Whereas, Pennsylvania is the most productive agricultural state in the Northeast, with more than 63,000 farms, 7,400 of which are dairy operations that are home to 541,000 head of cattle, and
Whereas, agriculture and agriculture-related industries are the leading economic drivers in the state of Pennsylvania, contributing more than $51 billion to the state economy; and
Whereas, Pennsylvania's farmers are a vital component of the commonwealth's economy, with dairy farmers generating $1.96 billion in value to the overall economy, around 85 percent of the dairy farm's income being spent locally and each farm dollar recycling approximately 2.5 times through the community; and
Whereas, in 2010, Pennsylvania dairy farmers produced 10.7 billion pounds of milk, with 19,841 pounds produced per cow per year; and
Whereas, Pennsylvania produces 5.6 percent of the nation's milk supply and ranks 5th nationally in milk production, 6th in butter, 9th in low-fat ice cream, and 19th in hard milk sherbet production; and
Whereas, Pennsylvania's dairy industry has the potential to support and grow the agriculture industry in Pennsylvania by providing more than 45,000 jobs, diversifying agricultural activities, and strengthening the agriculture industry.
Now Therefore, I, Tom Corbett, Governor of the Commonwealth of Pennsylvania, by virtue of the authority vested in me by the Constitution of the Commonwealth of Pennsylvania and other laws of the commonwealth, do hereby establish the Pennsylvania Dairy Leadership Council to coordinate the development and expansion of the dairy industry in the Commonwealth of Pennsylvania.

The purpose of the Pennsylvania Dairy Leadership Council is solely to provide recommendations and input to the Governor, the appropriate Commonwealth agencies and other entities regarding best practices for policies and strategies to promote the coordination of the development and expansion of the dairy industry in this Commonwealth.
§ 6.462. Responsibilities.
The Pennsylvania Dairy Leadership Council (Council) does not have authority to make binding recommendations. Recommendations and input are to be provided by the Council, or subcommittees established by its Chairperson, as it performs the following functions:
(1) Make recommendations to the Governor on policies, procedures, regulations and legislation that would aid in the development of the dairy industry.
(2) Serve as the Governor's advisory liaison to the agricultural community on policies, procedures, regulations and legislation that affect the production of dairy products to ensure that State government is accessible, accountable and responsive to the constituency in the dairy industry.
(3) Serve as an advisory resource to departments, commissions and agencies under the Governor's jurisdiction to ensure that these government entities are cognizant of the issues surrounding the dairy industry.
(4) Identify key variables and short- and long-term critical issues for the dairy industry including the following areas:
(i) Dairy farm business profitability.
(ii) Environmental compliance for dairy operations.
(iii) Dairy cattle welfare.
(iv) Family and next generation dairy producer opportunities.
(v) United States Farm Bill and Federal dairy policy.
(vi) Pennsylvania dairy policy and legislation.
(5) Form work groups to address specific topics and meet as needed to explore issues and identify the needs of the industry relating to those issues.
(6) Establish subcommittees and rules and procedures for the effective implementation of its functions, consistent with this subchapter, including procedures to evaluate and measure the effectiveness of the Council as a whole.
(7) Conduct studies and issue reports, as it deems necessary, on issues affecting the dairy industry in this Commonwealth.
§ 6.463. Composition.
The Pennsylvania Dairy Leadership Council (Council) will be composed of no more than 25 individuals, each of whom shall be appointed by and serve at the pleasure of the Governor, to provide leadership on key dairy issues.
(1) The Secretary of the Department of Agriculture will serve as the Chairperson of the Council.
(2) The Council may establish advisory work groups, as the Chairperson may determine are needed, and membership of the workgroups may be extended beyond members of the Council, as necessary to perform its functions.
§ 6.464. Cooperation by State agencies.
Agencies under the Governor's jurisdiction shall cooperate with and provide assistance, staff and other support as needed by the Pennsylvania Dairy Leadership Council (Council) to carry out its functions effectively. The Council shall receive administrative support from the Department of Agriculture.
§ 6.465. Compensation and expenses.
Members of the Pennsylvania Dairy Leadership Council (Council) will not receive compensation for their service as Council members. Nongovernment members will be reimbursed for travel and related expenses in accordance with Commonwealth policy. See Chapter 40 (relating to travel and subsistence).
§ 6.466. Effective date.
This subchapter takes effect immediately.
§ 6.467. Termination date.
This subchapter will remain in effect until December 31, 2015, unless revised or rescinded by the Governor.
