[33 Pa.B. 6233] THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on an NPDES application are invited to submit a statement to the contact office noted before the application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after any public hearings are held.

Description of Size and Scope of Proposed Operation/Activity: The Nolt Farm CAFO is an existing swine, dairy and pullet operation with a total of 752.68 AEUs. The operation includes 4,300 swine, 145 beef and 44,000 pullets with an estimated total annual manure production of 12,372 tons. This application is for a proposed expansion of the swine operation. The expansion plans are to construct two swine finishing floors with each barn holding approximately 2,300 hogs. The manure will be handled as a liquid and stored in two 225-foot by 81-foot by 8-foot deep reinforced concrete underhouse storages. Each manure storage has a capacity of 840,700 gallons. The barn will have slotted floors for the transfer of manure to the storage facility. An existing manure storage structure and one of the existing swine barns will be removed to accommodate the proposed barns.
The receiving stream, Tulpehocken Creek, is in watershed 3-C and classified for TSF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25-year/24-hour rain storms, the CAFO general permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with the Pennsylvania Nutrient Management Act and The Clean Streams Law constitutes compliance with the State narrative water quality standards.

Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a Site-Specific Standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office after which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. AIR QUALITY PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS NEW SOURCES AND MODIFICATIONS The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.
46-0222: Bostik Findley, Inc. (1740 County Line Road, Huntingdon Valley, PA 19006) for expansion of an adhesive and sealant manufacturing process at their facility in Upper Moreland Township, Montgomery County. This facility is a non-Title V facility. The pollutants of concern from the adhesive and sealant manufacturing process are VOCs, PM and HAPs. There are no controls for VOCs and HAPs. However, emissions of PM will be controlled by one of three dust collectors. VOC emissions will be less than 17 tpy. HAP emissions will be less than 11 tpy. PM emissions will be less than 1 tpy. The Plan Approval will contain recordkeeping and operating restrictions designed to keep the facility operating within the allowable emissions and all applicable air quality requirements.
09-0117A: Heucotech, LTD (99 Newbold Road, Fairless Hills, PA 19030) for the expansion and modification of the pigment mixing operations in Falls Township, Bucks County. This expansion and modification of the pigment mixing operations may result in the emissions of 1.1 tons per year of PM10, 3.34 tons per year of ammonia and 0.02 ton per year of VOCs. The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

The facility has emission caps to limit the emissions to below 100 tons per year of CO, NOx, SOx and PM10, 50 tons per year of VOCs, 10 tons per year of HAPs and 25 tons per year HAPs. The plan approval shall contain testing, monitoring, recordkeeping and reporting requirements, emission restrictions and work practice standards designed to keep the facility operating within all applicable air quality requirements.

17-303-003B: Glenn O. Hawbaker, Inc. (711 East College Avenue, Bellefonte, PA 16823) for construction of a recycled asphalt pavement (RAP) crusher and two associated screens, three associated conveyors, one associated feeder and one associated bin, the construction of a 2,000-gallon oil storage tank and a 25,000-gallon oil storage tank and the modification of a drum mix asphalt concrete plant in Sandy Township, Clearfield County. The modification is the proposed use of virgin no. 5 fuel oil, virgin no. 6 fuel oil and reprocessed/recycled oil as fuel in the asphalt concrete plant's drum burner in addition to the gas (natural or LP) and virgin no. 2 fuel oil which the plant is currently allowed to burn.
Fugitive particulate matter emissions from the plant's RAP crushing system are projected by the applicant to be no greater than 10.51 tons in any 12 consecutive month period but are actually expected by the Department to be much less than this. The VOC emissions from the two oil storage tanks are expected to be negligible. The asphalt concrete plant will emit no more than 16.5 pounds of NOx, 39.0 pounds of CO, 43.95 pounds of SOx and 21.6 pounds of VOCs when firing no. 5 fuel oil, no. 6 fuel oil or reprocessed/recycled oil nor will the fabric collector used for the control of PM emissions from the plant emit more than .04 grain of particulate matter per dry standard cubic foot of collector exhaust. The total combined HAP emissions from the asphalt plant are not expected to exceed 6.75 tons in any 12 consecutive month period and the formaldehyde and toluene emissions are not expected to exceed 2.09 and 1.96 tons, respectively, in the same period.
Following the completion of the proposed construction and modification, the entire facility will not emit more than 37.84 tons of NOx, 88.35 tons of CO, 99.59 tons of SOx, 29.84 tons of VOCs and 56.85 tons of PM, respectively, in any 12 consecutive month period.
The Department has determined that the proposed construction and modification will comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The Department consequently intends to issue a plan approval.
The following is a summary of the conditions the Department plans to place to place in the plan approval to be issued to ensure compliance with all applicable regulatory requirements:
1. The asphalt plant shall only be fired on gas (natural or LP), virgin no. 2 fuel oil, virgin no. 5 fuel oil, virgin no. 6 fuel oil or reprocessed/recycled oil.
2. The sulfur content of the virgin no. 5 fuel oil, virgin no. 6 fuel oil and reprocessed/recycled oil shall not exceed .5% (by weight).
3. The reprocessed/recycled oil used as fuel in the asphalt plant shall not contain contaminants equal to or in excess of the following limitations:

4. The permittee shall not accept for use in the asphalt plant any shipment of reprocessed/recycled oil for which the arsenic, cadmium, chromium, lead, total halide and PCB content and/or flashpoint are unknown, or which fails to meet any established limitation for any of these, nor shall the permittee accept for use any shipment of any oil to be used as fuel for which the sulfur content is unknown, or which fails to meet the limitation established herein for sulfur content. Additionally, the permittee shall not accept any shipment of virgin no. 5 or virgin no. 6 fuel oil to which reprocessed/recycled oil has been added unless the shipment is treated as reprocessed/recycled oil with respect to all applicable conditions of this plan approval nor shall the permittee accept any shipment of virgin no. 5 or virgin no. 6 fuel oil to which waste oil or other waste materials have been added nor shall the permittee add any waste oil or other waste materials to any fuel storage tank.
5. A sample of each load of reprocessed/recycled oil delivered to the asphalt plant shall be taken at the time of delivery to the plant using a sampling technique capable of achieving a representative composite sample of the entire load and shall be retained onsite for at least 2 years for random selection and analysis by the Department. The samples are to be sealed and identified as to the date of delivery, delivery invoice number, and the like.
6. A sample of each shipment of reprocessed/recycled oil delivered to the asphalt plant shall be taken at the time of delivery to the plant using a sampling technique capable of achieving a representative composite sample of the entire load and analyzed for total halide concentration using EPA Method 9077. The results of these analyses will not, however, be accepted by the Department as a demonstration of compliance with the limitation established herein for total halides should they differ from the results of analyses performed using EPA Method 9076. The permittee shall also perform a complete analysis for all contaminants and parameters for which limitations have been established herein using reference methods specified by the Department on at least 1 out of every 15 shipments of reprocessed/recycled oil received.
7. The following analytical methods are to be employed to determine compliance with the contaminant limitations and flashpoint limitations specified herein unless the Department specifies an alternate method:

The permittee shall submit an annual report to the Department listing the delivery date, quantity delivered, origin and delivery invoice number of each shipment of reprocessed/recycled oil delivered to the asphalt plant during the previous calendar year as well as identifying the arsenic, cadmium, chromium, lead, total halide, PCB and sulfur content and the flashpoint of each shipment. This report shall further identify the specific source of all analytical data provided and describe why this analytical data accurately represents the contaminant concentrations and flashpoint of the reprocessed/recycled oil delivered to the plant. This report shall be submitted by March 15 of each year.
9. The emission of particulate matter from the exhaust of the fabric collector controlling the emissions from the asphalt plant shall not exceed .04 grain per dry standard cubic foot of exhaust.
10. The NOx emissions from the asphalt plant shall not exceed .055 pound per ton of asphalt concrete produced when firing no. 5 fuel oil, no. 6 fuel oil or reprocessed/recycled oil.
11. The CO emissions from the asphalt plant shall not exceed .13 pound per ton of asphalt concrete produced when firing no. 5 fuel oil, no. 6 fuel oil or reprocessed/recycled oil.
12. The SOx emissions from the asphalt plant shall not exceed .141 pound per ton of asphalt concrete produced when firing no. 5 fuel oil, .139 pound per ton of asphalt concrete produced when firing no. 6 fuel oil or .146 pound per ton of asphalt concrete produced when firing reprocessed/recycled oil.
13. The VOC emissions (expressed as methane) from the asphalt plant shall not exceed .032 pound per ton of asphalt concrete produced when firing no. 5 fuel oil, no. 6 fuel oil or reprocessed/recycled oil.
14. The total combined HAP emissions from the asphalt plant shall not exceed 6.75 tons in any 12 consecutive month period, the formaldehyde emissions shall not exceed 2.09 tons in any 12 consecutive month period, the toluene emissions shall not exceed 1.96 tons in any 12 consecutive month period and the emission of any other individual HAP shall not exceed 1 ton in any 12 consecutive month period.
15. The quantity of asphalt concrete produced in the asphalt plant shall not exceed 1.35 million tons in any 12 consecutive month period.
16. The asphalt concrete plant shall not process RAP at a rate in excess of 25% of the total weight of all materials charged into the drum at any time.
17. The asphalt plant shall be stack tested to determine the NOx, CO and VOC emission rates when firing no. 5 fuel oil and processing virgin material, when firing no. 5 fuel oil and processing a combination of virgin material and RAP, when firing no. 6 fuel oil and processing virgin material, when firing no. 6 fuel oil and processing a combination of virgin material and RAP, when firing reprocessed/recycled oil and processing virgin material and when firing reprocessed/recycled oil and processing a combination of virgin material and RAP. The plant shall additionally be stack tested to determine its particulate matter emission rate while operating in one of the six operating scenarios. Should the required NOx, CO and VOC stack testing not be performed for any of the six operating scenarios identified herein, the asphalt plant will not be authorized to operate using that operating scenario.
18. The operation of the RAP crusher, screens and associated conveyors and feeder shall not result in the emission of any visible fugitive air contaminants (other then steam or water vapor).
19. No material other then virgin no. 2, no. 5 or no. 6 fuel oil and reprocessed/recycled oil shall be stored in the oil storage tanks. Additionally, no material having a vapor pressure equal to or greater than 10.5 kilopascals (1.5 psia) shall be stored in the tanks.
20. Following the completion of the construction and modification approved herein, the NOx, CO, SOx, VOC and PM emissions from the entire facility shall not exceed 37.84, 88.35, 99.59, 29.84 and 56.85 tons, respectively, in any 12 consecutive month period.
21. Comprehensive accurate records shall be maintained of the quantity of asphalt concrete produced each month as well as the amount of each type of fuel burned each month. All records shall be retained for at least 5 years and shall be made available to the Department upon request.

04-00033B: NOVA Chemicals, Inc. (400 Frankfort Road, Monaca, PA 15061) for the construction of new sources, the modification of existing sources and the installation of a catalytic oxidizer to increase production of ARCEL and PES in the D2 area of the Nova Chemicals Facility in Potter Township, Beaver County.
Notice is given, under 25 Pa. Code § 127.44(a)(4), that the Department intends to issue a Plan Approval for the expansion of the ARCEL production line and the installation of an associated catalytic oxidizer at the Beaver Valley site as described in the application to the Department, received on September 2, 2003. This is a Title V facility.
Copies of the application, the Department's analysis and other documents used in evaluation of the application are available for public inspection during normal business hours at the Department of Environmental Protection, 400 Waterfront Drive, Pittsburgh, PA 15222.
Special Conditions for Plan Approval PA-04-00033B
For the Department to assure compliance with all applicable standards, the Department proposes to place the following conditions on the Plan Approval:
1. Plan Approval PA-04-00033B is for the construction of new sources, the modification of existing sources and the installation of a catalytic oxidizer to increase production of ARCEL and PES in the D2 area of the Nova Chemicals Facility in Potter Township, Beaver County. These changes are being made in accordance with the application for Plan Approval and are listed in the following table (25 Pa. Code § 127.12b).

2. The emissions from the D2 area of the facility shall be limited as follows: 55 tons of VOC in any consecutive 12-month period. Compliance with this condition shall be demonstrated through source testing as required in Condition No. 12 and the recordkeeping provisions in Condition No. 11 (25 Pa. Code § 127.12b).
3. Overall destruction efficiency of VOC (as propane) in the CATOX shall not be less than 98%. For inlet concentrations less than 1,000 ppmv VOC (as propane), the outlet concentration may not exceed 20 ppmv (as propane) (25 Pa. Code § 127.12b).
4. Visible emissions from the oxidizer stack shall not exceed 10% opacity at any time. The visible emission performance standard will be met by operating the D2 CATOX in accordance with manufacturer's specifications. This stack shall also be included in the qualitative inspection procedures described in the facility's Title V Permit, Section C (Site Level Requirements), Condition No. 018 (25 Pa. Code § 127.12b).
5. Equipment to continuously monitor and record the inlet and outlet temperature of the CATOX shall be installed. A minimum acceptable outlet temperature shall be established during the most recent stack test demonstrating at least 98% VOC (as propane) destruction efficiency. Records of inlet and outlet temperatures shall be kept on file for a minimum of 5 years and shall be made available to the Department upon request. Operation of the CATOX at an outlet temperature below the established minimum acceptable temperature shall be recorded as a deviation and reported in the next compliance history update (25 Pa. Code § 127.12b).
6. Incidental VOC emissions from the D2 area shall not exceed an aggregate of 1,000 pounds in the 6-month periods, January--June and July--December of each year as allowed in Title V Permit. For purposes of this condition, incidental emissions are those emissions associated with the normal or routine operation of the D2 area in a manner consistent with good operating practices that have been approved by the Department (25 Pa. Code § 127.12b).
7. The owner/operator shall not permit the emission to the outdoor atmosphere of any malodorous air contaminants from the D2 area in a manner so that the malodors are detectable outside the property of the owner/operator (25 Pa. Code § 123.31).
8. This facility is subject to the fugitive emission requirements of 25 Pa. Code §§ 123.1 and 123.2.
9. The owner/operator shall keep monthly VOC emission estimates for the D2 area. Material balances and calculations used to estimate emissions shall be kept onsite for a period of 5 years and be made available to the Department upon request (25 Pa. Code § 127.12b).
10. Source testing shall be conducted within 90 days following completion of the Phase 2 portion of the project or no later than February 28, 2005, to demonstrate the following (25 Pa. Code Chapter 139).
a. CATOX destruction efficiency for VOC emissions.
b. Compliance with the requirements of Condition 4 shall be demonstrated through the testing of the centrifugal dryer, the surge bin exhaust and one uncontrolled PES source in the D2 area and the application of the emission calculation procedures included in the Phase 1 Request for Determination dated August 6, 2003.
11. The simultaneous stack testing of the inlet and outlet of the CATOX shall demonstrate compliance with the destruction efficiency requirement. This testing shall be performed at least once during the term of the permit.
12. The owner/operator shall submit a pretest protocol to the Department for approval at least 30 days prior to the performance of the source test (25 Pa. Code Chapter 139).
13. Stack testing shall be performed in accordance with 25 Pa. Code Chapter 139 and the Department's Source Testing Manual.
14. The Department shall be notified at least 2 weeks prior to the date of the source test so that an observer may be present (25 Pa. Code Chapter 139).
15. Two copies of the source tests results shall be supplied to the Department for review within 60 days following completion of the source test (25 Pa. Code Chapter 139).
16. The owner/operator may apply for Emission Reduction Credits once emission limitations are established through source testing in accordance with 25 Pa. Code Chapter 127, Subchapter E. Baseline emissions shall be established in accordance with 25 Pa. Code § 127.207(4).

[Continued from previous Web Page] 17. This Plan Approval authorizes temporary operation of the new or modified process equipment and operation of the catalytic oxidizer covered in this Plan Approval provided the following conditions are met (25 Pa. Code § 127.12b).
a. The Department must receive written notice from the owner/operator of the completion of the installation of the CATOX and the operator's intent to commence operation of the CATOX at least 5 working days prior to the completion of construction. Once the CATOX is installed increases of production can commence while the remainder of Phase 2 construction is completed.
b. Operation is authorized only to facilitate the start-up and shake-down of sources and cleaning devices, to permit operations pending the issuance of an Operating Permit or to permit the evaluation of the sources for compliance with all applicable regulations and requirements.
c. This condition authorizes temporary operation of the sources for a period of 180 days from the commencement of increased production, provided the Department receives notice from the owner/operator under subpart (a).
d. The owner/operator may request an extension if compliance with all applicable regulations and Plan Approval requirements has not been established. The extension request shall be submitted in writing at least 15 days prior to the end of this periods of temporary operation and shall provide a description of the compliance status of the source, a detailed schedule for establishing compliance and the reasons compliance has not been established.
e. The notice submitted by the owner/operator under subpart (a), prior to the expiration of this Plan Approval, shall modify the plan approval expiration date. The new plan approval expiration date shall be 180 days from the date of the written notice.
Persons wishing to provide the Department with additional information which they believe should be considered prior to the issuance of the Plan Approval may submit the information to the Department at the following address. A 30-day comment period, from the date of this publication, will exist for the submission of comments. Written comments must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval (specify the Plan Approval number) and concise statements regarding the relevancy of the information or objections to issuance of the Plan Approval.
A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in a newspaper or the Pennsylvania Bulletin or by telephone, when the Department determines notification by telephone is sufficient.

AMS 03012: Southwest Water Pollution Control Plant--Biosolids Recycling Center (8200 Enterprise Avenue, Philadelphia, PA 19153) for installation of four 25.5 mmBtu/hr boilers burning no. 2 fuel oil and digester gas to replace four existing boilers in the City of Philadelphia, Philadelphia County. There will be a reduction of 4.31 tpy of NOx emission because of BAT level controls on the new boilers. The Department has made a preliminary determination to approve a RACT plan as an amendment to the SIP for the facility. The proposed SIP revision does not adopt any new regulations. COAL AND NONCOAL MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.
Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.
Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of the NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30 day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). The project will disturb approximately 0.42 acre of earth. The project will not impact wetlands while impacting approximately 50 feet of waterway. The West Branch of Parks Creek is a CWF.

To remove an existing bridge and construct, operate and maintain a single-span bridge to carry Wendell Road (T-426) across Gazzam Run (HQ-CWF). The single-span bridge shall be constructed with a prestressed concrete spread box beams that provide a minimum normal span of 50 feet, clear width of 26 feet and underclearance of 4.5 feet. Since Gazzam Run is protected as a wild trout and stocked trout fishery, no construction or future repair work shall be conducted in or along the stream channel between October 1 and December 31 or April 1 and June 15 without the prior written permission from the Fish and Boat Commission. Bridge construction shall be conducted in stream low flow conditions and all in-stream abutment and wingwall construction shall be completed in dry work conditions through dam and pumping or fluming stream flow around work areas. Construction work also includes the installation of R-8 rock for footing scour protection. All rock scour protection shall have openings or voids choked with small, clean stone materials to avoid stream flow loss. The bridge construction project will permanently impact 0.01 acre of wetland while impacting 65 feet of waterway. The bridge construction project is long the eastern right-of-way of SR 0729 approximately 675 feet east of SR 0729 and Wendell Road (T-426) intersection. This permit authorizes the construction, operation, maintenance and removal of temporary stream diversions, cofferdams, road crossings and causeways. All temporary structures shall be constructed with clean rock, clear of fines; upon completion of the bridge, all structures removed with disturbed areas being restored to original contours and elevations. The 0.01 acre of wetland impacts incurred by bridge removal and construction are deemed de minimis and replacement of wetland 0.01 acre of wetland shall not be required.

To remove an existing single-span bridge and construct, operate and maintain a public road crossing an unnamed tributary to the Cowanesque River (CWF). The public road crossing shall be constructed to carry T-485 (Fox Hill Road) across the unnamed tributary with a single corrugated metal culvert pipe. The corrugated metal culvert pipe shall have a minimum diameter of 6 feet and a depression of 0.5 foot below the existing streambed elevations. The 6-foot diameter culvert pipe shall be installed between existing concrete bridge abutment with R-7 rip rap outlet protection along both stream banks. The public road crossing shall also include timber-cribbing headwalls. All construction and future work shall be conducted at stream low flow. As proposed, the project will not impact wetlands while impacting 50 feet of waterway. The Fox Hill Road project is along the northern right-of-way of SR 0049 approximately 4,100 feet north of T-485 and SR 0049 intersection. This permit does not authorize any temporary or permanent wetland impacts and as such, the permittee shall ensure no wetland impacts result from the removal of the existing bridge or construction of the proposed road crossing.

3. Realign approximately 150 linear feet of the channel of Norris Run extending upstream from the inlet of the extended box culvert under the eastbound lanes of I-80.
4. Extend and maintain the existing 74.5-foot long, 12-foot wide by 6.5-foot high reinforced concrete box culvert in Norris Run under the westbound lanes of I-80 an additional 25 feet on the downstream end, resulting in a total structure length of 99.5 feet.

HAZARDOUS SITES CLEANUP UNDER THE ACT OF OCTOBER 18, 1988 Notice of Proposed Interim Response Raymark Industries, Inc. Lower Mill Landfill Site, Manheim Township, Lancaster County The Department of Environmental Protection (Department), under the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.102--6020.1303), is proposing an interim response at the Raymark Industries, Inc. (Raymark) Lower Mill Landfill (landfill), Manheim Borough, Lancaster County.
The former 92-acre Raymark property is in the southeast portion of Manheim Borough, Lancaster County (USGS Manheim, PA Quadrangle map: North 40° 09` 29" latitude and West 76° 24` 34" longitude). This property can be found by measuring 6 1/2 inches north and 2 1/2 inches west of the southeastern corner of the map.
The 4.7-acre landfill is at the southern and southeastern borders of the Raymark property. This former disposal area (Site) comprises approximately 1.9 acres of the landfill area. The Site consists of a former in-filled lagoon and adjacent railroad right-of-way where waste and contaminated soil were placed. The Site is bordered to the north by the Norfolk Southern Railway Company and Pennsylvania Lines LLC right-of-way, to the west by Chickies Creek, to the east by Doe Run (tributary of Chickies Creek) and to the south by the confluence of Chickies Creek and Doe Run.
Prior to 1900, the Site was farmland. Plant operations began in 1908. These operations produced dry clutch brake linings or pads and other specialized friction products. The plant has produced these products throughout its history. All manufacturing operations were phased out during the 1990s. The Site was originally used as a settling basin/lagoon. Currently, this area contains lead and asbestos contaminated soil and solid waste with lead and asbestos content.
The Department proposes an interim response at this Site to protect public health and safety or the environment. This determination is based on the actual and potential human exposure to hazardous substances via inhalation, ingestion and dermal contact.
The Department is considering three alternatives: (1) No action, which allows the hazardous substances and contaminants to remain in place without modification. (2) Excavation of contaminated soil and waste from the railroad right-of-way with onsite disposal on the existing landfill, adding a 2-foot protective soil cover to the landfill area, institutional controls to prevent intrusive activities in the landfill area and routine groundwater monitoring. (3) Excavation of contaminated soil from the railroad right-of-way, removal of 2 feet of waste from the landfill area with off-site disposal, adding a 2-foot protective soil cover to the landfill area assuming original elevations and institutional controls and routine groundwater monitoring.
The Department is providing this notice under sections 505(b) and 506(b) of the HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)) and the publication of this notice starts the administrative record period under the HSCA. The Administrative Record, which contains information about the Site and supports the Department's decision to perform this action at the Site, is available for public review and comment. Notice of Proposed Interim Response Boldan-Davis Site, Penn Township,
Westmoreland CountyThe Department, under the HSCA, is proposing an interim response at the Boldan-Davis Site (Site), Penn Township, Westmoreland County. The Site is adjacent to Bolen Lane, approximately 0.25 mile south of Route 130. The Site consists of an area on the Davis and Blaine properties that contains an unknown quantity of buried and partially buried drums.
The Department has recently completed an investigation of the Site and is currently conducting an interim response at the Boldan Landfill Site (landfill), which is immediately adjacent to the south of the Site. William Bolen, the original owner and operator of the landfill, also owned the Site. William Bolen began operating an unpermitted landfill in 1958 that apparently included the landfill as well as the Site. Prior to waste disposal, the Site was used for coal strip mining. It appears that waste was deposited in pits left from the mining operation. The Site is currently used for residential purposes.
During the investigation, it was determined that waste is buried in a semicircle area at the base of the large hill on the Site. The buried waste portion of the Site is approximately 0.5 acre in size and contains pockets of industrial wastes including numerous 55-gallon drums and various amounts of debris. Samples collected during the investigation indicated the presence of hazardous substances in Site soil, groundwater and waste materials. The buried drums are in various states of deterioration. Continued deterioration of the buried drums will lead to a larger release of hazardous substances and a more extensive clean up. Several drums are also exposed at the surface presenting a direct contact threat. The current Site conditions present a substantial danger to the public health and the environment.
The Department considered several alternatives at the Site, including: no action; securing of the site; and removal and disposal of the hazardous substances at the Site. The Department determined that removal and disposal of the hazardous substances was the appropriate course of action. This alternative was selected because it complied with all applicable laws and regulations and was determined to be the most environmentally sound procedure for the Site.
Fieldwork for the prompt interim response to remove and dispose of the waste at the Site is anticipated to begin in early January 2004. All hazardous materials at the Site will be removed and properly disposed. The Department, following the public hearing and comment period, will complete a Statement of Decision and Response to Comments.
This notice is being provided under sections 505(b) and 506(b) of the HSCA. The administrative record contains the information that forms the basis and documents the selection of this response action is available for public review and comment at the Department's Southwest Regional Office in Pittsburgh and is available for review Monday through Friday from 8 a.m. to 4 p.m.

If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Submission Date for Grant Applications under the Solid Waste-Resource Recovery Development Act The Department of Environmental Protection (Department) announces that it is accepting resource recovery demonstration grant applications from counties, municipalities and municipal authorities within this Commonwealth under the Pennsylvania Solid Waste-Resource Recovery Development Act (act). Projects must be capable of demonstrating, for a minimum of 2 years, the production of energy or the recovery of materials from solid waste (except sewage sludge). Grant applications must meet the terms and conditions established in 25 Pa. Code Chapter 76, adopted under the act.
Priority in selecting successful applicants during this application solicitation will be given to unique and innovative resource recovery projects not previously demonstrated or currently being demonstrated in this Commonwealth. Priority in selecting successful applicants during this application solicitation will also be given to unique and innovative resource recovery demonstration projects involving regional cooperative projects involving more than one county or municipality. Other types of resource recovery projects may also be considered. All projects must be capable of being replicated in other areas of this Commonwealth.
Applicants must provide a business plan and market commitments for energy or materials produced by the demonstration project. All projects should be capable of reaching full scale production within 12 months of notice of a grant award.
A lead municipality or county serving as the development agency for regional projects must have resolutions from other participating counties or municipalities in support of the project. Counties and municipalities may sponsor cooperative projects with private sector entities provided that a minimum of 5% equity in the project is maintained by the development agency for the term of the demonstration period.
The Department will award no more than three grants from applications received during this grant solicitation period. The Department will award no more than $100,000 for any demonstration project selected for funding.
The deadline for submission of grant applications is 3 p.m. on April 22, 2004. Applications must be on forms provided by the Department. Applications received by the Department or postmarked after the deadline will not be considered during this application solicitation.
Counties and municipalities must contact the appropriate Department Planning and Recycling Coordinator to obtain a grant application. A preapplication conference with the Department Regional Planning and Recycling Coordinator is required. Public Hearing for NPDES Permit No. PAI024803028 The Department of Environmental Protection (Department) will hold a public hearing to accept comment on Individual NPDES Permit Application No. PAI024803028 for the discharge of stormwater from construction activities at the proposed Orchard View Estates, Lower Saucon Township, Northampton County.
The public hearing will be held on February 10, 2004, at 7 p.m. in the Lower Saucon Township Building, 3700 Old Philadelphia Pike, Lower Saucon Township, Northampton County by the Water Management Program, Soils and Waterways Section, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2553. The hearing is in response to an application submitted by Dolores Grunstra. The NPDES permit application proposes the discharge of stormwater from construction activities to Cooks Creek.
If the public hearing is cancelled due to inclement weather conditions, the hearing will be rescheduled on Tuesday, February 17, 2004, at 7 p.m. in the Lower Saucon Township Building.
The Department will notify Lower Saucon Township of the public hearing cancellation prior to 1 p.m. on the day of the proposed meeting.
The Department requests that individuals wishing to testify at the hearing submit a written notice of intent to Orchard View Estates Hearing, Department of Environmental Protection, Water Management Program, 2 Public Square, Wilkes-Barre, PA 18711. The Department will accept notices up to the day of the hearing. The Department requests that individuals limit their testimony to 10 minutes so that all individuals have the opportunity to testify. The Department can only review comments made with regard to NPDES Permit Application No. PAI024803028. Written copies of oral testimony are requested. Relinquishing time to others will not be allowed. All individuals attending the hearing will have the opportunity to testify if they so desire. However, individuals who pre-register to testify will be given priority on the agenda.
