip tank.
7. A condition requiring the semi-annual submission of reports of rust inhibitor coating material and thinner usage in each of the two dip tanks.
8. Conditions limiting the fuel used in the furnaces and heaters to natural gas.

The facility incorporates a raw coal feed bin, a rotary breaker, a radial stacking conveyor, five additional conveyors, various coal stockpiles, truck and railcar loading operations and a 375 horsepower diesel engine/generator. The air contaminant emissions from the facility are not expected to exceed 5.66 tons of NOx, 5.53 tons of CO, .81 ton of VOCs, .34 ton of SOx and 27.58 tons of PM including PM10 per year.
The facility is not a major (Title V) facility for any air contaminant.
The Department of Environmental Protection (Department) proposes to incorporate into the operating permit to be issued conditions requiring compliance with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants as well as conditions previously established in Plan Approval 17-305-020A, issued on October 5, 2004.
These previously-established conditions include:
1. A condition limiting the amount of coal processed by the facility to no more than 437,500 tons in any 12-consecutive month period.
2. A condition requiring all trucks entering or exiting the facility by means of a public roadway to be tarped or otherwise covered unless empty.
3. A condition requiring the first 300 feet of the facility entrance road to be paved and the remainder up to the tipple area to be covered with 1B limestone.
4. A condition limiting vehicle speed on facility roadways to no more than 5 miles per hour.
5. A condition requiring an operable water truck equipped with a pressurized spray bar and pressurized hose or nozzle connection to be maintained on site for the control of dust from roadways and stockpile areas.

8. A condition requiring the height of the stacking conveyor to be adjusted to maintain a maximum coal free-fall distance of less than 5 feet at all times.
9. A condition limiting the maximum height of any coal stockpile to 30 feet above grade.
10. A condition requiring all conveyors to be partially or fully enclosed and all material transfer points to be enclosed.
11. A condition requiring the front-end loader bucket-to-truck bed and bucket-to-railcar height to be kept to a minimum during loading operations.

Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.

Raw water transmission and treated drinking water distribution lines shall be installed beneath streambeds so there will be a minimum of 3 feet of cover between the top of the pipe and the lowest point in the streambed or concrete encased. Trench plugs or clay dikes shall be used at every waterway and wetland crossing to ensure the existing hydrology is not altered. Since Moshannon Creek is a wild trout stream, no construction or future repair work of the surface intake and monitoring weir shall be done in or along the stream channel between October 1 and December 31 without the prior written approval of the Fish and Boat Commission. To relocate Westover Borough Water Street; to construct, operate and maintain 1,400 feet of earthen levee within the 100-year floodplain of Chest Creek (CWF); and to install, operate and maintain rock scour protection at SR 3006 Bridge abutments for flood protection. The earthen levee shall be constructed with side slopes that shall not exceed 2 feet horizontal to 1 foot vertical, a top width no less than 10 feet and an elevation that provides for 1 foot of freeboard during the 100-year frequency flood. The project will permanently impact 0.016 acre of wetland and 75 feet of Chest Creek that is located along the eastern right-of-way of SR 0036 upstream of SR 3006 and SR 0036 intersection. The Department of Environmental Protection deems the 0.016 acre of wetland permanently impacted by the project de minimis, and so the permittee shall not be required to mitigate the impact with replacement wetlands. This permit also authorizes construction, operation, maintenance and removal of temporary cofferdams or stream diversions for the installation of the rock scour protection. Installation of the rock scour protection shall be completed during stream low flow and dry work conditions by diverting stream flow around work area. Demolition of all structures between Chest Creek and the levee shall include any existing septic tanks or other waste disposal facilities. Demolition waste, including septic tanks, shall be properly removed, handled and disposed to eliminate any future public health risk.

S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION UNDER ACT 2, 1995 PREAMBLE 2

These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

The proposed modification and realignment of Bristol Pike (SR 0013) is associated with road improvements for the Deluca Homes, St. Francis Residential Development at the intersection of Street Road (SR 0132) and Bristol Pike (SR 0013). Work will include an 8-foot wide bituminous walkway loop running approximately 733 linear feet into the wetlands. Associated with this permit is a sanitary sewer line crossing of the UNT of Core Creek, GP050905334 registered to Newtown Joint Municipal Authority. The site is located approximately on the northern edge by Newtown-Yardley Road (SR 0332) with Upper Silver Lake Road serving as its Western Border (Newtown Township, Bucks County, Langhorne, PA, Quadrangle N: 19.45 inches; W: 3.58 inches).

To remove the existing stone arch culvert and to construct and maintain in its place an open bottom reinforced concrete arch culvert across Trout Creek (WWF). The proposed culvert will have a clear span of 22 feet 9 inches and a minimum underclearance of approximately 5 feet 6 inches. This work also includes maintenance of utility line crossings, stabilization of the stream banks in the vicinity of the proposed culvert, modification of an existing outfall structure and construction and maintenance of a temporary sand bag cofferdam. The project is located on the west side of Washington Pike (SR 50) approximately 1,300.0 feet west from the intersection of Washington Pike (SR 50) and Greentree Road. The permittee shall mitigate 0.9 acre of wetlands onsite and shall provide for approximately 200.0 linear feet of stream bank stabilization on the Panhandle Trail in Collier Township, Allegheny County to compensate for the wetland and stream impacts.

The applicant proposes to conduct stream bank restoration of a 150-foot long section of McDannel Run on City of Erie Housing Authority property adjacent to and east of 745 Tacoma Avenue involving: 1) to construct and maintain a gabion wall along the left bank having a length of approximately 150 feet and a height of 6 feet; 2) to backfill the area behind the gabion wall with bank gravel and to install and maintain riprap rock protection at the upstream and downstream end of the project; 3) to reestablish the original channel width and establish additional floodplain by excavating the right bank for a length of approximately 150 feet; and 4) to stabilize the reconstructed right bank with perennial native vegetation. The restoration has been authorized by the Department of Environmental Protection under Emergency Permit EP2505609 issued on October 28, 2005. The eroding streambank has exposed a natural gas pipeline and several other utility lines and threatens a utility pole. McDannel Run is a perennial stream classified as a CWF and MF. The project proposes to directly impact approximately 150 feet of stream.
