    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period, will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

It also includes discharge of stormwater from roadway of Tank Farm No. 2 located in Upper Chichester Township in Delaware County to Baldwin Run.

       The receiving stream is classified for trout stocking fishery, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements, the existing downstream potable water supply intake considered during the evaluation was Columbia Borough Water Company located in Lancaster County. The discharge is not expected to impact any potable water supply.

       PA 0209708.  Hostetter Management Company (Sugar Valley Farms), 10 Copperfield Circle, Lititz, PA 17543.

       This proposed action is for issuance of a swine farrowing Concentrated Animal Feeding Operation (CAFO) NPDES permit for a new permit in Sullivan Township, Tioga County. The operation will consist of 1,604.6 average number of Animal Equivalent Units to produce 3,993,538 gallons per year of manure and wastewater to be stored in a 1.71 million gallon primary manure storage impoundment and a 5.2 million gallon secondary manure impoundment with associated transfer structures. The handling and application of the contents will be controlled under a Nutrient Management Plan (NMP), approved by the Tioga County Conservation District. The applicable Effluent Limitation Guidelines in Federal Regulations under 40 CFR Part 412 stipulate that Confined Animal Feeding Operations shall not have any discharge to surface waters under normal operating conditions. All CAFO operations must meet the provisions of an approved NMP, obtain and comply with the Department's Water Quality Management Part II Permit for constructing new manure storage facilities, develop and implement best management practices (BMPs) to ensure that the water quality of the receiving water is maintained. Collectively, these requirements constitute the Department's narrative ''effluent limits'' for CAFOs necessary to protect waters of this Commonwealth.

       The proposed operation is located on the watersheds of unnamed tributaries of Corey Creek and Canoe Camp Creek both classified for the following uses:  warm water fishery and aquatic life, water supply and recreation.

       This proposed action is for renewal of an NPDES permit for an existing discharge of treated industrial wastewater to Limestone Run in Turbot Township, Northumberland County.

       The receiving stream is classified for the following uses:  warm water fishery and aquatic life, water supply and recreation.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply (PWS) considered during the evaluation is PA American Water Company located at Milton Borough on the West Branch of the Susquehanna River.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply (stream and public water supplier) considered during the evaluation is Beaver River, Beaver Falls Municipal Authority--Eastvale Plant located at Eastvale, approximately 57.4 miles below point of discharge.

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit action. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

    Applications under the Pennsylvania Clean Streams Law

    (Part II Permits)

       The following permit applications and requests for plan approval have been received by the Department of Environmental Protection (Department).

       Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department at the address indicated above each permit application or plan. Each written protest should contain the following: name, address and telephone number; identification of the plan or application to which the protest is addressed; and a concise statement in sufficient detail to inform the Department of the exact basis of the protest and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given protest. Each commentator will be notified in writing of the time and place if a hearing or conference concerning the plan, action or application to which the protest relates is held. To insure consideration by the Department prior to final action on permit applications and proposed plans, initial protests and additions or amendments to protests already filed should be filed within 15 calendar days from the date of this issue of the Pennsylvania Bulletin. A copy of each permit application and proposed plan is on file in the office indicated and is open to public inspection.

       The following parties have applied for an NPDES permit to discharge stormwater from a proposed construction activity into the surface waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit and special conditions. The proposed determinations are tentative. Limitations are provided in the permit as erosion and sedimentation control measures and facilities which restrict the rate and quantity of sediment discharged.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision of 40 CFR 123.24(d).

    Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site.     Nonmajor Sources and Modifications

       The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.

       Persons wishing to file protests or comments on the proposed plan approval and/or operating permits must submit the protest or comment within 30 days from the date of this notice.        NMOP-59-00009:  Mansfield University (Mansfield, PA 16933) for their boilers, heaters and emergency generators used at the University in Mansfield Borough, Tioga County. Emissions from these sources include CO, NOx SO2, VOCs and particulate matter.

       NMOP-41-00032:  Department of Justice, Allenwood Federal Prison Camp (P. O. Box 1000, Montgomery, PA 17752) to produce heat and steam for use at the prison camp in Brady Township, Lycoming County. The main sources are the natural gas and no 2. oil fired boilers. Emissions from these sources include CO, NOx SO2, VOCs and particulate matter.

       NMOP-17-00012:  Shawmut Production Corp. (One Williamsburg Place, Suite 240, Warrendale, PA 15086) for their natural gas and oil production facility in Penn Township, Clearfield County. The main source is natural gas compressor. Emissions from the source include CO, NOx SO2, VOCs and particulate matter.

       NMOP-17-00014:  Keystone Oil & Gas (One Williamsburg Place, Suite 240, Warrendale, PA 15086) for their natural gas and oil production facility in Burnside Township, Clearfield County. The main source is a natural gas compressor. Emissions from the source include CO, NOx SO2, VOCs and particulate matter.

       NMOP-14-00011:  Atotech USA, Inc. (500 Science Park Road, State College, PA 16803) for their electronic equipment manufacturing facility in Ferguson Township, Centre County. The sources include: heaters, surface coating, cleaning and etching processes; and cutting, grinding and welding equipment. Emissions from these sources include CO, NOx SO2, VOCs, HAPs and particulate matter.

       17-305-012A:  Fuel Fabricators, Inc. (P. O. Box 368, Bigler, PA 16825) for operation of a bituminous coal-fired boiler and associated air cleaning device (a multicyclone collector) in Bradford Township, Clearfield County.


    Notice of Intent to Issue Title V Operating Permits

       Under 25 Pa. Code § 127.521, the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F and G (relating to operating permit requirements; and Title V operating permits).

The facility stores and transmits natural gas to the main distribution line. The facility's main sources include several natural gas fired engines, heaters and emergency generators which emit major quantities of nitrogen oxides (NOx), volatile organic compounds (VOCs) and hazardous air pollutant (HAPs). As a result of emissions of major quantities of HAPs, VOCs and NOx the facility is a major stationary source as defined in Title 1, Part D of the Clean Air Act Amendments. The facility is therefore subject to Title V permitting requirements adopted in 25 Pa. Code, Chapter 127, Subchapter G. The facility also emits CO, SOx and particulate matter. This facility is subject to all applicable requirements of Maximum Achievable Control Technology (MACT) and Reasonably Available Control Technology (RACT).

       TVOP-53-00004:  CNG Transmission Corp. (625 Liberty Ave., Pittsburgh, PA 15222-3197) for their gas transmission and storage facility (Harrison Station) located in Harrison Township, Clinton County. The CNG Corporation's Harrison facility stores and transmits natural gas to the main distribution line. The facility's main sources include several natural gas fired engines, heaters and emergency generators which emit major quantities of nitrogen oxides (NOx), volatile organic compounds (VOCs) and hazardous air pollutant (HAPs).        05-05003A:  JLG Industries, Inc. (1 JLG Drive, McConnellsburg, PA 17233-9533) for the modification of three spray paint booths located at their Weber Lane Facility, in Bedford Township, Bedford County.

       Ethan Allen, Inc.

       Erie County

       Notice is hereby given in accordance with 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Department of Environmental Protection (Department) intends to issue a plan approval to Ethan Allen, Inc. for their plant in Union City, Erie County. The facility has a Title V permit No. TV-25-00316. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V operating permit through an administrative amendment at a later date.

       Plan Approval No. PA 25-316B is for the construction of a wood furniture robotic spray process. This construction will result in an increase of 33.0 tons of VOC, and 24.0 tons of particulate matter per year. Conditions defined in the Plan Approval shall be as follows:

       1.  VOC emissions from this source shall not exceed 33.0 tons in any consecutive 12-month rolling period.

       2.  Facility VOC emissions shall not exceed 403.0 tons in any consecutive 12-month rolling period.

       3.  40 CFR Part 63, Subpart JJ requirements, as defined in facility Operating Permit TV-25-00316, shall be incorporated into this approval. The emission of VHAPs from this source shall be limited as follows:

       a)  Finishing Operations:

       i)  Achieve a weighted average VHAP across all coatings of 0.8 (maximum kg VHAP/kg solids [lb VHAP/lb solids]), as applied, or

       ii)  Limit finishing materials (maximum kg VHAP/kg solids [lb VHAP/lb solids], as applied), as follows:

Current CTG defined VOC contents are 1.9 lbs VOC/lb solid and 1.8 lbs VOC/lb solid for sealers and topcoats, respectively.

       The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

    Proposed Revision to the State Implementation Plan for Volatile Organic Compounds (VOC) Approval of a Reasonably Available Control Technology Plan and Operating Permit; Public Hearing

       The Department of Environmental Protection (Department) has made a preliminary determination to approve a Reasonably Available Control Technology (RACT) Plan and an amendment to the State Implementation Plan (SIP) for the Spherical Roller Bearing Production Plant owned and operated by SKF USA, Inc. at 525 Fame Avenue, Penn Township, York County.

       The proposed SIP revision does not adopt new regulations. It incorporates the provisions and requirements contained in (RACT) Operating Permit No. 67-2010 for the existing facility to comply with current regulations. Upon final approval, the operating permit will include material substitution, recordkeeping and reporting requirements.

    Proposed Revision to the State Implementation Plan for Oxides of Nitrogen and Volatile Organic Compounds; Public Hearing

       Approval of Reasonably Available Control Technology (RACT) plan for Masonite, Subsidiary of International Paper Company in Wysox Township, Bradford County.

       The Department of Environmental Protection (Department) has made a preliminary determination to approve a Reasonably Available Control Technology (RACT) plan and an amendment to the State Implementation Plan (SIP) for a hardboard manufacturing facility owned and operated by Masonite, Subsidiary of International Paper Company, in Wysox Township, Bradford County.

       The proposed SIP revision does not adopt new regulations. It incorporates the provisions and requirements contained in the RACT approval for the facility to comply with current regulations.

       The preliminary RACT determination, if finally approved, will be incorporated into an operating permit for the facility and will be submitted to the United States Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan.

       E35-308.  Encroachment. Clarks Summit Borough, 304 South State Street, Clarks Summit, PA 18411. To remove the existing structure and to construct and maintain a 200 foot long, 64-inch × 43-inch CMPA stream enclosure in a tributary (Tributary B) to Ackerly Creek (CWF). The project is located approximately 200 feet southeast of the intersection of S. R. 4024 (Winola Road) and Electric Street (Scranton, PA Quadrangle N: 20.9 inches; W: 12 inches), Clarks Summit Borough, Lackawanna County (Baltimore District, U. S. Army Corps of Engineers).

       E35-309.  Encroachment. Scott Township, R. R. 1, Box 458, Olyphant, PA 18447-0000. To excavate in 0.23 acre of PEM Wetlands in a tributary to Hull Creek (CWF) to form approximately 500 linear feet of trapezoidal channel having a bottom width of 6 feet, 2H:1V side slopes and a 2-foot minimum depth, with 100 feet of the upstream channel having R5 riprap channel lining. The project is intended to reduce frequent flooding by increasing the channel capacity. The project, known as ''Unnamed Tributary to Hull Creek Channel Improvements'' is located at a beginning point approximately 1,000 feet east of the intersection of T427 and T531 (Scranton, PA Quadrangle N: 22.3 inches; W: 0.1 inch), extending downstream 600 feet in Scott Township, Lackawanna County (Baltimore District, U. S. Army Corps of Engineers).

       E39-361.  Encroachment. Church of the Assumption B.V.M., 4101 Old Bethlehem Pike, Bethlehem, PA 18105. To fill in 0.36 acre of PEM/SS Wetlands for the construction of a combination soccer and softball field. The project, associated with the expansion of St. Michael's School, is located east of the intersection of S. R. 2038 (Oakhurst Road) and T-835 (Old Bethlehem Pike) (Allentown East, PA Quadrangle N: 12.9 inches; W: 2.6 inches), Upper Saucon Township, Lehigh County (Philadelphia District, U. S. Army Corps of Engineers).

       E40-516.  Encroachment. Gregory A. Renninger, 2656 Old Berwick Road, Bloomsburg, PA 17815. To place fill in the floodway of the Susquehanna River (WWF) for the purpose of constructing a motocross track, including periodic jumps, varying from 2 to 9 feet in height. The project includes modification of an existing 26-foot × 48-foot block building to add an 8-foot × 16-foot deck and awning. The project is located along Flats Road (T-573) (Wilkes-Barre, West, PA Quadrangle N: 19.2 inches; W: 11.8 inches), Plymouth Township, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

       E40-517.  Encroachment. City of Wilkes-Barre, 40 East Market Street, Wilkes-Barre, PA 18711. To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge, having a span of 21.3 feet (6.5 meters) and a minimum underclearance of 7.2 feet (2.2 meters), across Coal Brook (CWF). The project is located on Scott Street, approximately 300 feet west of the intersection of Scott Street and Business Route 309, (Wilkes-Barre East, PA Quadrangle N: 22.4 inches; W: 14.7 inches), City of Wilkes-Barre, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

       E45-368.  Encroachment. James and Debora Zug, 1164 St. Andrews Road, Bryn Mawr, PA 19010. To place fill in 0.03 acre of PFO wetlands for the purpose of constructing a carport and storage shed on Lot 309 in Pocono Lake Preserve. The total wetland impact, considering a previously authorized wetland fill by Permit No. E45-281 is equal to 0.24 acre. The project is located on the western side of Pocono Lake, approximately 900 feet southeast of S. R. 0940 (Blakeslee, PA Quadrangle N: 20.3 inches; W: 1.85 inches), Tobyhanna Township, Monroe County (Philadelphia District, U. S. Army Corps of Engineers).

To remove an existing structure and to (1) construct and maintain 20 linear feet of 57-inch by 38-inch corrugated metal pipe arch in an unnamed tributary to Rock Creek; (2) maintain a chain link privacy fence across the stream at this location; (3) restore approximately 100 linear feet of channel capacity; and (4) construct approximately 120 linear feet of a previously filled channel located upstream of the culvert. The site is located east of US 140 (Baltimore Pike) 1.2 miles south of Gettysburg Square (Gettysburg, PA Quadrangle N: 11.6 inches; W: 13.6 inches) in Cumberland Township, Adams County.

       E07-307.  Encroachment. Altoona City Authority, 20 Greenwood Road, Altoona, PA 16602. To excavate approximately 300 feet of stream channel to a depth of 2.5 feet and to replace the excavated material with limestone rock for the purpose of adding alkalinity to Glenwhite Run as part of an acid mine drainage abutment project in the Glenwhite watershed located about 2.5 miles upstream of the Horseshoe Curve (Cresson, PA Quadrangle N: 22.6 inches; W: 3.8 inches) in Allegheny Township, Blair County.

       E07-308.  Encroachment. Blair Township, 575 Cedarcrest Drive, Duncansville, PA 16635. To rehabilitate approximately 470 feet of stream channel which will include about 312 feet of streambank protection and about 140 feet of reconstructed channel in Poplar Run for the purpose of providing flood protection to a nearby residence located about 900 feet upstream of the SR 0036 bridge over Poplar Run (Hollidaysburg, PA Quadrangle N: 2.6 inches; W: 5.5 inches) in Blair Township, Blair County.

       E07-309.  Encroachment. Blair Township Water & Sewer Authority, 577 Cedarcrest Drive, Duncansville, PA 16635. To place fill in the floodway of Halter Creek and to place fill in the floodplain of Poplar Run for the purpose of constructing two wastewater pump stations as part of the construction of a wastewater collection system which will serve approximately 600 homes in and around Blair Township (Roaring Springs, PA Quadrangle N: 22.7 inches; W: 6.8 inches) in Blair Township, Blair County.

       E14-339.  Encroachment. Spring-Benner-Walker Joint Authority, 170 Irish Hollow Road, Bellefonte, PA 16823. To construct and maintain one 12 inch sewer main and seven 8 inch sewer mains through Spring Creek located 2 miles south of Bellefonte on SR 3001 from the intersection of Rt. 550 and SR 3001 extending 2 miles along SR 3001 (Bellefonte, PA Quadrangle N: 3.5 inches; W: 5.7 inches) in Benner Township, Centre County. This project proposes to impact 1,000 linear feet of Spring Creek which is designated a High Quality--Cold Water Fishery and proposes to impact 0.30 acre of Exceptional Value wetlands.

       E18-264.  Encroachment. Schrack Farms Partnership, R. R. 2, Box 68, Loganton, PA 17747. To realign the channel of Fishing Creek (High Quality--Cold Water Fishery) for the mitigation of flood damage. The realignment shall consist of removing 1,771 cubic yards of deposition, debris and woody vegetation through a 820-feet reach of channel. The project will not impact wetlands while impacting 820 feet of waterway that is located along the eastern right-of-way of SR 0880 approximately 2,000-feet east of the intersection of T-346 and SR 0880 (Mill Hall, PA Quadrangle N: 0.6 inch; W: 1.9 inches) in Logan Township, Clinton County. This permit also will authorize the construction, operation and maintenance of an agricultural crossing of Fishing Creek which shall be done in accordance with the Department's BDWM-GP-6.

       E55-157.  Encroachment. Emmit L. Kreamer, P. O. Box 88, Middleburg, PA 17842. The applicant is seeking authorization to place and maintain fill in 0.4 acre of man-made wetlands to expand an existing business. The proposed project site is located along the north side of US Route 522, approximately 1 mile east of Middleburg. The site is in Franklin Township, Snyder County (Middleburg PA Quadrangle N: 7.3 inches; W: 2.25 inches). The affected wetland is a 0.4 acre isolated palustrine emergent wetland created in 1963 by clay excavation. Onsite replacement would affect areas with ''high probability'' of archaeological significance. Therefore, replacement by payment to the Pennsylvania Wetland Replacement Project (Fund) is proposed.

       E59-381.  Encroachment. Covington Township, R. R. 1, Box 87, Covington, PA 16917. To maintain: 1) fill in the channel, with no added erosion protection, having a length of 1,040-feet, a maximum bottom width of 180-feet and a maximum height of 8.5-feet next to the left bank of the Tioga River for the purpose of redirecting flood flows away from both riverbanks, 2) to remove gravel deposits from the riverbed for a distance of 400 feet upstream of the island immediately downstream of the fill and a distance of 100 feet into the left and right channel from the top of the island, both encroachments are located 1,000 feet northwest of the intersection of S. R. 6015 and T-437 (Blossburg, PA Quadrangle N: 19.6 inches; W: 11.3 inches) in Covington Township, Tioga County. The project impacts 1,500 feet of the Tioga River, which is classified as a Cold Water Fishery.

       Southwest Regional Office: Soils and Waterways Section, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

       E02-1263.  Encroachment. Wil-Mar Group, 431 Brown Lane, P. O. Box 15284, Pittsburgh, PA 15237. To construct and maintain a 48 inch outfall pipe along the left bank side of Brush Creek (WWF) and to place and maintain fill in 0.8 acre of wetlands (PEM/PSS) for a proposed commercial development known as Warrendale Village. The development is located along the north side of Warrendale-Bayne Road (SR 4052) approximately 700 feet west of its intersection with Perry Highway (SR 0019) (Mars, PA Quadrangle N: 5.7 inches; W: 12.5 inches) in Marshall Township, Allegheny County. For the wetland replacement the applicant proposes to construct 0.4 acre of replacement wetlands (PEM/PSS) and to pay $7,500 to the wetland replacement fund.

       E11-271.  Encroachment. Hastings Area Industrial Development Association, 180 Bears Road, Hastings, PA 16646. To construct and maintain a 83-foot long, 14-foot by 8-foot R. C. box culvert in Brubaker Run (CWF) and to relocate and maintain the channel, approximately 16 l. f. upstream and 82 l. f. downstream of the structure for the purpose of constructing a new industrial park access road (Haida Road). The project includes placement and maintenance of fill in 0.15 acre of wetlands (PEM) for the purpose of a Pennsylvania Department of Transportation mitigation bank. The proposed road begins approximately 800 feet west of the intersection of S. R. 4021 and S. R. 4019 and extends easterly and ends at the intersection of S. R. 4010 (Hastings, PA Quadrangle N: 5.8 inches; W: 12.75 inches) in Susquehanna Township and Hastings Borough, Cambria County.

    HAZARDOUS SITES CLEANUP

    Under the Act of October 18, 1988

    Settlement Under the Hazardous Sites Cleanup Act

       The Department of Environmental Protection (Depart-ment), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) (42 U.S.C.A. §§ 9601--9675), has entered into proposed de minimis settlements under section 707 of HSCA (35 P. S. § 6020.707) and section 122(g) of CERCLA (42 U.S.C.A. § 9622(g)) relating to the cleanup of the Container Recyclers Ltd. HSCA Site (site) at 10 E. Wolf Street, Philadelphia, PA. The proposed settlements involve Consent Order and Agreements between the Department and parties known to the Department to be potentially responsible for only a minor portion of the response costs incurred at the Site.

       Contamination identified by the Department at the Site included hydrofluoric acid, hydrochloric acid, aqueous wastes with pH greater than 12.5, ignitable or corrosive waste, methyl ethyl ketone and trichloroethylene. A prompt interim response was implemented in accordance with a Statement of Decision (SOD) issued by the Department on December 21, 1994. The response conducted by the Department, which included the removal of hazardous wastes and materials located at the Site, was completed in late 1995. Under the terms of the proposed Consent Order and Agreements, settlors will reimburse a portion of the costs incurred by the Department in connection with the Site. The amount of the reimbursement will be proportional to the number of drums known to have been sent to the Site by each settlor.

       This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). The Department will provide for a 60-day public comment period on the proposed Consent Order and Agreements from the date of publication of this notice. The proposed Consent Order and Agreements may be examined from 8 a.m to 4 p.m. at the Department's office at Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428, by contacting Kevin Hess at (610) 832-6194 or Paul Rettinger at (610) 832-6300 during normal business hours.     Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

The fill placement shall not exceed a maximum elevation of 490-feet and have a minimum side slope of 1-feet vertical to 3-feet horizontal.        E11-264.  Encroachment. Pennsylvania Department of Transportation, 1620 North Juniata Street, Hollidaysburg, PA 16648. To remove the existing structure and to construct and maintain a 1.0-foot depressed single cell concrete box culvert having a normal span of 19.7 feet and an underclearance of 4.0 feet in Howells Run for the purpose of improving transportation safety and roadway standards. This permit also authorizes the construction and maintenance of an elevated flood plain along Howells Run for a distance of approximately 260 feet downstream from the proposed culvert and a temporary roadway crossing consisting of a single 71-inch × 47-inch corrugated metal arch culvert in an unnamed tributary to Howells Run and a single 77-inch × 52-inch corrugated metal pipe arch culvert in Howells Run upstream from proposed culvert.        E04-260.  Encroachment. Pennsylvania Power Company, Bruce Mansfield Plant, P. O. Box 128, Shippingport, PA 15077. To construct and maintain a conveyor having a total span of 264.0 feet with an underclearance of 38.0 feet across the channel of Haden Run (WWF) for the purpose of transporting synthetic gypsum across the channel of said stream from the Forced Oxidation Gypsum (FOG) facility to the National Gypsum Company (NGC) facility. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E02-1256.  Encroachment. Linmar Realty Company II, 1800 Moler Road, Columbus, OH 43207. To place and maintain fill in approximately 0.404 acre of wetlands (0.234 acre PEM and 0.17 acre PSS) adjacent to an unnamed tributary to Brush Creek (WWF) for the purpose of expanding the existing American Eagle Outfitters warehouse. The project is located on the south side of Thorn Hill Road, approximately 900 feet south from the intersection of Thorn Hill Road and Keystone Drive (Mars, PA Quadrangle N: 7.8 inches; W: 14.8 inches) in Marshall Township, Allegheny County. The applicant has met the wetland replacement requirement by contributing to the Wetland Replacement Fund, Project No. 95-096.

       E03-373.  Encroachment. Armstrong County Industrial Development Authority, 402 Market Street, Kittanning, PA 16201-1485. To relocate and maintain approximately 950 linear feet of an unnamed tributary to Glade Run (TSF) and to place and maintain fill in 0.33 acre of wetlands (PEM and PSS) for the purpose of property development. The permittee is responsible for 0.33 acre of replacement wetlands (PEM). This permit also authorizes the construction and maintenance of a culvert crossing consisting of two 30-inch pipes in an unnamed tributary to Glade Run (TSF). The project is located on Wible Road (T-530), approximately 0.5 mile south of its intersection with S. R. 4010 (Kittanning, PA Quadrangle N: 13.0 inches; W: 8.2 inches) in East Franklin Township, Armstrong County.

    Environmental Assessment Approvals and Actions on 401 Certification

       EA15-025CO.  Environmental Assessment. Oak Hill Associates, L.P. (607 Whiteland Hunt Road, Downingtown, PA 19335). To modify and maintain a jurisdictional dam across a tributary to West Branch Brandywine Creek (EV) located approximately 1,800 feet north of the intersection of Oakwood Road (T-402) and Chestnut Lane. The proposed modifications to the emergency spillway will maintain the existing normal pool level, preserving an emergent wetland which has developed in the reservoir (Coatesville, PA Quadrangle N: 17.7 inches; W: 2.2 inches) in West Bradford Township, Chester County. This dam has been assigned the permanent Department number of D15-376.


    SPECIAL NOTICES

    Public Meeting Followed by Public Hearing
    CAFO NPDES PA0209708 and WQM Permit
    No. 5998201

       The Department of Environmental Protection (Department) will be holding a public meeting followed by a public hearing on the following Concentrated Animal Feeding Operation (CAFO) permit applications: Hostetter Management Company (Sugar Valley Farms)--PA0209708, and Water Quality Management Application No. 5998201, located in Sullivan Township, Tioga County.

       The meeting/hearing is scheduled for March 30, 1999, at 6:30 p.m. at Mansfield Hose Company Fire Hall, 381 South Main Street, Mansfield, PA. The meeting is to solicit pertinent comments on the applications.

       The proposed CAFO operation will consist of approximately 1,600 average number of Animal Equivalent Units to produce 4 million gallons per year of manure and wastewater to be stored in a 1.71 million gallon primary manure storage impoundment and a 5.2 million gallon secondary manure impoundment with associated transfer structures. The handling and application of the contents will be controlled under a Nutrient Management Plan (NMP), approved by the Tioga County Conservation District. The applicable Effluent Limitation Guidelines in Federal Regulations under 40 CFR Part 412 stipulate that Confined Animal Feeding Operations shall not have any discharge to surface waters under normal operating conditions. All CAFO operations must meet the provisions of an approved NMP, obtain and comply with the Department's Water Quality Management Part II Permit for constructing new manure storage facilities, develop and implement best management practices (BMPs) to ensure that the water quality of the receiving water is maintained. Collectively, these requirements constitute the Department's narrative ''effluent limits'' for CAFOs necessary to protect waters of this Commonwealth.

       The proposed operation is located on the watersheds of unnamed tributaries of Corey Creek and Canoe Camp Creek both classified for the following uses: warm water fishery and aquatic life, water supply and recreation.

       Copies of these applications are available for review in the following office of the Department of Environmental Protection. Those interested in reviewing the application should call to schedule a date to review the files.

Comments should be kept brief and, depending on the number of speakers, may be limited to 10 minutes per speaker. Where groups are represented, a spokesperson is requested to present the group's concerns.
