       Under 25 Pa. Code § 93.4d (relating to processing of petitions, evaluations and assessments to change a designated use) the Department of Environmental Protection (Department) gives notice that an evaluation will be conducted on the basin listed as follows to determine the proper aquatic life use designation in the Commonwealth's Water Quality Standards.

       Persons who have technical data concerning the water quality, instream habitat or biological condition of this basin are encouraged to make it available to the Department for consideration in the assessment. This assessment may lead to a recommendation to the Environmental Quality Board (Board) for redesignation.

       Data should be submitted to Tony Shaw, Division of Water Quality Standards, Bureau of Water Standards and Facility Regulation, P. O. Box 8467, Harrisburg, PA 17105-8467, tshaw@state.pa.us. Data should be submitted no later than December 1, 2008. Questions concerning this evaluation can be directed to Tony Shaw at (717) 787-9637.

       This assessment is being conducted in response to a rulemaking petition submitted to the Board by Foundation Mining, LP. On August 19, 2008, the Board accepted the rulemaking petition for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board policy for processing petitions--statement of policy). The McCourtney Run basin is currently designated High-Quality-Warm Water Fishes (HQ-WWF) as identified in 25 Pa. Code § 93.9v (relating to Drainage List V). The petitioner is requesting that the McCourtney Run basin, from its source to the confluence with Hargus Creek (excluding the Garner Run subbasin) be redesignated as WWF. Hargus Creek is a tributary to South Fork Tenmile Creek.

       The referenced petition is available to the public by contacting the Environmental Quality Board, P. O.
