[Saturday, October 27, 2007]On October 16, 2007, the Environmental Quality Board (Board) accepted a rulemaking petition for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board policy for processing petitions--statement of policy). The petition, submitted collectively by the Brodhead Watershed Association, Tobyhanna Creek Tunkhannock Creek Watershed Association, the Brodhead Chapter of Trout Unlimited, the Swiftwater Preserve and the Buck Hill Conservancy, requests the Board amend 25 Pa. Code § 93.9c (relating to Drainage List C) to upgrade the Swiftwater Creek Basin in Monroe County (Source to SR No. 611) from High Quality-Cold Water Fishes to Exceptional Value designation.
Under 25 Pa. Code § 93.4d(a) (relating to processing of petitions, evaluations and assessments to change a designated use), the Department of Environmental Protection (Department) is required to publish a notice of intent to assess candidate waters before performing survey work. The Department's assessment notice for the Swiftwater Creek Basin will appear in a future issue of the Pennsylvania Bulletin.
