S. §§ 1303.101—1303.910); Doc. No. MS09-11-006 And Now, this 10th day of December, 2009, considering the motion of the Insurance Department, Medical Care Availability and Reduction of Error Fund (MCARE) to stay these proceedings and the appellants' response thereto, it is Ordered that argument on the motion will be conducted on January 7, 2010, at 1 p.m. in the Administrative Hearings Office, Capitol Associates Building, Room 200, 901 North Seventh Street, Harrisburg, PA 17102. The argument will be informal in nature, will not be transcribed and no briefs or legal memoranda will be entertained at this time. The parties should be prepared to discuss the status and nature of related Commonwealth Court litigation, the reasons for and against a stay of this consolidated appeal, and future scheduling should I deny the motions for stay. The Hearings Administrator shall cause notice of this consolidated appeal involving the 2010 MCARE assessment to be published in the Pennsylvania Bulletin. This order is effective immediately.
