Unless otherwise indicated on the basis of preliminary review and application of lawful standard and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

The Department of Environmental Protection has made a preliminary determination to approve RACT plans and amendments to the State Implementation Plan (SIP) for the following facilities:
Lafayette College, City of Easton, Northampton County.
The proposed SIP revisions do not adopt any new regulations. They incorporate the provisions and requirements contained in the RACT approval for this facility to comply with current regulations.
The preliminary RACT determinations, if finally approved, will be incorporated into the operating permit for this facility and will be submitted to the U. S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan.

Request for Variance
The Bureau of Deep Mine Safety has received a request for variance from Summit Anthracite, Inc. The following notification contains a summary of this request. Complete copies of the variance request may be obtained from Glen Ziegler by calling (717) 787-1376.
The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. Section 1402 of the Anthracite Coal Mine Act, 52 P. S. § 70-1402, provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.
Section 522 of the Anthracite Coal Mine Act reads: The face of a chamber, room or breast shall not be advanced more than sixty feet beyond the last open crossheading or crosscut.
Summary of the request: Summit Anthracite requests a waiver of section 522 of the Anthracite Coal Mine Act. This waiver would increase the maximum distance from 60 feet to 160 feet that advancement can be made from the last open crosscut for all gangway development at the Tracy Vein Slope Operation.
MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for water quality certification have been received by the Department of Environmental Protection. Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permits, and a United States Army Corps of Engineers (ACOE) permit. As proposed, the work shall consist of (1) removing 255.0 linear feet of stream enclosure and constructing 255.0 linear feet of rock lined trapezoidal stream channel; (2) removing fill from 0.13 acre wetlands and restoring the wetland cross-section and hydrology; and (3) placing and maintaining fill in 0.47 acre of wetland. The project is located along the western right-of-way of SR 0053 approximately 0.95 mile north of the intersection of SR 0253 and SR 0053 (Houtzdale, PA Quadrangle N: 13.9 inches; W: 12.9 inches) in Woodward Township, Clearfield County. The 0.47 acre of permanently impacted wetlands shall be mitigated with 2.0 acres of replacement wetlands by the applicant. Estimated stream disturbance is 255 linear feet; stream classification is Cold Water Fishery.

To construct and maintain a road crossing 174 feet in length × 10 feet in width through a de minimus area of forested palustrine wetlands less than or equal to 0.05 acre to provide access to a proposed single family residence. To construct and maintain a stream enclosure of Coal Brook (CWF), consisting of 840 linear feet of 7-foot-diameter corrugated steel pipe, for the purpose of constructing the Northeastern Pennsylvania Civic Arena/Convention Center. E46-761. Encroachment. New Hanover Township, 2943 North Charlotte Street, Gilbertsville, PA 19525-9718. To remove the 15-foot wide timber deck single lane bridge on Henning Road, with a span of 10 feet, and an average underclearance of 4 feet, and to construct and maintain a 24-foot wide, 12-foot by 4-foot precast reinforced concrete box culvert in and along Deep Creek (TSF), impacting a deminimus amount of wetland (PSS). This site is located approximately 400 feet north of the junction of Henning Road and Deep Creek Road (Sassamansville, PA Quadrangle N: 16 inches; W: 1.5 inches) in New Hanover Township, Montgomery County.

The new bridge will have a clear span of 35 feet and a maximum underclearance of 8 feet and will be located approximately 4,200 feet north of S. R. 0228 (Mars, PA Quadrangle N: 14.55 inches; W: 4.65 inches) located in Adams Township, Butler County.
E24-196. Encroachment. Department of Conservation and Natural Resources, Bureau of Forestry, 400 Rachel Carson State Office Building, 8th Floor, P. O. Box 8451, Harrisburg, PA 17105-8451. To remove existing wooden bridge and to construct and maintain a single span timber bridge with a clear span of approximately 19 feet across Paige Run (HQ-CFW). The project is located across Paige Run within the Elk State Forest on Red Run Road approximately 1.6 miles Northwest of the intersection of Quehanna Highway (S. R. 2004) and Red Run Road. This project will also include the use of a temporary Road crossing across Paige Run directly upstream of the existing and proposed bridge location (Driftwood, PA Quadrangle N: 3.75 inches; W: 16.75 inches) located in Benezette Township, Elk County.

EA20-002NW. Encroachment. U. S. Fish & Wildlife Service, Erie National Wildlife Refuse, 11296 Wood Duck Lane, Guys Mills, PA 16327. To remove a total of 1,900 linear feet of accumulated sediments and vegetation in three locations from a water course to accommodate discharge flows from an existing impoundment (Pool N) on the Erie National Wildlife Refuge. This project will reduce water levels over an existing 26-inch high pressure Natural Gas pipeline operated by Tennessee Gas Pipeline and to prevent flooding on adjoining private property. The project is located north of SR 0198 approximately 3,800 feet west of the intersection of S. R. 0198, S. R. 2013 and S. R. 2032 in the village of Guys Mills (Townville, PA Quadrangle N: 1.25 inches; W: 12.0 inches) located in Randolph Township, Crawford County.

Final Reports
The following final reports were submitted to the Department of Environmental Protection under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

Environmental Assessment Approvals and Actions on 401 Certifications
EA10-009NW. Environmental assessment. Department of Environmental Protection, District Mining Operations, White Memorial Building, Knox, PA 16323. To construct and maintain two separate two-cell vertical flow wetlands utilizing Successive Alkaline Producing System (SAPS) technology and to construct a nonjurisdictional dam to provide treatment of several acid mine water discharges. Typical water sampling analysis results of the discharges indicate pH <4.0, Mn 2.0 mg/l, Fl >2.0 mg/l, and Al>3.0 mg/l. Collectively these treatment facilities will be referred to as ''Ferris Treatment Complex'' and is located in the Slippery Rock Creek watershed (CWF). The project will impact 0.4 acre of wetlands (PEM). Recycling Grant Award Under the Municipal Waste Planning, Recycling and Waste Reduction Act
The Department of Environmental Protection announces the following grant to Northampton County for a paper recycling project at Ponderosa Fibers of Pennsylvania under the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 902). The grant is a re-offering of a previous Act 101 Public-Private Partnership Recycling Grant award to process milk and drink cartons into a high grade fiber pulp.
Act 101 § 902 grant funds can be used to develop and implement recycling collection, processing and manufacturing projects involving recyclable materials identified in section 1501(c)(1)(i) of Act 101 (53 P. S. § 4000.1501(c)(1)(i)) and the municipal waste regulations under the § 271.1 definition of source separated materials including clear glass, colored glass, aluminum, steel and bimetallic cans, high-grade office paper, newsprint, corrugated paper, plastics and other marketable grades of paper. Facilities and equipment funded under this program remain the property of the local government grantee for their useful life.
Municipalities and counties are eligible for up to 90% funding of approved recycling project costs. Municipalities considered financially distressed under the Municipalities Financial Recovery Act (53 P. S. §§ 11701.101--11701.501) are eligible to receive funding for an additional 10% of approved costs. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.

Application Period for Municipal Recycling Program Performance Grant Applications Under Act 101, § 904
The Department of Environmental Protection (DEP) announces a request for applications from municipalities for recycling performance grant assistance for recycling programs under the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 904). Municipalities include counties, cities, boroughs, incorporated towns, townships and home rule municipalities. This application period is for eligible materials recycled and marketed in calendar year 1996.
Municipal Recycling Program Performance Grant funds will be awarded to municipalities based upon the weight of source separated recyclable materials identified in § 1501(c)(1)(i) of Act 101 recovered by municipal recycling programs, and the population of the municipality as determined by the most recent decennial census. Municipalities awarded grants will receive a base award of $5 for each approved ton of eligible recyclable materials marketed, and a bonus award of $1 per approved ton for each percentage of municipal waste calculated by DEP to be diverted from disposal. The weight of eligible materials allowable from nonresidential (commercial and institutional) sources will be limited to no more than the weight of approved eligible materials from residential sources. The Department will not award grants calculated to be less than $10.
Eligible materials include postconsumer: clear glass, colored glass, aluminum, steel and bimetallic cans, high-grade office paper, newsprint, corrugated paper, other marketable grades of paper, and plastics. Grants will be awarded only for properly documented, eligible materials that were actually marketed on or after January 1, 1996, to and including December 31, 1996. Grant funds will not be awarded for residues, materials not listed as eligible including, but not limited to, leaf and yard wastes, or any materials which cannot be documented as being recycled into a new product or use.
Documentation to support all claims that eligible recyclable materials were generated within the municipality and marketed must be retained at the offices of the municipal applicant for 4 years from the end date of the year the application covers. The supporting documentation is not required to be submitted with the application.
Acceptable Supporting Documentation: Weight slips or receipts verifying that the materials were recycled or marketed are required as supporting documentation for the grant application. The documentation must include: 1) the date the materials were recycled/marketed; and, 2) the type of material recycled/marketed; and 3) the name of the municipality where the material was generated; and, 4) the weight, stated in pounds or tons, of the material recycled/marketed. Documentation supporting materials source separated from municipal waste by commercial/institutional establishments and recycled/marketed must bear the name of the establishment and the municipality where the establishment is located. This information must be contained on one of the following: 1) a weight/market receipt; or, 2) a report submitted by the hauler or market vendor on its company letterhead; or, 3) a signed report submitted by the hauler or market vendor, which clearly indicates the name of the company who collected the material or the name of the market vendor, as well as the name, title and signature of the company official who completed the report. Reports may be submitted on annual, monthly, weekly or other time period format. All information must be legible.
Estimates of weight will not be accepted except in cases where: 1) the material is packaged in uniform bales and the average weight of a bale can be demonstrated and supported by weight receipts, and a record of the number of bales was provided by the market vendors; or when, 2) multiple generators contribute to a known quantity of marketed material, and the hauler or market estimates the quantities attributable to any individual establishment or municipality, and verifies the estimate with a signature.
Supporting documentation must be available for review by representatives of the Department of Environmental Protection, the Office of the Attorney General and the Office of the Treasurer. Although the supporting documentation is not required to be submitted with the grant application, any documentation provided must conform to the above requirements or the materials claimed will not be credited toward the grant award.
Grant applications must be on forms provided by the Department for calendar year 1996. Grant applications must be delivered by 3 p.m., September 30, 1997, or postmarked on or before that day. Applications received by the Department after the deadline will be returned to the applicant. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of moneys in the Recycling Fund.
