     The following temporary authority and/or permanent authority applications for the right to render service as a common carrier or contract carrier in this Commonwealth have been filed with the Pennsylvania Public Utility Commission. Formal protests and petitions to intervene must be filed in accordance with 52 Pa. Code (relating to public utilities). A protest shall indicate whether it applies to the temporary authority application, the permanent authority application, or both. Filings must be made with the Secretary, Pennsylvania Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105-3265, with a copy served on the applicant by March 14, 2011. Documents filed in support of the applications are available for inspection and copying at the Office of the Secretary between 8 a.m. and 4:30 p.m., Monday through Friday, and at the business address of the respective applicant.

    Applications of the following for approval to begin operating as common carriers for transportation of persons as described under each application.

    A-2011-2223266. Smyth & Tomas, LLC t/a Economy Shuttle Service (475 Barker Road, Springfield, Delaware County, PA 19064)—persons, in airport transfer service, from points in Delaware County to the Philadelphia International Airport.

    A-2011-2225262. Stephanie L. Blakeney, t/a Blakeney Transportation Service (1353 East Vernon Road, Philadelphia, Philadelphia County, PA 19150) for the right to begin to transport persons, in paratransit service, from the City and County of Philadelphia to the following State Correctional Institutions located in Pennsylvania: Bellefonte, Cambridge Springs, Camp Hill, Chester, Coal Township, Dallas, Frackville, Graterford, Greene, Houtzdale, Hunlock Creek, Huntingdon, LaBelle, Marienville, Muncy, Philadelphia, Somerset and Waymart,and return.

    Applications of the following for the approval of the right and privilege to discontinue/abandon operating as common carriers by motor vehicle and for cancellation of the certificate of public convenience as described under each application.

    A-2011-2225166. Anthony L Attardo, t/a All Seasons Travel (34 North River Street, Plains, Luzerne County, PA 18705)—for the discontinuance of service and cancellation of its certificate to operate as a Broker, to arrange for the transportation of persons between points in Pennsylvania.

    A-2011-2225204. Earl Groff (32 Poplar Drive, Manheim, Lancaster County, PA 17545)—for the discontinuance of service and cancellation of the certificate as a common carrier, by motor vehicle, persons in paratransit service, limited to persons whose personal convictions prevent them from owning or operating motor vehicles, from points in the Counties of Berks, Chester, Dauphin, Lancaster, Lebanon, Schuylkill and York, to points in Pennsylvania, and return.

    A-2011-2225206. Community Renovations, Inc. (874 Douglas Avenue, Elkins Park, PA 19027)—for the discontinuance of service and cancellation of its certificate, as a common carrier, persons in group and party service in vehicles having a seating capacity not to exceed 15 passengers, excluding the driver, between points in the City and County of Philadelphia, and from points in said City and County to points in the Counties of Bucks, Delaware and Montgomery and return; subject to the following conditions: That no right, power or privilege is granted to originate service in that portion of the City and County of Philadelphia bounded by Spring Garden Street on the north, South Street on the south, the Schuylkill River on the west and the Delaware River on the east, and further excluding the Philadelphia Civic Center and all points which are within 1/4-mile radius thereof. That no right, power or privilege is granted to transport persons in conventional school bus-type equipment.

    A-2011-2225292. Senior Assist Services, Inc. (105 North Findley Street, Punxsutawney, PA 15767)—for the discontinuance of service and cancellation of its certificate, as a common carrier, by motor vehicle, persons in paratransit service, from points in the Counties of Jefferson and Clearfield, to points in Pennsylvania and return.

    COMPLAINT

     The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Transportation and Safety and other Bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Transportation and Safety Prosecutory Staff hereby represents as follows:

     1. That KNJ Limo Services, Respondent, maintains a principal place of business at 1506 Wistar Drive, Wyncote, PA 19095.

     2. That Respondent was issued a certificate of public convenience by this Commission on February 7, 2001, at Docket No. A-00116842, for limousine authority.

     3. That, between December 1 and December 31 of 2006, 2007, 2008 and 2009, Respondent did not provide this Commission with a current list of all of its vehicles utilized under its limousine authority. The list must contain the year, make, vehicle identification number and registration number for each vehicle. It shall be mailed to: Director, Bureau of Transportation and Safety, PA Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105.

     4. That, Respondent, by failing to provide this Commission with a current vehicle list, violated 52 Pa. Code § 29.333(d). The Bureau of Transportation and Safety Motor Carrier Services and Enforcement's Prosecutory Staff's proposed civil penalty for this violation is $250.

    Wherefore, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission fine KNJ Limo Services, the sum of two hundred and fifty dollars ($250) for the illegal activity described in this complaint and order such other remedy as the Commission may deem to be appropriate.

     3. That, between December 1 and December 31 of 2006, 2007, 2008 and 2009, Respondent did not provide this Commission with a current list of all of his vehicles utilized under his limousine authority. The list must contain the year, make, vehicle identification number and registration number for each vehicle. The list must contain the year, make, vehicle identification number and registration number for each vehicle.      3. That, between December 1 and December 31 of 2006, 2007, 2008 and 2009, Respondent did not provide this Commission with a current list of all of its vehicles utilized under its call or demand authority. The list must contain the year, make, vehicle identification number and registration number for each vehicle. The list must contain the year, make, vehicle identification number and registration number for each vehicle.      4. That, Respondent, by failing to provide this Commission with a current vehicle list, violated 52 Pa. Code § 29.314(c). The Bureau of Transportation and Safety Motor Carrier Services and Enforcement's Prosecutory Staff's proposed civil penalty for this violation is $250.

    Wherefore, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission fine D.N.T.      3. That, between December 1 and December 31 of 2006, 2007, 2008 and 2009, Respondent did not provide this Commission with a current list of all of its vehicles utilized under its call or demand authority. The list must contain the year, make, vehicle identification number and registration number for each vehicle. It shall be mailed to: Director, Bureau of Transportation and Safety, PA Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105.

     4. That, Respondent, by failing to provide this Commission with a current vehicle list, violated 52 Pa. Code § 29.314(c). The Bureau of Transportation and Safety Motor Carrier Services and Enforcement's Prosecutory Staff's proposed civil penalty for this violation is $250.

    Wherefore, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission fine Stephanie Cab Co. the sum of two hundred and fifty dollars ($250) for the illegal activity described in this complaint and order such other remedy as the Commission may deem to be appropriate.

     1. That all authority issued to Scott D. Zella, t/a Zella's Trucking (respondent) is under suspension effective July 09, 2010 for failure to maintain evidence of insurance on file with this Commission.

     2. That respondent maintains a principal place of business at P. O. Box 297, Leesport, PA 19533-0297.

     3. That respondent was issued a Certificate of Public Convenience by this Commission on September 11, 2006, at A-00122647.

     4. That respondent has failed to maintain evidence of Liability insurance on file with this Commission. The Bureau of Transportation and Safety Motor Carrier Services and Enforcement's Prosecutory Staff's proposed civil penalty for this violation is $500 and cancellation of the Certificate of Public Convenience.

     5. That respondent, by failing to maintain evidence of insurance on file with this Commission, violated 66 Pa.C.S. § 512, 52 Pa. Code § 32.2(c), and 52 Pa. Code § 32.11(a), § 32.12(a) or § 32.13(a).

    Wherefore, unless respondent pays the penalty of $500 and causes its insurer to file evidence of insurance with this Commission within twenty (20) days of the date of service of this Complaint, the Bureau of Transportation and Safety Prosecutory Staff will request that the Commission issue an Order which (1) cancels the Certificate of Public Convenience held by respondent at A-00122647 for failure to maintain evidence of current insurance on file with the Commission, (2) fines Respondent the sum of five hundred dollars ($500.00) for the illegal activity described in this Complaint, (3) orders such other remedy as the Commission may deem to be appropriate, which may include the suspension of a vehicle registration and (4) imposes an additional fine on the respondent should cancellation occur.
