    NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS

    NPDES APPLICATIONS

    PART I PERMITS

       Under to the Federal Clean Water Act and the Pennsylvania Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I below, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for five years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For all new permit applications, renewal application with major changes or applications for permits not waived by EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II below. These determinations are published as proposed actions for comments prior to taking final actions.

       Unless indicated otherwise below, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address, and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated above the application.

       This application is for issuance of an NPDES permit for a new discharge of treated sewage to Kegg Run in Watershed 11-C, in Juniata Township, Bedford County.

       The receiving stream is classified for warm water fishes, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, Fluoride, and Phenolics, the existing downstream potable water supply intake considered during the evaluation was Bedford Water Company located in Bedford Borough, Bedford County. The discharge is not expected to impact any potable water supply.

       The following effluent limitations are proposed for discharge to the receiving waters, Unnamed Tributary to Burgetts Fork, classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply, and recreation. The first existing/proposed downstream potable water supply (PWS) is Midland Borough Municipal Authority, located at Midland, Beaver County 44 miles below the discharge point.

       The following permit applications or requests for plan approval have been received by the Department of Environmental Protection (Department).

       Persons wishing to comment on any of the applications are invited to submit a statement to the office noted above the application within 15 days from the date of this public notice. Comments received within this 15-day comment period will be considered in making the final decision regarding the application. The comments should include the name, address, and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

       The Department reserves the right to hold a public hearing if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation of the area. If no hearing is held, the Department's Water Management Program Manager will make a final determination regarding the applications after a complete review. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       A copy of the permit application or proposed plan is on file in the office indicated and is open to public inspection. Appointments to review the application may be made by contacting Records Management at the indicated telephone number.


    Industrial Waste and Sewerage Applications Under The Clean Streams Law (35 P. S. §§ 691.1--691. 1001).

Box 276, Dudley, PA 16634 in Carbon Township, Huntingdon County to construct renovations to existing treatment equipment, source water protection, and sand drying beds was received in the Southcentral Region on January 18, 2001.

       Application Number 2101401. Sewage submitted by Ronald Mixell, P. O. Box 293, Carlisle, PA 17013 in North Middleton Township, Cumberland County to construct an individual sewage system consisting of septic tank, constructed wetland treatment cell and disinfection and land application of treated effluent from their single family residence was received in the Southcentral Region on February 6, 2001.

       Application Number 3601402. Sewage submitted by East Lancaster County School District, 669 East Main Street, New Holland, PA 17557 in Caernarvon Township, Lancaster County to replace the sewage treatment plant at Caernarvon Elementary School was received in the Southcentral Region on February 2, 2001.

       Application Number 2898401 01-1. Sewage submitted by Metal Township Municipal Authority, P. O. Box 216, Willow Hill, PA 17271 in Metal Township, Franklin County to modify a sewage treatment plant and outfalls and headwalls was received in the Southcentral Region on February 6, 2001.

       WQM Permit No. 4901402, Sewerage, West Chillisquaque Township Municipal Authority, P. O. Box 168, Montandon, PA 17850.

       This proposed facility is located in West Chillisquaque Township, Northumberland County.

       Description of Proposed Action/Activity: This project involves the construction of a sewer to serve Astro Village Mobile Home Park and Clymer Mobile Home Park plus Countryside Manor. All flow collected from these areas will then connect into a currently unused interceptor which will convey the flow to the Industrial Park Pump station and into the Borough of Milton Wastewater Treatment Plant. The application was received January 23, 2001 at the Northcentral Regional Office.

Application for the construction and operation of a sewer system and pumping station to serve the New England Road Sanitary Sewer System located in West Mifflin Borough, Allegheny County.

       Application No. 6500412. Sewerage, Charles R Chapman, RD 1 Box 1136, Ruffsdale, PA 15679. Application for the construction and operation of a sewage treatment plant to serve the Wen-Dell Mobile Home Park located in East Huntingdon Township, Westmoreland County.


    NPDES Stormwater Individual Permit

       The following parties have applied for an NPDES permit to discharge stormwater associated with a construction activity into waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices (BMPs) which restrict the rate and quantity of sediment discharged.

       Where indicated, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

       Persons wishing to comment on the proposed permit are invited to submit a statement to the appropriate Department Regional Office noted above the application within 30 days from the date of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address, and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate DEP Regional Office during the 30-day public comment period.

       Following the 30-day comment period, the appropriate Regional Office Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the office identified in this notice.

    Preamble 1


    Acknowledgment of Notices of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to public in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the site(s) identified below, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified below. During this comment period the municipality may request that the person identified below, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

       For further information concerning the content of a Notice of Intent to Remediate, please contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.        Willis Residence, Lower Makefield Township, Bucks County. Peter Kuyk, Environmental Compliance & Control, Inc., 400 Morris Ave., Denville, NJ 07834 (on behalf of Mr. & Mrs. John Willis, 3860 James Way, Boca Raton, FL, 33434) has submitted a Notice of Intent to Remediate site soil and groundwater contaminated with BTEX and petroleum hydrocarbons. The applicant proposes to remediate the site to meet the Statewide Health Standard. A summary of the Notice of Intent to Remediate was reported to have been published in the Intelligencer in January, 2001. A Final Report was simultaneously submitted.

       Former Fermtec Facility, West Chester Borough, Chester County. Richard P. Almquist, Jr., Oxford Engineers & Consultants, Inc., 2621 Van Buren Ave., Suite 500, Norristown, PA 19403 (on behalf of Robert M. Casciato & Senya Simeon D. Isayeff Real Estate Partnership, The G Building, 882 S. Matlack St., West Chester, PA 19382-4503) has submitted a Notice of Intent to Remediate site soil contaminated with lead and heavy metals and groundwater contaminated with solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The applicant proposes to remediate the site to meet the Statewide Health Standard for soil and Background standards for groundwater. A summary of the Notice of Intent to Remediate was reported to have been published in the Daily Local News on December 17, 2000.

       The Boeing Company, Ridley Township and Eddystone Borough, Delaware County. Colleen Costello, Langan Engineering & Environmental Services, Inc., 500 Hyde Park, Doylestown, PA 18901-1699 (on behalf of the Boeing Company, P. O. Box 16858, MS P25-62, Philadelphia, PA 19142-0858) has submitted a Notice of Intent to Remediate site soil contaminated with Benzene, Toluene, Ethyl Benzene, Cumene, Naphthalene, Fluorene, Phenanthrene and lead; and groundwater contaminated with Benzene, Toluene, Ethyl Banzene, Cumene, Naphthalene, Fluorene, Phenanthrene, lead, Trichloroethene, Methylene Chloride and Antimony. The applicant proposes to remediate the site to meet a combination of Statewide Health, Background and Site-specific Standards.     Notice of Plan Approval and Operating Permit Applications

    Non-Major Sources and Modifications

       The Pennsylvania Department of Environmental Protection (DEP) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       Notice is hereby given that DEP has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Office identified in this notice. Persons interested in reviewing the application files should contact the appropriate Regional Office to schedule an appointment.

       Persons wishing to receive a copy of the proposed Plan Approval or Operating Permit must indicate their interest to the DEP Regional Office within 30 days of the date of this notice, and must file protests or comments on a Proposed Plan Approval or Operating Permit within 30 days of the DEP providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Any comments or protests filed with DEP Regional Offices must include a concise statement of the objections to the issuance of the plan approval or operating permit and relevant facts, which serve as the basis for the objections. If DEP schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

       Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, Technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity, and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). The selected wastewater disposal alternative is described in the Plan Update Revision as ''Low-Pressure Sewer Alternative No. 2''. The alternative also proposes a limited rehabilitation of the Weissport Borough Municipal Authority's (Authority) existing main pumping station.

       Replacement of the Borough's entire wastewater collection system was found to be the only cost-effective alternative which would successfully eliminate excessive amounts of infiltration/inflow (I/I) from the Borough's wastewater collection system. Elimination of the excessive amounts of I/I is required to eliminate the existing hydraulic overload at the existing Lehighton Sewerage Authority's Wastewater Treatment Facility. Wastewater from the proposed, replacement collection system will be discharged to the existing Lehighton Sewerage Authority's Wastewater Treatment Facility for treatment and discharge. Upon completion of the proposed Central Carbon Municipal Authority's (CCMA) Wastewater Treatment Facility, wastewater from the Borough's wastewater collection system will be conveyed to and treated at the CCMA facility.

       Financing of the proposed wastewater collection/conveyance system is to be provided by the Pennsylvania Infrastructure Investment Authority (PENNVEST). Financing of the Borough of Weissport's portion of the CCMA Wastewater Treatment Facility is to be provided by the United States Department of Agriculture's--Rural Utilities Service.

       The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

    HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988

    NOTICE OF PROMPT INTERIM RESPONSE UNDER THE HAZARDOUS SITES CLEANUP ACT

       The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) has initiated a prompt interim response at the Clements Landfill site. This response has been undertaken under Section 505(b) of the HSCA (35 P. S. §§ 6020.505(b)). The site is located at: Ontelaunee and Perry Townships, Berks County, PA.

       The Clements Landfill Site (Site) is located approximately one and one-half miles east of Route 61, and is bordered by Birch Hill Road to the north, Shoemakersville Road to the east, Ontelaunee Drive to the south, and Kerns Road extending from the south to west-side of the site. The entire area surrounding the Site consists of residential and agricultural lands. The Site, an inactive landfill since 1970, is 68.29 acres on which approximately 25 acres are land filled.

       In June 2000, the Department sampled 13 residential wells adjacent to the Site. Three adjacent properties south of the Site, located on a geologic fracture trace running through the land filled area, have volatile organic compounds (VOC) contaminations above regulatory standards. Trichloroethylene (TCE) levels ranged from 24 micrograms per liter (µg/L) to 73 µg/L, vinyl chloride from 4 µg/L to 27 µg/L and cis-1, 2-Dichloroethylene (cis-1,2-DCE) from 79 to 140 µg/L. The regulatory limits for these VOCs in groundwater are 5 µg/L, 2 µg/L, and 70 µg/L respectively. Re-sampling of the impacted well water supplies confirmed these levels of VOC contamination.

       The Department proposes a prompt interim response at this site to protect public health and safety or the environment. This determination is based on the continued release of VOCs to the groundwater, and the actual human exposure to hazardous substances via inhalation, ingestion and dermal contact.

       The Department considered three alternatives: 1. No action, which allows the residents to have continued exposure to the VOC contamination; 2. Bottled water, which effectively removes the risk posed by ingestion, but would not remove the risk posed by inhalation and dermal contact; 3. Point-of-use water treatment systems that will treat the contaminated water to effectively remove the current human ingestion, inhalation and dermal contact threats. This alternative will be protective of human health and the environment.

       The Department is providing this notice under sections 505(b) and 506(b) of HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)), and the publication of this notice starts the administrative record period under HSCA. The Administrative Record which contains information about this site and which supports the Department's decision to perform this action at the site is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office located at 909 Elmerton Avenue, Harrisburg, PA 17110, by contacting Richard Morgan at (717) 705-4844. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

    The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

    FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

       The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)).

       To remove an existing 20-foot single span bridge over the East Branch of Tweed Creek (TSF-MF), and to construct and maintain a 32-foot long, 12-foot wide by 7-foot high twin-cell pre-cast box culvert and associated wing walls. The culverts will be depressed 1.0 foot below the streambed. The eastern cell will carry the low flow and western cell will have a 2.5-foot weir at each end of the box culvert to carry the flood flow. Work also includes reconstruction of approximately 625 linear feet of Hopewell Road and its intersection with Rodney Corner Road and associated stormwater facilities. The amount of wetland impact is considered a deminimis impact of 0.005 acre and wetland mitigation is not required.

       To construct and maintain two low-flow road crossings as follows: (1) a crossing of Craft Brook and adjacent wetlands, consisting of five 21-inch by 15-inch CMP arch culverts and rock fill, and (2) a crossing of a Tributary to Sawkill Creek and adjacent wetlands, consisting of two 21-inch by 15-inch CMP arch culverts and rock fill. The project includes the placement of fill in 0.13 acre of wetlands. The crossings are to be part of the Delaware State Forest trail system. The permittee is required to provide for 0.13 acre of replacement wetlands by participating in the Pennsylvania Wetland Replacement Project. The project is located along an existing natural gas pipeline right-of-way, within a tract of land known as the Milford Reservation. Crossing 1 is located approximately 3,000 feet north and upstream of Lily Pond (Milford, PA-NJ Quadrangle N:  22.4 inches; W:  14.3 inches), and Crossing 2 is located approximately 3,000 feet northeast of Lily Pond (Milford, PA-NJ Quadrangle N:  22.2 inches; W:  13.3 inches).

       E39-367. County of Lehigh, 17 South Seventh Street, Allentown, PA 18101-2400. City of Allentown, Lehigh County, ACOE Philadelphia District.

       To maintain the existing bridge, having three normal spans of approximately 58 feet, 61 feet and 62 feet, with an underclearance of approximately 22 feet, across Little Lehigh Creek. Work will consist of (1) the placement of R-6 riprap scour protection along one of the bridge piers and at a sanitary sewer manhole, (2) installation of two gabion deflectors along the left bank of Trout Creek, just upstream of the bridge, and (3) removal of debris and gravel at the confluence of Trout Creek and Little Lehigh Creek, extending downstream within the right side of the channel of Little Lehigh Creek for a distance of approximately 200 feet. The project is located along Basin Street (Allentown East, PA Quadrangle N:  18.6 inches; W:  11.6 inches).

       E64-213. Pennsylvania Department of Transportation Engineering District 4-0, P. O. Box 111, Scranton, PA 18501, in Dreher Township, Wayne County and Greene Township, Pike County, ACOE Philadelphia District.

       To remove the existing structure and to construct and maintain a prestressed concrete spread box beam bridge having a single span of 62.3 feet (19.00 meters) and underclearance of approximately 13.2 feet (4.03 meters) across Wallenpaupack Creek and to permanently place fill in a de minimis area of wetlands equal to 0.03 acre. The project also includes the construction of a temporary bridge, upstream of the existing structure, having a single span of 77.4 feet (23.59 meters) and underclearance of approximately 9.2 feet (2.80 meters) and the temporary placement of fill in 0.4 acre of wetlands for the purpose of maintaining a temporary roadway during construction of the new bridge. The project is located along S.R. 0507, Segment 0230, Offset 1187 (Newfoundland, PA Quadrangle N: 12.0 inches; W: 9.1 inches).

       E54-269. Pennsylvania Department of Transportation, Engineering District 5-0, 1713-41 Lehigh Street, Allentown, PA 18103-4727, ACOE Philadelphia District.

       To remove two 48-inch diameter R.C.P. culverts and five R.C.P. stormwater outfall structures and to construct and maintain the following in a tributary to the Little Schuylkill River: 1) a 90-inch x 60-inch concrete box culvert stream enclosure under S.R. 0061 having a length of approximately 228 feet and depressed 12 inches below the streambed; 2) a channel change having a length of approximately 222 feet for the purpose of redirecting said tributary into the S.R. 0061 box culvert; and 3) three R.C.P. stormwater outfall structures to convey runoff from S.R. 0061 directly to said tributary. The project is associated with the reconstruction of the S.R. 0061/S.R. 0895/T715 intersection to lessen the incident of accidents and address public safety concerns (Auburn, PA Quadrangle N: 20.0 inches; W: 4.4 inches).

       To construct and maintain two 6-inch diameter water intake structures in two separate ponds situated on a tributary to Wigwam Run to be used as dry hydrants to provide fire protection at the Christian Center.        E17-352. Pennsylvania Department of Transportation, Engineering District 2-0, 1924-30 Daisy Street, Clearfield, PA 16830. Bridge SR 001, Sect. A03, in Lawrence Township, Clearfield County, ACOE Baltimore District (Clearfield, PA Quadrangle N: 0.6 inches; W: 5.1 inches).

       To remove an existing structure and construct, operate and maintain a single span adjacent box beam bridge to carry SR 1001, Section A03 across Montgomery Creek for the improvement of public highway safety. The single span bridge shall be constructed with a center-to-center bearing span of 39.4-feet, underclearance of 6.2-feet, and skew of 90-degrees. The project is located along the southern right-of-way of SR 0879 approximately 2,200-feet north of SR 1001 and SR 0879 intersection in Lawrence Township, Clearfield County. This permit also authorizes the construction, operation, maintenance and removal of temporary stream diversions and a minor road crossing. Upon removal of all temporary structures, Montgomery Creek shall be shall be restored to natural geometry, profile and pattern.

       E18-307. PA DCNR, Bureau of Facility Design, P. O. Box 8451, Harrisburg, PA 17105-8451. Robbins Road over Shintown Run, in Noyes Township, Clinton County, ACOE Baltimore District (Renovo West, PA Quadrangle N: 17.6 inches; W: 11.3 inches).

       To remove an existing structurally deficient bridge and to construct and maintain a reinforced concrete box culvert with a clear span of 15.50 feet and an underclearance of 5.50 feet with the associated concrete wingwalls, R-6 riprap choked with R-4 stone or equivalent sized native stone aprons and fish baffles in Shintown Run all of which are located 2 miles southeast on Robbins Road from its intersection with Basin Road. This project proposes to impact 66 feet of Shintown Run, which is classified as High Quality--Cold Water Fishery. This permit was issued under Section 105.13(e) ''Small Projects.''        To remove existing Forestry Bridge No. 15-0019 and construct, operate and maintain a single span Bebo pre-cast concrete arch bridge to carry Twelve Mile Road across Left Branch Young Womans Creek (High Quality-Cold Water Fishery). The single span bridge shall be constructed and maintained with a span of 28.9-feet, rise of 8.5-feet and underclearance of 8.7-feet. The project will not impact wetlands while impacting 110-feet of waterway which is located along the western right-of-way of SR 0044 approximately 3.4-miles north of Greenlick Road and Twelve Mile Road intersection in Stewardson Township, Potter County. This permit also authorizes construction, operation, maintenance and removal of temporary stream diversions and a road crossing. The temporary structures shall be constructed with non-erodible rock that is free of silts and fines. Upon removal of the temporary structures, Left Branch Young Womans Creek shall be restored to natural stream geometry, profile and pattern. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E59-412. PA DCNR, Bureau of Facility Design, P. O. Box 8451,Harrisburg, PA 17105-8451, in Shippen Township, Tioga County, ACOE Baltimore District (Asaph, PA Quadrangle N: 7.2 inches; W: 10.1 inches).

       DCNR, Bureau of Forestry is proposing to 1) remove an existing bridge, 2) construct and maintain a prestressed concrete spread box beam bridge with a normal span of 7.07-meters and a minimum underclearance of 2.02-meters in Left Asaph Run, 3) temporarily construct and maintain three 915-millimeters corrugated aluminum culvert pipes placed on Class 4 geotextile with the associated R-4 rock fill over the pipes to be placed 25 meters upstream of the existing bridge, 4) temporarily construct and maintain a concrete and sand bag diversion dike at the existing bridge site, all of which are located 643 meters south west of the intersection of Left Asaph Run Road and Right Asaph Run Road. This project proposes to temporarily impact 35-meters and permanently impact 22-meters of Left Asaph Run, which is classified as a High Quality-Cold Water Fishery.

       E60-147. Raymond Young and Carol Brink Young, RR 2, Box 1048, New Columbia, PA 17856. 24-inch culvert crossing, in White Deer Township, Union County, ACOE Baltimore District (Allenwood, PA Quadrangle N: 5.21; W: 1.56).

       The permit application proposes to maintain a 24-inch culvert crossing on an unnamed tributary to the West Branch of the Susquehanna River for a private residence. The crossing contains 25 feet of fill above the culvert, is 175-feet long and is 15-feet wide. This project is located .5 mile north on Milroy Road from the intersection with SR 1004. This project proposes to impact 100 linear feet of unnamed tributary to the West Branch of the Susquehanna River, which is designated a Warm Water Fishery and does not propose to impact any wetlands. This permit was issued under Section 105.13(e) ''Small Projects.''

       2.  Fill 0.48 acre of wetland for construction of a pond and Hole 3 of the golf course (Baden, PA Quadrangle N: 18.6 inches; W: 2.5 inches).

       3.  Construct and maintain a raw water intake in Brush Creek approximately 600 feet west of Powell Road near the Cranberry Township Municipal Sewer and Water Authority Wastewater treatment plant (Baden, PA Quadrangle N: 17.0 inches; W: 2.85 inches).

       The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

       These actions of the Department may be appealed to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483, by any aggrieved person under the Environmental Hearing Board Act (35 P. S. § 7514); 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). Appeals must be filed with the Environmental Hearing Board within 30 days from the date of this issue of the Pennsylvania Bulletin unless the appropriate statue provides a different time period. Copies of the appeal form and the Department's regulations governing practice and procedure before the Board may be obtained from the Board.

       Project Description: This activity involves the discharge of supernatant from the U.S. Army Corps of Engineers Fort Mifflin Dredge Disposal Basin into the Delaware Estuary--Zone 4. The supernatant will be generated through the disposal of approximately 49,000 cubic yards of sediment dredged from the Sunoco Girard Point Wharf facility at the Philadelphia Refinery. A hydraulic suction dredge and pipeline will be used to move the sediment directly to the disposal basin.

    SPECIAL NOTICES

    Public Notice of Proposed Consent Order and Agreement

    Former Avtex Fibers, Inc. Site,

    Vernon Township, Crawford County

       Under Section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), notice is hereby provided that the Department of Environmental Protection (Department) has agreed to a Consent Order and Agreement (Agreement) with FMC Corporation, 200 E. Randolph Drive, Chicago, Illinois 60601 (FMC) concerning the resolution of their liability for the mercury contamination at the former Avtex Fibers, Inc. facility's wastewater treatment plant (site), located in Vernon Township, Crawford County.

       Between 1929 and 1986, mercury from the mercury seals leaked into the trickling filter tanks and the trickling filter media in the wastewater treatment plant at the Avtex Fibers, Inc. facility in Vernon Township, Crawford County, Pennsylvania. In 1995, certain aspects of the wastewater treatment plant, including the trickling filter media and mercury-lubricated distribution arms were dismantled. During and subsequent to this dismantling, mercury leaked into the trickling filter tanks, trickling filter media and soils near the trickling filter tanks. This leaking of mercury constituted a ''release'' and ''threat of release'' as defined by Section 103 of HSCA. Mercury is also defined in Section 103 of HSCA as a ''hazardous substance''.

       As an owner during a period of time that hazardous substances were released at the site, FMC is a ''responsible person'' as defined in Section 103 of HSCA. Under the terms of the Agreement, FMC shall: 1) Collect the elemental mercury for off-site disposal or recycling to the extent possible from the trickling filter tanks; 2) Test the trickling filter media, if it fails a characteristically hazardous waste determination it will be treated to a level that allows on-site containment or disposed off-site as a hazardous waste; 3) Permanently contain all other sediments, wastes, and apparatus within a trickling filter tank, following any necessary decontamination. Following the completion of these actions, FMC shall be relieved of further liability concerning the release and threat of release of mercury from the wastewater treatment facility at the site, pursuant to Section 501(a) of the Land Recycling Act (35 P. S. § 6026.501(a)).

       The specific terms of this settlement are set forth in the Agreement between the FMC and the Department. The Department will receive and consider comments relating to the Agreement for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations, which indicate that the Agreement is inappropriate, improper, or not in the public interest. After the public comment period, the Department's settlement with FMC shall be effective upon the date that the Department notifies FMC, in writing, that this Agreement is final and effective in its present form, and that the Department has filed a response to significant written comments to the Agreement, or that no such comments were received.

    Consent Order and Agreement

    Borough of Kane

    Borough of Kane Authority, McKean County

       The Department of Environmental Protection (Department) has entered into a Consent Order and Agreement with the Borough of Kane and the Borough of Kane Authority (hereinafter collectively referred to as ''Kane'') concerning the Pine Street wastewater treatment plant and sewerage collection and conveyance system.

       On January 17, 2001, the Department of Environmental Protection signed a Consent Order and Agreement with the Borough of Kane and the Borough of Kane Authority. The Consent Order and Agreement requires Kane to pay a civil penalty of $7,500 for past National Pollutant Discharge Elimination System Permit violations and sewage overflows from the sewerage collection and conveyance system. Kane will also submit a long term control plan to the Department, focusing on a comprehensive solution to any outstanding environmental issues.

       The specifics of the Department's settlement with Kane are set forth in the Consent Order and Agreement.     Proposed Coastal Zone Management Program

    Section 309 Assessment

       The Department of Environmental Protection, Office for River Basin Cooperation has voluntarily developed a draft Assessment of the Coastal Zone Management Program in accordance with Section 309 of the Coastal Zone Management Act (CZMA), as amended in 1990 and 1996. States and territories are encouraged to develop program changes in one or more of nine coastal enhancement areas, including wetlands, public access, coastal hazards, cumulative and secondary impacts, energy and government facility siting, marine debris, ocean resources, special area management plans and aquaculture. Under this program, the U. S. Secretary of Commerce is authorized to make awards to states and territories to develop and submit for Federal approval program changes that support attainment of the objectives of one or more of the enhancement areas.
