    APPLICATIONS RECEIVED UNDER THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

    [National Pollution Discharge Elimination System Program (NPDES)]

    DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

    (Part I Permits)

       The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and applications of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

       Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

       Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

       The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

       This proposed action is for renewal of an NPDES permit to discharge treated sewage into Tobyhanna Creek in Tobyhanna Township, Monroe County.

       The receiving stream is classified for the following uses:  high quality, cold water fishery, aquatic life, water supply and recreation.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply (PWS) considered during the evaluation is the Hazleton Water Authority on the Lehigh River near Rockport.

       The receiving stream is classified for trout stocking fishes, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the proposed downstream potable water supply intake considered during the evaluation was Hagerstown located in Maryland. The discharge is not expected to impact any potable water supply.

       This application is for amendment of an NPDES permit for an existing discharge of treated industrial waste to the Susquehanna River, in Martic Township, Lancaster County.

       The receiving stream is classified for warm water fishery, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was Conowingo Dam located in Maryland. The discharge is not expected to impact any potable water supply.

       This application is for renewal of an NPDES permit for an existing discharge of treated industrial waste to an unnamed tributary to Kreutz Creek, in Windsor/Lower Windsor Township, York County.

       The receiving stream is classified for warm water fishes, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was Red Lion--Green Branch located in York County. The discharge is not expected to impact any potable water supply.

       For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the downstream potable water supply (PWS) considered during the evaluation is the Hawthorne Area Water Authority located approximately 30 miles below the discharge.

       This application is for renewal of an NPDES permit to discharge treated process water, stormwater and leachate from the Southern Alleghenies Landfill in Conemaugh Township, Somerset County.

       The following effluent limitations are proposed for discharge to the receiving waters, Stony Creek and Unnamed Tributary 45265, classified as warm water and cold water fishery, respectively, with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply (PWS) is Saltsburg Municipal Water Works, located on the Conemaugh River, over 50 miles below the discharge point.

       The receiving water is classified for the following uses:  cold water fishes, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply considered during the evaluation is the Camp Allegheny--Salvation Army on Slippery Rock Creek located at Camp Allegheny, approximately 24 miles below point of discharge.

       The proposed interim effluent limits, based on a design flow of 0.005 mgd, are:

    Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges

       The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (Department) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.

       The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.

       Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Comments should include the name, address and telephone number of the writer and a brief statement to inform the Field Office of the basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Field Office considers the public response significant.

    HAZARDOUS SITES CLEAN-UP

    Under the Act of October 18, 1988


    Prompt Interim Response
    Under the Hazardous Sites Cleanup Act

    Covington Township
    Lackawanna County

       The Department of Environmental Protection (Department) under the authority of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA) initiated a prompt interim response (response) at the Windship Road Drum Site (Site). The Site is located along a private roadway off of Windship Road near Route 307, in Covington Township, Lackawanna County.

       On February 26, 1996, the Department personnel inspected the site subsequent to a citizen's report that several drums of unknown material were discovered as a result of some excavation activities performed during the cleanout of a drainage culvert. During the inspection, six drums, exposed or partially exposed, were noted. A subsequent investigation by the Department, using metal detection instrumentation, indicated the probable presence of additional buried drums. The Site is located directly adjacent to a commercial property as well as several residences. A small stream runs along the eastern edge of the site into a wetland approximately 200 feet south of the site.

       After determining that the Site constituted a substantial threat to public health and safety and the environment, the Department initiated a response at the Site on February 28, 1996. The prompt action interim response chosen by the Department (Prompt Action Interim Response #1) consisted of excavation of drums, repackaging, chemical analysis, temporary storage and final disposal at an approved facility. A total of 56 drums, as well as one small container, were unearthed and subsequently disposed of. This action by the Department eliminated the substantial threat to public health and the environment posed by the material in the drums. The Department made the public aware of Prompt Action Interim Response #1 by issuing a public notice which appeared in the March 23, 1996 editions of the Pennsylvania Bulletin and the Scranton Times newspaper.

       On November 20, 1996, metal detector and ground penetrating radar surveys were conducted at the Site. The surveys resulted in the delineation of additional areas of suspected drum burial. On April 27, 1997 the Department completed an investigation which resulted in the unearthing of 19 drums at the Site. The material in the drums was determined to be a hazardous waste and contained the hazardous substance trichloroethylene (TCE) and lead. On July 17, 1997, after determining that the Site constituted a substantial threat to public health and safety and the environment, the Department undertook a Prompt Action Interim Response (Prompt Action Interim Response #2) at the Site. The Prompt Action Interim Response involved the disposal, at an approved hazardous waste disposal facility, of the drums which were unearthed during the April 27, 1997 investigation. This action by the Department eliminated the substantial threat to public health and the environment posed by the material in the drums. The Department made the public aware of Prompt Action Interim Response #2 by issuing a public notice which appeared in the August 16, 1997 editions of the Pennsylvania Bulletin and the Scranton Times newspaper.

       Subsequent to the unearthing of drums containing hazardous waste at the Site, 12 home wells were sampled and analyzed for volatile organic compounds. Four of the home wells were contaminated with levels of TCE above the Federal Maximum Contaminant Level (MCL). On August 12, 1997, after determining that the Site constituted a substantial threat to public health and safety and the environment, the Department undertook a Prompt Action Interim Response (Prompt Action Interim Response #3) at the Site. Prompt Action Interim Response #3 involved the installation of point-of-entry carbon filtration systems on those homes whose well water had been contaminated at levels above the MCL for TCE. Point-of-entry carbon filtration systems were placed in a total of four homes. This action by the Department eliminated the substantial threat to public health posed by the TCE in the groundwater. The Department also considered the alternative of supplying bottled water to affected residents. This option was rejected because it would not protect affected individuals from exposure to TCE through inhalation. The Department also considered the alternative of taking no action. This option was rejected due to the substantial threat posed by TCE in the groundwater to the public and the environment.

       The administrative record contains information which was used as the basis for the decision to conduct the response at the Site. The administrative record will be available for public inspection from 8 a.m. to 4 p.m., Monday through Friday, at the Department's Northeast Regional Office located at 2 Public Square, Wilkes-Barre, PA 18711.

       Written comments concerning the response of information in the administrative record will be accepted in person, if delivered, or by mail, if postmarked, on or before January 23, 1998 to the attention of Leonard Zelinka, Project Officer--Hazardous Sites Cleanup Program, at the Northeast Regional Office address.

       Additionally, the public will have an opportunity to present oral comments on Prompt Action Interim Response #3 at a public hearing. The public hearing has been scheduled for December 3, 1997 at 7 p.m. at the Covington Township Municipal Building. Persons wishing to present oral comments must register on or before November 25, 1997 by calling Leonard Zelinka at (717) 826-5441. If no person registers to present oral comments by November 25, 1997, the hearing will not be held.     LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department must provide a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Rhoads Metals Fabrication & Maintenance Services, Inc., Lower Moreland Township, Montgomery County. Darryl D. Borrelli, Manko, Gold & Katcher, Suite 500, 401 City Avenue, Bala Cynwyd, PA, 19004, has submitted a Notice of Intent to Remediate site soil contaminated with lead, heavy metals, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons; and groundwater contaminated with solvents and BTEX. The applicant proposes to remediate the site to meet the Statewide health standard for soils and background standard for groundwater. A final report was simultaneously submitted.

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    Acknowledgment of Notices of Intent to Remediate submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Sections 304 and 305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use a site-specific standard or who intend to remediate a site in a Special Industrial Area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

       Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific cleanup standard, in whole or in part, and for sites determined to be located in Special Industrial Areas. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area by the person conducting remediation. For the sites identified, a municipality may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period a municipality may request that the person identified, as the remediator of a site, develop and implement a public involvement plan. Requests to be involved and comments, should be directed to the remediator of a site. For further information concerning the content of a Notice of Intent to Remediate, contact the Department's Regional Office under which the notice appears.     Notice of Intent to Issue Title V Operating Permits

       Under 25 Pa. Code § 127.521, notice is given that the Department of Environmental Protection (Department) intends to issue a Title V Operating Permit to the following facilities. These facilities are major facilities subject to the operating permit requirements under Title V of the Federal Clean Air Act and 25 Pa. Code Chapter 127, Subchapters F (relating to operating permit requirements) and G (relating to Title V operating permits).

    Notice of Intent to Approve
    Plan Approval Application #PA-30-072B

       Under 25 Pa. Code § 127.44, the Department of Environmental Protection (Department) intends to issue a Plan Approval to Consol Pennsylvania Coal Co. for the modification of the Bailey Mine Complex Coal Preparation Plant located in Richhill Twp., Greene County as described in its application.

       Based on the information provided by the applicant and on the Department's analysis of that information, this operation will emit not more than 1,708 tons per year of sulfur dioxide (SO2), 718 tons per year of nitrogen oxides (NOx), 1170.1 tons per year of volatile organic compounds (VOC), 1359 tons per year carbon monoxide (CO), and 313.2 tons per year particulate matter (PM10). These emissions in conjunction with other PSD increment-consuming sources, require allocation of 47.1% of the annual, 86.8% of the 24-hour, and 44.6% of the 3-hour SO2 increments; and 23.4% of the annual, and 64.7% of 24-hour PM10 increments; and 22.2% of the annual NOx increment available in the area of the maximum impact of the source.

       Copies of the application, the Department's analysis and other documents used in evaluation of the application are available for public inspection during normal business hours at the following address.

       In order to assure compliance with all applicable standards, the Department proposes to place the following conditions on the Plan Approval:

    General Conditions

       1.  This Plan Approval is for the installation of additional coal wash equipment and the modification to increase plant capacity to a 27MM ton/year coal preparation facility owned by Consol Pennsylvania Coal Company (CONSOL) located at the Bailey Mining Complex Preparation Plant, Richhill Township, Greene County.

       2.  This approval to construct/modify shall become invalid if: (1) construction is not commenced (as defined in 40 CFR 52.21(b)(8)) within 18 months after the date of this approval; or (2) if construction is discontinued for a period of 18 months or more; or (3) construction is not completed within a reasonable time. CONSOL shall provide a detailed construction schedule to the Department within 30 days of issuance of this Plan Approval.

       3.  The facility is permitted to operate 8,760 hours per year.

       4.  CONSOL shall maintain records of coal fired (tons/month) in each thermal dryer and the monthly average of the sulfur content, ash content and heating value of the coal burned. This information shall be reported to the Department upon request.

       5.  This construction/modification is subject to 25 Pa. Code § 127.206(d)(1) and (2) and other applicable provisions of Subchapter E of Chapter 127 for New Source Review. The plant may not commence operation of the new coal washing equipment or increase emissions from the dryers until the required emission reductions are certified by the Department.

       6.  In accordance with 25 Pa. Code § 127.205(3), each modification to a facility shall offset in accordance with 25 Pa. Code §§ 127.201 and 127.211, the total of the net increase in potential to emit.

       7.  In accordance with 25 Pa. Code § 127.206(d)(1) and (2), ERCs must be properly generated, certified by the Department and processed through the registry no later than the date approved by the Department for commencement of operation of the proposed modified facility.

       8.  CONSOL is required to obtain 434.5 tons/yr. of VOC emission reduction credits and 464.4 tons/yr. of NOx emission reduction credits.

       9.  CONSOL shall install, certify, maintain and operate continuous emission monitors on each of the thermal dryers for the following pollutants: sulfur oxides (as SO2) and oxides of nitrogen (as NO2) in accordance with 25 Pa. Code Chapter 139. Emissions shall be continuously recorded and reported to the Department on a quarterly basis.

       10.  At least 90 days prior to system start-up, the company shall submit information required by Phase I of the Department's ''Continuous Source Monitoring Manual'', Revision 4, July 1987 to Joe Nazzaro at 1st Floor Executive House, Harrisburg, PA 17120.

       11.  Data from the continuous emission monitoring systems shall be recorded in both pounds per million BTU and pounds per hour and shall be reported on a quarterly basis in a format to be specified during the certification process.

       12.  CONSOL shall continuously monitor and record the following conditions:

             A.  Outlet gas temperature from each dryer prior to the scrubber.

             B.  Pressure drop (in w. c.) across the scrubber on each dryer.

             C.  Pressure of the water supply to the scrubber on each dryer.

       These monitoring devices must meet the accuracy specifications, the location and calibration requirements in 40 CFR 60.253.

       13.  This Plan Approval authorizes temporary operation of the source covered by this Plan Approval provided the following conditions are met.

       A.  The Department must receive written notice from the Owner/Operator of when the Operator expects to commence operation.

       B.  Operation is authorized only to facilitate the startup and shakedown of sources and air cleaning devices, to permit operations pending the issuance of an Operating Permit or to permit the evaluation of the sources for compliance with all applicable regulations and requirements.

       C.  This condition authorizes temporary operation of the source for a period of 180 days from the date of commencement of operation, provided the Department receives notice from the Owner/Operator under Subpart (A), above.

       D.  The Owner/Operator may request an extension if compliance with all applicable regulation and Plan Approval requirements have not been established. The extension request shall be submitted in writing at least 15 days prior to the end of this period of temporary operation and shall provide a description of the compliance status of the source, a detailed schedule for establishing compliance and the reasons compliance has not been established.

       E.  The notice submitted by the Owner/Operator under Subpart (A), above, prior to the expiration of this Plan Approval, shall modify the Plan Approval expiration date. The new Plan Approval expiration date shall be 180 days from the date of the written notice.

       14.  Thermal Dryer No. 1 and Thermal Dryer No. 2 Conditions:

       A.  The particulate emissions (TSP/PM10) from Thermal Dryer No. 1 and Thermal Dryer No. 2 shall not exceed 138 and 128 tons/year, respectively.

       B.  Particulate emissions (TSP/PM10) from Thermal Dryer No. 1 and No. 2 shall not exceed 31 and 32 lb./hr., respectively.

       C.  Particulate emissions from Thermal Dryer No. 1 shall not exceed .031 grains/dscf and Thermal Dryer No. 2 shall not exceed .02 grains/dscf.

       D.  The sulfur oxide emissions (as SO2) from Thermal Dryer No. 1 and No. 2 shall not exceed 631 and 1077 tons/year, respectively.

       E.  The sulfur oxide emissions (as SO2) from Thermal Dryer No. 1 and No. 2 shall not exceed 144 and 246 lb./hr., respectively.

       F.  The sulfur oxide emissions (as SO2) from Thermal Dryer No. 1 and Thermal Dryer No. 2 shall not exceed 1.2 lb./MMBTU.

       G.  The NOx emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 305 and 413 tons/yr., respectively.

       H.  The NOx emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 96 and 121 lb./hr., respectively.

       I.  The NOx emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 0.8 lb./MMBTU and .59 lb./MMBTU, respectively.

       J.  The CO emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 946 and 413 tons/yr., respectively.

       K.  The CO emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 274 and 107 lb./hr., respectively.

       L.  The CO emissions from Thermal Dryer No. 1 and Thermal Dryer No. 2 shall not exceed 1.8 lb./MMBTU and .46 lb./MMBTU, respectively.

       M.  The VOC emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 231 and 368 tons/yr., respectively.

       N.  The VOC emissions from Thermal Dryer No. 1 and No. 2 shall not exceed 70 and 109 lb./hr., respectively.

       O.  Thermal Dryer No. 1 and Thermal Dryer No. 2 venturi scrubber shall operate with a pressure differential of at least 35 and 32 inches of water, respectively.

       P.  The Department reserves the right to revise the emission limits above, based upon stack test results, continuous monitoring date and other reliable information.

       Q.  There shall be no malodors emitted from the Thermal Dryers or from the coal washing equipment which are detectable beyond the property line.

       R.  Visible emissions from Thermal Dryer No. 1 and No. 2 shall not exceed an opacity of 20%.

       S.  Compliance with the short term emission limits, specified in lb./MMBTU or lb./hr., shall be established on a 1-hour average basis.

       T.  The Department reserves the right to require additional stack testing at any time.

       U.  The maximum dryer gas exit temperature, minimum pressure drop across the venturi and minimum scrubber water supply pressure shall be established during the initial compliance stack test. Operation above that temperature or below these pressures shall be deemed to be a violation of this permit unless compliance is established through stack testing and continuous emission monitoring, while operating at the new conditions.

       15.  Conditions for the new Wash Module at Plant 1

       A.  The VOC emission from the new froth flotation cells and vacuum filters in Plant 1 shall not exceed 27.2 tons/yr.

       B.  The VOC emissions from the antifreeze and flocculent shall not exceed 15 tons/yr.

       16.  In the event of a malfunction of the air cleaning devices, CONSOL shall promptly shut the sources down. CONSOL shall not restart the sources until the air cleaning device have been repaired and are functioning properly. CONSOL shall maintain a log of any malfunctions to the air cleaning device and provide it upon request.

       17.  Stack Testing Requirements

       A.  CONSOL shall conduct stack tests for compliance purposes for TSP/PM10, VOC, and CO and for monitor certification purposes for sulfur oxides (as SO2) and NOx (as NO2) in accordance with 25 Pa. Code Chapter 139, 40 CFR 60.8 and 40 CFR 60.254.

       B.  Within 60 days after achieving maximum firing rate, but no later than 180 days after start-up, stack tests shall be conducted on the new equipment and the modified capacity of the Thermal Dryers. Stack testing for compliance purposes (TSP/PM10, VOC, and CO) shall be performed on at least an annual basis thereafter. For VOC emissions, CONSOL shall perform emission checks using portable instruments approved by the Department on at least a quarterly basis.

       C.  Consol shall submit a pretest protocol to the Department for approval at least 30 days prior to the performance of the stack test.

       D.  The Department shall be notified at least 2 weeks in advance to the date and time of the stack test so that an observer may be present.

       E.  Two copies of the stack test report outlining the test results of the above mentioned test shall be supplied to the Department for review within 60 days of completion of testing.

       18.  The Bailey Coal Preparation Plant (including Thermal Dryer No. 1 and No. 2) is subject to the new source performance standards for coal preparation plants, 40 CFR Part 60, Subpart Y. In accordance with 40 CFR 60.4, copies of all requests, reports, applications, submittals and other communications shall be forwarded to both the EPA and the Department at the following addresses unless otherwise noted.

    MINING ACTIVITY APPLICATIONS

       Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19(a)); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

       The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for the certification.

       Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

       Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

       Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

    ENCROACHMENTS

       The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department).

       In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a United States Army Corps of Engineers (ACOE) permit. Section 401(a) of the Federal Water Pollution Control Act requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1301--1303, 1306 and 1307, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the BDWW permit application.        E15-556.  Encroachment. PA DOT, 200 Radnor Chester Rd., St. Davids, PA 19087-5178. To remove a steel girder bridge and to construct and maintain a single-span prestressed concrete spread box beam bridge with a clear span of 50 feet and an underclearance of 9 feet 2 inches on a 76 degree skew. This bridge spans Bucks Run along Park Avenue (SR 3077 Section 67S) (Coatesville, PA Quadrangle N: 12.2 inches; W: 15.75 inches) in East Fallowfield and Highland Townships, Chester County.

       E46-787.  Encroachment. Gambone Brothers, 1030 W. Germantown Ave., Fairview Village, PA 19409. To divert stormwater runoff into approximately 1,750 feet of storm sewer piping between Cassel Road and the proposed stormwater detention basin located at the southwest corner of the proposed Cassel Mill Farm Residential Subdivision and also to relocate an unnamed tributary of the Skippack Creek (TSF) through approximately 210 linear feet of pipe and approximately 1,425 feet of open channel.        E53-300.  Encroachment. Pa. Dept. of Transportation, 1924-30 Daisy St., Clearfield, PA 16830. To remove an existing structure and to construct, operate and maintain a twin cell precast concrete box culvert to carry SR 1011, Seg-offset 0090/0000 across the Genesee River. The twin cell culvert shall be constructed with a span of 20.0 feet, a rise of 7.0 feet and a skew of 90 degrees. The project is located along the eastern right-of-way of SR 0449 approximately 2,000 feet south of the intersection of T-407 and SR 1011 (Ulysses, PA Quadrangle N: 12.7 inches; W: 9.3 inches) in Bingham Township, Potter County. Estimated stream disturbance is 85 linear feet of stream with no wetland impact; stream classification is cold water fishery.

To remove existing structure and to construct and maintain a 3-span bridge with a 47-foot underclearance over the Allegheny River (WWF) located on SR 0128 at the southwest end of Ford City (Kittanning, PA Quadrangle N: 2.1 inches; W: 6.3 inches) in Borough of Ford City, Manor Township and North Buffalo Township.

       E11-256.  Encroachment. PA Department of Transportation, 1620 North Juniata Street, Hollidaysburg, PA 16648. To remove the existing bridge and to construct and maintain a prestressed concrete spread box beam bridge having a single normal span of 31.5 feet and a minimum underclearance of 7.0 feet over Clearfield Creek (WWF); to place and maintain fill in 0.11 acre of PEM wetlands for the purpose of widening the bridge; and to construct and maintain a temporary stream crossing consisting of four 60-inch pipes in Clearfield Creek during construction. The project is located along SR 1005, 150 feet north of its intersection with Township Road T542 (Cresson, PA Quadrangle N: 20.1 inches; W: 14.7 inches) in Allegheny Township, Cambria County. The wetland loss will be compensated by Advance Wetland Construction at State Game Lands No. 108.

    SEWAGE FACILITIES ACT

    PLAN APPROVAL


    Plan approval granted under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

       Regional Office: Water Management Program Manager, Southcentral Region, One Ararat Blvd., Harrisburg, PA 17110.

       Location: Oxford Township, Adams County, P. O. Box 86, New Oxford, PA 17350.

       The approved plan provided for construction of an interceptor, gravity and low pressure collection system that will connect to the New Oxford Municipal Authority sewage treatment plant. The service area includes Oxford Meadows, Mt. Misery and Irishtown. The remainder of Township will utilize On-lot Disposal System (OLDS) Management. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

       Location: Pike Township, Berks County, 112 Oysterdale Rd., Boyertown, PA 19512.

       The approved plan provided for continued use of individual on-lot disposal system (OLDS), more stringent planning requirements in the Exceptional Value (EV) Pine Creek watershed and in elevated nitrate areas surrounding Piketown Village. The Township will conduct an OLDS education and voluntary maintenance program, with a provision for mandatory OLDS management in 3 years if voluntary does not achieve compliance. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

       Location: Lyons Borough, Berks County, P. O. Box 230, Lyons Station, PA 19536.

       The approved plan provided for expansion of the Lyons Borough Municipal Authority sewage treatment plant capacity to .2 mgd from .15 mgd. The additional capacity is to provide treatment capacity for future sewer service to Bowers area of Maxatawny Township. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

SLV will also require a booster pump station for adequate pressure. All wells in VS and SLV will be abandoned. This is located in Northampton County.

    LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

    The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

       Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of any final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

       For further information concerning the final report, contact the Environmental Cleanup Program in the Department's Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate Regional Office listed.        E09-743.  Encroachment Permit. Borough of Doylestown, 57 West Court Street, Doylestown, PA 18901. To improve the North Street stormwater management facilities in and along a tributary to Cooks Run (WWF, MF). This work will include the following:  1.  To remove the existing culverts and enclosures between Swamp Road (S. R. 313) and Fonthill Drive. 2.  To install and maintain stream enclosures consisting of:  a.  851 linear feet of twin 30-inch diameter HERCP stream enclosure and associated swaling, being just downstream from S. R. 313 to point 190 linear feet, upstream from Fonthill Drive. (Roadway culverting described separately). b.  57 linear feet of twin 38-inch by 24-inch HERCP culvert under Chapman Avenue. c.  27 linear feet of twin 30-inch CPP culvert under Mercer Avenue. 3.  To install and maintain 50 linear feet of 6.5 foot by 2.5 foot concrete box culvert under Fonthill Drive. 4.  To modify the stream channel approximately 190 linear feet, upstream from the proposed Fonthill Drive culvert. This project is located approximately 1,400 feet southeast from the intersection of Route 313 and Route 611 (Doylestown, PA Quadrangle N:  13.5 inches; W:  0.3 inch) Doylestown Borough, Bucks County.

The project is located on the east side of S. R. 0309, approximately 3,000 feet north of S. R. 0080 (Freeland, PA Quadrangle N:  11.3 inches; W:  12.2 inches) in Butler Township, Luzerne County.

       E45-324.  Encroachment. Pennsylvania Department of Transportation, Engineering District 5-0, 1713 Lehigh Street, Allentown, PA 18103-4727. Giving its consent to maintain a concrete, open bottom arch stream enclosure having a length of approximately 245 l. f. in Forest Hills Run. This stream enclosure was modified using Emergency Permit No. EP4597401 to authorize pouring a concrete channel along the stream bed to interlock with the existing abutments to prevent further scour of the stream bed and abutments while preserving the structural integrity of the structure. The arch stream enclosure has a span of 8.5 feet and a minimum underclearance of approximately 7.3 feet measured from the top of the 8-inch high concrete fish baffles. The project is located along S. R. 0611, Section 07M, approximately 0.9 mile south of its intersection with S. R. 0940 (Mount Pocono, PA Quadrangle N:  21.0 inches; W:  13.8 inches) in the Borough of Mount Pocono, Monroe County.

       E45-325.  Encroachment. Pocono Property Finders, Inc., R. R. 5, Box 5234, East Stroudsburg, PA 18301. To place fill in a de minimis area of wetlands less than or equal to 0.05 acre for the purpose of constructing a gravel driveway and lawn area for a proposed single family dwelling on Lot 57, Section 1 of Lake of the Pines Residential Subdivision. The project is located approximately 1 mile southwest of the intersection of S. R. 1016 and S. R. 0209 (Bushkill, PA-NJ Quadrangle N:  13.1 inches; W:  6.1 inches) in Middle Smithfield Township, Monroe County.

       E48-244.  Encroachment. Saucon Valley Square L. P., 961 Marcon Boulevard, Allentown, PA 18103. To place fill in approximately 0.18 acre of wetlands for the purpose of constructing a commercial building and widening S. R. 0378 for the proposed Saucon Valley Square Shopping Center. The project is located between S. R. 0078 and S. R. 0378, south of Township Road T411 (West Raders Lane) (Allentown East, PA Quadrangle N:  15.5 inches; W:  1.5 inches) in Lower Saucon Township, Northampton County. The permittee is required to provide 0.10 acre of replacement wetlands onsite and by participating in the Pennsylvania Wetland Replacement Project for 0.08 acre.

       E54-234.  Encroachment. Schuylkill County Commissioners, 401 North 2nd Street, Pottsville, PA 17901. To repair and maintain a concrete arch bridge, County Bridge No. 105, having a span of approximately 100 feet and a maximum underclearance of 10.5 feet across Mill Creek. Repairs consist of the removal and replacement of sidewalks, the placement of riprap along the abutments and minor concrete work on spalled areas. This project is located along Acre Street, 100 feet upstream of S. R. 0209 (Pottsville, PA Quadrangle N:  12.6 inches; W:  5.6 inches) in the Borough of Port Carbon, Schuylkill County.

       E64-179.  Encroachment. Kenneth Love, P. O. Box 147, Narrowsburg, NY 12764. To excavate 0.62 acre of wetlands for the construction of a pond. This project is located along the east side of Township Road T-624 (Atco Road), 0.2 mile north of Township Road T-517 (Mohn Road) (Damascus, PA Quadrangle N:  1.4 inches; W:  11.7 inches) in Damascus Township, Wayne County. The permittee is required to provide 1.24 acres of replacement wetlands to resolve a violation on this previously constructed pond.

       E66-112.  Encroachment. Preston D. Funk, R. R. 2, Box 181F, Mehoopany, PA 18629. To construct and maintain a private footbridge across White Brook having a single span of 26.0 feet and an underclearance of approximately 6.0 feet. The project is located 200 feet upstream from S. R. 3001 (Dutch Mountain, PA Quadrangle N:  22.5 inches; W:  1.0 inch) in Forkston Township, Wyoming County.

       E02-1195.  Encroachment. Ben Avon Borough, 7101 Church Avenue, Ben Avon, PA 15202. To remove the existing bridge, to construct and maintain a metal arch culvert having a span of 15.7 feet and an underclearance of 8.0 feet and to construct and maintain gabion walls on the upstream and downstream sides of the culvert in Spruce Run. The project is located on Spruce Run Road at the intersection of Spruce Run Road and Strugeon Street, Spruce Run Bridge No. 2 (Emsworth, PA Quadrangle N:  1.0 inch; W:  11.0 inches) in Ben Avon Borough, Allegheny County.

       E11-251.  Encroachment. Cambria County Commissioners, Cambria County Courthouse, P. O. Box 269, Ebensburg, PA 15931. To remove the existing structure, to construct and maintain a 1-foot depressed 22.0-foot x 7.0-foot concrete box culvert in Little Conemaugh River, to construct and maintain an outfall channel downstream of the proposed culvert, to place and maintain R-7 rock riprap along the banks of Little Conemaugh River for a distance of 50.0 feet upstream and 62.5 feet downstream of the proposed culvert for bank stabilization and to place and maintain fill in 0.1 acre of wetlands for the purpose of widening T-434. This permit also authorizes 0.16 acre of replacement wetlands adjacent to the project area. The project is located on T-434, Station 14+44.44 (Cresson, PA Quadrangle N:  10.8 inches; W:  17.1 inches) in Washington Township, Cambria County.

       E11-252.  Encroachment. Cambria County Commissioners, P. O. Box 269, Cambria County Courthouse, Ebensburg, PA 15931. Remove the existing structure, to construct and maintain a single span bridge having a normal span of 84.7 feet and an underclearance of 11.5 feet across North Branch Blacklick Creek and to place and maintain fill in a de minimis area of wetlands less than or equal to 0.05 acre for the purpose of improving transportation safety and roadway standards. This permit also authorizes the construction and maintenance of a temporary roadway crossing consisting of nine 60-inch corrugated metal pipe culverts in North Branch Blacklick Creek at a point approximately 110 feet downstream from the proposed bridge for the purpose of accommodating local traffic during construction. The project is located on T-498, Station 24+42 (Colver, PA Quadrangle N:  11.1 inches; W:  15.1 inches) in Blacklick Township, Cambria County.

       E56-278.  Encroachment. Somerset County Commissioners, 111 East Union Street Ste. 100, Somerset, PA 15501. To remove the existing structure and to construct and maintain the New Baltimore Covered Bridge. The proposed structure is a single span bridge having a normal span of 72.0 feet and an average underclearance of 6.6 feet across the Raystown Branch of the Juniata River located on Town Hill Road (T-813) (New Baltimore, PA Quadrangle N:  20.3 inches; W:  3.2 inches) in Allegheny Township and New Baltimore Borough, Somerset County.

       E63-066-A1.  Encroachment. Dredge Docks, Inc., 1231 River Avenue, Pittsburgh, PA 15212. Giving its consent to amend Permit No. E63-066 to extend and maintain the existing barge mooring facility an additional 175.0 feet in the channel of and along the left back of the Monongahela River (WWF) for the purpose of improving the existing facility. The project is located near River Mile 39.0 (Monongahela, PA Quadrangle N:  7.1 inches; W:  0.4 inch) in Carroll Township, Washington County.

       E63-426.  Encroachment. PA Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106-7676. To remove existing structures, to construct and maintain four culverts in various unnamed tributaries to Peters Creek (TSF); to construct and maintain a bridge having a span of 43.4 feet and an underclearance of 7 feet across Peters Creek (TSF); to relocate and maintain nine channel relocations in Peters Creek and its tributaries, Huston Run and its tributaries and an unnamed tributary to Mingo Creek (TSF); to place and maintain fill in two nonjurisdictional dams; to place and maintain fill in 0.32 acre of six wetlands (PEM); and to place and maintain fill in two nonjurisdictional ponds located at Station 1292+30 and 1301+00. The work is being done in conjunction with the construction of the Mon/Fayette Expressway (S. R. 0043), Construction Section 52H, consisting of a four lane limited access, divided toll highway. This construction section begins off of Finleyville Elrama Road and ends approximately 1,500 feet north of Gill Hall Road (project starts at Monongahela, PA Quadrangle N:  18.1 inches; W:  15.4 inches and ends at Glassport, PA Quadrangle N:  2.5 inches; W:  14.6 inches) in Union Township, Washington County. The wetland replacement was approved under PA DEP Permit No. E02-1132.

       E63-433.  Encroachment. Gustine Washington Associates, Ltd., Birmingham Towers, 2100 Wharton St., Ste. 700, Pittsburgh, PA 15203. To place and maintain fill in approximately 0.35 acre of wetlands associated with an unnamed tributary to Chartiers Creek for the purpose of constructing the Strabane Square Development. The project is located on the east side of Old Manifold Road at the intersection of 19 and S. R. 70-79 (Interchange 7) (Washington East PA Quadrangle N:  11.6 inches, W:  14.0 inches) in South Strabane Township, Washington County. This permit also authorizes the construction of 0.55 acre of replacement wetlands.

       E65-657.  Encroachment. The Municipal Authority of the Borough of Smithton, P. O. Box 350, Smithton, PA 15479-0350. To construct and maintain a sanitary sewage treatment facility along an unnamed tributary to the Youghiogheny River. Project includes construction of 11,000 l. f. of sanitary sewers; a wetland crossing, a discharge outfall below normal pool elevation of the Youghiogheny River and to relocate and maintain 113 feet of an unnamed tributary to the Youghiogheny River located along S. R. 981, west of the intersection of S. R. 981 and T-372 (Smithton, PA Quadrangle N:  5.7 inches; W:  16.5 inches) in Smithton Borough, Westmoreland County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

       E65-673.  Encroachment. Hannastown Golf Club, 121 Blank School Road, Greensburg, PA 15601. To place and maintain fill in and along 2,810 feet of an unnamed tributary to Jacks Run, to place and maintain fill in 0.5 acre of wetlands (PEM, PSS) and to construct and maintain three separate culverts in an unnamed tributary to Jacks Run. Culverts A and B consist of single 38-inch x 60-inch elliptical concrete pipes. Culvert C consists of two 34-inch x 53-inch elliptical concrete pipes in an unnamed tributary to Jacks Run. This permit also authorizes 0.62 acre of replacement wetlands (PEM, PSS) onsite. This work is part of the construction of a 9-hole golf course expansion of the existing Hannastown Golf Club. The project is located off of Union Cemetery Road (T-798) (Greensburg, PA Quadrangle N:  14.0 inches; W:  4.5 inches) in Hempfield Township, Westmoreland County.

       E32-388.  Encroachment. Ronald J. Stewart, R. R. 1 Box 133, Marion Center, PA 15759. Construct and maintain a 100-foot x 60-foot convenience store/garage building in the 100-year floodway of an unnamed tributary to Pine Run for the purpose of replacing the previous structure destroyed by fire at this location. The project is located on SR 403 (Marion Center, PA Quadrangle N:  3.4 inches; W:  6.75 inches) in the Borough of Marion Center, Indiana County.        E63-432.  Encroachment. Craig and Cindy Fox, 645 Duncan Avenue, Washington, PA 15301. Operate and maintain the existing bridge having a span of 12.0 feet with an underclearance of 6.0 feet (constructed under Emergency Permit No. EP6397202) across an unnamed tributary to Georges Run to provide access to applicant's property. The bridge is located approximately 900 feet west from the intersection of S. R. 4035 and S. R. 0018 (Washington West, PA Quadrangle N:  16.4 inches; W:  5.3 inches) in Canton Township, Washington County.
