       Under the regulatory authority of 25 Pa. Code § 271.811 (relating to authorization for general permit) of the municipal waste regulations and the statutory authority of the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Department of Environmental Protection (Department) is proposing a General Permit for the processing and conversion of municipal waste to produce a fuel product.

       This proposed General Permit authorizes permittees to process municipal waste to produce a fuel. Fuel manufactured under the authority of the permit is not considered a waste when marketed as a commodity in trade for use in an air contamination source approved through an Air Quality authorization issued by the Department under 25 Pa. Code Chapter 127 (relating to construction, modification, reactivation and operation of sources). General Permit WMGM037 will reduce the amount of waste disposed in landfills by providing a mechanism to divert waste suitable for use under this permit to a more productive, beneficial use.
