Rescission Order

   On December 3, 2007, the Commission entered a Default Order at this docket against Lakeside Water Systems, Inc. (Lakeside), a water utility certificated at A-210069, for failure to file its 2005 Annual Report.

   The Commission has subsequently learned that Deer Haven, LLC, on behalf of Lakeside, filed the 2005 Annual Report on April 4, 2007, but an internal administrative error in handling the filing did not properly credit the filing to Lakeside. The Secretary's Bureau is now in the process of correcting this error. Based on review of Commission records, it is clear that Lakeside's 2005 Annual Report was properly filed before the Complaint in this matter was filed on April 23, 2007; Therefore,

It Is Ordered That:

   1.  The Default Order entered December 3, 2007, is hereby rescinded.

   2.  A copy of this Order be published in the Pennsylvania Bulletin.
