    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

    DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

    (Part I Permits)

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the Field Office indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Field Office of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application, and related documents, proposed effluent limitations and special conditions received and other information are on file and may be inspected and arrangements made for copying at the Field Office that has been indicated above the application.


    Applications for National Pollutant Discharge Elimination System (NPDES) permit to discharge to State waters.

       This application is for renewal of an NPDES permit to discharge treated process wastewater, noncontact cooling water and stormwater from an industrial wastewater treatment plant, vacuum equipment and paved surface of Microsemi Company located at 140 Commerce Drive in Montgomery Township, Montgomery County. This is an existing discharge to an unnamed tributary to Park Creek.

       The receiving stream is classified for the following uses:  warm water fishery.

       The proposed effluent limits for Outfall 001, based on an average flow of 24,000 gallons per day of noncontact cooling water from vacuum equipment, are as follows:

For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was Pottstown Borough located on the Schuylkill River. The discharge is not expected to impact any potable water supply.

       The following effluent limitations are proposed for discharge to the receiving waters, of an unnamed tributary to Pine Run, classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply (PWS) is West Leechburg Water Authority, located at Kiskiminetas River, 12.48 miles below the discharge point.

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit action.        Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site.        The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.

       The Department has received applications for plan approvals and/or operating permits from the following facilities. Although the sources covered by these applications may be located at a major facility, the sources being installed or modified do not trigger major new source review or prevention of significant deterioration requirements.

       Copies of these applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the Regional Offices identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.

       Persons wishing to file protests or comments on the proposed plan approval and/or operating permits must submit the protest or comment within 30 days from the date of this notice.     Notice of Intent to Issue

    Plan Approval No. 08-318-027

       Mill's Pride--Pennsylvania, c/o Mill's Pride LP (423 Hopewell Road, Waverly, OH 45690-9700) has submitted an application to the Department of Environmental Protection (Department) for approval to construct a wooden kitchen cabinet and cabinet door manufacturing and finishing operation in Athens Township, Bradford County. The information provided by the applicant and the Department's own analysis indicates that this operation may potentially result in the emission of 128.34 tons per 12 consecutive month period of particulate matter, 29.79 tons per 12 consecutive month period of volatile organic compounds, 2.53 tons per 12 consecutive month period of sulfur oxides, 37.6 tons per 12 consecutive month period of nitrogen oxides (expressed as NO2), 8.7 tons per 12 consecutive month period of carbon monoxide, less than 10 tons per 12 consecutive month period of individual hazardous air pollutants and less than 25 tons per 12 consecutive month period of combined hazardous air pollutants. A preliminary review of the information submitted by Mill's Pride-Pennsylvania indicates that the proposed construction will meet all applicable air quality requirements. Based on this finding, the Department intends to approve the application and issue a plan approval to construct the proposed wooden kitchen cabinet and cabinet door manufacturing and finishing operation.

       To ensure compliance with all applicable standards, the Department proposes to place the following conditions in the respective plan approval:

       1.  The wooden kitchen cabinet and cabinet door manufacturing and finishing operation is to be constructed in accordance with the plans submitted with the application (as approved herein).

       2.  This plan approval is issued for the construction of a wooden kitchen cabinet and cabinet door manufacturing and finishing operation consisting of the following:

       a.  A 1.12 million board feet capacity green lumber pre-dryer.

       b.  Eight oak lumber drying kilns, each with a capacity of 70,000 board feet.

       c.  Ten maple lumber drying kilns, each with a capacity of 50,000 board feet.

       d.  Various pieces of woodworking equipment (saws, planers, routers, sanders, and the like), the air contaminant emissions from which shall be controlled by five Torit and Day No. 484RF12 fabric collectors, in parallel, and operated as described in the application and supplemental materials submitted for plan approval.

       e.  A 12,862 cubic foot capacity wood waste storage silo (Silo No. 1), the air contaminant emissions from which shall be controlled by a Torit and Day No. 156RFW8 fabric collector.

       f.  Two 28,700,000 BTU per hour Hurst Boiler and Welding Company No. M-4000 natural gas/wood waste fired boilers. The air contaminant emissions from each of the two boilers shall be controlled by an air cleaning system consisting of two multi-clones in series. In both cases, the primary multi-clone will be a Hurst Boiler and Welding Company, Inc. No. 12k-1CT and the secondary multi-clone will be a Hurst Boiler and Welding Company, Inc. No. 6UP-44T.

       g.  A finishing operation consisting of the following:

       i.  A main conveyorized finishing line consisting of six automated spray booths, six drying/flash off ovens, five sanders, six postsanding cleaners and a wiping machine;

       ii.  A hand wipe stain application area;

       iii.  A stand alone hand spray booth; and

       iv.  Associated cleanup operations.

       The air contaminant emissions from all volatile organic compound-emitting finishing operation sources shall be controlled by a Durr No. 125K-16.5x12-800 regenerative thermal oxidizer, as described in the application and supplemental materials submitted for plan approval.

       Additionally, the air contaminant emissions from the sanding and cleaning operations incorporated in the finishing operation shall be controlled by several small dust collectors that shall exhaust into the finishing room.

       h.  Various saw blade grinding and sharpening tools contained in the maintenance shop, the air contaminant emissions from which shall be controlled by a fabric collector.

       i.  The following storage tanks:

       i.  A 5,250 gallon topcoat storage tank;

       ii.  A 5,250 gallon sealer storage tank; and

       iii.  A 3,750 gallon stain tank.

       The air contaminant emissions from the stain storage tank shall be controlled by a pressure relief valve that complies with the requirements specified in 25 Pa. Code § 129.57.

       3.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the total combined air contaminant emissions from the entire facility shall never exceed the following emission limitations:

       4.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the particulate matter emissions from each of the five fabric collectors identified in condition 2d herein shall never exceed 0.005 grains per dry standard cubic foot. Additionally, each fabric collector shall be equipped with a monitor or gauge that will accurately measure the pressure drop across the respective fabric collector. Only one fabric collector may be cleaned at any time and only during times when the other four fabric collectors are in operation.

       5.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, Silo No. 1 identified in condition 2e herein shall never at any time contain more than 5% by weight of particleboard waste.

       6.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the particulate matter emissions from Silo No. 1, after control, shall never exceed 0.02 grains per dry standard cubic foot. Additionally, the fabric collector controlling the air contaminant emissions from Silo No. 1 shall be equipped with a monitor or gauge that will accurately measure the pressure drop across the fabric collector.

       7.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the two Hurst and Welding Company boilers identified in condition 2f herein shall utilize staged combustion and flue gas recirculation as nitrogen oxide reduction techniques. Additionally, each of the boilers shall be equipped with oxygen monitors as described in the application and supplemental materials submitted for plan approval, and each of the boilers shall comply with the following emission limitations:

       8.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the two Hurst and Welding Company boilers identified in condition 2f herein shall be fired on either natural gas or kiln dried wood waste with a particleboard content of not greater than 5% by weight except that a mixture of green wood waste and kiln dried wood waste may be fired provided the following conditions are met:

       a.  The green wood waste content of the mixture shall not exceed 30% by weight, and

       b.  The total firing time of this mixture shall not exceed 336 hours in any 12 consecutive month period, combined, for both boilers, that is, if both boilers are ever fired simultaneously with the green wood waste mixture each hour of simultaneous firing shall count as 2 hours.

       The combustion of a green wood waste/kiln dried wood waste mixture during the period of time starting from the date of initial startup of either of the two boilers until the first day of stack testing of either of the two boilers will not count towards the 336 hour per year limit specified in condition 8b herein.

       9.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, the finishing operation identified in condition 2g herein shall operate as follows:

       a.  All stains shall have a VOC content of not greater than 6.8 pounds per gallon, minus water.

       b.  All topcoats and sealers shall have a VOC content of not greater than 5.2 pounds per gallon, minus water and as mixed for application.

       c.  All stains shall be applied as received from the vendor, that is, no thinners, catalysts or other additives will be used.

       d.  The only additives to be mixed with the topcoats and sealers prior to application shall be their respective catalysts.

       e.  Only the sealers and topcoats may contain formaldehyde and the formaldehyde content shall not exceed 0.20% by weight.

       f.  None of the finishes used in this finishing operation shall contain methylene chloride, 1,1,1-trichloroethane or any other halogenated compound.

       g.  All spray guns (either hand held or automated) shall utilize airless spray technology or an application technique having an equivalent transfer efficiency (as determined solely by the Department).

       h.  All sources identified in condition 2g herein shall be located and operated within the finishing room as described in the application supplemental materials submitted for plan approval and the finishing room shall provide 100% capture of all air contaminant emissions from all sources identified in condition 2g herein.

       i.  All VOC-containing materials (finishing materials, cleaning solvents, catalysts, and the like) shall be stored in closed containers when not in actual use; spray gun lines shall be cleaned by flushing solvent through the lines and into closed containers; all used cleaning rags and used rags for the hand application of stains shall be stored in closed containers and shall never be treated so as to allow the evaporative loss of solvents to atmosphere.

       j.  The company shall, from the date of startup of the finishing operation, implement a finish transfer equipment leak detection and repair program. The program shall establish a monthly transfer equipment inspection schedule, will address the steps to be taken to minimize leaks and the steps that will be taken should transfer equipment repairs ever become necessary. The company shall maintain records of the monthly inspections as well as any corrective actions taken. The company shall retain these records on site for at least 2 years.

       k.  The company shall implement a training program that will instruct finishing operators on the proper finish application and cleanup methods and equipment use. All personnel responsible for the operation of finishing operation equipment shall be adequately trained prior to the startup of the finishing operation. An outline of the training program as well as records of the dates of training and the personnel trained shall be retained on site for at least 2 years.

       l.  Should the company ever decide to incorporate into this operation the use of finishing materials other than topcoats, sealers or stains, the company must obtain written Department approval for the use of these materials prior to their actual use.

       10.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, all VOC emissions generated within the finishing room as described in the application and supplemental materials submitted for plan approval shall be collected and vented to the Durr thermal oxidizer identified in condition 2g herein. The thermal oxidizer shall provide at least a 98% VOC destruction efficiency. Additionally, the oxidizer shall meet the following design requirements:

       a.  The oxidizer shall subject all emissions directed to it to a minimum temperature of at least 1,550 degrees Fahrenheit and shall subject these air contaminant emissions to this minimum temperature for at least 0.75 seconds.

       b.  The oxidizer shall be equipped with a temperature monitoring and recording system that will accurately monitor and record the oxidizer temperature on a continuous basis to ensure that the oxidizer is complying with provisions of condition 10a herein. These records shall be maintained on site for at least 2 years.

       c.  The oxidizer shall be equipped with an alarm that will alert the operator should the oxidizer temperature drop below 1,550 degrees Fahrenheit or climb above a preset maximum oxidizer temperature. Should a low temperature or high temperature incident occur, all operations occurring with the finishing room shall be shut down until the oxidizer is operating in compliance with all applicable conditions contained herein.

       11.  Under the best available technology provisions of 25 Pa. Code §§ 127.1 and 127.12, at no time shall any of the VOC-emitting sources identified in condition 2g herein be operated unless the oxidizer is simultaneously operating in compliance with all applicable conditions contained herein.

       12.  The finishing operation identified in condition 2g herein is additionally subject to the provisions of 25 Pa. Code § 129.52.

       13.  The company shall maintain the following records on a monthly basis:

       a.  Total board feed of lumber processed in the predryer.

       b.  Total board feed of lumber processed in each of the eight oak kilns.

       c.  Total board feed of lumber processed in each of the ten maple kilns.

       d.  Total quantities of natural gas, green wood wastes, kiln dried wood wastes and particleboard wastes burned in each of the two Hurst and Welding Company boilers.

       e.  Total hours that the green wood waste/kiln dried wood waste mixture is burned in either boiler.

       f.  The identity, classification (stain, sealer, cleaning solvent, and the like), VOC content, hazardous air pollutant content and quantity used of every VOC-containing material used in the finishing operation.

       g.  Quantities of all materials stored in each of the three finishing material storage tanks.

       14.  The company shall perform stack tests on the following sources according to the following schedules:

       a.  Within 90 days of startup of each of the two Hurst Boiler and Welding Company boiler, the company shall test the respective boilers for nitrogen oxides, carbon monoxide and particulate matter using reference method test procedures acceptable to the Department. All testing is to be performed while each of the boilers is being fired at its maximum capacity and while being fired on kiln dried wood waste only.

       b.  Within 90 days of startup of the finishing operation identified in condition 2g herein, the company shall perform volatile organic compound (VOC) testing to determine the VOC destruction efficiency of the thermal oxidizer and the VOC emission rate from the oxidizer exhaust. Additionally, the company shall determine the VOC capture efficiency in the finishing room. All testing, and the like shall be performed using reference method procedures acceptable to the Department and while the finishing operation is operating at full production.

       15.  At least 60 days prior to the performance of any testing required by condition 14 herein a pre-test plan or protocol shall be submitted to the Department for evaluation. The pre-test plan or protocol shall contain the specific testing and analytical procedures to be used in performing the testing.

       16.  The Department shall be given at least 14 days advance notice of the specific dates and times for the performance of any testing required by condition 14 herein in order that Department personnel can arrange to be present. The Department is under no obligation to accept the results of any testing performed without adequate advanced notice having been given to the Department.

       17.  Within 60 days of completion of the testing required by condition 14 herein two copies of the test report shall be submitted to the Department. The report shall contain the results of the testing, a description of the testing and analytical procedures actually used, all operating data collected during the test, a copy of all raw data and a copy of the calculations generated during the data analysis.

       18.  The two Hurst Boiler and Welding Company boilers are subject to Subpart Dc of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.40c--60.48c. The company shall comply with all applicable requirements of this Subpart as well as any other applicable Subpart of the Standards of Performance, including any recordkeeping and reporting requirements. Under 40 CFR 60.4 of the Standards of Performance, the submission of all requests, reports, applications, submittals and other communications required by the Standards of Performance must be made to both the Department and the Environmental Protection Agency. The Environmental Protection Agency copies may be sent to: U. S. EPA Region III, 1650 Arch Street, 11th Floor--3WC22, Philadelphia, PA 19103-2029.

       19.  Issuance of an operating permit for the aforementioned sources is contingent upon the sources being constructed, the air cleaning devices being installed, and the sources and air cleaning devices being maintained and operated, as described in the application and supplemental materials submitted for plan approval, as well as in accordance with all conditions contained herein, and upon satisfactory demonstration that any air contaminants emitted from the sources are in compliance with the requirements specified in any condition contained herein and the requirements specified in 25 Pa. Code §§ 123.1, 123.11, 123.13, 123.22, 123.31 and 123.41, all sections of Chapter 123 and 25 Pa. Code § 129.52 as well as in compliance with the requirements specified in, or established under any other applicable rule or regulation contained in 25 Pa. Code Part I, Subpart C, Article III. Additionally, the air contaminant emissions from the two boilers identified in condition 2f herein shall be in compliance with the requirements specified in Subpart Dc of the Federal Standards of Performance for New Stationary Sources, 40 CFR 60.40c through 60.48c.

       20.  The company shall immediately notify the Department of any malfunction of the sources or associated air cleaning devices which results in, or may possibly be resulting in, the emission of air contaminants in excess of the limitations specified in, or established under, any applicable rule or regulation contained in 25 Pa. Code Part I, Subpart C, Article III or in excess of the limitations specified in any condition contained herein or which otherwise results in, or may possibly be resulting in, noncompliance with the requirements specified in any condition contained herein.

       21.  This plan approval authorizes temporary operation of the sources covered by this plan approval provided the following conditions are met.

       a.  The Department must receive written notice from the owner/operator of the completion of construction and the operator's intent to commence operation at least 5 working days prior to the completion of construction. The notice should state when construction will be completed and when the operator expects to commence operation.

       b.  Operation is authorized only to facilitate the start-up and shake-down of sources and air cleaning devices, to permit operations pending the issuance of an operating permit or to permit the evaluation of the sources for compliance with all applicable regulations and requirements.

       c.  This condition authorizes temporary operation of the sources for a period of 180 days from the date of commencement of operation, provided the Department receives notice from the owner/operator under subpart (a), above.

       d.  The owner/operator may request an extension if compliance with all applicable regulations and plan approval requirements has not been established. The extension request shall be submitted in writing at least 15 days prior to the end of this period of temporary operation and shall provide a description of the compliance status of the source, a detailed schedule for establishing compliance, and the reasons compliance has not been established.

       e.  The notice submitted by the owner/operator under subpart (a), above, prior to the expiration of this plan approval, shall modify the plan approval expiration date. The new plan approval expiration date shall be 180 days from the date of commencement of operation.

       In accordance with 25 Pa. Code § 127.45 the conditions to be listed in the plan approval do one or more of the following:

       1.  Identify the sources and location.

       2.  Establish allowable air contaminant emission rates.

       3.  Establish monitoring, recordkeeping, testing and reporting requirements.

       4.  Help ensure proper operation and adequate maintenance of the air contamination sources and air cleaning devices.

       Copies of the application, the Department's analysis and other documents used in the evaluation of the application are available for public inspection during normal business hours at the address listed.

       Persons wishing to provide the Department with additional information which they believe should be considered prior to the issuance of the plan approval may submit the information to the Department at the address listed. A 30-day comment period, from the date of publication of this notice, will exist for the submission of comments. Each written comment shall include the following: name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval No. 08-318-027, and concise statements regarding the relevancy of the comments or any objections to the issuance of the plan approval.

       A public hearing may be held, if the Department in their discretion, decides that such a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in a newspaper of general circulation in the county in which the source is to be located by the Pennsylvania Bulletin, or by telephone, where the Department determines the notification by telephone is sufficient. All comments and requests must be received by the Department no later than 30 days after publication of this notice.

    APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21).        The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for the certification.

       Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH.        Section 702 of the Bituminous Coal Mine Act (52 P. S. §§ 701 and 702) (act) provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

       Section 221(d) requires that in case of accident to a ventilating fan or its machinery, or if the fan stoppage is a planned interruption whereby the ventilation of the mine is interrupted, the mine foreman shall order the power to be disconnected from the affected portions and withdraw the men immediately from the face areas. In mines employing the use of multiple fans equipped with self-closing doors which operate automatically when the fan is stopped, the action need not be taken provided the minimum requirements are met by other fans of the system. If the fan has been stopped for a period of time in excess of 15 minutes in a gassy mine, and 30 minutes in a nongassy mine, the mine foreman shall order the men withdrawn from the mine. If the mine foreman shall deem it necessary, he may withdraw the men from a gassy mine in less than the said 15 minutes and from a nongassy mine in less than the said 30 minutes. He shall not allow the men to return to their work until ventilation has been restored and the mine has been thoroughly examined by certified personnel and reported safe. A record shall be made of said examination.

       Summary of the request: T.J.S. Mining, Inc. requests a waiver of section 221(d) of the Bituminous Coal Mine Act. This waiver will provide accommodations for the evacuation of men from the mine by way of battery-powered personnel carriers and/or mantrips at the T.J.S. #4 Mine.

       Section 702 of the Bituminous Coal Mine Act (52 P. S. §§ 701 and 702) (act) provides a mechanism for operators to obtain variances from specific requirements of the act to accommodate the adoption of new machinery, equipment, tools, supplies, methods or processes.

       Section 253(b) states that, should a mine operator propose use of roof bolts in lieu of conventional timbering, he shall discuss his proposed plan with the mine inspector in the district. If roof bolts are to be used in a first mining area, the mine inspector in the district and the operator or his representative shall arrange for a test area. Roof bolts shall be installed in conjunction with conventional timbering as the working places advance. After these places have advanced a predetermined distance, all entrances shall be fenced off and approved danger signals displayed on same fences. The conventional timbering shall then be removed. Observations of the test area shall be made by the mine inspector in the district and the operator or his representative. If they are satisfied that the roof bolting is successful, an application together with a copy of the roof bolting plan shall be sent to the secretary requesting a permit. The secretary shall either approve or reject the proposed roof bolting plan within 60 days after its initial submission to him. If the request for the permit is rejected, the secretary shall give his reasons therefor in writing to the operator.

       Summary of the request: DLR Mining, Inc. requests a variance to use a roof bolt ''pull test'' in lieu of a test area as required by section 253(b) for approval to use roof bolts as the primary roof support system at the Ridge Mine.

       Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street Floor 2, P. O.     SEWAGE FACILITIES ACT

    PLAN APPROVAL


    Plan Revision Approval granted October 19, 1998, under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

       William Dietzel Subdivision, Single Family Residence, East Providence Township, Bedford County.

       The approved plan revision provided for approval of a revision to the Official Plan of East Providence Township, Bedford County. Project involves construction of a small flow treatment facility to serve one proposed residential dwelling with sewage flows of 400 gallons per day. Located 6/10 mile from the intersection of TR 438 and TR 495, along the east side of TR 495. Treated effluent is to be discharged into an unnamed tributary into French Run, which is listed as a Warm Water Fisheries under Chapter 93. Any required NPDES Permits or Water Management Permits must be obtained in the name of the owner.

       The approved plan provides for expansion and upgrade of the existing Twin Boroughs Sanitary Authority STP from .58 mgd to a .9 mgd flow capacity. The expanded regional STP, consisting of an SBR system will provide treatment capacity for Mifflin and Mifflintown Boroughs as well as Milford, Fermanagh and Walker Townships. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES permits or WQM permits must be obtained in the name of the municipality or authority as appropriate.

       Approved plan provides for conveyance of sewage, previously approved for collection in the Village of Mexico, to an upgraded and expanded Twin Boroughs Sanitary Authority STP located in Mifflin Borough. This alternative replaces a previous one calling for construction of a local STP approved by the Department in September of 1997. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES permits or WQM permits must be obtained in the name of the municipality or authority as appropriate.

    SAFE DRINKING WATER

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program

       Provisions of Chapter 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the Act 2 (Land Recycling and Environmental Remediation Standards Act) remediation standards. Plans and reports required by provisions of Act 2 for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

       Jomax Property, City of York, York County. The Redevelopment Authority of the City of York, One Market Way West, York, PA 17401 submitted a baseline environmental report concerning the remediation of site soils contaminated with heavy metals and groundwater contaminated with solvents. The site is being remediated as a Special Industrial Area. The baseline environmental report was approved by the Department October 2, 1998.

       Conrad's Delicatessen, City of York, York County. GeoServices, Ltd., 1525 Cedar Cliff Drive, Camp Hill, PA 17011 submitted a work plan concerning the remediation of site soils and groundwater contaminated with BTEX, PHCs and PAHs. The site is being remediated as a Special Industrial Area. The work plan was approved by the Department October 16, 1998.

       Antaloski and Hauser Properties, Borough of Frackville, Schuylkill County. Brian Evans, Environmental Scientist, Hydrocon Services, Inc., 2945 South Pike Avenue, Allentown, PA 18103 submitted a Final Report (on behalf of his client, Hawranick Plumbing, 61 North 5th Street, Frackville, PA 17931) concerning the remediation of site soils found contaminated with BTEX (benzene, toluene, ethylbenzene and xylene) compounds and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide human health standard and was approved by the Department on October 16, 1998.

       GPU Energy, Parcel A., Grain Elevator Site, North of Holland Street, Erie County, City of Erie has submitted a Remedial Investigation Report, Risk Assessment Report and the Final Report concerning the remediation of site soils contaminated with heavy metals. These reports were approved by the Department on October 16, 1998.

       Pine Instrument Company (Former Cooper Energy Services Steel Service Center), 109 Madison Avenue, Grove City, PA 16127), Mercer County, Borough of Grove City, has submitted a Final Report concerning the remediation of soil contaminated with PAHs. The report was approved by the Department on October 21, 1998.

To remove an existing structure and to construct and maintain a 20-foot wide box culvert having an underclearance of 3 feet, 6 inches on the Codorus Creek at Pentland Road (T-370) located west of Hill Climb Road (Seven Valleys, PA Quadrangle N: 9.0 inches; W: 15.5 inches) in Codorus and Manheim Townships, York County. This permit also includes 401 Water Quality Certification.

       E13-093A.  Encroachment. Lehighton Water Authority, Municipal Building, P. O. Box 29, Lehighton, PA 18235. To amend Permit No. E13-093 to include the installation and maintenance of two 12-foot × 18-foot raw water intake structures and associated 12-inch diameter concrete encased D. I. pipes within the bed of the Lehigh River. The project is located immediately east of the Packerton railroad yards approximately 0.2 mile east of S. R. 0209 and S. R. 3006 (Lehighton, PA Quadrangle N: 18.1 inches; W: 11.7 inches) in Mahoning and Franklin Townships, Carbon County.

       E48-272.  Encroachment. Bethlehem Steel Corporation, 4th and Emery Streets, Bethlehem, PA 18016-7599. To remove an approximate 275 c. y. tar and sediment deposit from the Lehigh River below Bethlehem Steel Corporation's Outfall No. 015. The project is located at the confluence of the Lehigh River and Saucon Creek, approximately 0.15 mile upstream of the S. R. 3005 bridge (Hellertown, PA Quadrangle N: 21.8 inches; W: 11.9 inches) in the City of Bethlehem, Northampton County.

The project is located on the west side of Evergreen Road, just west from the intersection of Evergreen Road and Wible Run Road (Pittsburgh East, PA Quadrangle N: 22.4 inches; W: 14.5 inches) in Shaler Township, Allegheny County.        E02-1225.  Encroachment. Girty's Run Joint Sewer Authority, Room 110, McKre Building, 1097 North Avenue, Pittsburgh, PA 15209. To remove the existing structure and to construct and maintain a wet weather equalization tank, blower (operations) building and a 12-inch diameter outfall structure on the left bank and in the floodplain of Girty's Run (WWF). The project is located on the north side of Babcock Boulevard, approximately 700 feet upstream from the intersection of Babcock Boulevard, Evergreen Road and Thompson Run Road (Glenshaw, PA Quadrangle N: 2.1 inches; W: 16.9 inches) in Ross Township, Allegheny County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E02-1246.  Encroachment. Jeff and Joan Hrynda, 1507 Saw Mill Run Blvd., Pittsburgh, PA 15210. To construct and maintain a two story garage in the floodway along the left bank side of Saw Mill Run (WWF). The project is located at the corner of Goff Street and Fawn Street (Pittsburgh East, PA Quadrangle N: 4.5 inches; W: 17.3 inches) in the City of Pittsburgh, Allegheny County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E63-460.  Encroachment. Pennsylvania Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106-7676. To construct and maintain a dual 2,300 to 3,000 linear foot multi-span structure over Mingo Creek (HQ-TSF) and Froman Run (TSF), to construct and maintain a 7` × 10` box culvert 560 feet long in Dry Run (WWF), to construct and maintain two temporary stream diversions 510 feet long on Dry Run and to place and maintain fill in 0.29 acre of wetlands (PEM) with 0.03 acre of temporary wetland impacts. The work is being done in conjunction with the Mon/Fayette Expressway (S. R. 0043), construction Section 52G consisting of a four lane limited access, divided toll highway. This construction section starts at Dry Run Road (S. R. 0136) and ends South of Courtney Run Road (S. R. 1065) (Project starts at Monongahela, PA Quadrangle N: 13.1 inches; W: 15.8 inches and ends at Monongahela, PA Quadrangle N: 18.0 inches; W: 15.4 inches) in Carroll, Union and Nottingham Townships in Washington County. The wetland replacements were approved under PA DEP Permit No. E02-1132.

       E65-705.  Encroachment. R.W.S. Development Company, Inc., R. R. 1, Box 61, Rillton, PA 15678. To place and maintain fill in 0.52 acre of wetlands (PEM) and to place and maintain fill in an unnamed tributary to Long Run (HQ-TSF) for the purpose of constructing a residential development. The permittee will construct 0.52 acre of wetlands off-site. The project is located along the south side of S. R. 3055 at its intersection with S. R. 3022 (Irwin, PA Quadrangle N: 14.0 inches; W: 16.6 inches) in North Huntingdon Township, Westmoreland County.

       E65-709.  Encroachment. Elsie H. McAdoo, 1213 Denbigh Lane, Radnor, PA 19087. To operate and maintain five 36-inch cmp culverts in an unnamed tributary to Tubmill Creek constructed under the Department's Emergency Permit No. EP6598201. The project is located off of S. R. 1007, approximately 0.75 mile south of its intersection with S. R. 0711 (Rachelwood, PA Quadrangle N: 18.25 inches; W: 12.6 inches) in St. Clair Township, Westmoreland County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

       E20-458.  Encroachment. Hamilton Wentworth Limited, Hungry Hollow Road, Great Valley, NY 17441. To impact 0.15 acre of isolated wetland for construction of a commercial development east of the Meadville Wal-Mart store along the north side of S. R. 0322 approximately 0.5 mile west of S. R. 0098 (Geneva, PA Quadrangle N: 22.25 inches; W: 11.75 inches) located in Vernon Township, Crawford County. Project includes contribution to the Pennsylvania Wetland Replacement Fund for replacement of 0.15 acre of wetland.

       E20-459.  Encroachment. PA Department of Transportation, District 1-0, 1140 Liberty Street, Franklin, PA 16323. To remove the existing bridge and to construct and maintain a prestressed concrete box beam bridge having a normal span of 77 feet and an underclearance of 10 feet on a 50 degree skew across Little Sugar Creek on SR 2022, Segment 0030, Offset 0000 approximately 900 feet north of S. R. 0173 (Cochranton, PA Quadrangle N: 4.1 inches; W: 6.8 inches located in Cochranton Borough, Crawford County.

       E25-571.  Encroachment. General Partitions Corporation, 1702 Peninsula Drive, Erie, PA 16505. To fill 0.112 acre of a wetland area for the expansion of a parking lot associated with the existing General Partitions industrial facility located at 1702 Peninsula Drive approximately 0.5 mile south of S. R. 0005 (Swanville, PA Quadrangle N: 17.8 inches; W: 2.4 inches) located in Millcreek Township, Erie County. Project includes contribution to the Pennsylvania Wetland Replacement Fund for replacement of 0.112 acre of wetland.

    Under Act 101, § 904
    The Municipal Waste Planning, Recycling and Waste Reduction Act of 1988

       The Department of Environmental Protection (Department) announces an extension to the deadline for calendar year 1997 Recycling Program Performance Grant applications from municipalities for grant assistance under the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. § 904) (Act 101).

       The deadline for submission of calendar year 1997 applications has been extended to 3 p.m., November 30, 1998. Applications must be on forms provided by the Department. Applications received by the Department after that date will not be considered. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of monies in the Recycling Fund.
